On a common characterization, moral luck occurs when factors beyond agents’ control affect their moral responsibility. The existence of moral luck is widely contested, however. In this paper, I present a new challenge for deniers of moral luck. It seems that some factors beyond agents’ control—such as moral principles about blame- and praiseworthiness—clearly affect moral responsibility. Thus, moral luck deniers face a dialectical burden that has so far gone unnoticed. They must either point to a relevant difference between factors like (...) moral principles and the kind of factors that according to them do not affect moral responsibility or show how they can avoid having to point to such a difference. I argue that no obvious way to meet the challenge presents itself and that it thus amounts to a serious worry for deniers of moral luck. (shrink)

Robert Hartman’s parallelism argument aims to show that resultant moral luck exists. The gist of the argument is this: because there is circumstantial moral luck in a particular circumstantial luck scenario and that scenario is analogous in important ways to a particular resultant luck scenario, the resultant luck scenario is plausibly an instance of resultant moral luck. I argue that there is a principled way of denying that circumstantial moral luck is present in the circumstantial luck scenario. Doing so is (...) not enough, however, to reject Hartman’s general analogical line of reasoning since an alternative parallelism argument based on a resultant luck scenario and a circumstantial luck scenario of another kind can be made. Nevertheless, I argue that the analogy between the circumstantial luck scenario and the resultant luck scenario in both the alternative parallelism argument and its original counterpart is too weak to support the claim that resultant moral luck is present in the resultant luck scenario. In this paper, we give a new argument for the existence of moral luck. The argument is based on a manipulation case in which two agents both lack second-order control over their actions, but one of them has first-order control. Our argument is, we argue, in several respects stronger than standard arguments for moral luck. Five possible objections to the argument are considered, and its general significance for the debate on moral luck is briefly discussed.

Well–being, health and freedom are some of the many phenomena of interest to science whose definitions rely on a normative standard. Empirical generalizations about them thus present a special case of value-ladenness. I propose the notion of a ‘mixed claim’ to denote such generalizations. Against the prevailing wisdom, I argue that we should not seek to eliminate them from science. Rather, we need to develop principles for their legitimate use. Ellie Anderson had always known that she wanted to have children. Her mother, Louise, was aware of this wish. Ellie was designated male at birth, but according to news sources, identified as a girl from the age of three. She was hoping to undergo gender reassignment surgery at 18, but died unexpectedly at only 16, leaving Louise grappling not only with the grief of losing her daughter, but with a complex legal problem. Ellie had had her sperm frozen before starting (...) hormone treatment, specifically so that she would retain the chance of becoming a parent after her gender reassignment. Ellie had considered what might happen to the sperm if she died and was adamant that her children should be brought into the world. She made her mother promise to ensure that this would happen. But according to UK law, Ellie’s mother has no legal right to retain her sperm, or to use it to fulfil Ellie’s wishes. In this paper, we raise several key ethical questions on this case, namely: does a refusal to bring Ellie’s children into the world wrong her posthumously? Is Ellie’s mother morally entitled to use her daughter’s sperm as Ellie wished? Should the fact that Ellie was a minor at the time of her death or the fact that she was transgendered undermine her wish to have children? Can Ellie become a parent posthumously? Partial lying denotes the cases where we partially believe something to be false but nevertheless assert it with the intent to deceive the addressee. We investigate how the severity of partial lying may be determined and how partial lies can be classified. We also study how much epistemic damage an agent suffers depending on the level of trust that she invests in the liar and the severity of the lies she is told. Our analysis is based on the results from (...) exploratory computer simulations of an arguably rational Bayesian agent who is trying to determine how biased a coin is while observing the coin tosses and listening to a liar’s misleading predictions about the outcomes. Our results provide an interesting testable hypothesis at the intersection of epistemology and ethics, namely that in the longer term partial lies lead to more epistemic damage than outright lies. This article studies an illuminated manuscript of St. Augustine’s Enarrationes in Psalmos: Vat. lat. 451 (Città del Vaticano, Biblioteca Apostolica Vaticana). The manuscript was commissioned by the bishop Giovanni Capogallo, when he was in Lombardy in close contact with the court of the duke Gian Galeazzo Visconti. The article examines the cultural milieu of Pavia in the early 15th century, highlighting the role of the Order of the Hermits of Saint Augustine in the monastery of San Pietro in Ciel d’Oro. (...) The two incipit pages ff. 1r and 239r, illuminated by Michelino da Besozzo, are an example of the International Gothic style and this article analyses not only their stylistic aspect, but also their allegorical meaning, as an interesting case of decoration of a patristic text. Background: Ethics and dignity in prehospital emergency care are important due to vulnerability and suffering. Patients can lose control of their body and encounter unfamiliar faces in an emergency situation. Objective: To describe what specialist ambulance nurse students experienced as preserved and humiliated dignity in prehospital emergency care. Research design: The study had a qualitative approach. Method: Data were collected by Flanagan’s critical incident technique. The participants were 26 specialist ambulance nurse students who described two critical incidents of preserved and (...) humiliated dignity, from prehospital emergency care. Data consist of 52 critical incidents and were analyzed with interpretive content analysis. Ethical considerations: The study followed the ethical principles in accordance with the Declaration of Helsinki. Findings: The result showed how human dignity in prehospital emergency care can be preserved by the ambulance nurse being there for the patient. The ambulance nurses meet the patient in the patient’s world and make professional decisions. The ambulance nurse respects the patient’s will and protects the patient’s body from the gaze of others. Humiliated dignity was described through the ambulance nurse abandoning the patient and by healthcare professionals failing, disrespecting, and ignoring the patient. Discussion: It is a unique situation when a nurse meets a patient face to face in a critical life or death moment. The discussion describes courage and the ethical vision to see another human. Conclusion: Dignity was preserved when the ambulance nurse showed respect and protected the patient in prehospital emergency care. The ambulance nurse students’ ethical obligation results in the courage to see when a patient’s dignity is in jeopardy of being humiliated. Humiliated dignity occurs when patients are ignored and left unprotected. This ethical dilemma affects the ambulance nurse students badly due to the fact that the morals and attitudes of ambulance nurses are reflected in their actions toward the patient. (shrink)

