Avrupa Fetva Meclisi, çoğu Batı’da ikame eden hem şerî delilleri hem de vâkıayı bilen kıymetli âlimleri bünyesinde toplamış ilmi bir müessesedir. 1997 yılında Yûsuf el-Karadâvî’nin (1926-2022) başkanlığında kurulmuştur. Bu tarihten itibaren özellikle de Batı’da yaşayan müslümanları ilgilendiren ve müslüman ülkelerde gözlemlenen problemlerden ciddi manada farklılaşan önemli fıkhî meseleleri gündemine taşımış, ürettiği çözümlerle hem oradan yaşayan hem de benzer problemlerle yüzleşen Müslümanlar için referans niteliğinde karar ve fetvalara imza atarak, kendisine başvurulan ilmi bir merci haline gelmiştir. Kuruluşundan günümüze Meclis’in yapısını (...) konu edinen ve genel ya da aile hukuku veya muamelat gibi, özel bazı meseleler bağlamında izlediği fetva yöntemine ilişkin farklı dillerde bazıları akademik tarzda pek çok çalışma yapılmıştır. Meclis, 2023 yılında İstanbul’da icra ettiği toplantısını bu tarihe kadar yaptığı çalışmalar ve kendisine yöneltilen tenkitlere hasretmiş, toplantıda Meclis’i farklı yönleriyle değerlendiren çok sayıda bildiri sunulmuştur. Bu çalışma da aynı gayeye hizmet etmek maksadıyla Meclis’in fetvalarını neşrederken izlediği metodu, fıkıh ve fetva usulü kuralları bağlamında eleştirel bir bakış açısıyla değerlendirmek üzere kaleme alınmıştır. Değerlendirme, fetvanın muteber sayılabilmesi için müftüde aranan ilmi ehliyet ve adalet şartlarıyla sınırlandırılmıştır. Bu bağlamda öncelikle fıkıh meclislerinin fıkıh ilmine yaptığı katkıdan bahseden bir giriş yapılmış, ardından Meclisle ilgili tanıtıcı kısa bir malumat verilerek, “ekalliyyât fıkhı” olarak da bilinen alanda doldurduğu boşluk başta olmak üzere, diğer fıkıh meclislerinden olumlu yönde ayrıldığı hususiyetlerine değinilmiştir. Fetvanın kabul edilmesi için gerekli şartlar meşhur usul kitaplarıyla iktifa edilerek tahlil edilerek aktarılmış, Meclis’in neşrettiği fetva ve kararların bu kurallara uygunluğu tartışılarak, diğer fıkıh meclisleriyle mukayese imkânı oluşturabilmek için onlar tarafından neşredilmiş karar ve fetvalara da yer verilmiştir. Çalışmanın sonucunda Meclisin, karar ve fetvaların kimler tarafından alındığını ilan etmemek suretiyle kriter olarak belirlenen fetva usulü kurallarına riâyet etmediği anlaşılmış, diğer fıkıh meclislerinin de çoğunlukla aynı problemle malul olduğu sonucuna varılmıştır. Çalışma, tespit edilen problemlerin çözümü için bazı tavsiyelerin de yer aldığı bir sonuçla tamamlanmıştır. Çalışmanın, ulaştığı sonuçlarla fetva müesseselerinin bu faaliyeti icra ederken fetva usulü çerçevesinde hareket etmelerine rehberlik edecek ölçüler ortaya koymak suretiyle alana katkı sağlaması umulmaktadır. Bunun yanında, hangi isimle anılırsa anılsın kurumsal olarak fetva neşreden müesseselerin, özelde ise Avrupa Fetva Meclisi’nin kararlarıyla amel eden ya da karar ve fetvalarını esas alarak fetva veren veya çalışmalarında istifade eden araştırmacı ve müftülerde farkındalık oluşturması ümit edilmektedir. In this paper, I analyse the issue of “hadith fatwas”, which has not studied enough in academic ground. The litera-ture of hadith fatwas is consisted of the questions asked by all Muslims, whether they have academic interest in Hadith or not, to the scholars and the answers given by the scholars. The most famous samples of this literature, which dates back to 3rd century AH, were written in the 9th and 10th century AH. One of the most distinguishing features of (...) this genre is that it addresses all Muslims. Various modern works can be included in this literature, which are similar to hadith fatwas in terms of the form and the audience addressed by them. However, the works of the pre-modern and