El acceso a la justicia como derecho, y el diseño e implementación de políticas públicas que lo tornen operante, exige un abordaje formativo crítico que se inscriba en la línea de una triple articulación: filosófica, jurídica y política. Enmarcada en dicha pretensión, la propuesta del curso “Agencias judiciales, políticas públicas y acceso a la justicia” tiene por objeto: a)Promover la reflexión sobre el acceso a la justicia como núcleo problemático de nuestra contemporaneidad social y jurídica. b)Reinscribir dicha reflexión crítica en (...) las filiaciones iusfilosóficas que la posibilitan e impulsan. c)Conceptualizar el acceso a la justicia como desafío medular de políticas de inclusión social.d)Identificar las complejidades que se derivan del carácter críptico y técnico que reviste el derecho moderno y el lenguaje jurídico que lo constituye, circunstancia que dificulta su accesibilidad y difusión. e)Efectuar aportes formativos que sirvan de base para la elaboración de políticas de acceso a la justicia que posibiliten la desarticulación de esta opacidad y formalización del lenguaje jurídico. f)Advertir el carácter performativo que porta el derecho como práctica social discursiva no solo como esfera de producción normativa sino también de construcción de las representaciones sociales que se disputan en la escena pública. g)Comprender el rol fundamental que poseen las agencias judiciales como instancias de promoción y desarrollo de políticas públicas en materia de acceso a la justicia. h)Esbozar los desafíos de dichas agencias judiciales para la profundización del acceso a la justicia como derecho vinculado a problemáticas específicas tales como la vulnerabilidad social y la diversidad cultural y lingüística. El artículo intenta recuperar la figura de Dora Benjamin como referente de la crítica social, reconstruyendo las huellas de aquello que el silencio de su imagen posibilita interpretar.

El presente trabajo pretende explorar las contribuciones que lecturas y categorías posestructuralistas ofrecen a la conformación de una crítica decolonial. En particular, se orienta a la recuperación del concepto de tercer espacio desarrollado por Homi Bhabha, la reinscripción de una política del reconocimiento en las figuraciones del lenguaje propuesta por Julia Kristeva y la crítica al humanismo de Sylvia Wynter. Lejos de confundir colonialismo y colonialidad o estudios poscoloniales y decoloniales, el artículo intenta dar cuenta de su íntima productividad. Es (...) precisamente en la torsión de la enunciación donde se esboza una apuesta por la subversión de dicha disputa. ¿Qué relación hay entre derecho y lenguaje? Y ¿entre lenguaje y ley? ¿Cómo se inicia la serie de la juridicidad? ¿Qué la posibilita? Una característica hace de lo humano algo aparte de lo vivo: la palabra. El presente trabajo pretende recorrer parte de esta huella, intentando repensar allí la centralidad del lenguaje en la estructuración misma de la juridicidad. Volverse al lenguaje es, en definitiva –como señala P. Sneh– un gesto político.

La literatura de Kafka no es ciertamente complaciente, obliga al lector a releer una y otra vez. El sentido no está dado allí en el texto sino desplazado, porque la única manera que tiene de acontecer es en lo ausente, en lo inacabado. En diálogo con V. Karam, el presente artículo pretende recorrer parte de esa huella, intentando repensar allí la inasibilidad del tiempo, de la ley y de la interpretación.

En una entrevista realizada en la Revista Pratiques, Barthes plantea una pregunta de profunda relevancia para la enseñanza jurídica: ¿cómo reinscribir el deseo en los pliegues de un espacio de saber institucional? La mayoría de las veces nos preocupamos por los contenidos en la enseñanza. Pero la tarea no se centra solamente allí, advierte. El verdadero problema es saber cómo se puede poner en el contenido, en la temporalidad de una clase valores o deseos que no están previstos por la (...) institución. ¿Cómo hacer de la comunidad universitaria una comunidad de deseo? ¿Cómo forjar una poética del pensar que potencie la afirmación de la comunidad toda? El presente trabajo pretende abordar estos interrogantes a partir de dos referencias: el movimiento derecho y psicoanálisis, y una lectura spinoziana de la educación. En ese marco se sostiene que, en tanto el deseo se construye con ley y no fuera de ésta como suele argumentar el pensamiento político pre- freudiano, es precisamente la articulación entre el derecho y el psicoanálisis el espacio adecuado para su despliegue y comprensión. Una enseñanza jurídica como política del deseo se ofrece así como una clave para repensar nuevas prácticas que posibiliten desplazar las racionalidades instrumentales, desburocratizar los saberes y abrir nuevas temporalidades que problematicen las demandas de inmediatez del capitalismo cognitivo. Asimismo se propone una mirada spinoziana del campo educativo que renueve la imaginación política, enseñe a desconfiar de las clausuras y conciba a lo colectivo como una fuerza poética generadora de mundo. Una lectura spinoziana de la enseñanza apuesta a un pensamiento del campo educativo lejos de las tecnocracias y cerca, en cambio, de lo político como poiesis, como construcción colectiva de la libertad de pensar. Implicando ello, ante todo, leer el encuentro entre el concepto y el afecto. Porque, en definitiva, como bien enseña Spinoza: nadie sabe lo que puede un cuerpo. (shrink)