This special issue aims to spotlight the individual, lived experiences of caregivers and those receiving care–areas often overshadowed by clinical and medicalized narratives within clinical ethics. Our aim is to enrich the discourse by incorporating stories and narratives of medical care and challenge existing clinical practices by emphasizing patient and practitioner experiences. Through a blend of clinical and academic insights, this issue provides phenomenological narratives, highlighting the importance of lived experiences in understanding and improving clinical caregiving practices. Recent research has demonstrated an asymmetry between the origins and endpoints of motion events, with preferential attention given to endpoints rather than beginnings of motion in both language and memory. Two experiments explore this asymmetry further and test its implications for language production and comprehension. Experiment 1 shows that both adults and 4-year-old children detect fewer within-category changes in source than goal objects when tested for memory of motion events; furthermore, these groups produce fewer references to source than goal objects (...) when describing the same motion events. Experiment 2 asks whether the specificity of encoding source/goal relations differs in both spatial memory and the comprehension of novel spatial vocabulary. Results show that endpoint configuration changes are detected more accurately than source configuration changes by both adults and young children. Furthermore, when interpreting novel motion verbs, both age groups expect more fine-grained lexical distinctions in the domain of endpoint configurations compared to that of source configurations. These studies demonstrate that a cognitive-attentional bias in spatial representation and memory affects both the detail of linguistic encoding during the use of spatial language and the specificity of hypotheses about spatial referents that learners build during the acquisition of the spatial lexicon. This study belongs to the ethnomethodological tradition of identifying the everyday practices accounting for the oiled machinery of social organization and applies this approach to understanding direction light usage. We observe a set of episodes videorecorded in North-East Italy in the urban traffic. We first unpack the meaning of direction light usage from a pragmatic perspective and then test our interpretation against the cases in our collection that seem to deviate from it. We argue that direction lights’ usage works as (...) an announcement to some road users and a request to a subset of them; in both cases, direction lights convey contextualized (indexical) coordinates about the vehicle’s prospective trajectory. We then explain the cases in which signaling is omitted and draw some implications for traffic coordination and safety. (shrink)

Standard notions in philosophy of mind have a tendency to characterize socio-cognitive abilities as if they were unique to sophisticated human beings. However, assuming that it is likely that we are soon going to share a large part of our social lives with various kinds of artificial agents, it is important to develop a conceptual framework providing notions that are able to account for various types of social agents. Recent minimal approaches to socio-cognitive abilities such as mindreading and commitment present (...) a promising starting point from which one can expand the field of application not only to infants and non-human animals but also to artificial agents. Developing a minimal approach to the socio-cognitive ability of acting jointly, I present a foundation for future discussions about the question of how our conception of sociality can be expanded to artificial agents. Anna Alexandrova on value judgements and the measurement of well-being.

