Educational Justice and Democratic Education.Gosepath Stefan - 2023 - In Johannes Drerup, Douglas Yacek & Julian Culp (eds.), The Cambridge Handbook of Democratic Education. Cambridge University Press. pp. 263-280.
What are the purposes or aims of education in general and of democratic education in particular? And what are the appropriate ways and means of such an education? This chapter offers an overview of some of the more important approaches to these questions in contemporary, mostly anglophone, conceptions of educational justice in primary and secondary education. Section 16.2 starts with some provisions of some important goals of education. Section 16.3 turns to educational justice in gerneral. Section 16.4 asks about the (...)

What, if anything, is wrong with bequest?Gosepath Stefan - 2022 - In Schmidt am Busch Hans-Christoph, Halliday Daniel & Gutmann Thomas (eds.), Inheritance and the Right to Bequeath: Legal and Philosophical Perspectives. Oxon/New York: Routledge. pp. 15-35.
This chapter is concerned with the fundamental question of whether it is just that people inherit property. Should a property owner be entitled to transfer that property after their death to a person of their choosing? Is the right to posthumous transfer a part of the right to private property? I will defend the thesis that the common social practice of inheritance, embodied in law and institutions, is actually pro tanto unjust, since it confers an unjust advantage on the beneficiary. (...)

  3. Equality.Gosepath Stefan - 2021 - The Stanford Encyclopedia of Philosophy.
This article is concerned with social and political equality. In its prescriptive usage, ‘equality’ is a highly contested concept. Its normally positive connotation gives it a rhetorical power suitable for use in political slogans (Westen 1990). At least since the French Revolution, equality has served as one of the leading ideals of the body politic; in this respect, it is at present probably the most controversial of the great social ideals. There is controversy concerning the precise notion of equality, the (...)

  6. Gleiche Gerechtigkeit: Grundlagen eines liberalen Egalitarismus.Stefan Gosepath - 2004 - Frankfurt am Main: Suhrkamp.
Equal Justice explores the role of the idea of equality in liberal theories of justice. The title indicates the book’s two-part thesis: first, I claim that justice is the central moral category in the socio-political domain; second, I argue for a specific conceptual and normative connection between the ideas of justice and equality. This pertains to the age-old question concerning the normative significance of equality in a theory of justice. The book develops an independent, systematic, and comprehensive theory of equality (...)

The subject of my dissertation is "rationality". In this book I undertake a comprehensive, systematic and independent treatment of the problem of rationality. This furthers progress toward a general theory of rationality, one that represents and defends a uniform conception of reason. The structure and general outline are as follows: Part I: General Definition of the Concept; Part II: Rationality in the Theoretical Realm; Part III: Rationality in the Practical Realm (parts II and III are divided respectively into A. Relative (...)

In order to at least begin addressing the extensive the problem of moral clarity in aiding the deprived to some degree, I first argue that the duty to aid the deprived is not merely a charitable one, dependent on the discretion, or the arbitrary will, of the giver (1). Then, before further analysing the individual duty to aid, I critically examine whether deprivation is better alleviated or remedied through the duties of corrective justice. I argue that the perspective of corrective (...)

In this paper, I examine the question of the scope of justice, in a not unusual distributive, egalitarian, and universalistic framework. Part I outlines some central features of the egalitarian theory of justice I am proposing. According to such a conception, justice is – at least prima facie – immediately universal, and therefore global. It does not morally recognize any judicial boundaries or limits. Part II examines whether, even from a universalistic perspective, there are moral or pragmatic grounds for rejecting (...)

In this paper I would like to suggest that we should distinguish between three levels of education in schools: basic education for all, the cultivation of individual talents and capacities; and the selection for higher education and the job market. On each level egalitarians should in my view demand a different kind of equality and a different kind of metric. Since for the selection for higher education and the job market equality of opportunity seems the approriate metric of justice in (...)

Addressees of the obligation to help the destitute in cases of need are all individuals living in better circumstances, who have a shared responsibility to eradicate states of need. In order to do justice to this obligation, they have to join together and create political institutions to jointly render assistance. These institutions must be capable of attributing an appropriate share of the common responsibility to the individual persons and of enforcing the completion of the obligation. These political constructs of shared (...)

In my paper, I comment on Rainer Forst's paper in this issue. I raise doubts as to whether the justification of democracy emerges from a fundamental moral right to reciprocal and general justification, as Forst claims. His basic argument appears questionable because democracy is different from a “hypothetical‐consent‐conception” of moral legitimacy, which limits as well as enables democratic legitimacy. The former cannot, however, justify the latter through an argument centered on self‐government: Such an argument relies heavily on the possibility of (...)

    A Vindication of Distributive Justice.Stefan Gosepath - 2019 - Yearbook for Eastern and Western Philosophy 2019 (4):5-19.
This paper addresses one particular controversy that has recently received much attention in political theory broadly, and in justice theory in particular: it concerns the role of distributive justice. The proponents of the so-called distributive paradigm argue that just distribution is the most basic aspect of justice. Their opponents claim that this is a misleading “picture” of justice. Instead, they argue for a concept of justice that is primarily concerned with the social status of persons. The distributive paradigm is confronted (...)

When ‘we’ in the West talk about philosophy, we most often mean ‘Western Philosophy’, i. e. philosophy with ancient roots in Greece from the pre-Socratic period onwards until today, thereby neglecting other cultures and traditions, whose history of philosophical thinking is at least as old and important. This neglect of other philosophical traditions is a problem in general, since it is unfair, hegemonic, ignorant, and imprudent. The article argues that there are instrumental as well as intrinsic reasons to diversify and (...)

    Eine einheitliche Konzeption von Rationalität.Stefan Gosepath - 1994 - ProtoSociology 6:114-133.
This article argues for the thesis that there is only one basic form of rationality, which is applied in different areas. First of all, there is one meaning of the term "rational" which applies to all situations in which the term is used: "justified." If "rational" means simply "justified", then rationality can be broken down into as many types as there are kinds of justification. Two distinctions between kinds of justification seem particularly plausible: 1. relative vs. absolute justifications and 2. (...)

Which role does publicity play in an adequate theory of individual and collective reasoning? To analyze the role publicity should play in our societies in solving societal problems, I will start, in the first part, with some general remarks about problems and problem solving. In the second part, I will deal with the role responsible reasoning plays in problem solving. Finally, I will argue that, and why, the public use of reason is necessary for finding the best solutions for problems (...)

Many of these are familiar, such as issues of fairness, responsibility and privacy, but are presented in a new and challenging guise due to our limited ability to steer and predict the outputs of AI systems. This chapter first introduces these ethical challenges, stressing that overviews of values are a good starting point but frequently fail to suffice due to the context (...)