Jean Luc Nancy (2020) refería a la pandemia como un virus demasiado humano. Esto es un virus ligado a nuestros modos de producción y consumo; al uso ilimitado de todas las fuerzas disponibles, naturales y humanas, con miras a una producción que no tiene otra finalidad más que ella misma. El virus, señala Nancy, viene a señalarnos que hay límites. A partir de esta lectura, el artículo propone tres aportes conceptuales para repensar nuestro modo de habitar el mundo. Mundo no (...) como un concepto autoevidente sino como lo indeterminado que cada nueva generación deberá concebir y crear. Asimismo reflexiona sobre el lugar del derecho en el marco de dicho desafío. En “The King´s two bodies” Kantorowicz explora la ficción legal de los dos cuerpos del Rey: cuerpo mortal y cuerpo político. Ficción en la cual el rey, constituido como persona ficta, trasciende la temporalidad de cualquier cuerpo individual sobre la idea de “dignitas non moritur”. El presente trabajo pretende abordar la lectura de esa dualidad corporal encarnada en el derecho a través de un doble registro: cuerpo textual y cuerpo imaginario, explorando asimismo cómo el discurso jurídico se construye en el (...) marco de dicha simbología y legitimidad. Instituir lo vivo del texto jurídico no puede hacerse más que sobre el rastro de la semiótica misma. Como señala Legendre, la normatividad produce un “Écrit vivant” en perpetua necesidad de interpretación. Es paradójicamente la batalla por la apertura del texto lo que permite la imagen misma de su continuidad. Una crítica de los montajes vividos, de la instancia de la censura que ata y moviliza el discurso jurídico, provee el fondo de una urgencia: el de la tarea iusfilosófica por venir. (shrink)