There are (at least) two ways to think of the differences in basic concepts and typologies that one can find in the different scientific practices that constitute a research tradition. One is the fundamentalist view: the fewer the better. The other is a non-fundamentalist view of science whereby the integration of different concepts into the right abstraction grounds an explanation that is not grounded as the sum of the explanations supported by the parts. Integrative concepts are often associated with idealizations (...) that can successfully set the stage for different phenomena to be compared or for explanations of different phenomena to be considered as jointly increasing our understanding of reality beyond that which each explanation provides separately. In this paper, our aim is to argue for the importance of the notions of an ?affordance? and ?scaffolding? as integrative concepts in the cognitive sciences. The integrational role of the concept of affordance is closely related with the capacity of affordances to generate the scaffoldings leading to the integration. The capacities of affordances that turn them into (stable) scaffoldings explain why such notions are often used interchangeably (as we shall see). On this basis, we aim to show that the concepts of affordance and scaffolding provide the sort of epistemic perspective that can overcome common complaints about the limits and unity of the cognitive sciences once claims about extended cognition are taken seriously. Johann Heinrich Tieftrunk has a place among the early Kantians in Halle as both a theologian and a philosophical thinker. After situating Tieftrunk within this intellectual history and determining his theological and philosophical position, this paper provides a chronological account of the concept of hope—which lies at the basis of Kant’s moral philosophy—in Tieftrunk’s writings on philosophy of religion. In particular, the discussion centers on the relationship between the foundation of hope in the moral law and the exclusion of a (...) legalistic fulfilment of hope. The “love of the law,” which emerges especially in Tieftrunk’s work, takes a prominent position in the interpretation. The investigation is accompanied by an evaluation of Tieftrunk’s role in the early reception of Kant. (shrink)

If only implicitly, social anthropology has long incorporated joint attention as a research technique employed in what anthropologists call “the field”. This paper outlines the crucial role joint attention plays in anthropolgical fieldwork—specifically in Participant Observation—and advances the position that joint attention is a goal rather than a starting point of fieldwork practice. Exploring how anthropologists tentatively use attention as a methodological tool to understand other people’s lifeworlds, this paper draws parallels between Participant Observation and ordinary everyday interactions, thus teasing (...) out a view of _joint_ attention as a goal to be reached only by means of knowing what matters to others in the context of the lifeworld they inhabit. Almaatouq et al. propose an integrative experiment design space combined with large samples for scientific advancement. We argue recent innovative designs combining closed-loop experiment designs and Bayesian optimisation allow for integrative experiments at an individual level during a single session, circumventing the necessity for large samples. This method can be applied across disciplines, including developmental and clinical research.

Recent developments in the field of artificial intelligence (AI) present profound challenges for law. These challenges stem from law’s anthropocentrism, which is often left unspoken. This essay examines both the epistemic and normative dimensions of anthropocentrism within German Law, with a focus on Private Law. It defends the proposition that law’s anthropocentrism does not inherently oppose the idea of granting AI some form of legal capacity. Rather, so the essay argues, it is essentially a question of regulatory prudence to determine (...) the conditions and criteria under which the law should grant a legal status, legal capacity, or partial legal capacity to AI entities. Nonetheless, it is crucial to acknowledge that the core principles of private law as well as questions of liability for fault and negligence are rooted in human agency and cannot be directly applied to AI. It will be argued that the legal discourse on the recognition of AI is to be understood as a fundamentally political discourse. The political dimension of that discourse will be analyzed through the lens of the political theories of Hannah Arendt and Jaques Rancière, among others. (shrink)

The aim of this study was to describe specialist ambulance nurse students’ experiences of ethical conflicts and dilemmas in prehospital emergency care. In the autumn of 2015, after participating in a mandatory lecture on ethics, 24 specialist ambulance nurse students reported experiences and interpretations concerning conflicts and ethical dilemmas from prehospital emergency care. The text consisted of 24 written critical incidents which were interpreted using hermeneutic text interpretation. The text revealed three themes: Not safeguarding a patient’s body and identity; Not (...) agreeing on the care actions; and Not treating the patient with dignity. The SANs experiences ethical dilemmas and conflict of values when they witness how others violate a patient’s dignity. Discussion and reflection is based on ethical conflicts and dilemmas experienced when students see how caregivers do not safeguard the patient’s body or identity. When caregivers have a conflicting will, it results in patients not being treated in an ethical manner. Also, seeing how caregivers put themselves in a power position over patients is described as an ethical dilemma that students experience when they choose not to intervene. (shrink)

