Normativity and the Will collects fourteen important papers on moral psychology and practical reason by R. Jay Wallace, one of the leading philosophers currently working in these areas. The papers explore the interpenetration of normative and psychological issues in a series of debates that lie at the heart of moral philosophy. Themes that are addressed include reason, desire, and the will; responsibility, identification, and emotion; and the relation between morality and other normative domains. How can a system of criminal punishment be justified? In particular can it be justified if the moral demand that we respect each other as autonomous moral agents is taken seriously? Traditional attempts to justify punishment as a deterrent or as retribution fail, but Duff suggests that punishment can be understood as a communicative attempt to bring a wrong-doer to repent her crime. This account is supported by discussions of moral blame, of penance, of the nature of the law's demands, (...) and of the proper meaning and purpose of the criminal process of trial and verdict: it deals both with the ideals that should inform a system of criminal law and the extent to which those ideals are actualised in existing institutions and practices. The conclusion is pessimistic: punishment cannot be justified within our legal system; and this gap between the ideal and the actual presents us with serious moral dilemmas. (shrink)

BLWith new text and full apparatus criticus The Eudemian Ethics was one of two ethical treatises which Aristotle wrote on the subject of ethica or `matters to do with character'. Although the two works cover much the same ground, the Nicomachean Ethics is better known; the poor manuscript tradition of the Eudemian Ethics has made correct translation and interpretation of the text extremely difficult. The subject of the work is the choice of a certain means of conduct, made by a (...) `man of practical wisdom', between two extremes of behaviour: asceticism and yielding to uncontrolled impulses. Aristotle also stresses the notion of moral intention and the importance of virtue of character. This new Oxford Classical Text of the Eudemian Ethics is the result of many years of work. After Sir David Ross's death, his original text was substantially reworked and revised by his friend and colleague R. R. Walzer, who was aided in the revision by his former pupil Mrs Jean Mingay, who continued his work after his death in 1974. Mrs Mingay was fortunate in being able to make use of previously unpublished contributions from D. J. Allan after his death in the late seventies, and more recently has been helped in her work by the suggestions of Professor D. A. Russell, David Robinson, and Christopher Rowe. (shrink)

