This article addresses the long-standing problem of how to understand Mill’s famous harm principle in light of his failure to specify what counts as “harm” in On Liberty. I argue that standard accounts restricting “harm” to only certain negative consequences fail to do justice to the text, and that this fact forces us to rethink Mill’s defense of individual liberty. I then offer a new account of that defense in which “harm” is understood in an expansive sense, despite apparent problems (...) for such a view. (shrink)

My aim in this chapter is to push back against the tendency to emphasize Mill’s break from Bentham rather than his debt to him. Mill made important advances on Bentham’s views, but I believe there remains a shared core to their thinking—over and above their commitment to the principle of utility itself—that has been underappreciated. Essentially, I believe that the structure of Mill’s utilitarian thought owes a great debt to Bentham even if he filled in that structure with a richer (...) conception of human nature and developed it in more liberal directions. This commonality is revealed, in particular, in Mill’s own institutional designs and practical reform proposals in Considerations on Representative Government and related writings. If this is right, then the tendency of interpreters to highlight their differences rather than their similarities has been to the detriment of both Mill and Bentham scholarship, and so to our understanding of the rise of liberal utilitarianism. John Stuart Mill’s defense of free discussion in On Liberty includes the claim that silencing discussion implies an “assumption of infallibility.” This claim is often dismissed as absurd on the ground that a censor might attempt to silence an opinion he believes to be true but pernicious, or because rational assurance short of infallibility is obviously sufficient to justify censorship. This paper argues that Mill is concerned about the epistemic position one assumes with regard to future persons and circumstances as (...) a result of attempting to settle some matter irremediably. The irrationality of this "assumption" sets an important authority-limiting constraint on both social authority and individuals in matters that otherwise would fall under their rightful control. This paper addresses the question of whether all that unites the main parts of John Stuart Mill’s On Liberty—the liberty principle, the defense of free discussion, the promotion of individuality, and the claims concerning individual competence about one’s own good—is a general concern with individual liberty, or whether we can say something more concrete about how they are related. I attempt to show that the arguments of On Liberty exemplify Mill’s institutional design approach set out in Considerations of Representative Government (...) and related works. Mill’s approach reflects both his debt to Bentham and his own progressive development of the utilitarian tradition. The paper proceeds by setting out the elements of Mill’s institutional designs and then showing that On Liberty neatly applies them, thereby clarifying the structure of the arguments of On Liberty. Recent scholarship on John Stuart Mill’s moral theory has settled on the view that he is committed to a form of rule utilitarianism. I argue that this consensus is mistaken. Mill’s explicit account of practical rules is incompatible with rule utilitarianism but consistent with sophisticated act utilitarianism. I also examine the direct, textual evidence cited by rule utilitarian interpreters, arguing that it is consistent with the act utilitarian account of practical rules. Finally, I argue that two systematic considerations cited by (...) rule utilitarian interpreters—Mill’s analysis of “wrong” in terms of the appropriateness of punishment, and his account of supererogation—also do not require a rule utilitarian reading. The key thought underlying Persky's argument is that Mill has an ‘evolutionary theory of justice’, according to which the set of institutions and practices that are appropriate to one state of society should give way to a new set of institutions as circumstances change and the (...) people themselves improve. However, Persky does not spend a great deal of time discussing Mill's theory of reform, in particular the principles he believes should guide our reform efforts. Mill argues that, apart from the principle of utility, his utilitarianism is incompatible with absolutes. Yet in On Liberty he introduces an exceptionless anti-paternalism principle—his liberty principle. In this paper I address ‘the absolutism problem,’ that is, whether Mill's utilitarianism can accommodate an exceptionless principle. Mill's absolute claim is not a mere bit of rhetoric. But the four main solutions to the absolutism problem are also not supported by the relevant texts. A leading classical utilitarian, John Stuart Mill is an unlikely contributor to the public reason tradition in political philosophy. To hold that social rules or political institutions are justified by their contribution to overall happiness is to deny that they are justified by their being the object of consensus or convergence among all those holding qualified moral or political viewpoints. In this chapter, I explore the surprising ways in which Mill nevertheless works to accommodate the problems and insights of the (...) public reason tradition, and the extent to which he makes arguments that can help those working within that tradition. From its inception in 1890, the journal Ethics declared that it was “Devoted to the Advancement of Ethical Knowledge and Practice.” Although the latter concern may seem anachronistic, the extensive practical work of the Journal’s founders was inspired by an aim shared by many of today’s liberals: establishing a public morality that respects well-intentioned individuals holding a diversity of philosophical and religious commitments. Felix Adler, the guiding force behind the journal and the founder of the Society for Ethical Culture, argued (...) that shared ethical values can be explored, and can have social authority, independent of the truth of any controversial philosophical foundations. I argue that a notorious passage from Utilitarianism concerning the relationship between morality and blameworthiness need not be an obstacle to a consistent act-utilitarian interpretation of Mill's moral theory. First, the Art of Life provides a framework for reconciling Mill's evaluation of conduct in terms of both expediency and blameworthiness. Like contemporary sophisticated act-utilitarians, Mill treats expediency as the more fundamental category of evaluation. Second, textual evidence suggests that, on Mill's view, evaluations of blameworthiness are not strictly bound by rules, (...) despite rule-ish considerations about punishment and discretion. By the turn of the nineteenth century, Jeremy Bentham was a well‐ known moral and legal reformer. Bentham's moral philosophy is often introduced as an object lesson in the failures of simplistic utilitarianism. This chapter outlines the basic elements of Bentham's political philosophy. It looks at three important and distinctive features of his utilitarian thought: his introduction of four subordinate ends to guide public morality and law, his account of “official aptitude,” and his “assumption of infallibility” argument. The chapter then (...) considers James Mill's own published comments, positive and negative, on Bentham's work. It argues that, despite some rhetorical flourishes, Mill's critical comments are carefully qualified and quite specific, and do not touch large parts of Bentham's utilitarian reform project. My aim in this chapter is to place John Stuart Mill’s distinctive utilitarian political philosophy in the context of the debate about luck, responsibility, and equality. I hope it will reveal the extent to which his utilitarianism provides a helpful framework for synthesizing the competing claims of luck and relational egalitarianism. I attempt to show that when Mill’s distributive justice commitments are not decided by direct appeal to overall happiness, they are guided by three main public principles: an impartiality principle, (...) a sufficiency principle, and a merit principle. The question then becomes how luck and relational considerations figure into his articulation of these public principles. I argue that relational egalitarianism is more fundamental than considerations of luck and responsibility in Mill’s thought, but I also hope to show that any fleshed out picture of Mill’s reform proposals must recognize his condemnation of the role luck plays in determining the distribution of opportunities and outcomes. This article is part of a symposium on Bruce Cain's "Democracy More or Less: America’s Political Reform Quandary." It identifies the basic normative framework of Cain's skeptical "reform pluralism" as a form of democratic instrumentalism rather than political realism, and then argues that a more optimistic instrumentalist alternative is available. The instrumentalist can accept that more democracy need not entail better democracy. But the instrumentalist account of better democracy also gives us reason to believe that significant reform efforts remain worth (...) pursuing, for the simple reason that some of them have worked in the past. In this chapter, I examine the three main arguments of On Liberty: first, a largely epistemic argument that individual and social improvement, because they depend so much on intellectual development, require social conditions allowing for free discussion and “experiments of living;” second, an argument that individuality, or self‐directedness, is itself a key constitutive part of the individual human good; third, the introduction of a principle – the liberty principle – according to which only considerations of nonconsensual “harm to others” may (...) justify social or political interference. This article examines John Stuart Mill's position as the principal historical opponent of legal moralism. I argue that inattention to the particular form of his opposition to legal moralism has muddied the interpretation of his liberty principle. Specifically, Mill does not endorse what I call the illegitimacy thesis, according to which appeals to harmless wrongdoings, whether or not they exist, are illegitimate in the justification of legal interference.

