Based upon the concept of Law qualified in Monarchia, II.50, Dante was not only a general philosopher (a lover of knowledge) as well as a political disputant in his times, but also his primary contribution (not always obvious) in legal speculation could be demonstrated. In fact, if his thought reflected the platonic ordo sapientiae through a deep intersection between téchne and episteme (phronesis) toward a linguistic koiné, could we say the same thing on his concept of justice as a rational (...) ars boni et aequi? This essay aims to depict Dante as legal theorist of his times and theorist of Justice beyond them, adopting the hermeneutical point of view, not just as an interest into textual interpretation but referring his use of language as form of life and his works an inexhaustible sources of education for legal philosophy. The paper provides to give a minimal contribution about a typical argumentation scheme which called "ad hominem". Especially, this mode of conduct a dialogue and arguing towards an opponent has been revisited by not long past approaches on Argumentation Theory with the aim to re-legitimate it in logical context and re-consider its consequences in terms of validity, consistence and alethic thinking. Ad hominem argument is part of rational discussion and informs audience about the coherence between speaker and his favored thesis.

This paper attempts to look Francesco Gentile's concept of the Law under phenomenological point of view. Francesco Gentile (1936-2009) was full professor of Philosophy of Law at Padua University and Dean of School of Law; during his academic career, based on Roman Jurisprudentia and Christian message of Redemption, he developed a personal conception of law like "conversion the human conflict to interpersonal dispute". Then, in this paper, I want to observe this philosophical result, under biblical term "justification" connected (...) to Levinas' ethic, and I want to aim to revalue and exploit the problem of his systematic approach like a specific theory of Law. This brief essay would want to point out the soft-law as an useful device to study in deep the legal phenomenon by problematizing it into our current socio-economical reality. Then, it aims to consider this expression of special legal normativity in order to revaluate the role of interpreters in qualifying sources of Law.

