Emergency situations cannot be defined as situations in which a person is facing contradictory moral duties. Rather, they are situations in which an asset secured also by moral norms is in imminent danger so that the situation is perceived as existentially threatening for a person, either by the person herself or by someone else, for reasons comprehensible also for a third person. Hence, emergency situations call for an emergency ethics since in an emergency situation an action can be morally permissible (...) that would not be permissible in a different situation. As I will show in this paper, whether an action is morally permissible in such an emergency situation that would not be permissible in a different situation depends on five conditions. These conditions are individually necessary and jointly sufficient for the moral permissibility of an action that would be morally forbidden if they were not fulfilled. (shrink)

Lässt sich Kunst definieren? Von vielen analytischen Kunstphilosophen wird das bezweifelt. Für sie ist der Kunstbegriff ein “offener Begriff”, der auf unterschiedlichste Phänomene angewandt werden kann, selbst wenn diese keine gemeinsame Eigenschaft miteinander verbindet. Wer danach fragt, was Kunst denn eigentlich sei, verkennt in ihren Augen das Wesen des Kunstbegriffs. Träfe diese Auffassung zu, wären philosophische Theorien über das Wesen der Kunst bloße Spekulation. Der Streit um den Kunstbegriff, der bis heute nicht beigelegt ist, ist deshalb ein Streit um die (...) Grundlagen und die Möglichkeit einer Ästhetik der Kunst. Der Band stellt die wichtigsten Protagonisten dieses Streits in Aufsätzen vor, die hier größtenteils zum ersten Mal in deutscher Übersetzung vorliegen. Er enthält Beiträge von Berys Gaut, William E. In this paper a standard that can enable us to judge the alleged legitimacy of an interventional war is proposed. The paper consists of three parts. In the first part, it is shown that the opinion that waging a war is illegitimate in every case cannot be reconciled with the legitimacy of individual and collective self-defence, which is widely accepted in all civilizations. For this reason the second part specifies, in accordance with traditional just-war theory, six conditions of a justified (...) war and substantiates the view that assistance in an emergency is the only reason that can, under certain circumstances, morally justify a war of aggression. In the third part the term ‘humanitarian intervention’ is defined by stating special legitimacy conditions that must be satisfied to make a war of aggression a humanitarian intervention and by rejecting an influential objection against the legitimacy of such an interventional war. Hitherto, ethics has barely addressed the normative significance of time and timeliness themselves. This contribution first distinguishes between four elementary respects in which time is normatively significant. This is followed by an investigation into the temporal dimension of distributive, restitutive, and retributive justice. It is shown that aspects of temporal duration and intervals are every bit as relevant for a theory of justice as are the finiteness of human life and of interpersonal relations.

Gibt es Bedingungen gerechten Handelns, die die Politik zu beachten hat? Namhafte Philosophen aus dem deutschen Sprachraum begründen in diesem Buch, warum sich politisches Handeln am Maßstab der Gerechtigkeit orientieren muss, und zeigen am Beispiel aktueller politischer Probleme, welchen Beitrag die Philosophie zur Klärung der Prinzipien einer gerechten Politik zu leisten vermag.

Weder Machttheorien noch Willens- oder Eigentumstheorien können den Anspruch, den ein Staat auf sein Territorium erhebt, überzeugend begründen. Die Gebietshoheit von Staaten sollte vielmehr als ein Mittel zum Zweck der Gewähr von Rechtsstaatlichkeit, Partizipationschancen und Menschenrechten begriffen werden. Ein bestimmter territorialer Status quo lässt sich demnach genau dann als ungerecht ausweisen, wenn er der Erfüllung dieses Zwecks entgegensteht. Ein Recht zur Veränderung staatlicher Grenzen ergibt sich dann als ein Notwehrrecht, das die erfolglose Ausschöpfung aller milderen Mittel zur Voraussetzung hat.

In aesthetics a misleading idea of autonomy prevails: art is autonomous because it does not serve any heteronomous purposes. This conviction is deeply rooted in the philosophy of art from Romanticism to Heidegger and Adorno. However, it is not convincing because art is functional in various ways. It can have a variety of very different purposes – including some that the artist does not approve. Against this background, the article focuses on a peculiarity of modern aesthetics which has not been (...) noticed so far: the development of the modern concept of art has made the category of the mistake almost disappear. Works of art are taken to be something given which is not supposed to be examined for mistakes but to be explained and made understandable by the artistic decisions they are based on. By reflecting this peculiarity, the author develops an understanding of the autonomy of art as a normative artistic competence, which is compatible with the functionality of works of art and can help to clarify the social importance of art.