Los escenarios de inequidad y exclusión que exhibe nuestra contemporaneidad agudizados por las complejidades sanitarias y habitacionales producidas por la pandemia, el lastre de los discursos xenófobos, el racismo persistente, las violencias sacrificiales que producen día a día más cuerpos desechables, la explotación creciente del medio ambiente, la crisis del capitalismo depredador expuesta con gran nitidez en este último 2020 en el mundo, nos demandan con urgencia desde el campo jurídico pero también académico y docente el intercambio colectivo de aportes (...) formativos críticos que posibiliten desarticular las racionalidades instrumentales que han venido a regazo de la modernidad misma. En ese marco, el presente trabajo pretende aportar dos conceptos para repensar la enseñanza y el lenguaje jurídico: una crítica del signo desde y con una crítica del ritmo, situada por Benveniste y retomada por Meschonnic. Y una lectura del concepto de Tiempo-ahora (Jetztzeit) de Walter Benjamin, que interroga el tiempo homogéneo y vacío propio del paradigma del progreso moderno; proponiendo una praxis ya no del proyecto por venir, sino de la interrupción como modo de acción. Los profundos niveles de asimetría, inequidad y exclusión que exhibe nuestra contemporaneidad, las deportaciones masivas de refugiados, la criminalización de la indocumentación demandan más que nunca la necesidad de impulsar nuevos modos de pensar el derecho; modos que permitan forjar un derecho inclusivo, dialógico, abierto y participativo. Llevar adelante esta tarea supone, ante todo, repensar los presupuestos filosóficos sobre los que el pensamiento jurídico se asienta. Resulta así imprescindible deconstruir ciertas categorías medulares en la conformación de la Teoría Jurídica. ¿Cómo pensar lo femenino? ¿Es posible ubicar allí algo del orden de lo identificable que permita inscribirnos como parte de un conjunto? ¿Cómo tramitar las diferencias? ¿Cómo articular una propuesta de acción que soporte lo inasible de la subjetividad misma? ¿Cómo impulsar las condiciones jurídicas que atribuyan un rol activo al Estado en la protección de los derechos de las mujeres frente a la violencia estructural? ¿Cómo desplazar esta esfera de inscripción moderna de la violencia sacrificial que produce día a (...) día cada vez más cuerpos desechables? El presente trabajo pretende abordar estos interrogantes dando cuenta de la necesidad de forjar un feminismo crítico que sitúe los discursos de género lejos de toda lectura fácil y simplista. Este desafío supone consolidar un movimiento feminista que problematice y desarticule ciertas categorías medulares de la teoría jurídica moderna; categorías que: a) han imposibilitado comprender la complejidad y desplazamientos de los procesos de constitución subjetiva. b) han ignorado las micropolíticas de la diferencia y las disputas/ renegociaciones que éstas implican. c) han presupuesto una temporalidad teleológica como marco de acción. d) no han dado cuenta cómo los paradigmas de excepción se han convertido en formas paradigmáticas de gobierno, constituyéndose en una de las esferas de inscripción moderna de la violencia sacrificial. Nadie sabe lo que quiere la Justicia porque la justicia no se deja escribir. Cuando digo escribir, digo instituir. La Justicia no se deja instituir. Con ello debe lidiar la actividad judicial, con el límite mismo, con la propia imposibilidad. Límite que exhibe oculto que hay algo allí que no hace cuerpo. Que hay algo que el orden de lo simbólico no logra apresar. Legendre decía: en occidente, instituir es escribir. Instituir a los hombres es ante todo, escribirlos, inscribirlos, ¿marcar (...) sus cuerpos? Kafka lo sabía bien. La democracia enfrenta también un desafío similar: asumir que el signo de lo ilimitado la acompaña en el regazo mismo que la dialéctica de la modernidad le ofrece. Los escritores, señala Milner, han descripto lo ilimitado para condenar sus consecuencias y sustraerse a ellas, como el caso de Rousseau, o para constatarlas y combatirlas mediante estrategias de inversión, de Baudelaire a Brecht.Arrasar con la diferencia es no soportar el límite, aquello que hace borde, aquello que no se deja decir. En otras palabras no aceptar la falta en el lenguaje. El presente trabajo pretende mostrar que es, precisamente, el punto de cruce que constituye el límite mismo, el lugar que aloja un encuentro posible entre justicia y democratización. El límite, lejos de clausurar, posibilita aquel enlace, lo augura. Es a nivel del lenguaje que esta relación requiere ser situada. Democratizar la lengua supone horizontalizarla, en otras palabras, abogar por la apertura y circulación del sentido. Son las teorías críticas del derecho las que aportan las herramientas necesarias para pensar esta articulación. Como señala Cárcova, es en el campo del sentido en donde el derecho adquiere su especificidad y produce los efectos que le son propios. Profundizar la democracia desde el campo jurídico exige, ante todo, democratizar al derecho mismo. (shrink)

