This book examines the role of the EU in ensuring privacy and data protection on the internet. It describes and demonstrates the importance of privacy and data protection for our democracies and how the enjoyment of these rights is challenged by, particularly, big data and mass surveillance. The book takes the perspective of the EU mandate under Article 16 TFEU. It analyses the contributions of the specific actors and roles within the EU framework: the judiciary, the EU legislator, the independent (...) supervisory authorities, the cooperation mechanisms of these authorities, as well as the EU as actor in the external domain. Article 16 TFEU enables the Court of the Justice of the EU to play its role as constitutional court and to set high standards for fundamental rights protection. It obliges the European Parliament and the Council to lay down legislation that encompasses all processing of personal data. It confirms control by independent supervisory authorities as an essential element of data protection and it gives the EU a strong mandate to act in the global arena. The analysis shows that EU powers can be successfully used in a legitimate and effective manner and that this subject could be a success story for the EU, in times of widespread euroskepsis. It demonstrates that the Member States remain important players in ensuring privacy and data protection. In order to be a success story, the key stakeholders should be prepared to go the extra mile, so it is argued in the book. The book is based on academic research for which the author received a double doctorate at the University of Amsterdam and the Vrije Universiteit Brussels. It builds on a long inside experience within the European institutions, as well as within the community of data protection and data protection authorities. It is a must read in a time where the setting of EU privacy and data protection is changing dramatically, not only as a result of the rapidly evolving information society, but also because of important legal developments such as the entry into force of the General Data Protection Regulation. This book will appeal to all those who are in some way involved in making this regulation work. It will also appeal to people interested in the institutional framework of the European Union and in the role of the Union of promoting fundamental rights, also in the wider world.. (shrink)

The article is a response to Dana Robert’s keynote address “One Christ – Many witnesses: Visions of Mission and Unity, Edinburgh and Beyond” at the Celebration Symposium of the Regnum Edinburgh Centenary Series, 4 September 2015 in Oxford. The author wonders whether Dana Robert has sufficiently taken into account the awareness in the World Council of Churches of the diversity in and among Christian traditions. He highlights the more dynamic understanding of unity, which does not find expression in new structures (...) but in a commitment to travel together in a pilgrimage of justice and peace. (shrink)

Research into television's ethical value has mostly focused on scandal genres, such as Big Brother, Jersey Shore, and Jerry Springer. Only recently have researchers started to explore television's moral content with a broader focus. In this study we explore and describe the types of morality and moral content of a night of Dutch prime time television with an open and inductive approach through a qualitative content analysis. Our results revealed 13 types of morality and a basic differentiation between morals that (...) react on violations and transgressions, focusing on restricting behavior, and morals that are focused on ideals and values and stimulate social behavior. Lastly, we differentiated three moral meta-themes that permeate all genres, as well as six moral themes that arose only in specific genre-clusters. (shrink)

In recent publications, Harré and Llored Challenges of cultural psychology, Routledge, London, pp 189–206, 2018a; Philosophy, 93:167–186, 2018b; The analysis of practices, Cambridge Scholars Publishing, Newcastle upon Tyne, 2019) take the role of philosophy of science as a digging out of the ‘hinges’, that are the tacit elements of a discipline. In this perspective, the philosophy of chemistry consists, at least partly, in making explicit the hinges on which chemistry turns and in examining their origins and logical status. In this (...) paper, we propose to query Harré and Llored’s research approach in the case study of the element chlorine. Whereas most early nineteenth-century textbooks define the element as the endpoint of chemical decomposition, the controversy surrounding the element chlorine reveals implicit criteria that surpass operational indivisibility. From 1810 onwards, Davy argued that chlorine was a simple substance; yet, even though it had been known to be indecomposable using the strongest instruments available, the widespread acceptance of chlorine took until 1816–1818. The main factor that contributed to the resolution of the debate was the discovery of iodine, an analogous element which provided new theoretical coherence between explanations of different phenomena :247–258, 1959). Thus, the idea that elements should qualitatively resemble each other is an implicit belief which appears to have been shared by many prominent chemists of the time, despite the fact that it was not stated as part of the definition of the chemical element. Could we assert that this idea was a ‘hinge’ around which the notion of chemical element revolved? Our talk will answer this question. (shrink)

