The French scholar Jacques Ellul is nearly forgotton in German-speaking theology. The author presents Ellul's book of 1946 in which he developed a theological foundation of law, puts it in its historical context and tries a theological evaluation. In spite of some fundamental Iacks, particularly in the comprehension of revelation, at least three ideas still merit consideration: no sphere of human reality is independent of God; therefore, theology comprehends an investigation of the inner structures of society; in this, it is (...) focused on the Christan hope. Pacifism is an active form of resistance, and therefore not to be criticised as a passive withdrawal from the world. The defining characteristic of pacifism, in both the institutional and the witness approach, is its categorical commitment to nonviolence. Therefore, pacifism’s discourse on violence deserves special attention. This article identifies incoherencies and developments in pacifism’s discourse on violence, which are due to the almost unbearable burden of thinking and acting categorically in a nonviolent manner. It furthermore identifies two presuppositions in (...) pacifist thinking on the consequences of the use of violence which turn out to be rather myths than reality. It cannot be proven that violence always begets violence nor that violence cannot be tamed in military operations. Therefore, the belief of pacifism that peace can be brought about effectively only when refusing any kind of violent means turns out to be an irrational myth as well. (shrink)

Die Universalität der Menschenrechte wird seit Jahren zwischen den verschiedenen Kulturkreisen kontrovers diskutiert. Die vorliegende Untersuchung geht der Frage nach, ob ethische Normen, wie z.B. die Menschenrechte, universal oder nur partikular (für eine bestimmte Wertgemeinschaft) begründbar sind. Zur Klärung werden Beiträge aus dem Protestantismus (u.a. W. Herrmann, E. Troeltsch, K. Barth und T. Rendtorff) und der Philosophie (Naturrechtstradition, R. Alexy, O. Höffe) analysiert. Der Verfasser kommt zu dem Ergebnis, daß ethische Normen immer in einem bestimmten, etwa dem christlichen, Menschenbild fundiert (...) sind, aber zugleich auf universale, im Weltanschauungsdiskurs zu erweisende Plausibilität zielen.
