This essay contends that the ethics around the use of spy technology to gather intelligence (TECHINT) during espionage and counterintelligence operations is ambiguous. To build this argument, the essay critically scrutinizes Cécile Fabre's recent and excellent book Spying through a Glass Darkly, which argues that there are no ethical differences between the use of human intelligence (HUMINT) obtained from or by human assets and TECHINT in these operations. As the essay explains, Fabre arrives at this position by treating TECHINT (...) as a like-for-like replacement for HUMINT. The essay argues instead that TECHINT is unlikely to act as a like-for-like replacement for HUMINT. As such, TECHINT might transform existing practices of espionage and counterintelligence, giving rise to new ethical challenges not captured in Fabre's analysis. To illustrate the point, the essay builds an analogy between TECHINT and recent armed conflicts in which precision weapons have been deployed. Although precision weapons seem ethically desirable, their availability has created new practices of waging war that are ethically problematic. By analogy, TECHINT, though not intrinsically undesirable, has the capacity to generate new practices of intelligence gathering that are ethically problematic—potentially more than HUMINT. Ultimately, recent negative experiences with the use of precision weaponry should caution against an overly positive assessment of TECHINT's ethical desirability. (shrink)

A normative defense of espionage and counterintelligence activities in the service of foreign policy goals must show at least two things. First, it must show which foreign policy goals, if any, provide a justification for such activities. Second, it must provide an account of the means that intelligence agencies are morally permitted, indeed morally obliged, to use during those activities. This thesis investigates transnational macro-narrative decendancy in violent conflicts and identifies enabling dynamics that facilitate re-framing. To date there has been little focus on processes involved, explicitly narrative descendancy, bridging, resonance building, or grafting, representing a critical knowledge gap. -/- This thesis reviews relevant literature on constructivism and rational choice theory and tests the findings against an empirical case study in Central Sulawesi. The findings demonstrate a mixture of approaches is present, though this is likely due to a range of (...) dynamics unique to the conflict. In the age of the Internet, people have increased access to information along multiple dimensions. It might seem that we are on our way to an epistemic utopia in which we spend less time and effort on basic cognitive tasks while devoting more time and effort to complex deliberation. However, though there are many accurate sources on the Internet, they must be sifted from the spammers, concern trolls, practical jokers, conspiracy theorists, counterintelligence sock-puppets, and outright liars who also proliferate (...) online. We can approach this problem via the individual or via the network, asking two questions. First, holding the topology of the network constant, which moral and epistemic dispositions are conducive to successful inquiry by nodes at different positions within it? Second, holding the distribution of people’s epistemic dispositions constant, which network topologies are more likely to produce epistemic goods and avoid epistemic ills? To answer these questions, we need to combine virtue-theoretic reflection on individual dispositions with a nuanced understanding of the dynamics of networks. In this paper, I highlight and explore some important properties of such networks and connect those properties with dispositions that make someone an excellent member of an epistemic network. Cécile Fabre draws back the curtain on the ethics of espionage and counterintelligence. In a book rich with historical examples she argues that spying is only justified to protect against ongoing violations of fundamental rights. Blackmail, bribery, mass surveillance, cyberespionage, treason, and other nefarious activities are considered.

Every one of us has been a participant these days in futile and endless conversations about the fact that in the past few years violence in our country has excalated to the limit or, more accurately, beyond all limits. No one remembers the nightmares concealed behind the bureaucratic term "mass repressions," when tens and hundreds of thousands of the country's inhabitants were sentenced to death and were exterminated on orders from the top, in a planned manner through "troikas." Human memory (...) is short, and everyday consciousness can only exist thanks to this forgetfulness. Yet it should not be difficult to recall that ten years ago it was no less dangerous to go out for a walk in the evenings. But the newspapers were silent then and crime statistics were secret. If we go back to the origins of the Soviet state, we will see even from the permitted literature of the time that the ferocity of the communist secret police and the White counterintelligence accompanied a deluge of lawlessness that a European can hardly imagine. Suffice it to say that the leader of the world's first proletariat state was accosted and robbed by bandits. (shrink)