Hay una profundidad en la letra, entre las letras, que solo la lectura es capaz de enunciar. Enunciación que evoca la pregunta por la violencia de la palabra misma, su ambición de significar. La letra, en cambio, es un acontecer sutil. No hay escritor ni lector que pueda estrecharla, reducirla, asfixiar su siempre prosódica pulsión. Hay otros signos que la letra codicia -dice Jabes- signos borrados que el gesto reproduce en lo que nombra. El presente trabajo pretende interrogar la tradición (...) de la interpretación jurídica occidental emprendiendo la tarea de una restauración: la de la lectura midrashica como modo otro de interpretación. Como advierte Legendre, el armazón lógico de nuestros sistemas jurídicos sostenido sobre un derecho romano canónico como su representación histórica se instituyó sobre la marca de un silencio: la represión de cualquier sistema de interpretación disonante, juzgados como contrarios a la Razón por la tradición del derecho romano cristianizado. ¿Cómo leer esta censura? Pensar es trabajar en transformar el pensamiento, escribía Meschonnic. La crítica es, ante todo, eso: reflexionar precisamente sobre lo que nuestros saberes nos impiden saber. Un gesto que transforma a partir de la interrogación misma. En diálogo con el Profesor Duncan Kennedy, el presente trabajo pretende repensar la relación entre enseñanza, crítica y acción en el campo jurídico, insistiendo en la necesidad de reinscribir la crítica no como develamiento de una “verdad esencial” oculta sino como una praxis que transforme a (...) partir de los propios límites que el orden simbólico instituye. Asimismo el artículo aborda la pregunta por la interpretación judicial sugiriendo la necesidad de desplazar el significante “trabajo jurídico” hacia la órbita de la “acción” en sentido arendtiano. El trabajo o la fabricación a diferencia de la acción se produce en aislamiento. La acción, en cambio, necesita de otros. Es por ello que se ofrece como cambio y sobre todo: ausencia de cálculo. El presente trabajo pretende abordar la tensión entre los conceptos de hospitalidad y hostilidad, intentando mostrar allí el papel fundamental que desempeña la extranjería como clave política para sustraer al poder del encierro mismo que la verticalidad genera; aspirando a ofrecer así una mirada a una otra temporalidad.

¿Cómo desplazar un sistema de signos? ¿Cómo expandir el alcance textual de una fuerza? ¿Cómo repensar una teoría del cambio en el marco de un discurso que por estructura se nutre del silencio como su modo otro de conformación? ¿Cómo des-leer los montajes e imágenes que el lenguaje jurídico ata y moviliza? El presente trabajo pretende abordar la pregunta por la relación entre texto jurídico, ausencia y transformación a partir de los aportes de tres autores: Julia Kristeva, Gayatri Spivak y (...) Pierre Legendre. Entendiendo que es allí en la tensión misma entre lo dicho, lo ausente y lo im-puesto donde se inscribe la posibilidad misma de la acción. Mientras que Kristeva aborda la pregunta por la transformación a partir de una crítica vuelta sobre la semiótica misma, Spivak inscribe una teoría del cambio en el marco de una relectura semiótica de la subalternidad. Legendre, por su parte, insiste en el carácter inconsciente, libidinal de la sujeción. (shrink)

Kant es como un trueno, escribe Deleuze. Después siempre podemos hacernos los listos. Es con Kant que la conciencia moderna del tiempo recibe su estatuto filosófico. El tiempo deviene línea recta. Levinas reinscribe dicha conciencia temporal ya no en el plano de la razón especulativa sino de la relación ética que trae aparejada el encuentro con el Otro y en la idea de Infinito. Significante que se inscribe como aquello que no podemos abarcar (lo totalmente Otro), y que al no (...) poder abarcar mantiene abierto al pensamiento. Rosenzweig, por su parte, propone una completa renovación del pensamiento que consiste en poder acceder al fenómeno fundamental de necesitar al otro “y lo que es lo mismo, en tomar en serio al tiempo”. A partir de los aportes que estas lecturas ofrecen, el presente trabajo pretende abordar la pregunta por la temporalidad y sus implicancias para el pensamiento jurídico, augurando allí la posibilidad del tono para una nueva juridicidad. The sense is not given there in the text but shifted, because the only way that has happened is in what is missing, in the unfinished. In dialogue with V. Karam, the present article aims to go part of that trace, trying to rethink there ethereality of time, law and interpretation.

La obra de BAJTIN es maravillosamente fragmentaria, se sustrae con gran habilidad a toda sistematización. Sin embargo, la lectura exige irremediablemente alguna suerte de rodeo: leer no es sino recortar. El presente trabajo pretende recorrer parte de estos textos a fin de repensar su productividad jurídica y política; un proyecto filosófico que apunta a revelar la íntima relación entre vida y literatura, entre valor artístico y valor ético. Un proyecto centrado fundamentalmente en las categorías del otro, del diálogo, la polifonía, (...) la risa y la carnavalización. El carnaval (y la carnavalización) son el medio de encarnar la imposibilidad última de todo proyecto totalitario. El carnaval es una forma sincrética de espectáculo ritual que ha elaborado todo un lenguaje de formas simbólicas organizadas bajo categorías de inversión, parodia, desjerarquización, contacto libre y unión de los opuestos. Esta risa ritual encantatoria y mágica se refugia, tras una serie de transformaciones en la llamada “cultura popular” que preserva y reivindica el sentido original de la fiesta ritual. La vida carnavalesca propone así un otro mundo y una otra temporalidad. Una dualidad donde todo se extingue y se vuelve a generar. El carnaval, escribe BAJTIN, es la fiesta del tiempo, que aniquila y renueva todo. Durante el carnaval es la vida misma la que juega e interpreta sin escenario, sin tablado, sin actores, sin espectadores, su propio renacimiento y renovación. -/- . (shrink)

