This paper examines undergraduate business students' perception of corporate social responsibility in cases in which they have not attended any specific course either dealing with CSR or providing training in ethics. A survey was conducted of 535 Spanish business students as future managers. The results show that the stakeholders' perspective deserves a huge attention for those students considering what the keys of business success are. Significant differences in perception were nevertheless identified when a multifactorial analysis was undertaken. Female students are (...) more concerned about CSR issues. The maximization of value for shareholders is less valued by second- and third-year students than by first-year ones. The findings point to a number of important orientations for the future development of university curriculum. (shrink)

Although the few references to the term, Nietzsche's notion of perspectivism is an important assumption of his philosophical reflection. It is a notion, as it will be tried to demonstrate, significant for the understanding of many theoretical positions of the author concerning science and knowledge and decisively for the interpretation of both notions as interpretative perspectives The following argument aims to analyze the influences and assumptions of this notion, highlighting its Kantian (Neokantian), Schopenhaurian background, but also considering influences outside of (...) philosophy, such as Ruggero Boscovich's theoretical physics, which plays a decisive role in the formulation of the notions of perspectivism and perspectivist interpretation in Nietzsche's philosophy. This essay takes up Noel Annan’s claim that “The key to Oakeshott” is in the relatively neglected book on horse racing, A Guide to the Classics. The analysis develops Oakeshott’s anti-rationalist, skeptical perspective by examining how he approached the topic of handicapping horse racing. Like politics, and practical life more generally, horse racing requires experience in the face of contingency and suggests a conservative and playful response is the appropriate one.

O objetivo deste artigo é analisar a crítica de Waldron a Rawls, feita no livro “Law and Disagreement”. Queremos saber se nessa crítica está implícita a ideia de que Rawls faz uma má idealização. Para fazer isso, teremos, em primeiro lugar, que esclarecer o que é uma “teoria ideal” e o que são boas ou más idealizações. Falaremos sobre essas distinções na primeira seção do artigo. Waldron ataca a alegada incapacidade da teoria de Rawls de tratar seriamente os desacordos sobre (...) princípios políticos. A exposição dessa crítica e a análise de seu desenrolar vai ocupar as parcelas mais significativas do artigo, e será feita nas seções seguintes. Ao fim da análise, defenderemos que, apesar de a crítica de Waldron ser forte, ela não implica que há más idealizações de Rawls. (shrink)

A FALÊNCIA DO ESTADO SOMALI E A PIRATARIA EM ÁGUAS INTERNACIONAIS: UMA ABORDAGEM ILUSTRADA A PARTIR DO FILME “CAPITÃO PHILLIPS”.

O objetivo deste artigo é propor, em confluência com a filosofia de Gaston Bachelard, uma pedagogia do não inspirada na figura do cogito do sonhador para refletir sobre uma educação para a imaginação. Parte-se da filosofia do não de Bachelard para a construção de uma pedagogia do não, expressa como pedagogia do diálogo, que põe em relação complexa e complementar o conceito e a imagem, como prolongamentos do racionalismo aberto e da imaginação criadora. Na sequência, o cogito do sonhador é (...) evocado para o estudo do devaneio e do imaginário, no quadro da imaginação material dos quatro elementos. Esses passos preambulares são necessários para se chegar à educação para a imaginação, cuja dimensão de Bildung se opera por meio da eufemização. Como função da imaginação, a eufemização tende a transfigurar o sofrimento, a morte e o nada em algo aceitável, não como negação, mas como dinamismo prospectivo que tenta melhorar a situação do homem no mundo. Exemplo desse dinamismo são as imagens literárias, com a polissemia e a polifonia que as caracterizam e as alçam ao domínio do estranho e da transgressão em relação à ordem do sentido primário. Desse modo, intenta-se mostrar como a pedagogia do não e o cogito do sonhador se articulam na proposição de uma educação para a imaginação pautada pela função de eufemização. São convocadas para este estudo, além da já mencionada filosofia de Gaston Bachelard, as contribuições teóricas de Gilbert Durand e Jean Jacques Wunenburger. (shrink)

