The present paper deals with an investigation of the conception and development of the idea (principle) of proportionality, the variety of concepts and the procedure for the verification of the principle of proportionality. The genesis of the conception of coercive measures is studied by reviewing the process of the formation of the current principle of proportionality manifested in the historical sources of the law of Prussia, Germany, and the evolution of the principles consolidated in them. Quite often, for one or the other purpose, the fact (or phenomenon) that does not exist is presented to the society or individuals as the real, really existing although it (the fact or phenomenon) simply does not exist in the real life. And often the term “fiction” is used to describe such phenomena. Although fiction is considered an inseparable companion of a social life, the question arises what the actual (true) fiction is and whether the use of it in criminal (...) proceeding does not mean an intentional law maker’s (or the person’s applying the law) fraud, deceit directed towards the addressee of the applicable law. Fiction and its impact on criminal proceedings is analyzed in this article. Features, characterizing fiction are discussed here as well. (shrink)

The article investigates the problem of the truth as the purpose of the criminal procedure, the problem of its cognition. Individuals carrying out criminal procedure activities (including the court) are servants of the procedural form and, at the same time, its hostages, therefore they are unable to approach the objective, absolute truth and should be content with the formal (legal) truth. This position falls under criticism. Attempts to artificial segmentation of the truth to its separate categories or forms are nothing, (...) but justification of the procedural erosion of a certain form. The article offers the opinion that the classical criminal procedure shall establish absolute, not formal (legal) truth. The truth is not only an aspiration of the criminal procedure, but, at the same time, a derivative, regulatory principle, the idea that works only in classical criminal procedure. This principle does not work in quasi-processes, i. e. in those criminal procedure forms that are organically separated from the classical procedure form. (shrink)

Evidence for recombination suppression has been identified in linkage studies of several unstable DNA diseases. Also sex‐specific changes in recombination frequency have been detected at the loci of Huntington's disease and myotonic dystrophy. It can be hypothesized that meiotic recombination is regulated by genome‐wide genomic imprinting and that changes in meiotic recombination imply the presence of the genomic imprinting defect. If aberrant recombination at the locus of trinucleotide repeat expansion is verified, new theoretical and experimental opportunities will arise in studies (...) on the role of genomic imprinting in the unstable DNA diseases. This paper discusses the results of the international applied research project ‘UniDiversity – Universities Towards Diversity’ that examined what discriminatory attitudes, beliefs and behaviours based on sexual orientation, gender identity and sex characteristics (SOGISC) exist in the Lithuanian, Greek and Italian academic environment. Specifically, this paper analyses how LGBTI+ individuals conceive of different forms of discrimination in the Lithuanian academic environment. The paper fills the knowledge gap in terms of intolerance and discrimination against LGBTI+ individuals at Lithuanian higher education institutions (...) and provides its theoretical explanation. By focusing on the empirical data collected from survey and focus group interviews, the paper interprets them within the framework of both the sociopolitical context and theoretical debates about heteronormative attitudes. The paper argues that there exists a gap between the declarative openness to LGBTI+ people within Lithuanian universities and persisting stereotypes and discriminatory attitudes towards them. This article analyses implementation of freedom of assembly within Lithuania and in some other States of the European Union. Attention is paid to the differences in the implementation practices for this freedom while analysing probability of restriction of freedom of assembly in the light of legal, political and social factors. The article aims to substantiate that the quality of decision while adopting spreading ideas and expressed views during peaceful meetings, or adopting them later, or dismissing in general, is determined by (...) the democratic society being formed in the state during a particular period. On the other hand, although physical restriction of diffusion of ideas while implementing freedom of assembly is legitimate, it should not become the main control tool, since the development of the state in this direction is absolutely opposite to the expansion of democratic ideas in the society. Legal education should become the priority area of the policy conducted by the state. Particularly since this priority provides the security for the spread of best practices in democratic states, thus laying the grounds for effective prevention of expression of illegal behaviour. Such illegal behaviour may occur in the form of incitement of hatred and aggression in respect of persons who have different faith, race, nation or sexual orientation. The article substantiates that the real challenge faced by the modern democracy is security for practical implementation rather than the formal recognition and regulation of rights and freedoms. It has been found in practice that the implementation of freedom of assembly can be faulty restricted by the procedural justice. After evaluating experience of the States of the European Union and the way in which their national legal system is structured, the recommendations are made enabling a timely dispute settlement concerning the right of assembly, i.e., in order to prevent decision making process from becoming an obstacle for the implementation of freedom of assembly. It is pointed out that settlement of the dispute concerning the permission to hold a peaceful assembly after the date of the assembly is pointless and denies social importance of right of the assembly. Przedmiotem artykułu jest recepcja filozofii Schopenhauera w Czarodziejskiej górze – najbardziej znanej powieści Tomasza Manna. Wpływ Schopenhauera na twórczość Manna jest sprawą znaną i omawianą w różnych kontekstach przez historyków literatury niemieckiej. W tym przypadku relacja głównych protagonistów powieści Hansa Castorpa i Kławdii Chauchat, zostaje przedstawiona jako literacka „ilustracja” doktryny filozofa. Tomasz Mann posługuje się „mistyką ciała” jako próbą doświadczenia Schopenhauerowskiej transcendencji. Analogiczną funkcję w oparciu o estetykę Schopenhauera wypełnia w powieści muzyka. Czarodziejska góra zostaje ukazana jako przykład koncepcji artystycznej (...) wyrosłej z systemu filozofa, choć traktowany jest on raczej jako punkt wyjścia, a nie jako cel. (shrink)

