The United Nations has shown recurrent inability to respond to international threats caused by severe human rights violations and thus failed to perform one of its main function—preservation of international peace and security in the world. This evidenced gaps in the United Nations, caused mainly by the veto right in the voting system within the Security Council and limited powers of the General Assembly. The international community gave a twofold answer to this problem: radical humanitarian intervention and the recent concept (...) of the responsibility to protect. The main problem with regard to humanitarian intervention is its legality—its compliance with the prohibition of the use of force. The responsibility to protect does not clash with the prohibition of the use of force, but its legal implications are rather vague—being intensively discussed in the international forum, the responsibility to protect has not yet appeared in any legally binding international document. This article discusses the legal significance of humanitarian intervention and the responsibility to protect, and aims to determine how they affect, if at all, the regulation of the use of force in the international relations, as well as how they respond to the issue of large scale atrocities in the world. U novije vrijeme smatra se da učitelji imaju ključnu ulogu u suočavanju s problemom vršnjačkog nasilja, a za kvalitetne intervencije važna je kompetentnost učitelja. Cilj ovog istraživanja je ispitati odnos kompetentnosti i percipirane ozbiljnosti nasilne situacije u predviđanju intervencija učitelja u slučajevima vršnjačkog nasilja. Istraživanje je provedeno na nacionalno reprezentativnom uzorku učitelja osnovnih škola u Republici Hrvatskoj, prosječne dobi 43 godine. Za prikupljanje podataka, uz upitnik sociodemografskih karakteristika, korištene su Vinjete te Skala samoprocjene kompetentnosti za rad učitelja na problemima (...) vršnjačkog nasilja. Uz analizu temeljnih odrednica kompetentnosti utvrđeno je da će učitelji koji su kompetentniji procjenjivati nasilje ozbiljnije od svojih manje kompetentnih kolega, a oni koji nasilje percipiraju ozbiljnije češće će i intervenirati. Rezultati pokazuju da kompetentnost ima značajnu prediktivnu ulogu u predviđanju intervencija, a u tom odnosu ozbiljnost nasilja ima moderatorski efekt. Najnižu vjerojatnost intervencije imaju učitelji s niskom kompetentnosti i niskom percepcijom ozbiljnosti nasilja, a najvišu vjerojatnost intervencije imaju učitelji koji imaju visoke razine kompetentnosti i procjenjuju nasilje ozbiljnim. Uz temeljno određenje kompetentnosti, ovaj rad nudi i relevantne smjernice za edukaciju učitelja. Since the fall of the Berlin wall, the process of globalization has been understood as a necessary fate. The myth of the almightiness of the market economy, liberalization and deregulation is revitalized. Before us, there is a phenomenon Lacan?s discourse of University, which in 20 century was firstly given as a Stalinist discourse and today is given as a neo-liberal discourse of globalization. From underneath og a seeming objectivity, a Master insists-either the Party and the Capital. Just as the utopia (...) of the world proletarian revolution has fallen apart, the utopia of globalize capitalism and liberal democracy is also falling apart. The 9/11 event is opening opportunities for a construction of the field of social and political, out of the contour of the status quo. The coordinates of the possibility has changed and if we take the non-existence of the grand Autre on ourselves, then the contingence interference in the existent socio-symbolic order is possible. Posle pada berlinskog zida proces globalizacije je shvatan kao nuzna sudbina Revitaliziran je mit svemogucnosti trzisne privrede, liberalizacije i deregulacije. Ovaj fenomen moze se razumeti kroz diskurs Lacanovog "Univerziteta", koji se u 20. stolecu prvo prikazivao kao staljinisticki diskurs, a danas kao neoliberalisticki diskurs globalizacije. Uvek se ispod prividne objektivnosti univerzitetskog diskursa pokazuje Gospodar - ili Partija ili Kapital. Isto kao sto je propala utopija svetske proleterske revolucije, raspada se i utopija univerzaliziranog globaliziranog kapitalizma i liberalne demokratije. Dogadjaj od 11. septembra otvara mogucnosti za konstrukciju terena drustvenog i politickog izvan kontura status quo. Koordinate moguceg promenile su se i ako uzmemo na sebe ne-egzistenciju velikog Drugog, moguca je kontingentna intervencija u postojeci drustveno-simbolicni poredak. (shrink)

Istraživanje daje uvid u glavne dimenzije i aspekte roditeljskog ponašanja roditelja djece s poremećajem iz spektra autizma s obzirom na prisutnost/neprisutnost nepoželjnih ponašanja djece, temeljem samoprocjene. Istraživanje je provedeno na uzorku od N=121 roditelja djece s PSA iz Dalmacije. Rezultati su ukazali na prisutnost restriktivne kontrole i kažnjavanja kada su prisutna nepoželjna ponašanja, dok roditelji čija djeca nemaju nepoželjna ponašanja pokazuju više autonomije za svoje dijete, imaju veće roditeljsko znanje i primjenjuju induktivno rezoniranje. U raspravi se ističe značaj osobnih karakteristika (...) roditelja i partnerstva, kvalitete podrške te znanstveno utemeljenih intervencija i roditeljskog znanja za roditeljsko ponašanje. Predlažu se smjernice za učinkovite intervencije na nepoželjna ponašanja