First of all, I would like to thank to the Philosophy of Law Department for this encounter with Professor Solum. It is really a pleasure meeting you Professor, and having the possibility to discuss this profoundly interesting and courageaus text with my colegues and specially with its author. The adjetive I have just used is not simply politeness, I really think we are in front of a very interesting work not only because of its persuasive humorous rhetoric but mainly because (...) it is a text that interrogates its own tradition even if it is with the intention to oxygenate, give air to it. And from a critical position that is something always to be welcomed. Nevertheless what I want to argue in this brief words is that what it is surprising (for my humble point of view) is that originalism, even in this new textual linguistic outfit or clothing, doesnt still address the question of the concept of origin itself. A question and a signifier that has a long inscription not only in western philosophical and interpretative traditions (meaning Nietzsche, Freud, Philosophical Hermeneutics as Gadamer, Ricoeur or in Derrida s deconstruction and so on) but also in non western interpretative tradition such as the Talmudic, for example. In these lines of thought the origin is unreachable, either lost or doesnt exist at all as far as there is no absolute ground that soustain an unique pure original meaning. In short, it is an empty signifier, obviously in dispute. So at last what it is called “original public meaning” it is no more than the result of the force relations between discourses. In other terms, there is an internal intimate relationship between power, language and interpretation. As Bajtin puts it (a russian linguist from the early XX century): the sign is the arena of social struggle. Or as Roland Barthes use to write: power parasitizes the language itself. (shrink)

Es una superficie que implica un autoatravesamiento: la torsión que conlleva hace que los giros que la rodean se in-viertan después de dar la primera vuelta. Su construcción se gesta a partir de dos bandas de Moebius de torsión diferente pegadas en su borde. Como el sin-fin de las mil y una noches o la escena dentro de la escena, el trazado topológico de la (...) Botella de Klein reabre el enlace de una infinita interrogación: ¿Hay un afuera y un adentro en la interpretación jurídica? Si – como señala Cárcova- un razonable equilibrio permite superar la pretensión de un sentido último y definitivo en hechos y normas sin que ello importe decantar en un radical escepticismo, ¿cuál es el recorrido de esta multiplicidad? ¿Es esta errancia una migración sin orden, o por el contrario -como en los cuentos de Kafka- la apuesta por el desplazamiento del sentido nos habla de la ausencia como posibilidad? El presente trabajo pretende recorrer parte de esta huella inscribiéndose en el marco de una profunda convicción: el derecho merece la posibilidad de su resignificación. Nuevas topologías pueden ciertamente contribuir a este desafío. Desafío que nos interroga como operadores jurídicos pero fundamentalmente nos interroga como comunidad. -/- . (shrink)

Phantasmagoria explores ideas of spirit and soul since the Enlightenment; it traces metaphors that have traditionally conveyed the presence of immaterial forces, and reveals how such pagan and Christian imagery about ethereal beings are embedded in a logic of the imagination, clothing spirits in the languages of air, clouds, light and shadow, glass, and ether itself. Moving from Wax to Film, the book also discusses key questions of imagination and cognition, and probes the perceived distinctions between fantasy and deception; it (...) uncovers a host of spirit forms--angels, ghosts, fairies, revenants, and zombies--that are still actively present in contemporary culture. It reveals how their transformations over time illuminate changing ideas about the self. Phantasmagoria also tells the accompanying story about the means used to communicate such ideas, and relates how the new technologies of the Victorian era were applied to figuring the invisible and the impalpable, and how magic lanterns (the phantasmagoria shows themselves), radio, photography and then moving pictures spread ideas about spirit forces. As the story unfolds, the book features the many eminent men and women--scientists and philosophers--who in the Society of Psychical Research applied their considerable energies to the question of other worlds and other states of mind: they staged trance seances in which mediums produced spirit phenomena, including ectoplasm. The Pseudo-Aristotelian De Melisso Xenophane Gorgia, along with the well-known evidence of Sextus Empiricus, interests scholars as a major evidence about Gorgias’s treatise “On Not-Being or On Nature”. The paper offers the first Russian translation of the section of the De Melisso Xenophane Gorgia, V–VI, which concerns Gorgias; and analyses the sources and the formal structure of the argument in the treatise.