modern eras differ in the sense of the questions and the answers. In order to introduce this genre and compare between its samples in two different eras, I examine the works of as-Sahawi, as-Suyuti, Ahmet Yücel and Yavuz Köktaş. In this article, we use a mix of computational techniques to identify textual shifts in the Ottoman şeyhülislams’ fetvas between the sixteenth and twentieth centuries. Our analysis, supplemented by a close reading of these texts, indicates that the fetvas underwent multiple forms of transformation, a consequence of the institutional evolution of the şeyhülislam’s fetva office that aimed to speed up and streamline the production of the fetvas: over time, the texts appropriated a more uniform character and came to contain (...) shorter responses. In the compositions of the questions, we identified many “trigger terms” that facilitated reflexive responses independent of the fetvas’ jurisprudential contexts, a tendency that became stronger after the second half of the seventeenth century. In addition, we propose in the article a methodology that measures the relative strengths of textual and conceptual links among the fetva corpora of various Ottoman şeyhülislams. This analysis informs us about possible paths of long-term evolution of this genre of jurisprudential documents. (shrink)

Ijtihad is the mujtahid's putting forward all his efforts on a fiqh issue within the framework of methodological principles. Fatwa, on the other hand, are the explanations made regarding the questions asked in fiqh issues. Therefore, although there are similarities between fatwa and ijtihad in terms of declaring a fiqh knowledge, there are also some differences that distinguish both scientific activities from each other. Because of this difference, not every ijtihad qualifies as a fatwa that a Muslim can apply in (...) his life. A jurist who does not have the qualifications for ijtihad has to pay attention to when giving a fatwa by making use of the classical period ijtihad. The most important thing to consider when benefiting from the ijtihads that have been put forward is to correctly distinguish between the ijtihads that are historical and those that will always be used. In the fiqh books, there are many issues that can be described as historical ijtihad, in the context of their own time and conditions. Since it is not possible to present all such ijtihads within the framework of an article, in this study, the subject is discussed within the framework of ijtihads selected from fiqh books. From international relations to family law, there are many historically qualified ijtihads in the fields of fiqh, especially in the field of transactions. Today, international relations are quite different. It is of great importance to redefine the world and present fiqh rules accordingly. In the changing social structure, a new perspective is needed in the determination of the muruet. In the process of women's social position and participation in social life, great changes have been experienced all over the world and women have started to take part in many areas of life. In terms of the minimum age limit for marriage, it has become natural to marry at an older age than in the past. It has become almost impossible to act with the approach that those who have the same belief will obtain citizenship without other terms and conditions. It has become necessary to consider the views of jurists regarding the rights of non-Muslim citizens from a new perspective in the globalizing world structure. The implementation of views that give authority to private property owners regarding mineral ownership may be harmful to the security of the state and the public interest. There has been a need to look again at the legal provisions regarding the treasures under the ground in terms of public interest. In the article, it is stated why the ijtihads on the aforementioned issues have a historical character and in which framework the issue should be handled today. (shrink)