djeteta te poželjne odrednice roditeljskog ponašanja. Također, navode se ograničenja provedenog istraživanja i prijedlozi za buduća istraživanja. The research provides insight into the main dimensions and aspects of behavior of parents of children with autism spectrum disorder with regard to the presence/absence of challenging behavior patterns in children, according to the parents’ self-assessment. The research was conducted on a sample of N=121 parents of children with autism spectrum disorder from the Croatian region of Dalmatia. The results indicate the presence of such parental behaviors as restrictive control and punishment when challenging behaviours are present. On the other hand, the parents whose children do not exhibit challenging behaviors give their child more autonomy, have greater parental knowledge and apply inductive reasoning. The discussion section of the paper emphasizes the importance of parents’ personal characteristics and partnerships, the quality of support, scientifically based interventions, and parental knowledge for parental behavior. Guidelines for empowering parents on effective interventions in cases of challenging behaviors, desirable determinants and aspects of parental behavior, work on personal growth and the quality of relationships are proposed along with suggestions for future research as well as limitations of the conducted research. Autor secira polemiku otvorenu osvrtom Tončija Matulića na knjigu Darka Polšeka Sudbina odabranih objavljenom u Filozofskim istraživanjima 98/2005: 671-693. Okosnica ovoga članka je seciranje Matulićevih stavova kako nema bitne razlike između stare eugenike i nove, i njegovih sveobuhvatnih antiliberalnih, paternalističkih i navodno „bioetičkih“ argumenata. Polšek koristi argumentaciju J. S. Milla iz djela O slobodi i tvrdi da demokratsko i pravedno društvo mora poštivati i „puke želje“ budućih roditelja u ostvarenju njihovih prava da odgajaju djecu, kao i da bude u mogućnosti, (...) između ostalog, izbjeći daleko veće opasnosti kolektivizma i svih vrsta intervencija države u privatne stvari što je i iznjedrilo sve ružne oblike eugenika u prošlosti. Štoviše, Polšek raspravlja o tome da svatko treba poštivati te liberalne principe kako bi ozbiljno shvatio neosporne principe bioetike: osobnu autonomiju, neovisnost i jednakost.The author dissects a polemic by Tonèi Matuliæ against Polšek’s book Sudbina odabranih printed in Filozofska istra®ivanja,98 , pp. 671–693. The main point of the article is a dissection of Matuliæ’s views that thereis no fundamental difference between old eugenics and new, and of his overall anti-liberal, paternalist,and allegedly ‘bioetical’ contentions. Polšek uses J. St. Mill’s arguments from On Libertyand argues that a democratic and a just society has to respect ‘mere wishes‘ of prospective parentswhen fulfilling their right to bear children, as to be able, among other things, to avoid far greaterdangers of collectivism and all sorts of state intervention in private matters, from which ugly formsof eugenics arose in the past. Moreover, Polšek argues that one has to respect these liberal principles in order to take seriously uncontested principlesof bioethics: of personal autonomy, independence, and equality. (shrink)

Razgovoru su presudno doprineli predstavnici beogradskog krila Praxis grupe, uz potonje, mahom neslavno, ucesce u dogadjajima, pre svega versko-gradjanskim ratovima; za razliku od glavne, zagrebacke?centrale? Cyber warfare is becoming a new reality with new battles fought everyday on virtual battlefields. For a century and a half, International Humanitarian Law has been a sentry for victims of wars guaranteeing their legal protection from the calamities of war, trying hard to respond to Clausewitz’s “chameleon of war”. Cyber conflict marks new chameleon’s colour together with the unmanned aerial vehicles, autonomic battle systems and other technologies deployed on battlefields. However, it would be greatly erroneous to claim that the (...) International Humanitarian Law may not apply to the new phenomena just because it is caused by the advanced technology. Even if the Geneva Conventions of 1949 are already sixty years old, the International Humanitarian Law in itself has at minimum customary response mechanism, granting, in a spirit of Marten’s clause, protection and authority of the principles of international law derived from established custom, from the principles of humanity and from dictates of public conscience (Protocol I). Notwithstanding, some more complicated fundamental issues also have to be addressed: how the use of cybernetic weapons and means may affect the classic notion of armed conflict? How it can be interpreted in the light of new technologies, i.e. can we still rely on a classic understanding of weapon’s kinetic effect as the main element, or shall we embrace effectsbased “Schmitt’s criteria”. If it so happens, will it make an act without apparent damage to a person/property equal to military hostilities, required by the armed conflict notion and justify the real-life response to it. The effective or overall control tests were used for the attribution of non-state actor’s activity to the state party of an armed conflict but these tests might not meet its purpose in the virtual battlefield of loose networks and open-source communities. If the concept of armed conflict