Since the beginning of the late modern era, modern constitutions have been trying to keep both group rights as minority rights and individual rights. But, in some cases, it is still ambiguous if an action or a phenomenon must refer to individual rights or group rights. Abortion discussions, with regard to political rights, are one example of these ambiguous cases. In this context, whereas Liberal view tends to regard abortion as individual rights of a woman, Communitarian view can be against (...) it by pointing out the right to life and this case may lead to a kind of liberal constitutional crises. This article gains importance as such constitutional crises still emerge even nowadays. John Rawls’s theory of overlapping consensus in Political Liberalism tries to solve these political conflicts that emerged in liberal constitutions by prioritizing public reason. This article conceptionally aims to examine Rawls’s theory in terms of prioritization and value relativity in abortion discussions. The method of article is hermeneutics. In order to extend the universe of the discussion, some important thinkers such as Immanuel Kant, Isaiah Berlin and John Gray, who have related studies on the topic, were included. In conclusion, it is asserted that Rawl’s theory is weak both practically and theoretically as to the principle of utilitarianism violates the rights of communitarians. (shrink)

The purpose of the current study was to investigate the effects of COVID-19 on high school students' psychological symptoms and to understand how ready counselors and school counseling services are based on the data we have. Therefore, this research is designed under two different studies: Study 1: Effects of COVID-19 pandemic on students' psychological symptoms and Study 2: Views and expectations of students and school counselors about school counseling services. The first study was a quantitative study and included 549 high (...) school students. A structural equation model was created to examine the effects of COVID-19 pandemic on participants' psychological symptoms. The Impact of Event Scale-Revised scores showed that 107 individuals had a score of 50 and above pointing out that individuals in this group had severe impact of event/trauma symptomologies. The SEM analysis indicated that IES-R scores had a total effect of 0.79 on anxiety, 0.75 on depression, 0.74 on negative self-concept, 0.68 on somatization, and 0.66 on hostility scores. Furthermore, female students had significantly higher scores on anxiety, depression, negative self-concept, somatization, hostility, and impact of events variables than male students. Study 2 was a qualitative design and consisted of five school counselors and five students from different schools. The results indicated that students' difficulties during the coronavirus disease 2019 outbreak were educational, cognitive, emotional, physiological, relational, technological, and related to routines. Academic, social, emotional, and behavioral issues came to the fore among the difficulties that can be experienced if students start face-to-face education. On the other hand, the school counselors listed that family relations, personal–social, emotional, and academic themes were the difficulties experienced by the students at the beginning of the COVID-19. In addition, when COVID-19 started, the services offered by school counselors were discussed under services for the student, services for the family, and services for the teacher. Finally, according to the opinions of the school counselors, if students start face-to-face education, they may experience emotional, academic, and relational difficulties. In summary, it is vital that student personality services be prepared and implemented by school counseling services for schools based on the results. (shrink)

The primary source of income in the Ottoman Empire, like in other pre-vious and contemporary states, was land. For this reason, the private ownership of land, especially those used for grain production, was avoided, and efforts were made to keep them as state-owned or public lands known as "mirî" or "memleket arazisi". This situation brings up the issue of cultivating the land and generating income from it. The Ottoman Empire further developed the timar system, which was also implemented by the (...) previous states, and allocated land to families based on its productivity by dividing it into certain sizes. These families were required to pay a tax known as "çift resmi", "raiyyet resmi", or "kulluk akçası." The system was based on the cultivation of the land by the peasants, thus ensuring both the production of crops without venturing food security and providing the state with the necessary tax revenue. Thus, it was necessary for the peasants not to abandon their land. One of the precautions taken to ensure this was "cebrî ikamet" (compulsory residency), and the other was "çift bozan resmi" (a tax imposed on those who leave their land uncultivated). Regulations regarding these measures have been included in the Kanunnames (legal codes) since the time of Fatih Sultan Mehmet, and