Resumo Neste artigo, o autor analisa o significado específico, atribuído por Kant, a certas noções fundamentais da sua Filosofia do Direito, dando especial atenção às implicações mais relevantes, que podem ser inferidas da sua caracterização das noções de liberdade, contracto, Estado e república, enquanto “ideias de razão pura”. A análise do estatuto ideal de tais noções deverá não só contribuir para um melhor entendimento do caracter normativo da doutrina jurídica de Kant, mas também permitir abordar questões difíceis relativas à possibilidade (...) de uma realização factual de tais ideias. Como será sugerido, em ordem a correctamente interpretar o estatuto peculiar das ideias jurídicas mencionadas, dever-se-á observar a distinção entre os conceitos puros do entendimento e ideias transcendentais da razão . Estas distinções desempenham um papel importante na caracterização das noções jurídicas como ideias da razão pura, ideias essas que devem guiar a nossa praxis política. Palavras-chave : contracto, estado, função reguladora, ideias, liberdadeIn this paper it is analyzed the specific meaning that Kant assigns to certain fundamental notions of his Philosophy of Law, paying special attention to the most relevant consequences that can be inferred from his characterization of the notions of freedom, contract, State and republic as “ideas of pure reason”. The analysis of the ideal status of such notions should not only contribute to a better understanding of the normative character of Kant’s juridical doctrine, but may also allow us to tackle difficult issues concerning the possibility of a factual realization of such ideas. As it will be suggested, in order to correctly interpret the peculiar status of the mentioned juridical ideas, we should focus on the critical distinction between pure concepts of understanding and transcendental ideas of reason . These distinctions play an important role for the characterization of juridical notions as ideas of pure reason, ideas which should guide our political praxis. In der 1970 gegründeten Reihe erscheinen Arbeiten, die philosophiehistorische Studien mit einem systematischen Ansatz oder systematische Studien mit philosophiehistorischen Rekonstruktionen verbinden. Neben deutschsprachigen werden auch englischsprachige Monographien veröffentlicht. Gründungsherausgeber sind: Erhard Scheibe (Herausgeber bis 1991), Günther Patzig (bis 1999) und Wolfgang Wieland (bis 2003). Von 1990 bis 2007 wurde die Reihe von Jürgen Mittelstraß mitherausgegeben.

The article offers an analysis of Kant’ s “Third Antinomy of Pure Reason” (in which he examines the possibility of reconciling Transcendental freedom with natural Determinism), in order to show the lack of grounds of the interpretation that claims that the critical resolution of the antinomy implies a shift with respect to the cosmological terms in which the conflict was initially stated. Through a detailed analysis of the sources, we will suggest that the conflict analyzed in the Third Antinomy is (...) not exclusively cosmological, but rather that it also –and to the same degree– constitutes a practical conflict, and, secondly, that the critical solution is not developed in exclusively practical terms, but that it also involves certain aspects directly linked to the cosmological question initially formulated. En este trabajo analizamos dos defi niciones kantianas de la libertad política que han sido consideradas como defi niciones antagónicas: una de ellas parece aproximar a Kant a la corriente del liberalismo moderno; la otra daría lugar, en cambio, a una interpretación republicana del pensamiento político kantiano. El análisis de ambas definiciones permitirá mostrar que éstas no resultan necesariamente incompatibles. In this paper we shall analyze two Kantian defi nitions of political freedom which have been considered mutually exclusive: one of (...) them would allow us to consider Kant as an exponent of the liberal tradition; the other would lead to a republican interpretation of Kant's political thought.
