On Typology and Deontics of Private Institutes of Law. In continuation of my treatise "Grundlegung zu einer Strukturtheorie des Rechts" Part I of this paper develops a typology of the fundamental patterns of institutes of law belonging to the relations of persons to move (movable or fixed)) assets. In Part II some reflections deal with the deontics of Gestalten of actions (in the sense of Part I) and related models in economics.

In 1926, Mally proposed the first formal deontic system. As Mally and others soon realized, this system had some rather strange consequences. We show that the strangeness of Mally's system is not so much due to Mally's informal deontic principles as to the fact that he formalized those principles in terms of the propositional calculus. If they are formalized in terms of relevant logic rather than classical logic, one obtains a system which is related to Anderson's relevant deontic logic and (...) not nearly as strange as Mally's own system. The existing literature treats of several investigations with a certain bearing on the question which is roughly indicated by the title “Imperatives and Logic.” Some of those investigations, however, are entirely outside the scope of the present work.Mally sets himself the task of developing a “Logik des Willens” constituting a parallel to the usual logic, the “Logik des Denkens". In order to emphasize its independence, the author also calls this “Logik des Willens” “Deontik”, and he conceives it as being (...) based on the “Wesensgesetze” of will in the same way as the usual logic is conceived as being based on the “Wesensgesetze” of thought. The author develops a formalistic deductive system on the basis of 5 axioms of demands, including the axiom that there is at least one fact which is unconditionally demanded, and through a lengthy series of theorems he arrives at the sentence that what is unconditionally demanded is identical with what is actually the case: “was sein soll, ist Tatsache”. Similarly, the author develops a system of axioms for “right” volition, including the axiom that right volition is non-contradictory. (shrink)

Deontic logic is an area of logic which investigates normative concepts, systems of norms, and normative reasoning. The word ‘deontic’ is derived from the Greek expression ‘déon’, which means ‘what is binding’ or ‘proper’. Thus, Jeremy Bentham used the word ‘deontology’ for “the science of morality,” and the Austrian philosopher Ernst Mally, who developed in the 1920s a system of the “fundamental principles the logic of ought,” called his theory ‘Deontik’. Normative concepts include the concepts of obligation (ought), permission (...) (may), prohibition (may not), and related notions, such as the concept of right. Systems of deontic logic contain, in addition to the usual sentential connectives and quantifiers, logical constants which represent some of these normative concepts. (shrink)

Als Schiiler Ernst Mallys hatte ich das Gluck, mitzuerleben, wie sich urn 1930 die Philosophie Mallys von der reichen Vielfalt der Meinongschen Lehre zu eigenen geschlosseneren Konturen wandelte. Es folgten Jahre intensiven Weiterbaus bis zum Todesjahr 1944. Durch widrige Um­ sHinde, Krankheit und Krieg, kamen Mallys Erkenntnisse nicht zu brei­ terer Wirkung. Urn so erfreulicher ist es, daB im Jahre des 25. Todestages und 90. Geburtstages ein Kreis Interessierter zusammenfand, urn ein Opus postumum MalIys, ein groBes logisches Fragment, von Mally (...) einmal Schwanberger Logik genannt, herauszugeben, das in den letzten Lebens­ jahren des Philosophen entstand. Auf Anregung von Professor Dr. Roderick M. Chisholm (Brown University, Rhode Island) wird gleich­ zeitig auch ein 'basic work' der Deontik, Mallys Grundgesetze des Sol/ens aus dem Jahr 1926, im Neudruck publiziert. Damit ist auch Gelegenheit gegeben, eine erste zusammenfassende Darstellung uber die Philosophie Mallys mit Schriftenverzeichnis etc. zu veroffentlichen, so daB diese Edition auch als Gedenkschrift fUr Mally gelten kann.