they remained in effect until the 1858 Land Code. Since the nişancıs who prepared the Kanunnames had a good command in Islamic fiqh and the laws were at least theoretically approved by the sheikh al-islam until the mid-17th century, no one among the Ottoman scholars was known to oppose these regulations. Due to the serious disruption of the timar system and the increasing oppression of the peasants, criticisms of the "çift bozan" and "cebrî ikamet" measures began among the scholars in the Damascus region, led by Hayreddin Remlî, in the second half of the 17th century. This criticism intensified over time. In fact, two separate treatises were written on this issue. The scholars in Istanbul were also partly affected by this criticism. In this article, the "çift bozan" tax and its status in Islamic law will be primarily examined. All views in favor or against this issue will be put forth as much as possible, and an evaluation will be made while trying to come up with a different perspective. (shrink)

Ibrahim Aczî Kendi lived between 1882-1965, received a good education, and held many government positions such as civil servant, director and teacher. He retired in 1936, after 34 years of service, and devoted himself to researching cultural values and transferring these values to future generations. Until the last moments of his life, he wrote many works in this framework. In his works, he gave special importance to Mawlânâ Jalâl al-Dîn Rûmî (d. 672/1273) and focused on Rumi’s famous book, Mathnawî. Aczî, (...) who dealt with lives of himself and some important historical figures, also included critics of some contemporary writers and their works in his books. Besides, he has his own Turkish, Arabic and Persian poems. He did not only present the conditions, traditions and customs of the society, but also gave his opinion to the change and transformation movements that took place in the nineteenth and twentieth centuries, without any, hesitation. Since his childhood, Ibrahim Aczî had expressed his feelings through his poems and tried to introduce the cultural values to the young generation with the aim of that the younger generations do not forget Turkish culture and values. He contributed to the field of folklore, and presented some important data for the geographical realm he lives in by reflecting the panorama of his life period. In the studies carried out on Ibrahim Aczî his life and works are described superficially; and the information in these studies is a repetition of each other. Cahit Öztelli is the first person to include Ibrahim Aczî's bibliography, in his works. Later, Mehmet Ali Uz wrote a new article by adding a few more works to the bibliography written by Öztelli. Although Öztelli and Uz’s studies set an example for other studies made after them these studies and follow up studies do not fully reflect Ibrahim Aczî's bibliography. In this respect, our study aims to search the literature about Ibrahim Aczî Kendi and to present a comprehensive bibliography of him. In the introduction part of the article, the studies on Ibrahim Aczî's bibliography were evaluated and, brief information about his life was given. The bibliography of Aczî was presented in the next section. Thus, in this study, Aczî’s serially published works, alongside the studies made by other authors about his life and works have been tried to be analysed. (shrink)

In this work, the author deals with the source of Ottoman Family Law, its application examples and its transformation adventure, together with theory, based on court records in different cities. It reflects the examples of the concrete side of the practical applications of Islamic family law, the Hanafi sect in particular, reflected in the registers in the Ottoman Empire. In general, the application is in accord with the views in fiqh sources. However, the views in the fürû sources of the (...) Ḥanafī sect on some controversial issues caused difficulties in practice. In order to eliminate the troubled situations, the state power sought a solution by intervening with kanunnâme, adâletnâme and fermans at the request of Sheikh al-Islam. In addition to these records regarding the implementation of Islamic family law, the book also includes, the observations and notes of travelers, ambassadors and researchers who had been in the Ottoman country. Particular emphasis is placed on the parts that reflect the contradiction. The subject in the book is examined two parts as Classical Period and Ottoman Family Law in post-Tanzimat. In second chapter, it is stated that a radical change was made in the Islamic/Ottoman family law by including the views of four sects with the preparation of Hukûk-ı Aile Kararnamesi. (shrink)