The Fatwā-house, which was within the body of Meshihat in the Ottoman Empire, gave answers to the questions posed to it by focusing on the Hanafi sect and the preferred fatwās of this sect for centuries. These questions and answers were also duly recorded. In this study, based on The Record for the Legal Responses of the Supreme Fatwā Office, which is registered at records numbered 378 in the Meshihat Archive of the Istanbul Mufti, one of the records containing the (...) answers given by the institution. It is an attempt to create an imagination about the scope and sphere of influence of the fatwā activity in the last period of the Ottoman Empire. Accordingly, in the last thirteen years of the state, Fatwā-house has been the addressee of questions from individuals, state and private institution directors, societies, ministries and the Grand Vizier. While some of these questions came from the provinces within the Ottoman borders or from the countries that had an administrative ties with the Ottoman Empire, some of them were submitted to the Fatwā-house by the Muslims of other states from the lost lands or simply because the caliphate center was the official fatwā organ. At the records, there is also a record of the questions coming from muslims who are Ottoman citizens but residing in other countries. Looking at the subjects, it was determined that most of the questions were asked about foundations. In addition, the permissibility of obtaining interest by bank facility or depositing money in the bank, the establishment of modern schools and whether the ways to create resources for these schools are permissible, whether teaching in Latin letters is possible, the provision of life insurance, the importance of cleanliness in the fight against cholera, the fight against innovations (bidʻas) in mosques. It is seen that questions on different issues, from issues such as whether the wife of the lost (mafqud) can be separated by the judge or not; to the issues of whether the fulfillment of judgment can be regarded as the end of the judgment or not. As it is mentioned in some fatwā records at the record book, it is obligatory to decide on fatwā and its fulfillment in the Ottoman Empire with the most authentic and preferred view of the Hanafi sect. The last two fatwā questions mentioned above are handled as examples of giving up the act with the will of the head of state, with the preferred fatwâs discussed in this article. It is only possible with the will of the head of state to make a decision with an opinion other than preferred fatwâ or an other opinion out of the sect. According to the first example, some of those of the citizens of other states outside the Ottoman Empire came to the Ottoman lands for reasons like trade etc. and married to Muslim women there and then left them suffering. This was also true for the wives of men who went to wars and did not return. Although the drawbacks of the Hanafi sect's preferred view, that one should wait until the age of ninety, one hundred, one hundred and twenty, or until the death of their peers, were resolved by appointing a regent from other sects, continuity could not be ensured in this practice either, finding people has not always been possible. For this reason, in the time of Shaykh