Second, it contends that recent critiques of this (...) shift in position by scholars such as George Weigel and James Turner Johnson, however, are wrong to categorize this a “functional pacifism.” Though a development from within just war theory and pacifist reasoning, the Church's new stance does not operate as a type of pacifism, allowing too many possibilities for justified armed conflict to be labeled as “functional” pacifism. Christopher Norris is Emeritus professor at Cardiff University. Recently, he began to address philosophical questions through poetry. In his paper, he explains why. Rather than expressing definite ideas in an elegant way, poetry can be intended as a process from which new ideas (also philosophical ones) can emerge. The result are a number of poems which cover a variety of issues, ranging from philosophy to politics, arts, history of ideas and science. This essay responds to James Turner Johnson's critiques of my argument in “‘Never Again War’: Recent Shifts in the Roman Catholic Just War Tradition and the Question of ‘Functional Pacifism.’” . It attends specifically to three of Johnson's objections and offers accounts of the meaning and use of the term “functional pacifism,” an understanding of classic just war thought as a tradition, and the concepts of peace and authority within just war and pacifist thought. It argues that my analysis (...) of the Catholic Church's movement toward pacifism but ultimate theological inability to embrace a functional pacifism still stands in spite of Johnson's critiques. In addition, it suggests that Johnson offers a thin pacifistic conception of peace and promotes a restricted notion of ecclesial authority and democratic government. (shrink)