is treated more flexibly, other changes (including issues of attribution) may follow, as well. Perhaps this is the way how the combatant institute will evolve. With classic combatant’s criteria impossible to apply on virtual battlefields, one of the options would be to elaborate concepts of “constant combat function” and “direct participation in hostilities” more precisely, as well as to reconsider state’s affiliation requirements. Environmental protection in times of armed conflicts, irrespective internal or international, is rarely considered as a prioritized concern. Due to the concept of state sovereignty, this is especially problematic when examining interaction of warfare and environmental protection in non-international hostilities. Not only it is challenging to find any exhaustive and explicit legal provisions regulating the matter, but this issue has also been forgotten by international legal scholars. Therefore, in this article the author reviews written and customary norms laid down in (...) documents of various branches of international law, such as international humanitarian law, human rights law, environmental law and international criminal law, which directly or by way of interpretation may favour environmental protection in times of internal armed conflict. This is to be done in order to gather information about the sufficiency of legal framework on preservation of the environment in times of noninternational armed conflicts. After doing this research, a few possible means to improve current legal framework are suggested. Numerous studies have confirmed the correlation between music education and child development. In some studies, musical activities based on rhythm have been highlighted as a means of stimulating children’s development in non-music domains. The paper deals with the role of the temporal dimension of music for both the musical and general development of the child. The text presents knowledge about the perception, processing, and performance of music rhythm, pulse, and meter, as well as the course of the rhythmic development of (...) the child. An overview is provided of the impact of rhythm-based music activities on non-music developmental domains together with recommendation for early work on rhythm. We emphasized the need to conduct experimental research to shed light on the role of rhythm in the development of the child and the rhythmic models applicable in child care institutions, including therapeutic and rehabilitation institutions. Enforced disappearance is not a new type of human rights violation. This phenomenon is taking place all over the world. Nevertheless, with the exception of the single provision in the Rome Statute, there is no universal legally binding document which would be applicable in all the cases of enforced disappearances. This article introduces the phenomenon of enforced disappearances, analyses its multiple nature, and overviews the latest developments in drafting legally binding documents within the UN framework.

The present article is a subjective commentary on the case Kononov v. Latvia dealt by the European Court of Human Rights, in particular drawing attention to the Courts intention not to regard context of the case as important for the substantial issues. Author considers this approach in a bigger picture of clash of historical and legal paradigms of the heritage of the Second World War in different countries (namely, Western Europe, Russia, the Baltic States). Author also discusses what impact Kononov (...) case might have on Soviet crimes prosecution in the future. (shrink)

The use of private military force by states has been a long-standing phenomena in the history of warfare. Armies of mercenaries, privateering and recruitment of foreign nationals into armed forces have been common during the Middle Ages and later on. However, with the invention of effective firearms and artillery, standing regular armies, conscription and other developments that resulted in the essential rise of costs of war, the role of private military entrepreneurs diminished. By the end of XIXth century the state (...) became almost the only subject that was able to wage a full-scale war. Nevertheless, already in the middle of the XXth century mercenarism has been reborn in Africa’s colonial and post-colonial wars. The end of the XXth century and the beginning of the XXI century witnesses an enormous rise of private security and military companies (PSMC) that are hired to perform different functions related to use of force not only by states, but also by other clients such as international organisations, transnational corporations, etc. A PSMC may be defined as a profit-seeking private enterprise, which is established according to the national law of the state and which is providing, on the basis of a contract, services directly or indirectly connected with the use of military force or its institutions whether in time of armed conflict or peace, notwithstanding how such company describes itself. International humanitarian law has no specific regulation of PSMC. Nevertheless, it would be erroneous to state that the activity of PSMC is not regulated, because international humanitarian law in any case, in one or another way, is applicable to the personnel of PSMC if it is engaged in armed conflict of either international or non-international character.
