Al-Shāfi’ī’s Position on Analogical Reasoning in Islamic Criminal Law: Jurists Debates and Human Rights Implications.Luqman Zakariyah - 2017 - International Journal for the Semiotics of Law - Revue Internationale de Sémiotique Juridique 30 (2):301-319.
Al-Shāfi’ī has been unreservedly credited as one of the designers, if not the “master architect,” of uṣūl al-fiqh. His most important scholarly work, Al-Risālah, clearly demonstrates his cognitive creativity in this field. One of the methodologies for the decision of cases under Islamic law that Al-Shāfi’ī championed is qiyās, which he equated with ijtihād. His balanced approach invites further enquiry into the extensive use of qiyās in general and in criminal law in particular. The extent to which qiyās can be (...)

The Financial Distress of Corporate Personality: A Perspective from Fiqh.Saheed Abdullahi Busari, Luqman Zakariyah, Amanullah Muhammad & Akhtarzaite Bint Abdul Aziz - forthcoming - Intellectual Discourse:245-268.
Oriental scholars discuss the concept of corporate personalitywithout any reference to Islamic law. A leading proponent of this view isJoseph Schacht; a western scholar of jurisprudence who contended that Islamicjurisprudence is limited to individual personality and devoid of corporate laws, hence, contractual agreements between corporations has no basis in Islamiclaw. Several scholars and researcher have responded with sufficient literatureon the status of an artificial person in Islamic law, but there are still issues withthe legal implication of corporate personality in the event (...)

Yahya al-Ṣarṣarī and The Image of the Prophet Muḥammad in His Poems.İbrahim Fi̇dan - 2020 - Cumhuriyet İlahiyat Dergisi 24 (1):267-295.
The first poems about the Prophet Muḥammad appeared while he was alive. These first examples, which are panegyrics (madīḥ, i‛tiẕār, fakhr and ris̱ā), largely reflect the characteristics of the pre-Islamic qaṣīda poetry. Due to the developments in the following centuries, the number of poems about the Prophet increased. And thus, a separate literary genre was formed under the name al-madīḥ al-nabawī. Especially the fact that sufi leaning poets contributed to the literary richness in this field. Another factor is the beginning (...)

The Politics of Austerity and the Affective Economy of Hostility: Racialised Gendered Violence and Crises of Belonging in Greece.Anna Carastathis - 2015 - Feminist Review 109 (1):73-95.
In this paper, I examine the friction between xenophobic discourses on migration and the crisis caused by the politics of austerity in Greece. On the one hand, an ‘excessive’ influx of migration is managed through violent means by the state and the para-state; on the other, a ‘scarcity’ of domestic resources is blamed for a ‘rise’ in racist attitudes, and the political ascent of a fascist movement-cum-parliamentary party, Χρυσή Αυγή (Golden Dawn). ‘Crisis’ is said to give rise to ‘austerity’—and hostility. Transformation of Nature by Human and Distinctive Positions of the Prophets in Culture.Ferruh Kahraman - 2020 - Cumhuriyet İlahiyat Dergisi 24 (3):1241-1262.
One of the areas of study of tafsīr is the stories in the Qur’ān. In the stories of the Qur’ān, generally creation, man, the nature of man and different societies that lived in history are mentioned. Although the main theme in the stories is belief and disbelief, social structures and cultural features are explicitly and indirectly mentioned as well. But the mufassirs approached the stories mainly from the point of view of belief and disbelief. They did not declare an opinion (...)

The history of the Qurʾānic text begins with the time of its revelation. The research on Qurʾānic manuscripts is one of the main fields of textual studies of the Qurʾān. There have been many works done by both Muslim and Western scholars. Many museums and libraries around the world hold Qurʾān manuscripts. Each manuscript has its own characteristics such as orthography, calligraphy, decoration, and binding, number of the pages and the lines, and dating. This article deals with 110 Qurʾān manuscripts (...)