David Benatar argues that coming into existence is always a harm, and that – for all of us unfortunate enough to have come into existence – it would be better had we never come to be. We contend that if one accepts Benatar’s arguments for the asymmetry between the presence and absence of pleasure and pain, and the poor quality of life, one must also accept that suicide is preferable to continued existence, and that his view therefore implies both anti-natalism (...) and pro-mortalism . This conclusion has been argued for before by Elizabeth Harman – she takes it that because Benatar claims that our lives are ‘awful’, it follows that ‘we would be better off to kill ourselves’ (Harman 2009: 784). Though we agree with Harman’s conclusion, we think that her argument is too quick, and that Benatar’s arguments for non-pro-mortalism deserve more serious consideration than she gives them. We make our case using a tripartite structure. We start by examining the prima facie case for the claim that pro-mortalism follows from Benatar’s position, presenting his response to the contrary, and furthering the dialectic by showing that Benatar’s position is not just that coming into existence is a harm, but that existence itself is a harm. We then look to Benatar’s treatment of the Epicurean line, which is important for him as it undermines his anti-death argument for non-pro-mortalism. We demonstrate that he fails to address the concern that the Epicurean line raises, and that he cannot therefore use the harm of death as an argument for non-pro-mortalism. Finally, we turn to Benatar’s pro-life argument for non-pro-mortalism, built upon his notion of interests, and argue that while the interest in continued existence may indeed have moral relevance, it is almost always irrational. Given that neither Benatar’s anti-death nor pro-life arguments for non-pro-mortalism work, we conclude that pro-mortalism follows from his anti-natalism, As such, if it is better never to have been, then it is better no longer to be. -/- . It distinguishes six main interpretive approaches, each with its own conception of autonomy: autonomy as spontaneous self-determination, in the sense of traditional free will; a “standard model” interpretation counting actions as autonomous when they are caused by rationalizing beliefs and desires; a view that traces autonomy to a Kantian transcendental subject; constitutivist theories that seek to explain the source of normativity by “deriving ethics from action”; “hierarchical model” interpretations arguing that (...) complex, higher-order attitudes “speak for the agent,” and thereby constitute her autonomy; and conceptions of autonomy as an ethical ideal. The most glamorous and even glorious moments in a legal system come when a high court recognizes an abstract principle involving, for example, human liberty or equality. Indeed, Americans, and not a few non-Americans, have been greatly stirred--and divided--by the opinions of the Supreme Court, especially in the area of race relations, where the Court has tried to revolutionize American society. But these stirring decisions are aberrations, says Cass R. Sunstein, and perhaps thankfully so. In Legal Reasoning and Political Conflict, (...) Sunstein, one of America's best known commentators on our legal system, offers a bold, new thesis about how the law should work in America, arguing that the courts best enable people to live together, despite their diversity, by resolving particular cases without taking sides in broader, more abstract conflicts. Sunstein offers a close analysis of the way the law can mediate disputes in a diverse society, examining how the law works in practical terms, and showing that, to arrive at workable, practical solutions, judges must avoid broad, abstract reasoning. Why? For one thing, critics and adversaries who would never agree on fundamental ideals are often willing to accept the concrete details of a particular decision. Likewise, a plea bargain for someone caught exceeding the speed limit need not--indeed, must not--delve into sweeping issues of government regulation and personal liberty. Thus judges purposely limit the scope of their decisions to avoid reopening large-scale controversies. Sunstein calls such actions incompletely theorized agreements. In identifying them as the core feature of legal reasoning--and as a central part of constitutional thinking in America, South Africa, and Eastern Europe-- he takes issue with advocates of comprehensive theories and systemization, from Robert Bork to Jeremy Bentham, the father of utilitarianism, and Ronald Dworkin, who defends an ambitious role for courts in the elaboration of rights. Equally important, Sunstein goes on to argue that it is the living practice of the nation's citizens that truly makes law. For example, he cites Griswold v. Connecticut, a groundbreaking case in which the Supreme Court struck down Connecticut's restrictions on the use of contraceptives by married couples--a law that was no longer enforced by prosecutors. In overturning the legislation, the Court invoked the abstract right of privacy; the author asserts that the justices should have appealed to the narrower principle that citizens need not comply with laws that lack real enforcement. By avoiding large-scale issues and values, such a decision could have led to a different outcome in Bowers v. Hardwick, the decision that upheld Georgia's rarely prosecuted ban on sodomy. And by pointing to the need for flexibility over time and circumstances, Sunstein offers a novel understanding of the old ideal of the rule of law. Legal reasoning can seem impenetrable, mysterious, baroque. This book helps dissolve the mystery. Whether discussing the interpretation of the Constitution or the spell cast by the revolutionary Warren Court, Cass Sunstein writes with grace and power, offering a striking and original vision of the role of the law in a diverse society. In his flexible, practical approach to legal reasoning, he moves the debate over fundamental values and principles out of the courts and back to its rightful place in a democratic state: the legislatures elected by the people. Heidegger’s early project aims to articulate the form of our being as Dasein, and he says that for this usually hidden form to become accessible, a certain kind of “mood” is required of the philosopher. This “ground-mood” he identifies in Sein und Zeit as anxiety. He also, however, presents anxiety as a mood anyone, philosopher or not, experiences when there is some significant breakdown in the living of her life. I argue here that there are largely unrecognized problems with this (...) conflation of methodological and “existential” moods, but that there is nevertheless a compelling methodological account of anxiety that can be teased apart from the existentialist one: methodologically understood, anxiety is a self-affected state of the ontologist, one that results from her asking ontological questions of herself, and, by imagining crisis or breakdown, withdrawing from her determinate situation to a position where she can see the form of her own activity as questioner and imaginer. I draw out some consequences this has for how we should understand the place of ontological understanding in living one’s life, and I conclude by briefly showing how my reading helps us see Heidegger as developing key elements in the work of Descartes and Kant. Divine temporality is all the rage in certain theological circles today. Some even suggesting that the doctrine of the Trinity entails divine temporality. While I find this claim a bit strong, I do think that divine temporality can be quite useful for developing a robust model of the Trinity. However, not everyone agrees with this. Paul Helm has offered an objection to the so-called Oxford school of divine temporality based on the Christian doctrine of the Trinity. He has argued that (...) this form of divine temporality entails Arianism. In other words, divine temporality suffers from an inadequate doctrine of the Trinity. In this paper I shall first articulate the so-called Oxford school of divine temporality. From there I shall develop some of the Oxford school’s theological benefits that help flesh out the doctrine of the Trinity, and assuage the charge of Arianism. Then I shall offer an examination and refutation of the Arian charge to divine temporality in order to show that the divine temporalist can maintain a robust Trinitarian theology. (shrink)