This article examines tafsir (interpretation of the Qurʾān) - translation relationship in the example of the translation of verse 184 of the Surat al-Baqara into Turkish. Undoubtedly, when the verses are translated into another language, it is necessary to reflect to translate what the first interlocutors understood from them. The fact that the rules (hukm) in some verses were repealed (naskh) or allocated (takhsis) later does not change this requirement. In verse 184 of surat al-Baqara, those who can afford to (...) fast but choose not to fast are ordered to pay ransom (fidya) for every day, that is, to pay the daily amount to feed a poor person. According to the detailed information and rumors in the tafsir literature; this rule was applied when the fast was made obligatory (fard) for the first time, and then it was abrogated. However, this practice, which was canceled for healthy and unexcused people, remained as a permission (rukhṣa) for those who were too old and sick to fast. Both the narrations conveyed from the companions (sahaba) and the general opinions of the mufassirs confirm the abrogation of this rule and that it remains a rukhṣa. The fact that the situation is described as naskh or takhsis does not make a difference in terms of transferring the verse to Turkish or another language. The verses on the subject were examined in the light of the most basic tafsir sources. To give an example that reflects the general opinion; It is stated in the thirty-five narrations reported by Tabari from the companions and tābiʿūn that the 184th verse expresses the option (takhyir) of not fasting in return for fidya for those who can fast. This option has been canceled in the next verse but it has remained for, -some people with special conditions-, as the elderly who cannot afford to fast, pregnant women and breastfeeding women who worry about harm to themselves or their childrens. According to the qirāʾa that is "وعلى الذين يُطوَّقونه", it is said that the verse is not abrogated, it is meant for old men and women. But as emphasized by Abū Ḥayyān, it is understood that this qirāʾa is not actually a qirāʾa but a kind of interpretation of the expression "وَعَلَى الَّذِينَ يُطِيقُونَهُ" in terms of rukhṣa. Therefore, the claim that it has not been repealed is probably due to the continued practice of fiqh. On the other hand, also rational evidence shows that the right to choose (takhyir), which was given initially, was later repealed. For example, in verse 184, it is stated that those who are sick and travelers should perform fasting on other days with the expression "فَمَنْ كَانَ مِنْكُمْ مَرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ"; The same issue is stated in verse 185 with the expression "وَمَنْ كَانَ مَرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ". The repetition in question shows that the two verses were sent not together but at different times. This state of affairs confirms that the second verse has repealed the right of choosing (takhyir) in first one. In addition, as Imam Māturīdi's determined by hit, if those who cannot endure fasting were meant in verse 184, it would be unwise to call these people at the end of the verse as "However, that you fast is better for you, if you only knew!" In the overwhelming majority of Turkish translations of the Qurʾān, it is seen that there is no emphasis on the meaning of the verse when it was first sent. Even the expression “Upon those who are able to fast...” in the verse is translated as “Upon those who aren’t able to fast...”. Whereas it is more consistent and appropriate to reflect the literal meaning of the verse in the translation and explain the situation with additional notes. In this way, it will be understood that two verses that contain the same words and come one after another are sent different times and about different things, hence the reader will be given accurate information. In the nearly thirty examples of translations in the article, it is seen that the translations belonging to Mehmet Akif and Süleyman Tevfik and the translation of the delegation chaired by Hüseyin Kazım are in full harmony with the data in tafsir literature and the general opinion of mufassirs. Rifat Börekçi, the first president of Religious Affairs of the Republic of Turkey, has criticized the translation committee headed by Hüseyin Kazım extremely harshly. Then, with the choice made by Elmalılı Hamdi, almost the direction of the wind changed and the translators could not surpass it. Although there have been some translations in line with the text of the verse, the relevant explanations of these authors reveal that they did not understand the issue in detail and did not make a conscious translation. Meantime the analysis made in the aforementioned verse example shows that reliable translations cannot be made without referring to detailed tafsir information and therefore a correct Qurʾān translation is often not possible without tafsir. Integrative experiment design assumes that we can effectively design a space of factors that cause contextual variation. However, this is impossible to do so in a sufficiently objective way, resulting inevitably in observations laden with surrogate models. Consequently, integrative experiment design may even deepen the problem of incommensurability. In comparison, one-at-a-time approaches make much more tentative assumptions about the factors excluded from experiment design, hence still seem better suited to deal with incommensurability.