En este trabajo la estereotipación judicial, como mala praxis de la argumentación judicial, se enfocará en la sentencia. Después de evidenciar el fundamental papel de la motivación como lugar donde poder ejercer un control de las decisiones judiciales (2), así como lugar donde detectar la estereotipación judicial (3), se propondrá reflexionar sobre dos (...) tipos de conocimiento que pueden vehicular los sesgos de una cultura discriminatoria: el sentido común (4) y la pseudo-ciencia (5). Si bien son dos tipos de conocimiento que se emplean en la motivación de la sentencia para alcanzar un mejor entendimiento de los hechos, se observa la necesidad de que el órgano judicial adopte una actitud crítica para detectar la subyacente práctica discriminatoria potencialmente presente en ambas formas de conocimiento. Two letters of the “Pythagorean” women Melissa and Myia, addressed to their female friends, are translated into the Russian for the first time. In the introduction, the reader will find background information about the origin of the letters, their textual tradition, their discovery in the beginning of the 19th century, and, finally, the formation of a critical approach to them in the context of the emerging studies of so-called Pseudopythagorica. In the complementary notes to the text, I am placing the (...) letters in the context of an appropriate philosophical tradition and making some textual observations. The translation of these two letters is a part of the research project called on to open a much-neglected page in the history of philosophy, and to show that ignoring secondary sources can often lead to a serious narrow-mindedness in our understanding of ancient philosophical tradition. In this paper, inspired by methods of Bigard, Keimel, and Wolfenstein , we develop an approach to sheaf representations of MV-algebras which combines two techniques for the representation of MV-algebras devised by Filipoiu and Georgescu and by Dubuc and Poveda . Following Davey approach , we use a subdirect representation of MV-algebras that is based on local MV-algebras. This allowed us to obtain: a representation of any MV-algebras as MV-algebra of all global sections of a sheaf of local MV-algebras on (...) the spectruum of its prime ideals; a representation of MV-algebras, having the space of minimal prime ideals compact, as MV-algebra of all global sections of a Hausdorff sheaf of MV-chains on the space of minimal prime ideals, which is a Stone space; an adjunction between the category of all MV-algebras and the category of MV-algebraic spaces, where an MV-algebraic space is a pair , where X is a compact topological space and F is a sheaf of MV-algebras with stalks that are local. The present study analyzes metaphors of life, self, emotional states, and relationships in forty life stories that differ in their communicative situations and narrative goals. Twenty interviews were conducted with people who were seeking psychological help. Another twenty interviews were conducted with Russian celebrities for publication in popular psychology magazines. Metaphors in happy stories were more numerous and diverse than in unhappy stories. Some conceptual metaphors (e.g., “LIFE IS A CONTAINER,” “LIFE IS A JOURNEY,” and “EMOTION IS A PHYSICAL IMPACT”) (...) were found in both happy and unhappy narratives. More specific metaphors demonstrated significant differences between the two types of narratives. The metaphors of life as a “purposeful journey,” self as “alive and flexible object,” and emotional states as “internal and controlled forces” were used more often in happy narratives. This may reflect higher levels of activity, responsibility, and awareness of the authors of happy narratives. Specific for unhappy stories were metaphors “LIFE IS DEATH” and “SELF IS A DEAD OBJECT,” which may indicate a low level of personal well-being and serve as specific markers of personal unhappiness. The results of our study suggest that metaphors may help to construct the subjective reality of happy and unhappy life. By telling their life stories people are able to redefine their past experiences and future perspectives. Specific metaphors play an important part in defining subjective happiness or unhappiness. Der Klimawandel ist die globale Krise unserer Gegenwart. Mit Blick auf die sich hieraus ergebenen Handlungsoptionen und -zwänge stellt der verantwortliche Umgang mit Energie sicher einen der zentralen Bereiche dar. Unsere ethische Verantwortung betrifft dabei beides: Erzeugung und Verbrauch von Energie gleichermaßen. Der vorliegende Band verfolgt zwei Ziele: Erstens soll ein interdisziplinärer Dialog ermöglicht und die dafür notwendigen fachlichen Reflexionen angestoßen werden. Keine Einzeldisziplin kann auf die komplexen Probleme des Klimawandels oder die mit dem Terminus Energieverantwortung angezeigten Herausforderungen alleine eine (...) plausible Antwort geben. Vielmehr müssen die Wissenschaften ein gemeinsames Verständnis der Probleme entwickeln, um auch interdisziplinär geteilte Antworten bereitstellen zu können. Zweitens soll dies in transdisziplinärer