We explore different ways in which the human visual system can adapt for perceiving and categorizing the environment. There are various accounts of supervised (categorical) and unsupervised perceptual learning, and different perspectives on the functional relationship between perception and categorization. We suggest that common experimental designs are insufficient to differentiate between hypothesized perceptual learning mechanisms and reveal their possible interplay. We propose a relatively underutilized way of studying potential categorical effects on perception, and we test the predictions of different perceptual (...) learning models using a two‐dimensional, interleaved categorization‐plus‐reconstruction task. We find evidence that the human visual system adapts its encodings to the feature structure of the environment, uses categorical expectations for robust reconstruction, allocates encoding resources with respect to categorization utility, and adapts to prevent miscategorizations. This paper develops a largely neglected parallel between prudence and population ethics. Prudence is generally understood to be concerned with the balancing of well-being over time. How, precisely, well-being ought to be balanced over time, however, is a fervently debated question. I argue that developing a standard guiding such evaluations is exceedingly challenging. This is due to an often overlooked fact about prudence, namely that it shares a structural similarity with population ethics: In both contexts, we assess the comparative value (...) of populations of personstages/people, which may vary in number and level of well-being. Based on this analogy, I show that the development of an adequate theory of prudence runs into very similar impossibility results as obtain in population ethics. In particular, I prove that Arrhenius’ fifth impossibility theorem can be applied to prudence. I develop and compare four possible answers to this challenge. First, I discuss the possibility of accepting the very repugnant conclusion intrapersonally. Second, I present and further develop Donald Bruckner’s Minimax Regret approach, which gives up Transitivity. Third, I apply Jacob Nebel’s Lexical Threshold View to prudence and critically evaluate it. Criticism is a staple of the scientific enterprise and of the social epistemology of science. Philosophical discussions of criticism have traditionally focused on its roles in relation to objectivity, confirmation, and theory choice. However, attention to criticism and to criticizability should also inform our thinking about scientific pursuits: the allocation of resources with the aim of developing scientific tools and ideas. In this paper, we offer an account of scientific pursuitworthiness which takes criticizability as its starting point. We call this (...) the apokritic model of pursuit. Its core ideas are that pursuits are practices governed by norms for asking and answering questions, and that criticism arises from the breach of these norms. We illustrate and advertise our approach using examples from institutional grant review, neuroscience, and sociology. We show that the apokritic model can unify several indices of criticizability, that it can account for the importance of criticizing pursuits in scientific practice, and that it can offer ameliorative advice to erstwhile pursuers. Canguilhem’s contemporary relevance lies in how he critiques the relation between knowledge and life that underlies Kantian rationality. The latter’s Critique of Pure Reason and Critique of Judgment represent life in the form of an exception: life is simultaneously included and excluded from understanding. Canguilhem’s critique can be grouped into three main strands of argument. First, his reference to concepts as preserved problems breaks with Kant’s idea of concepts regarding the living as a ‘unification of the manifold’. Second, Canguilhem’s vital (...) normativity represents life as the potential to resist normative orders that judge the living, relegating Kant’s ‘lawfulness of the contingent’ to a ‘mediocre regularity’. Third, Canguilhem’s introduction of the environment as a ‘category of contemporary thought’ decentres the living/knowing subject and introduces contingency. His idea of the ‘knowledge of life’ leads to the conclusion that life is the condition of possibility of rationality, rather than rationality’s ‘blind spot’. (shrink)