Around fifteen years before the chemical substance alumina could be decomposed in the laboratory, it was identified as a compound and predicted to contain a new element called ‘aluminium’. Using this episode from early nineteenth-century chemistry as a case study for the use of analogical reasoning in science, this paper examines how chemists relied on chemical classifications for the prediction of aluminium. I argue that chemists supplemented direct evidence of chemical decomposition with analogical inferences in order to evaluate the composition (...) of substances. Since they were established on the basis of relevant similarities in chemical properties, classifications were taken to reflect so-called ‘chemical analogies’ between substances. In combination with the knowledge that analogous properties indicated similarities in composition, this enabled chemists to infer the composition of experimentally indecomposable substances by analogy. The trust in such analogical inferences, even if they could not be confirmed through experiment, was justified by pragmatic considerations. Whereas the possibility of decomposing a substance depended on the available laboratory techniques, chemical analogies were thought to last independently of internal composition. It was therefore more practical to keep well-established classes of substances together rather than separate them on the basis of experimental results that might evolve as new techniques were developed. Besides highlighting the links between analogical reasoning and classification, this paper also illustrates the importance of analogy in the evaluation of elementary nature in the early nineteenth century. In many European countries the question of cultural identity has gained special importance due to the increase of globalization, the position of the United States, and the European unification. How can political leaders deal with these developments without alienating their people? In what ways do they express national identity in popular communication? Is nationalism a characteristic of their rhetoric? These questions are asked in regard to thirty-six New Year's speeches held by the last five French presidents. By answering these questions (...) we will develop a perspective on the concepts of national identity and nationalism. Discourse analysis shows a typical discourse for every president, in which nationalist rhetoric appears to play a role. Above all, differences between three structures of significance, or frames, are distinguished, which can be described as ‘sense of belonging’ or ‘paternal protection’, ‘the myth of French values’, and ‘the significant other’. This article aims to examine existential meaning constructions from an action theoretical perspective in a specific Internet environment: the personal homepage. Personal homepages are on-line multi-media documents addressing the question ‘Who am I?’ Authors of personal homepages provide information on both their personal and public identity. These identity constructions sometimes include reflections on the meaning of life. Answers to questions on the meaning of life reflect the way in which individuals assign ultimate meanings to human life, and consist of three (...) key components: orientation, beliefs, and experience. This paper aims to examine existential meaning constructions from a action theoretical perspective in a specific Internet environment: the personal homepage. Findings are reported of a qualitative content analysis of answers to the meaning of life provided in a sample of 42 personal homepages. We found that most answers to the meaning of life could be interpreted either as ‘divine/religious’, ‘experience centered’, ‘cosmic’, or ‘social utopian’. The answers provided on the homepages showed similarities with findings reported in other studies on existential meaning. In addition, we found that this Internet environment offers new venues for expressing orientation, beliefs, and experience reflecting answers to the meaning of life. (shrink)

De acordo com BL. Hijmans, diante da pergunta sobre o caráter filosófico do pensamento de Epicteto é possível afirmar que ele não se constitua, de fato, como uma filosofia. Para Hijmans, o estoicismo epictetiano é construído a partir de um conjunto de crenças inquestionáveis que têm como base a relação de submissão a um princípio divino responsável por criar e comandar o cosmos. Por esse motivo, Hijmans afirma que faltam dois elementos ao pensamento de Epicteto para caracterizá-lo (...) como filosofia, são eles: o sentimento de maravilhamento ou perplexidade típico de uma reflexão filosófica e a capacidade de autocrítica. Nesse sentido, nosso artigo irá propor duas objeções aos argumentos de Hijmans com o intuito de demonstrar que o estoicismo de Epicteto detém as características necessárias para ser considerado, de fato, filosofia.