Perspektive erfolgen. Das bedeutet, die von der Gesellschaft an die Wissenschaft herangetragenen Fragen und Problemstellungen ernst zu nehmen, aufzugreifen und Antworten zu formulieren, die auch außerhalb der wissenschaftlichen Diskurse als Antworten auf diese Fragen und Problemstellungen verstanden werden können. Background Few empirical studies have been found that explore ethical challenges among persons in high public positions that are responsible for elder care. The aim of this paper was to illuminate the meaning of being in ethically difficult situations related to elder care as experienced by high level decision-makers. Methods A phenomenological-hermeneutic method was used to analyse the eighteen interviews conducted with political and civil servant high level decision-makers at the municipality and county council level from two counties in Sweden. (...) The participants worked at a planning and control as well as executive level and had both budget and quality of elder care responsibilities. Results Both ethical dilemmas and the meaning of being in ethically difficult situations related to elder care were revealed. No differences were seen between the politicians and the civil servants. The ethical dilemmas mostly concerned dealings with extensive care needs and working with a limited budget. The dilemmas were associated with a lack of good care and a lack of agreement concerning care such as vulnerable patients in inappropriate care settings, weaknesses in medical support, dissimilar focuses between the caring systems, justness in the distribution of care and deficient information. Being in ethically difficult situations was challenging. Associated with them were experiences of being exposed, having to be strategic and living with feelings such as aloneness and loneliness, uncertainty, lack of confirmation, the risk of being threatened or becoming a scapegoat and difficult decision avoidance. Conclusion Our paper provides further insight into the ethical dilemmas and ethical challenges met by high level decision-makers', which is important since the overall responsibility for elder care that is also ethically defensible rests with them. They have power and their decisions affect many stakeholders in elder care. Our results can be used to stimulate discussions between high level decision-makers and health care professionals concerning ways of dealing with ethical issues and the necessity of structures that facilitate dealing with them. Even if the high level decision-makers have learned to live with the ethical challenges that confronted them, it was obvious that they were not free from feelings of uncertainty, frustration and loneliness. Vulnerability was revealed regarding themselves and others. Their feelings of failure indicated that they felt something was at stake for the older adults in elder care and for themselves as well, in that there was the risk that important needs would go unmet. This article deals with scientific advice to the public where the relevant science is subject to public attention and uncertainty of knowledge. It focuses on a tension in the management and presentation of scientific uncertainty between the uncertain nature of science and the expectation that scientific advisers will provide clear public guidance. In the first part of the paper the tension is illustrated by the presentation of results from a recent interview study with nutrition scientists in Denmark. According to the (...) study, nutrition scientists feel their roles as ‘‘public advisers’’ and ‘‘scientists’’ differ in that the former involves an expectation that they will provide unambiguous advice of the kind that might relegate scientific uncertainty to the background. In the second, more general, part of the paper we provide a normative analysis of different strategies of dealing with the tension. The analysis is structured around the extremes of either total concealment or full openness regarding scientific uncertainty. The result of analysis is that scientific advisers should not simply ‘‘feed’’ scientific conclusions to the public. They should rather attempt to promote the ability and willingness of the public to assess and scrutinize scientific knowledge by displaying uncertainties in the scientific basis of advice. On the other hand, scientific advisers must accommodate the public’s need for guidance. Such guidance should be restricted by careful consideration of what it is relevant for the public to know in order to evaluate scientific advice in practical terms. (shrink)

I identify my priority in teaching Christian ethics as fostering relationality, both in individual and collective contexts. I argue that focusing on the idea of relationality enables us to explore connections that exist or should exist between individuals and groups. For me, fostering relationality involves building an intellectual understanding of moral relationality and embodying this understanding in practical situations. In order to contain the theme of this study, I focus on a specific aspect of relationality, namely the idea of attunement. (...)