We offer a new account of the role of values in theory choice that captures a temporal dimension to the values themselves. We argue that non-epistemic values sometimes serve as “inquiry tickets,” justifying scientists’ pursuit of certain questions in the short run, while the answers to those questions mitigate transient underdetermination in the long run. Our account of inquiry tickets shows that the role of non-epistemic values need not be restricted to belief or acceptance in order to be relevant to (...) hypothesis choice: the relevance of non-epistemic values to a particular cognitive attitude with respect to h vary over time. It seems natural to think that emotional experiences associated with a memory of a past event are new and present emotional states triggered by the remembered event. This common conception has nonetheless been challenged at the beginning of the 20th century by intellectuals who considered that emotions can be encoded and retrieved, and that emotional aspects linked to memories of the personal past need not necessary to be new emotional responses caused by the act of recollection. They called this specific (...) kind of memories “affective memories” and defended their existence. My aim here is to expound the historical background of this debate as well as the characterization and development of the notion of affective memory since its first inception. I aim to show that although the debate was left unresolved and the term disappeared from academy around 1930, many of the characterizations of the nature of emotions and memory done by the advocates of affective memory have reappeared in the scientific agenda and been further developed during the last decades. In this paper we set out the context in which experiences of mental distress occur with an emphasis on the contributions of social and structural factors and then make a case for the use of intersectionality as an analytic and methodological framework for understanding these factors. We then turn to the political urgency for taking up the concept of recovery and argue for the importance of research and practice that addresses professional domination of the field, and that promotes ongoing engagement (...) and dialogue about recovery as both a personal and social experience. To this end, we describe a unique project that sought to deepen our understanding of how recovery is being thought about and applied in the current context of mental health care in Vancouver, BC, with a specific focus on how, and whether, people are taking up and addressing dimensions of power that we see as critical to the operationalization of recovery within a social justice framework. Emerging from our research and discussion is a set of critical questions about whether or not the political moment in Canada with respect to re-invigorating recovery should be embraced, versus a rejection of the concept of recovery as too limiting in its scope and too vulnerable to professional co-optation. Without a second thought, he picked out “the most beautiful, the most expensive, the most garish, the freshest and the most bizarre of the playthings.” But his horrified mother insisted he choose another, less extravagant present, and the little Baudelaire had to resign himself and relinquish his toy.The word joujou (not jouet, the usual word for toy) is almost a pet name with a nursery ring like a “teddy” or a “dolly”; its repetition hints at baby talk and hence at playing, as when a child exchanges endearments and questions with a toy in imaginary conversations and elaborate scenarios. The toy in so many children’s games becomes part of an ongoing story and in this way initiates the first invented narratives in the child’s life.That scene of seduction, pleasure, and frustration with Mme. Pancoucke and his own mother catches Baudelaire’s lasting affection and reasoned admiration for toys. He called them “cette statuaire singulière” (this singular statuary); he was first a poet and then an art critic rather than a novelist, and as a flâneur of the boulevards and the galleries, he adopted a language of aesthetics, treating toys as an unusual form of sculpture. He recalls in pleasurable detail the miniature worlds conjured by Victorian nursery games and child’s play—from tiny “diligences” or mail coaches to detailed model furniture. But above all he muses in wonder at children’s ability to play without props or models, creating narratives, dialogue, and dramas [End Page 3] through fantasy alone: “All children talk to their toys; toys become actors in the great drama of life, reduced by the camera obscura of their small brains. They play without playthings.”1Significantly, Baudelaire goes on to make the connection to creativity in general: “[The child’s] facility to satisfy the imagination shows the spirituality of childhood in its artistic conceptions. The plaything is the first initiation of a child to art.” Nothing will ever attain again, he says, the same degree of liveliness, or, crucially, the same intensity of presence or belief. For Baudelaire, the realization of childish make-believe cannot be regained: “Isn’t all of life found there in miniature, and much more vivid in colour, cleaner and shinier than real life?”2Yet Baudelaire’s essay lingers on the frustration that dims these vivid, shiny colors, for children, he says, also want to see the soul of a toy. He describes how they will turn about their playthings and shake them, hurl them to the ground, and often break them in their bafflement and even rage at their stubborn refusal to awaken into life. His meditation hints that at the point when make-believe fails, the vitality of toys vanishes and produces a primal encounter with mortality: “But where is the soul? It’s here that bewilderment and sadness begin.”3 The beginning of imagining stories brings with it frustration that the story is not powerful enough—it is not the real thing. In a connected prose poem entitled “Le Joujou du pauvre,” published nine years later, Baudelaire pursues this thought, as he observes an exchange between a beautiful, pampered child inside the exclusive railed park of a chateau. Drawing from a multi-sourced data corpus gathered from high-net-worth social media influencers, this article explores how these individuals reconcile ethicality and living a luxury lifestyle through the enactment of three types of personas on Instagram: Ambassador of ‘True’ Luxury, Altruist, and ‘Good’ Role Model. By applying the concepts of taste regimes and social moral licensing, we find that HNW social media influencers conspicuously enact and display ethicality, thereby retaining legitimacy in the field of luxury consumption. As these individuals are highly (...) influential, they could leave a potentially significant mark on public discourse and, consequently, on their audiences’ construction of ethically responsible luxury consumption. In this vein, this article offers significant managerial insights into professional influencers and discusses ethical managerial practices to ensure ethical collaborations between influencers and managers. During the course of this article, we examine the use of membership categorisation practices by a high-profile celebrity public social media account that has been understood to generate interest, attention and controversy across the UK media ecology. We utilise a data set of harvested tweets gathered from a high-profile public ‘celebrity antagonist’ in order to systematically identify types of antagonistic formulation that have generated different levels of interest within the social media community and beyond. Drawing from classic ethnomethodological studies of (...) banner headlines and other means of generating public interest and ‘making sense’, we respecify high-profile antagonistic tweets as category formulations that exhibit particular and regular membership category features that are reflexively bound to potential antagonistic readings, interest and controversy. In conclusion, we consider how such formulations may be understood to represent resources that constitute ignition points within antagonistic flows of communication and information that can be metaphorically understood as ‘digital wildfires’. What, if anything, do the ‘square’ protests and ‘occupy’ movements of 2011 bring to contemporary democratic theory? And how can we, as political theorists, analyse their discourse and do justice to it? We address these questions through an analysis of the Greek and Spanish protest movements of the spring and summer of 2011, the so-called aganaktismenoi and indignados. We trace the centrality of the critique of representation and politics as usual as well as the ideas about horizontality and autonomy in (...) the protesters’ discourse. These ideas are not only important to their critique of the contemporary liberal democratic regimes in the two countries, but also important to the way in which the protesters organise themselves. Nonetheless, as we shall argue, the protesters are caught within a tension between horizontality and verticality, between autonomy and hegemony, or between moving beyond representation and accepting representational structures. Given this tension, we examine how the protesters negotiate it in three key areas: politics, representation and organisation. Drawing on Jacques Rancière, we further argue that the protesters can be seen as making a claim to equal voice. This is what Rancière refers to as politics proper, and the question is then whether such a politics is possible without falling back into traditional forms of politics. (shrink)

