This article presents a defense of Kant’s idea of a league of states. Kant’s proposal that rightful or just international relations can be achieved within the framework of such a league is often criticized for being at odds with his overall theory. In view of the analogy he draws between an interpersonal and an international state of nature, it is often argued that he should have opted for the idea of a state of states. Agreeing with this standard criticism that (...) a league of states cannot establish the institutional framework for international justice, others also suggest an alternative stage model interpretation. According to this interpretation, Kant’s true ideal is in fact a state of states, whereas the league is merely introduced as a temporary and second best solution. In contrast to both the standard criticism and the stage model interpretation, I argue that fundamental normative concerns count in favour of a league rather than a state of states. I also argue that Kant’s defense of such a league is consistent with his position on the institutional preconditions for just interaction in the domestic case because of crucial relevant differences between the state of nature among individuals and the external relations between states. This is the introduction to the Special Issue ‘Foundational Issues in Conceptual Engineering’. The issue contains contributions by James Andow, Delia Belleri, David Chalmers, Catarina Dutilh Novaes, Eugen Fischer, Viktoria Knoll, Edouard Machery and Amie Thomasson. We, the editors, provide a brief introduction to the main topics of the issue and then summarize its contributions.

By emphasizing the interdependence between management and integration, the EU governance can propose a new path. EU governance is not only the characteristics of the new EU system of government decisions, while national and European level on the formation of the system have a significant impact. EU governance and institutional building process of each member system may affect the integration and consistency. In a way, Europe "good governance" could threaten the ability of the existing state system of governance and democratic (...) quality. Can be assessed in a systematic way to EU governance when, why, consistent stumbling block is a member, or a springboard for cross-national integration. EU governance across national borders to open up political space, but at the national level, the EU governance has not caused any apparent disintegration of the results. The paper presents a new approach to EU governance by stressing the interdependence of governance and integration. It suggests that EU governance is not just shaped by the emerging properties of the EU polity but has a strong impact both on system formation at national arid European level. It is a process of mutual structuration which is likely to affect the integration and coherence of member state systems up to a point where European 'good governance' may threaten the governability and democratic quality of established national systems. The paper goes on to assess in a systematic way why and when EU governance may qualify as stumbling stones for member state coherence or stepping stones for transnational integration. EU governance has the effect of opening a trans-national polity space which, however, has not produced any visible dis-integrative effects at the national level. (shrink)

Concerned about the transformation of European governance that we are faced with confusion, although member states sovereignty and the increasing transfer of management authority. However, according to the national will to develop policies that principle is still showing infinite vitality. Decision-making in Europe, between private interests and public interests tilt the balance seems to have the former while the latter is negative, but it is the special nature of the European polity makes public actors to continue to exist. To better (...) understand the transformation of European governance, to take a different research methods may be useful. It is not the government at different levels or different types of power relations between the interests of actors change, but to changes in the practice of governance and management and the understanding. Looking at the transformation of governance confronts us with a puzzle, Member states have accepted an incremental transfer of sovereignty and regulatory power. Empirical evidence, however, gives proof of a rather unrestricted vitality to shape policies according to national preferences. In European policy-making the balance between private and public interests seems to have shifted to the detriment of the latter. At the same time the very properties of the European polity enable public actors to escape capture. In order to gain a better understanding of the transformation of governance it might be helpful to take a different approach. It is not the change in terms of shifting power relations between different levels of government or between different categories of actors which is of interest, but changes in the practice of governing and the understanding of what governance is about. The article sets out to explore the international legal dimension in Jürgen Habermas' latest publications on philosophy of law. It is our view that Habermas deals with the examination of just relations beyond the nation-state first and foremost from a legal perspective, and that the key to a Habermasian reading of international justice is not through an application of discourse-theoretical models of communicative or moral action as such, but primarily through proper legal institutionalisation of the rule of law. In asserting (...) this view, we will look closer at the Kantian influence in Habermas' legal construct at the international level, and show why this institutional approach is to be sharply distinguished from and preferred to any exclusively non-institutional approach to international justice. Resumo O fundamento teórico deste artigo compreende uma análise teológica, com especial interesse pelo diálogo com a sociologia e com a antropologia. Investiga as relações de dominação, com enfoque específico nas relações de gênero que se engendram a partir dos ritos religiosos ou profanos, Objetiva-se verificar a importância dos ritos para a construção da realidade social, sobretudo das noções de gênero e das relações que delas advêm; expor com embasamento antropológico e sociológico esta premissa, visando contribuir para a discussão da (...) função social da religiosidade como construtora da realidade social; oferecer uma compreensão dos ritos enquanto espaços nos quais podem surgir relações mais igualitárias entre homens e mulheres. Através da pesquisa bibliográfica, procurar-se-á na sociologia de Pierre Bourdieu conceituar o poder simbólico e compreender de que maneira ele é elemento que constrói noções de gênero; posteriormente, serão averiguados em obras da área da antropologia, conceitos de rito, estabelecendo sua ligação com o poder simbólico e seu possível potencial construtor da realidade social e das noções de gênero que orientam as relações entre mulheres e homens. A conclusão buscará apontar de que maneira podem os ritos se tornar espaços para a articulação de um novo modo de relações de gênero. Palavras-chave: Ritos, Sociedade, Gênero.The theoretical basis of this article consists of a theological analysis, with emphasis on a dialogue with sociology and anthropology. It investigates dominance relationships, focusing particularly on gender relationships engendered by religious or profane rites. The objective is to verify the importance of rites for the construction of social reality, above all of gender notions and the relationships that result from them; to expose this premise on an anthropological and sociological basis, seeking to contribute to the discussion of the social function of religiosity as builder of social reality; and to provide an understanding of rites as spaces where more egalitarian relationships between men and women can take place. Through bibliographical research, especially into Pierre Bourdieu's sociology, the text tries to describe symbolic power and to understand how this element builds gender notions. Then, it verifies concepts of rite in anthropological texts, establishing its connection with symbolic power and its potential to construct social reality and gender notions that guide the relationships between women and men. The conclusion tries to indicate how rites can become spaces for the articulation of a new mode of gender relationships. Key words: Rites, Society, Gender. (shrink)