In the passage of time from the 1960s to the 1970s, the Brazilian artist Waldemar Cordeiro developed his first works in computer art by applying the mathematical concept of “derivative function.” Around the same time, he organized and took part in exhibitions, and composed a series of essays envisaging that the use of digital resources would become an inevitable process for the future of information reception and artistic communication. A closer look at Waldemar Cordeiro's production, both artistic and theoretical, after (...) almost 50 years of his first forays into the field of art and technology, is an excellent opportunity not only to revisit his trajectory, but to rewrite the history of digital art and our conception of it, locating Brazil and Latin America as situated centrally, not peripherally, in relation to the European and North American narratives. Drawing from theorists in the field of informational esthetics as well as scholars in the field of media such as Arlindo Machado and Vilém Flusser, this article seeks to demonstrate, through the analysis of Waldemar Cordeiro's theoretical–artistic productions, the relationship between his work, the field of cybernetics, and his utopian and social vision of artistic production. The purpose of this paper is to present some thoughts upon the ever pressing question of the role of justice in our societies, according to Michel Foucault. Centered upon Discipline & Punish: The Birth of the Prison, the paper draws the guidelines which Foucault developed about the aggiornamento of the exercise of power and its changing methods, from torture to the scientific methods which he named technologies of the self. Going from the exercise of violence centered upon the body to (...) its submission by means of idea and mind control, power has associated itself to the scientific approach of identity, leading to a controllable abnormality. All of this in the name of a population policy, a bio power which ensures the docility of individuals while optimizing their productive force. Hence the remaining epigraph quoted challenge where Plato provocatively States: justice is the same everywhere, it is the rule of the strongest. (shrink)

O papel do sumo Bem na moral kantiana tem sido reavaliado, e parte desse processo envolve contato com conceitos fundamentais a ele relacionados, como vontade, lei moral, faculdades superior e inferior de apetição. Com base na argumentação da Crítica da razão prática e a partir de uma revisão da literatura secundária ligada a esses conceitos auxiliares e à ideia de sumo Bem, confrontaremos alguns lugares comuns na interpretação da moral de Kant, notadamente a ideia de se tratar apenas de uma (...) moral “principialista”, que não confere importância a fins e à felicidade. O que está em jogo não é uma recusa da felicidade, mas o sujeito se tornar digno dela, não tendo-a como critério de moralidade. (shrink)

O trabalho investiga a revista O Clarim, produzida pelos alunos de uma escola, em Porto Alegre/RS, entre os anos de 1945 e 1965. A história de O Clarim constitui-se em uma rica documentação de história da educação, pois revela um pouco das representações da cultura juvenil daquele tempo. Aqui interessam os significados da difusão dos discursos difundidos pelo periódico, nos processos de subjetivação provocados pelos textos e suas possíveis influências na construção das identidades daqueles jovens. A pesquisa identifica-se com os (...) pressupostos teóricos da História Cultural e se inscreve no campo das práticas de leitura e escrita e de memórias juvenis, tendo como referenciais as concepções de cultura escrita como uma produção discursiva de um determinado tempo e lugar. There has been considerable debate in legal philosophy about how to attribute purposes to rules. Separately, within cognitive science, there has been a growing body of research concerned with questions about how people ordinarily attribute purposes. Here, we argue that these two separate fields might be connected by experimental jurisprudence. Across four studies, we find evidence for the claim that people use the same criteria to attribute purposes to physical objects and to rules. In both cases, purpose attributions appear to (...) be governed not so much by original intention or by moral value as by current practice. We argue that these findings in the cognitive science of purpose attribution have implications for jurisprudential questions involving purposivist legal interpretation. (shrink)