al-Islam Hayri Efendi, a statement of change was prepared and submitted to the will of the sultan. In the issue of whether the signature of the head of state can be counted as the end of the judgment, another subject in which the will of the head of state is applied, the stages of abandoning the preferred view can be followed much more clearly. In the case of the dismissal of the judge or the expiration of the term of office before the execution of the judgment, especially in the distant provinces of the state, in the case of the judge's dismissal or the expiration of his term, according to the preferred view of the sect, which was based on juristic discretion, the closure of the cases took many years. It is seen that the judgment reached by analogy was submitted to the will of the sultan, with an article added to the script regarding the prepared procedure of reasoning, although there is no preferred view since it is the most suitable opinion for the interests of the people and the necessities of the century due to the increase in complaints. Effective from the time it was approved by the head of state, the execution of the sentence is no longer a requirement for the trial to be completed. The changes in the provisions of these matters also show that, although it was important for the Ottoman State to comply with the preferred view of the Hanafi sect - as in the previous Shaykh al-Islams' fatwās in the form of ma'ruzat - it was considered more necessary to look after the interests of the Muslims and different opinions were enacted and put into practice. Mezheplerin teşekkül etmeye başladığı ilk dönemlerden itibaren istihsanın bir istidlal yöntemi olup olmadığı tartışılagelmiştir. Bu tartışmaların temelinde kavramsallaşma sürecini henüz tamamlamamış olan istihsan teriminin çağrıştırdığı keyfiliğin/sübjektivitenin etkisi çok fazladır. Bu yüzden istihsanı bir yöntem olarak benimseyenler, ağır ithamlara maruz kalmışlardır. İstihsanı benimseyenlerin başında Hanefî hukukçular gelmektedir. Öyle ki istihsan yöntemi Hanefî mezhebiyle anılır hale gelmiştir. Bununla birlikte mezhebin önde gelen temsilcilerinden biri olan ve kıyas metodunu kullanmasıyla ön plana çıkan Züfer b. Hüzeyl’in istihsana yaklaşımıyla ilgili iki farklı yaklaşım tespitedilmiştir. Yaptığımız (...) araştırma ve inceleme neticesinde her iki tespitinde isabetli olmadığını; Züfer b. Hüzeyl’inkıyas yapmadaki becerisinin yanı sıra istihsana müracaatta sonuna kadar kıyas taraftarı olduğunu; ancak kıyasın meselelere çözüm üretmede yetersiz kaldığı ya da doğru sonuç vermediği durumlarda ise ızdırârın da bir gereği olarak meseleyi hükümsüz bırakmama adına istihsana müracaat ettiği görülmektedir. Sonuç olarak Züfer b. Hüzeyl’in genel hatlarıyla Hanefî usulüne bağlı kalmakla birlikte istihsanı bir istidlâl yöntemi olarak kullanma hususunda çerçeveyi oldukça daralttığını; kıyasa başvurma konusunda ise sınırları mümkün olduğunca geniş tuttuğunu söylemek mümkündür. İctihad hürriyeti ve hukûkî zenginlik açısından oldukça önemli olan Hanefi mezhebindeki mezhep içi ihtilaflar, hukûkî istikrar ve emniyeti tehdit etme potansiyeli taşımakta ve ayrıca ihtilaflı meselelerde hüküm veya fetva verecek fakihlerin işini zorlaştırmaktadır. Bu nedenle mezhep içerisindeki ihtilaflı meselelerde râcih görüşü tespit etmek, diğer bir ifadeyle mezhep içi tercih, zorunlu bir ihtiyaçtır. Mezhep içi tercih, “muayyen bir mesele ile ilgili mezhepteki muhtelif kavil veya rivayetlerden daha ağır basanı, üstün olanı belirlemek” şeklinde tarif edilebilir. Tarihi süreçte bu ihtiyacı karşılamak için muhtasar ve fetva kitapları gibi farklı telif türleri; esahh-ı akvâl