This study focuses on al-Taftāzānī’s discussion of the ontological status of divine attributes in his _Sharḥ al-ʿAqāid_ and aims to demonstrate that al-Rāzī’s (d. 606/1210) reluctantly and ambiguously proposed formula that divine attributes are possible by themselves and necessary by God, which itself is an adaptation of Avicennian formula about the ontological status of the divine intellects, received much more recognition after a more sophisticated and advanced version of it was introduced to Sunnī _kalām_ tradition by al-Taftāzānī (d. 792/1390). His (...) improvements generated a considerable amount of intellectual interest within the subsequent commentary and super-commentary tradition and were then refined by the later commentators, a crucial development which has been almost entirely neglected in the modern scholarship. This study further argues that the orientation of post-classical _kalām_ extends to the point where it embraces a specific formula promoted by the _Falāsifa_ to refine Sunnī theory about the ontological status of the divine attributes. Consequently, Sunnī theology deliberately adapted a previously rejected theory to one of its most exclusive and core subjects, that is the discussion of the divine attributes. This study will also show that dramatic transformations in the approach and the structure indicate that Sunnī _kalām_, especially in _Sharḥ al-ʿAqāid_ commentaries and super-commentaries, was significantly influenced by philosophical theories and was required to adopt both the vocabulary and the framework fashioned in philosophical debates on a greater scale after its first transformation due to al-Rāzī’s influence. Because of the voluminous commentaries and super-commentaries on _Sharḥ al-ʿAqāid_ and their extended coverage of a variety of subjects, the current study limits itself to al-Taftāzānī’s _Sharḥ al-ʿAqāid_ and its super-commentaries by Musa Khayālī (d. 862/1457) and Ramazan Efendi al-Ḥanafī (d. 1025/1616?). This study analyzes prospective teachers’ digital citizenship behaviour norms. The sample consists of the seventeen prospective teachers who studied at the University Of Gaziantep Faculty Of Education in the academic year 2009-2010. Qualitative methods were utilized in the collection and the analysis of data. The results indicated the teachers adequately demonstrated behaviour norms regarding digital communication and digital literacy, yet only few showed behaviour norms concerning digital access, digital etiquette, digital commerce, digital rights and responsibilities, digital law, digital health and (...) wellness, and digital security categories. Therefore, these results highlight the fact that the digital citizenship behaviour norms should be included in teacher training programs in Turkey. (shrink)

PREFACE WORD -/- Hilmi Ziya Ülken was born and educated in Istanbul during the last period of the Ottoman Empire and worked in many fields of the intellectual life of the newly established Republic. Although he was interested in many fields of social sciences, he gained fame in the fields of Turkish thought and Islamic philosophy, and undertook important tasks in revealing and introducing medieval Islamic thinkers and post-Tanzimat Turkish thought. Again, due to his deep knowledge of Eastern and Western (...) philosophies, he was a thinker who made comparative studies and revealed the similarities and differences in both cultures. Apart from philosophy, which is his main field of interest, he also wrote works in the fields of sociology, anthropology, logic, history, novels, poetry, painting, miniature painting and even calligraphy. Ülken served as a bridge to the disconnect in our culture due to the Alphabet Revolution through the works he wrote and the students he trained. He made great contributions to Turkish-Islamic thought with his maturity period works, especially when he was a faculty member in the field of systematic philosophy at Ankara University Faculty of Theology. The philosophy of being, which constitutes the main axis of our study, is intertwined with metaphysics and ontology. Metaphysics, which deals with the question of "what being is", and ontology, which seeks to answer the question of "what kind of the same things exist in essence", are closely related; in fact, it is almost impossible to separate these two fields. Metaphysics, or the philosophy of being, is the most important and yet the most problematic field of philosophy. This is because throughout the history of philosophy there are many philosophers who do not see metaphysics as a field of philosophy. Especially in the Enlightenment period, metaphysics was seen as unobservable and incapable of meaningful discourse because it included topics such as God, the soul and universals. Some positivist thinkers even saw metaphysics as a continuation of animist discourse, the biggest obstacle to progress and Enlightenment, and criticized it severely. As a continuation of this understanding, metaphysics has been viewed negatively in our country since the early years of the Republic, and some philosophers have ignored an important field of philosophy by saying, "Metaphysics is not philosophy; philosophy is not metaphysics." In