Piers Norris Turner’s recent interpretation of John Stuart Mill’s philosophy transforms Mill into an illiberal utilitarian, against the textual evidence. Mill rejects Turner’s standard utilitarian, or “expansive,” conception of harm, according to which mere displeasure or distress counts as nonconsensual harm. Moreover, Mill is not a radical antipaternalist. He says that society may legitimately consider the individual’s own good as a reason for interference with other-regarding actions that inflict nonconsensual harm on others. But there are no (...) reasons, paternalistic or otherwise, for interference with self-regarding actions that may be displeasing to others without causing them any nonconsensual harm. (shrink)

In the fourteenth paragraph of the fifth chapter of Utilitarianism, J. S. Mill writes that ‘We do not call anything wrong, unless we mean to imply that a person ought to be punished in some way or other for doing it; if not by law, by the opinion of his fellow-creatures; if not by opinion, by the reproaches of his own conscience.’ I criticize the attempts of three commentators who have recently presented act-utilitarian readings of Mill – Roger Crisp, David (...) The focus of this essay is on how we overcome the past by dealing with it. In this setting, the analysis is of the relationship between ‘moral transactions’ concerning blame, guilt, responsibility, apology and forgiveness and the possibility of transition away from states of trauma. The first section draws on previous work to set out a position on human love as the basis for an understanding of guilt and the ‘moral grammar’ of justice. The second section considers Martha Nussbaum’s claim (...) in Anger and Forgiveness that the idea of transition should be prioritized at the cost of a moral transactional analysis that would engage the moral grammar of blame, guilt, responsibility, apology and forgiveness. The latter is seen as potentially obstructing the transition to a better world. I suggest to the contrary there are grounds for thinking that a successful transition requires relevant moral transactions. (shrink)

ABSTRACTLove is the basis for a moral psychology of forgiveness. I argue for an account of love based on Roy Bhaskar's conception of its five circles, and of the ethical nature of human beings as concrete universals/singulars. Linking this to work of ‘The Forgiveness Project’, I argue that forgiveness can be understood metaphysically in terms of its relation to love of self, of the other, of the relation of self and other, of self, other and the wider community, and of (...) self and other in their ontological depth as unique individuals. Forgiveness involves both a ‘giving to’ and a ‘giving up’, and this can lead to a profound sense of identity between a victim and a perpetrator. Forgiveness is different for each person; it may draw upon a public/legal setting as a proxy for universal judgement; and it confronts social-structural and political elements which may block its development. In this paper, for the benefit of reflection processes in clinical and in local, regional, and national priority-setting, we aim to develop an ethical theoretical framework that includes both ethical principles and medium-range narratives. We present our suggestion in the particular case of having to choose between treatment interventions for attention deficit hyperactivity disorder (ADHD) and treatment interventions for other conditions or diseases, under circumstances of scarcity. In order to arrive at our model, we compare two distinct ethical approaches: a (...) generalist (principles) approach and a particularist (narratives) approach. Our focus is on Sweden, because in Sweden prioritization in healthcare is uniquely governmentally regulated by the “ethics platform.” We will present a (fictional) scenario to analyse the strengths and weaknesses of the generalist principled perspective of the ethics platform and the particularist perspective of narrative ethics. We will suggest an alternative (moderately particularist) approach to prioritization, which we dub a “principles plus medium-range narratives” approach. Notwithstanding the undeniably central role of principles in distributive justice, we claim that medium-range narratives concerning individuals or groups who stand to benefit or lose from ADHD prioritization practices should also be read or listened to and taken into account at all levels of priority-setting. These narratives are expected to ethically optimize clinical priority-setting, as well as that undertaken at local, regional, and national levels. (shrink)

This paper contributes to the growing literature in social epistemology of diagnosing the epistemically problematic features of fake news. I identify two novel problems: the problem of relevant alternatives; and the problem of the degradation of the epistemic environment. The former arises among individual epistemic transactions. By making salient, and thereby relevant, alternatives to knowledge claims, fake news stories threaten knowledge. The problem of the degradation of the epistemic environment arises at the level of entire epistemic communities. I introduce the (...) notion of an epistemic environment, roughly the totality of resources and circumstances relevant to assessing the epistemically interesting statuses, such as knowledge. Fake news degrades our epistemic environment by undermining confidence in epistemic institutions and altering epistemic habits, thereby making the environment less conducive to achieving positive epistemic statuses. This is problematic even if the decrease in confidence and the altering of habits are rational. I end by considering solutions to these problems, stressing the importance of reproaching each other for proliferating fake news. I argue that we should reproach even faultless purveyors of fake news. This is because fake news typically arises in abnormal epistemic contexts, where there is widespread ignorance of, and noncompliance with, correct epistemic norms. (shrink)