ve maʻrûzât gibi farklı uygulamalar ortaya çıkmıştır. Bu ihtiyacı gidermeyi hedefleyen uygulamalardan biri de Osmanlı Devleti’nin son dönemindeki kanunlaştırmalardır. Fıkha dayalı kanunlaştırmanın ilk örneği olan Mecelle-i Ahkâm-ı Adliyye ile mezhep içi tercih arasındaki ilişki ve bu bağlamda Mecelle hazırlanırken, mezhep içi tercihte nasıl bir usûl izlendiği; râcih görüşe ne oranda uyulduğu; Mecelleʼde yer alan râcih görüşe aykırı kanun maddeleri ve bunların gerekçeleri; ihtilaflı bütün konularda düzenleneme yapılıp yapılmadığı ve râcih görüşleri belirleme ihtiyacının ne kadar giderildiği, incelenmesi gereken konulardır. Mecelle-i Ahkâm-ı Adliyye gibi bir kanun metnine ihtiyaç duyulmasının temel nedenlerinden birisi, Hanefî mezhebinde mezhep içi ihtilafların çokluğudur. Buna bağlı olarak Mecelleʼnin hedefi râcih görüşler içeren oluşan bir kanun hazırlamaktır. Mecelle’nin esbâb-ı mûcibeleri mezhep içi tercih açısından incelendiğinde, esbâb-ı mûcibelerin iki temel işlevi olduğu görülür. Bunlardan ilki, kanunun büyük oranda mezhepteki râcih görüşlere uygun olarak hazırlandığını vurgulamaktır. Öyle ki, Mecelle’nin ilk on kitabının esbâb-ı mûcibelerinde bu husus mutlaka ifade edilmektedir. Esbâb-ı mûcibelerin diğer işlevi ise niçin bazı maddelerde râcih görüşe riayet edilmediğini gerekçelendirmektir. Esbâb-ı mûcibelerde on iki maddenin râcih olmayan görüş doğrultusunda hazırlandığı belirtilmektedir. Mecelleʼnin 1851 maddeden oluştuğu göz önünde tutulduğunda Mecelleʼnin muhtevasında râcih görüşlerin ne kadar etkili olduğu daha iyi anlaşılacaktır. Esasen devrin özelliği de bunu zorunlu kılmaktadır. Zira Kitâbüʼl-Havâlenin 692. maddesinde Züferʼin râcih olmayan görüşünün tercih edilmesi, başta Şeyhülislam Hasan Fehmi Efendi olmak üzere bazı çevrelerin tepkisine neden olmuş ve bu sebeple Ahmet Cevdet Paşa Divân-ı Ahkâm-ı Adliyye nâzırlığından ve Mecelle Komisyonu başkanlığından azledilmiştir. Râcih görüşe aykırı maddelerin esbâb-ı mûcibeleri incelendiğinde, bu yöndeki tercihlerde maslahat ve örfün belirleyici olduğu görülmektedir. Ayrıca bazı fakihlerin tercihlerinin de bir tercih sebebi olarak zikredildiği görülmektedir. Hanefi kaynaklarda en sık karşılaşılan tercih sebebi naslara uygunluktur. Buna karşın Mecelleʼde sefîhin hacri konusu dışında, naslara uygunluğun bir tercih sebebi olarak işletilmemesi dikkat çekicidir. Mecelle Komisyonunun bazı tercihlerine diğer kurumlarca müdahale edilmiştir. Komisyonca hazırlanan kitaplar hem Meclis-i Vükelâ hem de Meşîhat tarafından incelenmiş ve bu esnada bazı tashihlere konu olmuştur. İşte râcih olmayan görüş esas alınarak hazırlanan iki maddeye Meclis-i Vükelâ tarafından müdahale edilmiştir. Bunların birincisi hakk-ı mürur ve hakk-ı şirbin müstakil olarak satımının cevazını savunan Belh Meşâyihinin görüşü doğrultusunda yazılan 216. madde, ikincisi ise ecîr-i müşterekin tazmin sorumluluğunu düzenleyen 611. maddedir. Mecelle’nin ilk ve en hacimli kitabı olan Kitâbüʼl-Büyûʻun muhtevası mezhep içi tercih açısından incelendiğinde, ihtilaflı konularda genelde mezhepteki râcih görüşün esas alındığı görülmektedir. Kitâbüʼl-Büyûʻun esbâb-ı mûcibesinde, dört meselenin râcih olmayan görüş esas alınarak hazırlandığı ifade edilmekte ve bu tercihler örf ve maslahatla gerekçelendirilmektedir. Ancak Kitâbüʼl-Büyûʻdaki râcih görüşe aykırı maddeler bunlarla sınırlı değildir. Bizim araştırmamıza göre bunlara ilaveten üç madde daha râcih olmayan görüş tercih edilerek hazırlanmıştır. Bunlar beyʻ biʼl-vefânın menkullerde cevazına dair 118. madde, gabn-i fâhişin tanımı hakkındaki 165. madde ve şart muhayyerliğinin hükmü ile ilgili 309. maddedir. Bu üç madde, Mecelleʼdeki