This article refers to the analysis of types of entrapment while gathering evidence in criminal proceedings. Based on the analysis of the laws of criminal procedure, theory and judicial practice, one could say that entrapment, as absolutely impermissible action in the course of simulation of a criminal act, could not be seen as mere pressure, active enticement or instigation to engage in criminal activity by restricting a person’s freedom of choice. As it happens, it is possible to provoke a person (...) without any active enticement or instigation to engage in criminal activity. This could be regarded as passive, indirect type of entrapment. The gist of the latter – creating the effect of minimum risk, meaning that a person, without any active enticement or instigation to engage in criminal activity, is acting in the course of a simulated situation, by thinking that the criminal activity he or she is committing will never be discovered by law enforcement authorities. The identification of passive entrapment is quite complicated, as it requires the precise assessment of the relation between the conduct of law enforcement authorities, the criminal and the criminal act, by using subjective and objective criteria. This article summarizes recent work by epistemologists on four related problems. (1) The value of knowledge. Briefly, the problem is to explain why knowledge is, or at least appears to be, more valuable than any proper subset of its parts, such as true belief. (2) The value of understanding. The task here is to explain why understanding appears to be more valuable than any epistemic status that falls short of understanding, such as having knowledge without understanding. (3) Truth and epistemic (...) value. The arguments considered in this section have to do with whether truth is epistemically valuable at all, and whether it is the fundamental epistemic value. (4) Intrumentalism and the epistemic goal. This final section considers the instrumentalist view of epistemic reasons and rationality, and explains why instrumentalists formulate the epistemic goal in the ways they do. (shrink)

We first consider the entailment logic MC, based on meaning containment, which contains neither the Law of Excluded Middle (LEM) nor the Disjunctive Syllogism (DS). We then argue that the DS may be assumed at least on a similar basis as the assumption of the LEM, which is then justified over a finite domain or for a recursive property over an infinite domain. In the latter case, use is made of Mathematical Induction. We then show that an instance of the (...) LEM is intrumental in the proof of Cantor's Theorem, and we then argue that this is based on a more general form than can be reasonably justified. We briefly consider the impact of our approach on arithmetic and naive set theory, and compare it with intuitionist mathematics and briefly with recursive mathematics. Our "Four Basic Logical Issues" paper would provide useful background, the current paper being an application of the some of the ideas in it. (shrink)

Many have invoked the nihilism that is endemic of the age we call the anthropocene. Bernard Stiegler has articulated this sentiment by highlighting how anthropocene films are typically nihi listic, for example, Von Trier’s Melancholia. But if the age is characterized by a cultural pessi mism about the future of human kind, or again about its posthuman supersession, there is also a complementary symptom that corresponds to a strange optimism before the impasses of our age. This optimism, we find it (...) represented in another anthropocene film: Nolan’s Interstellar. This too is a film where the protagonists are faced with a world lacking a future, a world dying under the stresses caused by the human’s exploitation of nature. Here, instead of the mantra ‘Enjoy it while it lasts’, an opposing moral is repeated: ‘Don’t go gentle into that good night, Rage, rage against the dying of the light.’ In the film, Thomas’ poem is a tribute to prometheanism; the death of the earth will not mean the end of human life, it declares, the human will surpass all the limits of its ecosystem, the constraints of space time itself, and become pure hyperdimensional intelligence. The film echoes the superstitious optimism in the promise of technology we now find at the heart of contemporary movements such as accelerationism. This paper assesses the validity of this intrumentalization of optimism, drawing from Leibniz’s concept of compossibility and the cosmological anthropic principle. (shrink)

Oliver Marchart constructs an elaborate ontologization of the political that builds on theories developed by the Essex School while relying on Heideggerianism and Hegelianism. This original thought is a powerful and convincing attempt to think the ontology of the political without lapsing into a celebration of essentialist grounding or complete groundlessness, which are equally metaphysical and mutually supporting positions. Tensions arise within Marchart’s own thought when the notion of instrumentality appears to be inscribed solely on the side of politics or (...) the ontic. I suggest that a theory of practical judgment that is inchoate in Marchart’s own position can resolve the tensions toward constructing a genuinely materialist ontology. (shrink)
