Abstract
Emmanuel Picavet | : Les droits individuels fondamentaux ne sont-ils pas fragilisés, dans les contextes de prise en charge liés au vieillissement ou aux situations de handicap, si leur lien avec l’autonomie individuelle apparaît perturbé par la perte ou l’absence de capacités individuelles jugées importantes? Il est montré dans cet article que les inquiétudes à cet égard reposent sur des présupposés qui concernent le pouvoir de décision des individus. Un point de vue renouvelé sur ce pouvoir contribue à lever les inquiétudes. Il est ensuite montré que cet enrichissement nécessaire est pertinent pour l’organisation en vue de la prise en charge. | : If the connection between the basic rights of individuals and their autonomy turns out to be impacted by individual capacity losses or deficits, shouldn’t we expect a weakened status of these rights in the context of collective care? In this article, it is shown that such expectations only acquire meaning in association with presuppositions which relate to individuals’s decision-making power. Taking a renewed perspective of this power alleviates the fears in this respect. Then it is shown that this modified view is relevant to organization in the face of care challenges.