râcih görüşe aykırı düzenlemelerin sadece esbâb-ı mûcibelerde açıklananlardan ibaret olmadığını göstermektedir ve bu durum Mecelle hazırlanırken izlenen usûle aykırıdır. Hanefi mezhebindeki bazı ihtilaflı meselelerde hangi görüşün râcih olduğu konusunda tercih ehli fakihler ihtilaf etmişlerdir. Bu meselelerde Mecelleʼde düzenleme yapılırken nasıl bir yol izlendiği açıklanmamıştır. Bu meseleler incelendiğinde çoğunluk tarafından tercih edilme, kolaylığı temin etme ve bazı fakihler tarafından tercih edilme gibi hususların etkili olduğu söylenebilir. Mecelleʼdeki tercihler sadece şerʻî hükümler arasında gerçekleşmemiştir. Buna ilaveten tanımlar ve tanımlarda yer alan kayıtlar da tercihe konu olmuştur. Bu kapsamda Kitâbüʼl-Büyûʻdaki beyʻ akdi, mevkûf akid ve gabn-i fâhişin tanımına ilişkin tercihler örnek olarak zikredilebilir. Hanefi mezhebin içerisindeki ihtilaflı bazı meseleler Mecelleʼde düzenlenmemiştir. İhtilaflı meselelerin çokluğu ve dolayısıyla bütün bunları kapsayan bir kanun hazırlamanın zorluğu dikkate alındığında bu durum doğaldır. Ayrıca bu meselelerden bazıları sık gerçekleşmediği ve lüzumlu görülmediği için Mecelleʼde düzenlenmemiş olabilir. Ancak düzenleme yapılmayan ihtilaflı meselelerin tamamını bu sebeplerle izah etmek mümkün değildir. Zira yasal düzenleme yapılmayan ihtilaflı meselelerin bazıları temel, görece önemli meselelerdir ve muhtasarlarda yer almaktadır. Bu durum Mecelle hazırlanırken, ihtilaflı bazı meselelerde tercih yapmak yerine bu meselelere ilişkin düzenleme yapmama metodunun benimsendiğini göstermektedir. İhtilaftan ârî bir kanun metni oluşturmanın bir yolu olarak da bu usûlün benimsendiği söylenebilir. Böylece bu meselelerde râcih görüşü tespit etme işi hâkimlere bırakılmıştır. Bu durum Mecelleʼnin hedefi olan râcih görüşleri tespit etme ihtiyacını gidermeye uygunluk arz etmemektedir. Ancak bu durum bütün meseleleri kuşatan bir kanun yapmanın güçlüğünün bir sonucudur. Britanya'daki tüm Müslüman toplumu için tek bir dini otoritenin olmaması, etnik ve mezhepsel farklılıklara bağlı olarak pek çok dini otoritenin oluşmasına neden olmaktadır. Britanya’daki Müslüman topluluklar genelde etnik ve mezhepsel kimlikler etrafında kümeleştiklerinden ötürü camileri ve dini otoriteyi de buna göre oluşturmuşlardır. Bu makale, Britanya doğumlu genç Sünnî Müslümanlar için dini otoritenin ne olduğunu araştırmaktadır. Bu çalışmada kullanılan veriler Britanya’nın en kozmopolit şehirlerinden biri olan Leeds şehrinde, etnografik bir çalışmayla 18-30 yaş aralığındaki genç- Sünni Müslümanlarla yapılan mülakatlardan elde edilmiştir. Bu (...) çalışmanın temel gayesi bu genç Müslümanların günlük dini yaşamlarında dini tavsiyeleri nereden ve nasıl aldıklarını yansıtmaktır. Dolayısıyla bu çalışma, Britanya bağlamında araştırmaya katılan kişilerin dini otorite arayışlarındaki tercihlerini ortaya koymaktadır. Bu açıdan özellikle Britanya doğumlu genç Müslümanların eğilimini ortaya koymak son derece önemlidir. Bu makale, başlangıç olarak katılımcıların tercihlerine dayalı olarak Müslümanlar için dini otoritenin merkezinde bulunan dört cami imamını takdim etmektedir. Onları ele almakla, Britanya’daki Sünni Müslümanların yaşamlarında cami imamlarının rolü ortaya konulmaktadır. Her bir imamın profili incelenirken camii cemaatinin hangi sorular sorduğu ve imamlara yaklaşım metodu yansıtılmaktadır. Daha sonra, Leeds ’teki Müslümanların dini yaşamlarında özel bir önemi olan ve fetva veren iki meşhur din uzmanı ele alınmaktadır. Son olarak da Britanya’da yaşayan sıradan Müslümanların dini otorite arayışında sanal bir bilgi kaynağı olarak internet incelenmektedir. Böylece bu çalışma başlıca iki sonuç ortaya koyar: Britanya’daki genç Müslümanlar Deobandī, Barēlwī ve Cema’ati İslâmî gibi farklı mezhebi kimliklerden de olsalar da sıradan bir Müslümanın belli bir ameli mezhebi (Hanefî, Şafiî, Malikî ve Hanbelî) takip etmenin elzem olduğunu kabul etmektedirler. Diğeri ise onların dini otorite arayışındaki eğilimlerinin genelde ilk olarak yerel cami imamından başlayıp sonra da onların etnik ve mezhebi çevrelerinde meşhur olan daha uzman ulemaya kadar geniş çevreye ulaşmasıdır. 