This article takes issue with the common view that cosmopolitan normative commitments are incompatible with recognition of state sovereignty as a basic principle of international law. Against influential cosmopolitans, who at best ascribe a derivative significance to the sovereignty of states, the article argues that state sovereignty is not only compatible with, but also essential to the recognition of individuals as units of ultimate concern. The argument challenges a problematic distributive conception of justice underlying many cosmopolitans’ support for reforms of (...) the international legal order towards a system where respect for basic human rights is the only criterion for political legitimacy. An alternative relational conception of justice makes it possible to see why there is an internal connection between the rights of individuals and the rights of states. The purpose of this article is to present a critical assessment of Jürgen Habermas' reformulation of Kant's philosophical project Toward Perpetual Peace. Special attention is paid to how well Habermas' proposed multi-level institutional model fares in comparison with Kant's proposal—a league of states. I argue that Habermas' critique of the league fails in important respects, and that his proposal faces at least two problems. The first is that it implies a problematic asymmetry between powerful and less powerful states. The second (...) is that it entails creating a global police force that has an obligation to intervene against egregious human rights violations worldwide, and that this seems incompatible with the idea that every person has an innate right to freedom. There are important normative constraints relevant for institutional design in the international domain that Habermas does not take sufficiently into account. However, this does not mean that Kant's league cannot be supplemented with more comprehensive forms of institutional cooperation between states. On the basis of my assessment of the multi-level model, I propose a hybrid model combining elements from Kant and Habermas. (shrink)

Catholic opponents of abortion and embryonic stem cell research usually base their position on a hylomorphic account of ensoulment at fertilization. They maintain that we each started out as one-cell ensouled organisms. Critics of this position argue that it is plagued by a number of intractable problems due to fission (twinning) and fusion. We're unconvinced that such objections to early ensoulment provide any reason to doubt the coherence of the hylomorphic account. However, we do maintain that a defense of ensoulment (...) at fertilization must deny that we're essentially organisms. (shrink)

Taking Kant’s philosophy of right as my starting point, I defend the view that just exercise of political power requires economic redistribution. Against the common view that Kant’s political thinking has no economic implications, I argue that republican interpretations of his philosophy of right succeed in reconstructing a cogent argument in favor of public poverty relief. I also argue that the economic implications of Kant’s theory extend beyond public support of the poor. As freedom-enabling institutional structures, states are obliged to (...) remove hindrances to democratic self-legislation. It is reasonable to consider economic inequality as such a hindrance, and so public provisions for the poor is not enough. In order to exercise political power in a just way, public authorities must also take measures to reduce the gap between the richest and the poorest. (shrink)

It is common to interpret Kant’s idea of public reason and the Enlightenment motto to ‘think for oneself’ as incompatible with the view that testimony and judgement of credibility is essential to rational public deliberation. Such interpretations have led to criticism of contemporary Kantian approaches to deliberative democracy for being intellectualistic, and for not considering our epistemic dependence on other people adequately. In this article, I argue that such criticism is insufficiently substantiated, and that Kant’s idea of public reason is (...) neither at odds with deference to a certain kind of authority, nor with making judgements of character in rational deliberation. This view is corroborated by recent work on Kant’s epistemology of testimony. (shrink)

We comment on and translate Gustav Kirchhoff's important paper of 1857 entitled On the motion of electricity in conductors. The significance of this paper is that Kirchhoff proved with action at a distance that electric disturbances travel along wires of negligible resistance with the velocity of light. He accomplished this with the laws of Newtonian electrodynamics (Coulomb, Ampere, F. Neumann and Weber) before Maxwell had formulated his equations.

From fertilization to approximately the sixteenth day of development, human embryonic cells are said to have the capacities of totipotency and monozygotic twinning, both of which are problematic to a theory of ensoulment at fertilization. In this article I will address the problems which these capacities pose to such a theory and present an interpretation of the biological data which renders ensoulment at fertilization more plausible. I will then argue that not only is an ensoulment theory consistent with current biological (...) data on the human embryo, but it may offer an explanation for the phenomencon of monozygotic twinning. This article defends a pure functionalist theory of territorial jurisdiction according to which a state’s moral right to rule over a territory rests on its present moral performance as a freedom‐enabling institutional structure. A common objection against functionalist theories is that they cannot explain why it matters that one particular state has exclusive jurisdiction over a certain territory. This deficiency is often associated with the annexation challenge, which is supposed to show that functionalist theories cannot deal adequately with cases of (...) annexation. Against this line of criticism, I argue that the pure functionalist justification of the right to rule is capable of tackling challenges related to particularity and annexation. First, the pure functionalist theory explains why it is important that one particular state rules over a given territory. It also tells us what set of laws and what government we should comply with. Second, the pure functionalist justification of the right to rule entails sufficient conceptual resources to account for the wrongdoing involved in annexation. Although the theory deems past wrongs irrelevant for the justification of the right to exercise jurisdiction on a territory, it is adequately sensitive to historical injustice. (shrink)

This paper advances a new paradigm in clinical ethics education that not only emphasizes development of individual cli but also focuses on the institutional context within which health care professionals work. This approach has been applied to the goal of improving the care provided to critically and terminally ill adults. The model has been adopted by about thirty hospitals and nursing homes; additional institutions will soon join the program, entitled Decisions Near the End of Life.