Law No. 11,340/2006, also known as the "Maria da Penha" Law, was created after the condemnation to exclusively protect women victims of violence. In Article 9, § 2, item II, there is a specific rule on the employment contract, which allows the judge to ensure that women in situations of domestic and family violence maintain the employment relationship for up to six months. During this period, women have the right to be absent from work, thus contributing to the preservation of (...) their physical and psychological integrity. The objective of this paper is to better analyze how the international system may further contribute to increasing the labor legal protection of women victims of domestic violence. A prospective-documentary technique was employed to analyze the Brazilian domestic legislation and the international system, including norms of the International Labor Organization (ILO) and the jurisprudence of the Inter-American Commission on Human Rights of the Organization of American States (OAS). These analyses reveal that despite the separation of social phenomena – domestic violence occurring in the private sphere, and work belonging to the public sphere of the victim's life – international principles, so-called soft law rules, can be used to further enhance the protection of women victims of domestic violence in Brazil. These women require a whole set of mechanisms that protect their physical, psychological, and emotional integrity, but also guarantee financial and professional support. This multidimensional response to domestic violence is central to a country that ranks 5th in the world for femicide. (shrink)

Gilberto Freyre, autor de Casa-Grande & Senzala, pensador polêmico, mas singular no que se propõe - tradução da realidade brasileira à luz da miscigenação. Pode se dizer que nos textos desse recifense existem mais do que contradições, são, no sentido de determinados conceitos, debates dialéticos. Desse modo, o artigo aqui proposto intenta pensar o termo democracia racial por meio de um procedimento filosófico, a saber, dialética conceitual. Assim, não se pretende fazer uma defesa do autor em questão, mas para além (...) disso, observar o debate e contribuir para novos entendimentos em torno desse polissêmico conceito. Sendo assim, o texto encontra-se dividido em dois momentos, no primeiro momento, busca-se um diálogo com os estudiosos do pensamento de Gilberto Freyre para localização e compreensão histórica de seu expediente teórico e, no segundo momento, atina-se para uma observação filosófica do conceito de dialética. O objetivo deste trabalho é apresentar as diferentes posturas didático-pedagógicas dos professores pré-serviço de língua inglesa, quando tiveram que criar tarefas utilizando diferentes artefatos de ensino (tecnologias). A necessidade de se usar a tecnologia como recurso para o processo de ensino-aprendizagem de língua estrangeira, vem proporcionando a realização de trabalhos invest-igativos concernentes a observação de formas apropriadas para utilizá-la na educação. Warschauer e Healey (1998) e Nardi (1996) defendem que a inserção dos computadores e da internet no processo de ensino-aprendizagem (...) de línguas estrangeiras está proporcionando melhor condição de trabalho, bem como, uma formação adequada aos sujeitos envolvidos com a educação. Desta forma, pesquisar sobre a inserção do computador e da internet, como recurso de material didático (apoio) tendo como base os preceitos da Teoria da Atividade (Engestrom, 1987), nos permite compreender as alterações no sistema de atividade a partir dos diferentes artefatos utilizados. Tendo como contexto de pesquisa o curso de letras de uma universidade federal, os dados foram coletados por meio de observações das aulas de metodologia. A análise dos dados mostrou que na tentativa de se criar tarefas pedagógicas, utilizando diferentes artefatos de ensino, o professor pré-serviço desenvolveu práticas diferentes. (shrink)