18. yüzyılın başlarında vefat ettiği düşünülen Şevkizâde Süleyman Efendi, tütün kullanımının yaygınlaştığı ve şiddetli yasaklamalar sonrası yasakların gevşediği bir dönemde yaşamış bir Osmanlı âlimidir. Bu dönem, Şeyhülislam Bahâî Mehmed Efendi’nin tütünün mubahlığına dair verdiği fetvası ve devletin tütünü resmen vergilendirmesi sonrasına tekabül eder. Söz konusu dönemde tütün kullanmanın hükmüyle ilgili tartışmalar yoğun bir şekilde devam etmekte olup, lehte ve aleyhte pek çok risâle kaleme alınmıştır. Konuyla ilgili risale kaleme alan müelliflerden biri olan Şevkizâde risalesinde, tütün kullanımı ile ilgili tartışmalarda uygun (...) olmayan deliller ve hakarete varan sert bir üslup kullanıldığı, tütün içilmesine engel olmak ve fitneyi önlemek üzere bu eserlerde konuyla ilgili nass bulunmadığı ve kıyasla hüküm istihraç etmenin ihmal edildiği gibi pek çok asılsız iddialarda bulunulduğunu belirtir. Söz konusu tartışmaların ise insanları kafa karışıklığı içinde bıraktığını, bu nedenle Kitap, sünnet ve müçtehitlerin görüşleri ışığında mesele ile ilgili doğruları ortaya koymak üzere kısa bir risale telif ettiğini belirtir. Tütünle ilgili genellemeci bir hükümden kaçınan Şevkizâde risalesinde; tütün kullananların mescide gelmekten menedilmesi, tütünün habâisten olup olmadığı, devlet başkanının tütün hakkındaki emrinin hükmü ve bağlayıcılığı, tütün kullanmanın haramlığını ve mubahlığını savunanların bazı iddialarının değerlendirilmesi ve tütün içmenin oruca etkisi gibi meselere ayrı ayrı temas eder. Muhyiddîn el-Kâfiyecî (öl. 879/1474), on beşinci yüzyıl Saruhanoğulları, Osmanlı ve Memlüklü alimlerindendir. Yüzden çok eser yazmıştır. Makale Kâfiyeci’nin hayatı ve eserlerini araştırır. Yazdığı eserler, onun, Arap dili, Arap grameri, belagat, tarih metodolojisi, hadis ve usulü, tefsir ve usulü, fıkıh ve usulü, kelâm, tasavvuf, dil felsefesi, semantik, metafizik meseleler, geometri, optik ve astronomi gibi konularda uzmanlaştığını göstermektedir. Kâfiyeci en önemli eserlerini Arap dili ve mantık sahalarında yazmıştır. Eserleri içerisinde yaptığı linguistik çözümlemeler, onun yetkin bir dil alimi olduğunu göstermektedir. Kâfiyeci eserlerini yazarken (...) linguistik, mantıki, ilmi ve felsefi bir yöntem kullanmıştır. Araştırmada, Kâfiyeci’nin, hayatı boyunca en az yüz on iki eser yazdığı tespit edilmiştir. In this study, the tahrîj method, which is used in answering contemporary Fiqh issues throughout the history of Fiqh, will be described and some sample fatwas given by the High Board of Religious Affairs based on this method will be analysed. Tahrîj is firstly to define the procedural and legal principles on which the singular views of a madhhab imam is based on, and then to determine the verdict of the issues in which an opinion from that imam is not (...) conveyed, according to the rules reached. Firstly the High Board of Religious Affairs will be introduced briefly highlighting issues such the effort put forward by the Board in the answering current fiqh issues, its contributions to the unity of fatwa and that it is a continuation of the Islamic Meşîhat-ı İslamiyye in the Ottoman Empire. Tahrîj, will be defined