fact, in contemporary Western philosophy, Heidegger, Heidegger, Heidegger, Heidegger, Heidegger, Heidegger, Heidegger, Heidegger, Heidegger, Heidegger, Heidegger. In fact, in contemporary Western philosophy, philosophers such as Heidegger (1889-1976), Sartre (1905-1980) and Merleau-Ponty (1908-1961) attempted to demolish metaphysics in order to solve the problem of existence, but in doing so they themselves had to do metaphysics. When we ignore metaphysics, we ignore an important field of philosophy and an important function of the philosopher. Because in the pithy words of Ibn Rushd (1126-1198), "Man is a being who does metaphysics." Again, according to the Andalusian philosopher Ibn Bâjce (1077-1139), a virtuous society is one that emphasizes the metaphysical dimension of human beings. Although Ülken grew up in a period when metaphysics was viewed negatively, he wrote many works in this field and attached great importance to metaphysics. In fact, one of his first works was Metaphysics (1928), which is important in this respect. In addition, one of his mature works, Being and Becoming (1968), which is a summary of his philosophy, also shows the importance he attached to metaphysics. Ülken attached great importance to the philosophy of being (ontology) in his philosophical studies. He even wrote on this subject in his Felsefe Dersleri: Bilgi ve Vücûd Nazariyeleri (Metafizik) (Philosophy Lectures: Knowledge and Body Theory -Metaphysics) (1928), Aşk Ahlâkı (Love Ethics) (1931), İnsanî Vatanperverlik (Humanitarian Patriotism) (1933), and Varlık ve Oluş (Being and Becoming) (1968). These works on ontology are among the first publications in his field in Turkish. According to him, the basic subject of philosophy is existence. Other fields should be built on this philosophy. During our study, the most important problem was the change in Ülken's thought between his works. We also encountered difficulties such as the scattered nature of his works, the lack of a systematic system, the lack of methodological sensitivity in footnotes and citations, and the use of some terms in their original form instead of their Turkish equivalents. BackgroundIn terms of ethical decision making, every clinical case, when seen as an ethical problem, may be analyzed by means of four topics: medical indications, patient preferences, quality of life, contextual features. The aim of this study was to compare the performance of 4th year dental students on Ethical Decision Making before and after a course on ethics.MethodsFourth year dental students from academic year 2013–2014 participated in the study. A 3-h lecture, which was about four topics approach to clinical ethical (...) case analysis, was given to the students. The lecture was based on case scenarios related with dental ethics. After the completion of lectures,a case scenario was presented to the students to assess their ethical decision making abilities. At the end of the exam, four topics and ethical judgment were evaluated. Their performances on this examination were evaluated before and after lectures. Statistical evaluation was performed with the significance level set at p 0.05). The mean total score of the students after the course was significantly higher than before course.ConclusionMore lectures should be implemented to the curriculum to increase the student awareness of ethical issues and to reach the ultimate goals of dental education. In this article, the conceptions of prophethood of Peripatetic philosophers and Spinoza are discussed comparatively. Prophethood, one of the most original theories of Islamic philosophy, was discussed by the Peripatetic philosophers in connection with the theory of emanation, together with metaphysics, epistemology, ethics and politics. Al-Fārābī was the first Islamic philosopher to systematize the theory of prophethood with the Active Intellect and the faculty of imagination. After him, all Islamic philosophers dealt with the subject of prophethood in one way or (...) another. Like many Western philosophers, the New Age philosopher Spinoza was also influenced by the Peripatetic theory of prophethood. He explained prophethood in terms of the faculty of imagination and miracles; he also emphasized that prophets were chosen people and their messages were universal, unlike the linguistic perception of Western thought. This paper outlines the methodology and experiments associated with the reshaping of human intentions based on robot movements within Human-Robot Interactions. Although studies on estimating human intentions are well studied in the literature, reshaping intentions through robot-initiated interactions is a new significant branching in the field of HRI. In this paper, we analyze how estimated human intentions can intentionally change through cooperation with mobile robots in real Human-Robot environments. This paper proposes an intention-reshaping system that includes either the Observable Operator (...) Models or Hidden Markov Models to estimate human intention and decide which moves a robot should perform to reshape previously estimated human intentions into desired ones. At the low level, the system needs to track the locations of all mobile agents using cameras. We test our system on videos taken in a real HRI environment that has been developed as our experimental setup. The results show that OOMs are faster than HMMs and both models give correct decisions for testing sequences. (shrink)