Successful accounts of analogy in law have two burdens to discharge. First, they must reflect the fact that the conclusion of an argument by analogy is a normative claim about how to decide a certain case. Second, they must not fail to accord relevance to the fact that the source case was authoritatively decided in a certain way. We argue in the first half of this paper that the common view of the structure of analogical arguments in law cannot overcome (...) these hurdles. Os acontecimentos políticos do século XX, tais como o totalitarismo, fizeram Arendt indagar sobre o sentido da política, originando, assim, a categoria de condição humana. Ao tomarmos como ponto de partida a vida ativa, vemos que a pluralidade, categoria que fundamenta a ação, manifesta-se em meio ao espaço público. O campo da política é o da pluralidade, sendo que nele é necessário a liberdade que é a própria condição da política e, assim sendo, o espaço público torna-se a esfera acolhedora (...) de ambas. Portanto, a política jamais pode ser vista e entendida no singular, mas no plural, pois é na pluralidade dos homens onde a mesma surge em meio ao espaço público. Assim, temos como objetivo demonstrar a importância do espaço público como lugar de aparência da política, buscando na obra “A condição humana” as ferramentas argumentativas que nos auxiliarão a alcançar o mote da presente pesquisa. This paper discusses the first incarnation of what came to be known as the “Frege-Geach” point. The point was made by Peter Geach in his 1960 essay “Ascriptivism”, and developed in “Assertion”, a 1965 piece. Geach’s articles launch a wholesale attack on theories of non-descriptive performances advanced by “some Oxford philosophers” whom he accuses of ignoring “the distinction between calling a thing ‘P’ and predicating ‘P’ of a thing”. One view that Geach specifically targets is H. L. A. Hart’s claim (...) that sentences of the form “X φ-ed” are not primarily descriptive but ascriptive of responsibility for actions. Hart explicitly accepted Geach’s criticism, and disowned his essay. I argue that he was wrong to do so. Perhaps the essay was worth retracting, but not because of Geach’s objections. I begin by restating and refining Geach’s arguments, in order to bring out the flaw he claimed to have detected in the “pattern of philosophising” that he took Hart’s essay to exemplify. I go on to argue that Geach’s original point poses no obstacle either to non-descriptivism in general, or to Hart’s sui generis non-descriptivist claim in particular. (shrink)

Este artigo tem como principal objetivo analisar e discutir questões acerca de como à educação muitas vezes acaba por contribuir para o aumento das desigualdades sociais. Desse modo, através dessa análise pretende-se ainda destacar as contribuições e críticas do pensamento de Pierre Félix Bourdieu, Paul- Michel Foucault e Karl Marx sobre os problemas sociais que permeiam a sociedade desde o século XIX até os dias atuais e muitas vezes são fortalecidos pelos sistemas educacionais.

Can there be a non-reductivist, source-based explanation of the use of normative language in statements describing the law and legal situations? This problem was formulated by Joseph Raz, who also claimed to have solved it. According to his well-known doctrine of ‘detached’ statements, normative legal statements can be informatively made by speakers who merely adopt, without necessarily sharing, the point of view of someone who accepts that legal norms are justified and ought to be followed. In this paper I defend (...) two theses. I argue, first, that the notion of a detached statement cannot be made to work, and that Raz’s problem is thus not thereby solved. But the problem itself, I also suggest, is a false one. (shrink)

The mind-brain problem is a persistent challenge in philosophy and science, having marked implications for psychiatry. In this paper, we claim that physicalism, a kind of theoretical monism, is usually taken by many psychiatrists as the only possible solution to the MBP, and argue that this may have negative consequences for the field. Not only does it restrict the psychiatric training, thereby preventing professionals from considering and reflecting upon different perspectives on the MBP, but it also leads clinical psychiatrists to (...) ignore alternatives in their research agendas and clinical care. We suggest, therefore, that, as long as the MBP remains open and disputed by divergent views, theoretical monism should give place to theoretical pluralism in psychiatry. (shrink)