These are: the realm of nature, the realm of rationality and (...) the realm of morality. In each of them there are possible two ways of existence, which the author calls respectively „normality” and „non-normality”. „Normality” and „non-normality” are collective notions, the former referring to ordinary life, devoid of metaphysical dimension and the latter to life that exceeds the phenomenal character of empirical reality. In characteristics of life called non-normality the author shows an optimistic trait of Schopenhauer’s philosophy of a human being. (shrink)

W filozofii od dawna trwa spór dotyczący podstaw moralności. Myśliciele tacy jak Arystoteles, Immanuel Kant, czy John Stuart Mill podstawową funkcję w podejmowaniu decyzji moralnych przypisują rozumowaniu. Z kolei David Hume oraz Artur Schopenhauer podkreślają pierwszoplanowe znaczenie emocji. Celem niniejszego tekstu jest rewizja sentymentalistycznej teorii moralności Hume’a i Schopenhauer’a w perspektywie 1) doniesień z badań analizujących pracę mózgu ludzkiego podczas podejmowania decyzji moralnych 2) roli neuronów lustrzanych 3) obserwacji zachowań empatycznych naczelnych. Badania te wnoszą w obszar etyki nową perspektywę, pozwalającą (...) spojrzeć na problem dotyczący powstania i rozwoju moralności w zupełnie innym świetle. (shrink)

Niniejszy artykuł stanowi próbę ukazania symboliki Aten w twórczości Lwa Szestowa. W tym celu autor odwołuje się do Szestowowskiej koncepcji rozumu, którą Rosjanin buduje w ramach refleksji nad dziejami myśli filozoficznej. Wedle autora Aten i Jerozolimy rozum (za pośrednictwem działalności przytłaczającej większości filozofów), wikła człowieka w poznanie narażone na rozmaite błędy epistemiczne. Rozum występuje wobec rzeczywistości z postulatami m.in. jedności, ścisłości oraz powszechnej obowiązywalności, które eliminują z horyzontu poznania zjawiska niejednoznaczne i wyjątkowe. Owe kategorie służące rozumowi do opisu rzeczywistości, wybrzmiały (...) w filozofii wielkich myślicieli: Talesa z Miletu, Sokratesa, Barucha Spinozy i Artura Schopenhauera. W artykule dokonana została analiza krytyki Szestowa względem idei głoszonych przez wskazanych myślicieli. (shrink)

This article intends to critically envisage limits and values of philosophy of art of Arthur Danto and to point out the main problems of the theory of supstitutional representation, when placed within wider theoretical frame of traditional aesthetics, such as the notion of meaning in the philosophy of art of Arthur Danto. The article focuses on the notions of exteral and interal representation and denotation of non-existent and existent entities substituted by representation. This article intends to question the validity of (...) Danto?s position. Ovaj tekst pokusava da kriticki sagleda domete i vrednosti filozofije umetnosti Artura Dantoa i da istakne osnovne probleme sa kojima supstituciona teorija reprezentacije mora da se suoci, kada se ona zastupa u sirem teorijskom okviru tradicionalne estetike, kakav je pojam znacenja u filozofiji umetnosti Artura Dantoa. Posebnu paznju tekst usmerava na pojmove eksteralne i interalne reprezentacije i denotacije nepostojecih i postojecih entiteta, koji se reprezentacijom supstituiraju. Autor nastoji pokazati da je stav koji Danto zastupa apsurdan. (shrink)

Tomasz Mann umieścił w Czarodziejskiej górze zdanie, które ma swoją historię. Wspomniał, że jego bohater Hans Castorp spędził cztery semestry jako student budowy okrętów na gdańskiej Politechnice. Zafascynowany tym zdaniem – i co nie bez znaczenia – urodzony w Gdańsku pisarz Paweł Huelle napisał powieść o gdańskim epizodzie bohatera Tomasza Manna, której nadał tytuł Castorp. Artykuł wskazuje na najistotniejsze motywy obu tych powieści w perspektywie pytania o ideę kultury. Jak wiadomo jedną z najważniejszych inspiracji w twórczości Manna jest filozofia Artura (...) Schopenhauera. Jego metafizykę woli, grę sił płodzenia i unicestwiania, uznaje Mann za projekt bardzo atrakcyjny artystycznie. Jednak projekt, który w ostatecznym rezultacie musi przynieść roztopienie jednostki w bezforemnym świecie metafizycznej woli, jest w ocenie Manna wrogi życiu i stanowi zagrożenie dla form kultury. Castorp, bohater literacki wydany na działanie ciemnych i ślepych sił woli, jest przykładem człowieka, który przyjmuje ten fakt do wiadomości, ale staje po stronie życia. Podejmuje próbę okiełznania tych sił i nadania im cywilizowanej i bardziej przyjaznej człowiekowi formy. Jest to próba walki o wartość życia, która w interpretacji Manna posiada charakter etyczny. W świetle filozofii Heinricha Rickerta bohater literacki Castorp to człowiek, który dąży do ulepszenia własnej natury i widzi w tym zadanie, które spełnia się w obszarze kultury. Swoje postępowanie i działanie chce podporządkować normom i trwałym wartościom, przyjmując tę postawę za nadrzędny imperatyw etyczny. Dąży do wypracowania pozaczasowych wartości jako przeciwwagi dla metafizycznego bytu woli. W szerszym kontekście obrazuje to proces, w którym transcendentny byt zostaje zastąpiony przez „transcendentną powinność”. (shrink)