and its types, history, and its role in the development of fiqh and in solving current fiqh issues will be explained. Among the issues resolved by the High Board of Religious Affairs by applying the Tahrîj method or by making use of this method; commercial insurance, organ transplantation, gold-based lease certificate and the effect of injection/vaccine on fasting will be analysed. Given these exemplary fatwas, it will be tried to show that the method of Tahrîj is important today as it was in the past, both in terms of maintaining the consistency of fiqh and its contribution to the development of fiqh. This article focuses the divorce oaths reflected in fatwās from Ottoman social life, oathbreakings and the remedies muftīs suggested to nullify divorce oaths. The purpose of the article is to describe the usage areas of the divorce oath in Ottoman social life, the problems within and outside of marriage it created, and the ways to solve these problems, based on the issues consulted to muftīs. The fatwās used as a data source in the article are limited to those have personally (...) been asked to Hanafī muftīs who served in Anatolia and Rumelia between the 16th and 18th centuries. The article is a study of the history of law that uses the fatwās in the collections, most of which are found as manuscripts, as the main data source. The acceptance of conditional divorce as a kind of oath in the Hanafī legal tradition paved the way for its use in Ottoman social life for different purposes beyond divorce. A great number of fatwās indicate that the divorce oath of husband in the family was sometimes a means of restraining and educating the wife, and sometimes a counter measure some rules of the Hanafī madhhab that may cause victimization of the wife. In social life, the divorce oath was used to reinforce personal decisions, it often functioned as a verbal guarantee in debt relations, and allowed the authorities to put pressure on people. Violation of the divorce oaths would in many cases cause serious family problems. Therefore Ottoman muftīs suggested some remedies to nullify divorce oaths. These remedies generally are proxy, marriage by unauthorized person and to divorce the wife-to break the oath-to remarry the wife. The article describes and interprets numerous fatwās on which these findings are based, in the light of Hanafī legal doctrine. (shrink)

Bayʿ al-wafā is a fatwa issue (waqıʿat/nawazil) in the form of a legal solu-tion (hīla al sharʿiyyah), the legal nature of which was intensely debated by Central Asian Hanafi jurists. This contract appears to be a practice by which Muslim communities living in Central Asia, particularly in Bukhara and Samarkand, were able to conduct their debt relations without involving interest. The initial assessments regarding the legal nature of bayʿ al-wafā, for which there is no transmission from the founding imams, emerged (...) in the fatwas of Central Asian Hanafi scholars in the 4th/10th century. Subsequently, from this century, when the first examples of fatwa literature were penned, to the 6th/12th century, when the most advanced and influential examples were produced, there were many different opinions on the legal nature of this contract according to the Hanafī doctrine. In this study, based on the fatwa literature that emerged between these centuries, the chronological development of opinions on the legal nature of the bayʿ al-wafâ contract has been examined. Furthermore, this study also addresses the fundamental trends that have led to different assessments on the subject and identifies the subordinate and opposing views concerning it. (shrink)