Applied to evaluative properties the supervenience thesis is customarily understood as expressing two intuitions: (i) the idea that there is some kind of dependence between the (supervenient) value of an object and some (or all) of the natural properties of the object; (ii) the idea that if you assert that x is valuable and if you agree that y is relevantly similar to x, with regard to natural properties, you must be prepared to assert that y too is valuable. It (...) is argued that the influential account of supervenience by R. M. Hare is problematic in that it only expresses the latter but not the former intuition. Two solutions to this problem are outlined, one of which ought to be endorsable by a prescriptivist such as Hare. (shrink)

This book is a new edition of a short but fascinating treatise by Galen on causal theory. This text survives only in a Latin translation of the fourteenth century, and it is this which appears here. The volume also contains the first translation of the treatise into any modern language, and the first philosophical commentary thereon. The commentary ranges widely in Galen's voluminous œuvre, and compares his views with those of other ancient theorists. The introduction deals in detail with Galen's (...) life and work, with the background both philosophical and medieval to his causal theory, and with the history of the text itself. (shrink)

It is immensely difficult to give a philosophically adequate account of mental imagery. Peter F.R. Haynes, pp. 709–19) objects to the standard accounts, and offers one of his own which avoids the standard difficulties. Unfortunately it in turn seems to lapse into incoherence.Haynes rejects Cartesian accounts which would make images private objects in non-physical space. He also rejects current alternative views: both Rylean or behaviourist ones; and also intentionally complex ones, which assert that the relevant terms change their meaning. He (...) thinks that J. J. C. Smart's “topic neutral” approach may supply “the basis for a correct, intentionally simple, intuitively satisfying account of mental imagery”. But an adequate account must also be neutral, as Smart's is not, between different theories of mind. In addition to avoiding these difficulties an adequate theory has certain other desiderata; in particular Haynes places valuable emphasis on the need to explain the fact that we can sometimes mistake images for real perceptions or, more real perceptions for images. Interpretive Political Science is the second of two volumes featuring a selection of key writings by R.A.W. Rhodes. Volume II looks forward and explores the 'interpretive turn' and its implications for the craft of political science, especially public administration, and draws together articles from 2005 onwards on the theme of 'the interpretive turn' in political science. Part I provides a summary statement of the interpretive approach, and Part II develops the theme of blurring genres and discusses a variety of research (...) methods common in the humanities, including: ethnographic fieldwork, life history, and focus groups. Part III demonstrates how the genres of thought and presentation found in the humanities can be used in political science. It presents four examples of such blurring 'at work' with studies of: applied anthropology and civil service reform; women's studies and government departments; and storytelling and local knowledge. The book concludes with a summary of what is edifying about an interpretive approach, and why this approach matters, and revisits some of the more common criticisms before indulging in plausible conjectures about the future of interpretivism. Comment l'intention apologétique de Blondel dans L’Action est-elle compatible avec le caractère philosophique de l’œuvre ? Comment éviter le soupçon de préjugé, de pétition de principes ? R. Virgoulay montre comment le projet mis en œuvre dans L’Action et défini dans la Lettre de 1896, ouvrait la philosophie à l'examen du problème religieux par la détermination a priori de la notion de surnaturel. Après avoir exposé « la méthode de L’Action » pour faire passer d'une conviction subjective, d'un témoignage vécu, (...) à une « science », c'est-à-dire à l'exposé qui conjugue nécessité et universalité, il s'attarde sur la cinquième partie de L’Action. Celle-ci, après l'élaboration des quatre autres parties, peut être alors une philosophie de la religion qui porte sur le contenu même du Christianisme, et pour laquelle la notion décisive est celle du surnaturel. Les questions que pose cette notion amènent l'auteur à comparer la problématique blondélienne à celle de Laberthonnière, comparaison qui manifeste la différence entre la démarche théologique de ce dernier et celle, philosophique, de Blondel. How is the apologetic intention of Blondel in Action compatible with the philosophical character of the work ? How can one avoid the suspicion of prejudice, of begging the question ? R. Virgoulay shows how the project put to work in Action and defined in the Lettre of 1896, opened philosophy to the examination of the religious problem by the a priori determination of the notion of the supernatural. After discussing « the method of Action » in order to move from a subjective conviction, from a lived witnessing, to a « science », that is to say, to an analyses that conjugate necessity and universality, the author concentrates on the fifth part of Action. This latter, after, the elaboration of the four other parts, could be, then, a philosophy of religion that carries to the very content of Christianity, and for which the decisive notion is that of the supernatural. The questions that this idea brings up led the author to compare Blondel’s field of inquiry to that of Laberthonnière, a comparison that, manifests the difference between a theological approach of the latter and that, philosophical, of Blondel. While Laberthonnière tries theologically to justify the philosophical enterprise of Blondel, the Lettre rigorously distinguishes theology from philosophy. (shrink)