Este trabajo está dirigido a fundamentar cómo a través de un proceso de innovación tecnológica se establecieron relaciones entre la universidad, la sociedad y el sector empresarial. La introducción de los productos biológicos en los laboratorios de diagnóstico médico y su impacto en los servicios fue el elemento fundamental que identificó la relación universidad-sociedad, mientras que la transferencia tecnológica de la obtención de biológicos a la unidad productora y comercializadora articuló a la academia con el mundo empresarial. Los modelos seguidos (...) para la gestión de la actividad de innovación le otorgaron al proceso un carácter específico y aseguraron su pertinencia, por lo que constituyó un logro científico-tecnológico. Se demostró un caso peculiar y concreto de fortalecimiento de las capacidades de interacción de las universidades con entidades productivas y de servicios, de modo que se enriqueció la función extensionista del centro de altos estudios. This article is based on a process of technical innovation that allowed establishing a relationship in which the university, society and the managerial sector were involved. The introduction of the biological products in medical diagnosis labs and its impact on services were the main elements that distinguished the university-society relationship, while the technological transfer to the unit of the biologicals obtained, articulated the university and the managerial field. Models put into practice for innovation management granted the process a specific character and ensured its relevance, that´s why it is considered a scientific-technological achievement. The process demonstrated a peculiar case of interaction between the university and production entities. (shrink)

Reports of encounters with deceased people are as old as humanity and seem to be in the roots of many if not the majority of spiritual traditions. However, scientific studies on this exciting but controversial topic started in Nineteenth Century. Authors studying Spiritism, Spiritualism, and psychical research developed the first attempts at systematic and scientific investigations of these experiences (Alvarado 2012, Sharp 2006). The first large survey of apparitions was published by researchers from the British Society for Psychical Research (SPR) (...) in 1886 (Gurney, Myers, & Podmore 1886). Recently the subject has become more relevant given that in the last decades there has been an increasing interest in psychiatry and psychology literature in the study of “psychotic experiences” in the general population, which often involve anomalous sensory experiences. Several large epidemiological data studies have shown that most “psychotic experiences” happen in the nonclinical population and are usually not related to psychotic disorders. In a study performed by the World Health Organization in 52 countries involving more than 250,000 participants, psychotic experiences (when participants were not half asleep, dreaming, or under the influence of alcohol or drugs) occurring the previous year were reported by 12.52% of world’s population, ranging from 1% (Vietnam) to 46% (Nepal). It is remarkable that only 10% of those reporting psychotic symptoms had a diagnosis of schizophrenia (Nuevo et al. 2012). There is a need to investigate and better understand these “psychotic” experiences in non-clinical populations. Since spiritual experiences often involve psychotic-like ones, they are privileged venues to understand psychotic phenomena in the general population (Moreira-Almeida & Cardena 2011). One important sort of hallucinatory experience in the general population, both in terms of impact on the percipient and their potential theoretical implications, is the report of perceiving a deceased person. The distinction between 'conduct norms' and 'sanction norms' is widely assumed to be an essential tool for any correct understanding of criminal responsibility. Conduct norms (often also called 'primary') are referred to with the language of 'prohibitions', and it is normally accepted that a crime is by definition a 'prohibited' human behaviour, in the sense that it is always an infraction of a 'conduct norm'. I mean to discuss and criticize this rather consensual assumption. Modern criminal codes don't usually incorporate (...) a catalogue of prohibitions, but this is considered to be of no consequence when it comes to discuss whether the law prohibits those behaviours whose performance may lead to the application of a criminal sanction: there is no question that sanction norms may be properly read out of the special parts of our criminal codes, and from a sanction norm it is always possible to infer the correspondent prohibition. Or so the current understanding goes. I shall first try to make some sense of this common idea, which I call the inference thesis. I will then proceed to show why it is wrong. The inference thesis is necessarily committed to an understanding of conduct norms as prescriptive norms addressed to citizens, and the relevant notion of a prescriptive norm has to be characterized in some detail. Having done so, I will argue that such a prescriptive understanding of 'conduct norms' is incompatible with several aspects common to most modern systems of criminal law and unquestionably essential to the concept of a crime. : In this paper we examine two challenges to the orthodox understanding of the fallacy of denying the antecedent. One challenge is to say that passages thought to express the fallacy can usually be given an interpretation on which they express valid arguments, entitling us to query whether the fallacy is commonly, if ever, committed at all. We discuss this claim in Section 1. The second challenge comes from those who think that there are legitimate uses of denying the antecedent (...) that have traditionally been overlooked.