In many areas of the social and behavioral sciences, the nature of the experiments and theories that best capture the underlying constructs are themselves areas of active inquiry. Integrative experiment design risks being prematurely exploitative, hindering exploration of experimental paradigms and of diverse theoretical accounts for target phenomena.

The philosopher Lev Shestov aimed to establish a new free way of thinking, which manifested itself as a struggle against the delusion that we have a rational grasp of the necessary truths on matters that are of the greatest importance to us, such as the questions of life and death. Philosophy, as the Russian philosopher understood it, is not pure thinking, but ‘some kind of inner doing, inner regeneration, or second birth’ (Shestov in Lektsii po Istorii Grecheskoi Filosofii [Lectures on (...) the history of Greek philosophy], YMCA-PRESS, Moscow, 2001, p. 53). Having adopted the notion of the ‘regeneration of one’s convictions’ from Dostoevsky’s vocabulary in his earlier works, Shestov developed the idea of ‘awakening’ further in his mature thought, in which the motif of ‘awakening’ comprised one of the main ideas of his philosophy: the fight for the individual’s right to freedom and to creative transformation at a time when she is in despair or on the brink of death. In this article, I analyse Shestov’s idea of ‘awakening’ as one of the key tropes and developmental characteristics of his philosophical vision. In particular, I argue that, having stemmed from Shestov’s earlier interpretations of Dostoevsky, Shakespeare and Plotinus, in his later writings, the notion of ‘awakening’—the possibility of a fundamental, inner transformation of one’s worldview (probuzhdenie, pererozhdenie)—marked the beginning of a new salvific mode in his writing.