One of the important aspects of the classical kalām is that the philosophical topics related to physics and cosmology, namely daqīq or laṭīf al-kalām, have an important place in it. The reason for the involvement of the kalām scholars (mutakallimūn) in these kinds of issues is commonly regarded as an effort to defend Islamic beliefs against other religions and thought systems. However, when their studies are examined closely, the complexity of their concepts and theories, as well as the fact that (...) they discussed these matters not only with opposing groups but also among themselves, show that kalām had a much deeper and integrated relationship with science and philosophy in the classical period. Their engagement with philosophical and scientific matters, such body (jism), substance/atom (jawhar), accident (ʿaraḍ), motion, space, time, and causality dates back to the mid-8th century and displays great diversity. Although the mutakallimūn probably were the first ones to deal with physics-related issues in Islamic thought, it cannot be said that they are given the importance they deserve in modern studies pertaining to the history of science and philosophy in Islamic thought. The fact that, in kalām works, physics-related questions were generally discussed along with theological matters has caused the scholarship of mutakallimūn to be regarded as an adjunct of apologetic discipline and has thereby led to a limited description of kalām’s relationship with science and philosophy in the classical period. This set of circumstances hinders a proper understanding of how science and philosophy emerged and evolved in Islamic thought. In the present article, I will attempt to present the place and role of physical topics, namely daqīq or laṭīf al-kalām, in classical kalām, between the 9th and 11th centuries. Firstly, I will show how the classical mutakallimūn divided kalām into two parts, namely ‘major’ (jalīl) matters, which are based on revelation, and ‘subtle’ (daqīq) or ‘obscure’ (laṭīf) matters, which mainly depend on reason. Matters surrounding jalīl al-kalām indicate the theological problems on which the mutakallimūn had a general agreement, such as God’s oneness, revelation, prophethood, and eschatology. Questions discussed under the category of daqīq or laṭīf al-kalām mostly correspond to philosophical and scientific issues concerning epistemology, physics, and cosmology. Secondly, I will examine to what extent the mutakallimūn dealt with physical sciences and what kind of topics were primarily discussed in the field of daqīq or laṭīf al-kalām. The upshot of this will be that the claim that the mutakallimūn were interested in physics and cosmology merely for apologetic purposes is unsound; rather, in the 9th and 10th centuries, many Muslim theologians also concerned themselves with issues such as motion, void, body, and causality as truth seekers. That being the case, the mutakallimūn should be taken into consideration in studies related to the emergence and rise of science and philosophy in Islamic thought. (shrink)

It has long been suspected that attentional processes differ between olfaction and the other senses. Here, we test whether voluntary dishabituation, seen, for example, when we re-attend to the ticking of a clock, can occur in olfaction. Participants were seated in an odorized room, where at various intervals they had to evaluate what they could smell. An experimental group had one nostril open and the other closed, except during the evaluations, so that the closed side was subject to centrally driven (...) habituation, but not peripheral adaptation. A control group had both nostrils closed except during evaluations. Following exposure, the experimental group could not report the room's odor in either the centrally habituated nostril or the nostril that remained open, while the control group could. This effect could result from a number of causes, including olfaction's unique neuroanatomy, functional constraints imposed by detecting volatile chemicals, and as a consequence of limited cortical resources, with implications for the functional value of consciousness. In this paper, we propose some transfor mations based on the centroid points between single valued neutrosophic numbers. We introduce these trans formations according to truth, indeterminacy and falsity value of single valued neutrosophic numbers. We propose a new similarity measure based on falsity value between single valued neutrosophic sets. Then we prove some properties on new similarity measure based on falsity value between falsity value between single valued neutrosophic sets. Furthermore, we propose similarity measure based on falsity value between (...) single valued neutrosophic sets based on the centroid points of transformed single valued neutrosophic numbers. We also apply the proposed similarity measure between single valued neutrosophic sets to deal with pattern recognition problems. (shrink)
