Abstract

Resumo O momento atual vivido pela teoria jurídica, no qual se avulta a relevância dos direitos fundamentais de base constitucional e sua influência na compreensão e aplicação do Direito, impõe um diferente papel para a hermenêutica, a qual se apresenta como uma ciência que oferece os mecanismos para colocar em marcha o processo de atualização das normas, adequando- as ao horizonte constitucional. O presente artigo analisa o processo interpretativo a partir da concepção de Gadamer acerca da ciência hermenêutica, destacando o papel ativo desempenhado pelo intérprete na construção das normas jurídicas. This article analyzes the interpretive process from the Gadamer’s conception of the hermeneutical science, highlighting the active role played by the interpreter in the construction of juridical norms.