Moving from a behavioral definition of intelligence, which describes it as the ability to adapt to the surrounding environment and deal effectively with new situations (Anastasi, 1986), this paper explains to what extent the performance obtained by ChatGPT in the linguistic domain can be considered as intelligent behavior and to what extent they cannot. It also explains in what sense the hypothesis of decoupling between cognitive and problem-solving abilities, proposed by Floridi (2017) and Floridi and Chiriatti (2020) should be interpreted. (...) The problem of symbolic grounding (Harnad, 1990) is then addressed to show the problematic relationship between ChatGPT and the natural environment, and thus the impossibility for it to understand the symbols it manipulates. To explain the reasons why ChatGPT does not succeed in this task, an investigation is carried out and a possible solution to the problem in the artificial domain is proposed by making a comparison with the natural ability of living beings to ground their own meanings from some basic cognitive-sensory aspects, which, it is explained, are directly related to the emergence of self-awareness in humans. Thus, the question is raised whether a possible and concrete solution to the Symbol Grounding Problem would involve in the artificial domain the development of cognitive abilities fully comparable to those of humans. Finally, I explain the difficulties that would have to be overcome before such a level could be reached, since human cognitive capacities are intimately linked to intersubjectivity and intercorporeality. This paper examines the role and power of the state in modernity and its transformation throughout it and into the present. First, it recognizes the centrality of the role of information control for the modern state constitution, which allows sovereign power to extend to the national level. Secondly, it discusses the shift of state power from a purely informational power to an informational and bargaining power, as well as the gradual transformation of sovereignty into governmentality. Finally, it analyzes the transformations (...) that have led to a critical loss of both powers by the state and have enabled their acquisition by tech corporations. It examines the implications of this shift in power and the consequent disempowerment of the state, defining the mode of operation of the power embodied by tech corporations as a regime of performativity, rephrasing the Foucauldian regime of truth, which presided over the ways in which governmental power was performed. Such a regime bases its power not on the ability to order discourse and knowledge, but on the ability to automate it, and to predict and manipulate human behaviors. In this way, it has disintermediated not only the state in its role as the primary informational agent, but also, to some extent, the ability of individuals to assert rights through their actions. Objective correlates—behavioral, functional, and neural—provide essential tools for the scientific study of consciousness. But reliance on these correlates should not lead to the ‘fallacy of misplaced objectivity’: the assumption that only objective properties should and can be accounted for objectively through science. Instead, what needs to be explained scientifically is what experience is intrinsically— its subjective properties—not just what we can do with it extrinsically. And it must be explained; otherwise the way experience feels would turn out to be magical (...) rather than physical. We argue that it is possible to account for subjective properties objectively once we move beyond cognitive functions and realize what experience is and how it is structured. Drawing on integrated information theory, we show how an objective science of the subjective can account, in strictly physical terms, for both the essential properties of every experience and the specific properties that make particular experiences feel the way they do. Understanding Institutions proposes a new unified theory of social institutions that combines the best insights of philosophers and social scientists who have written on this topic. Francesco Guala presents a theory that combines the features of three influential views of institutions: as equilibria of strategic games, as regulative rules, and as constitutive rules. -/- Guala explains key institutions like money, private property, and marriage, and develops a much-needed unification of equilibrium- and rules-based approaches. Although he uses game theory concepts, (...) the theory is presented in a simple, clear style that is accessible to a wide audience of scholars working in different fields. Manufacturing and industry practices are undergoing an unprecedented revolution as a consequence of the convergence of emerging technologies such as artificial intelligence, robotics, cloud computing, virtual and augmented reality, among others. This fourth industrial revolution is similarly changing the practices and capabilities of operators in their industrial environments. This paper introduces and explores the notion of the Operator 4.0 as well as how this novel way of conceptualizing the human operator necessarily implicates human values in the technologies that constitute it. (...) The design approach known as value sensitive design (VSD) is used to explore how these Operator 4.0 technologies can be designed for human values. Expert elicitation surveys were used to determine the values of industry stakeholders and examples of how the VSD methodology can be adopted by engineers in order to design for these values is illustrated. In this paper, we take a meta-theoretical stance and aim to compare and assess two conceptual frameworks that endeavor to explain phenomenal experience. In particular, we compare Feinberg & Mallatt’s Neurobiological Naturalism (NN) and Tononi’s and colleagues' Integrated Information Theory (IIT), given that the former pointed out some similarities between the two theories (Feinberg & Mallatt 2016c-d). To probe their similarity, we first give a general introduction to both frameworks. Next, we expound a ground plan for carrying out our analysis. (...) We move on to articulate a philosophical profile of NN and IIT, addressing their ontological commitments and epistemological foundations. The experimental approach in economics is a driving force behind some of the most exciting developments in the field. The 'experimental revolution' was based on a series of bold philosophical premises which have remained until now mostly unexplored. This book provides the first comprehensive analysis and critical discussion of the methodology of experimental economics, written by a philosopher of science with expertise in the field. The Risk of Freedom presents an in-depth analysis of the philosophy of Jan Patočka, one of the most influential Central European thinkers of the twentieth century, examining both the phenomenological and ethical-political aspects of his work. In particular, Francesco Tava takes an original approach to the problem of freedom, which represents a recurring theme in Patočka’s work, both in his early and later writings.Freedom is conceived of as a difficult and dangerous experience. This paper takes up some threads of Deleuze’s and Ruyer’s engagement with biology. I begin by laying out the main features of Deleuze’s scheme of morphogenesis, through the lens of his references to embryology. I take Deleuze’s interest in embryology to be guided by the effort to define bodies solely by form-generating factors which are immanent to them. His concept of virtuality, which indicates the creative component of reality, the open field of connections defining a body’s capacities for transformation and (...) interaction, plays a key role in this regard. I then consider two implications: (1) The insistence on morphogenesis displaces the question of life from given biological entities, which preserve themselves and act through regulated cycles, to the myriad of activities that compose and modify them; (2) It also rearticulates the distinction between the living and the nonliving, in that it separates the question of life from that of its emergence from a given material arrangement. In the second part I examine these points with greater reference to Ruyer. After introducing Ruyer’s concepts of functioning and formation, I focus on his account of the continuity between biological and physicochemical forms, following some of his work on the microbiology and ethology of the time. The real difference is not between the living and the nonliving, but between two modes of bonding and composition variously operating on all scales: morphogenetic and statistical. I conclude by assessing the significance of this claim with respect to the traditional distinction between vitalism and mechanism. (shrink)

This article investigates the effects of perceived supervisor support on ethical and unethical employee behavior using a multi-method approach. Specifically, we test the mediating mechanism and a boundary condition that moderate the relationship between support and ethical employee behaviors. We find that supervisor-based self-esteem fully mediates the relationship between supervisor support and ethical employee behavior and that employee task satisfaction intensifies the relationship between supervisor support and supervisor-based self-esteem.

Current debates in social ontology are dominated by approaches that view institutions either as rules or as equilibria of strategic games. We argue that these two approaches can be unified within an encompassing theory based on the notion of correlated equilibrium. We show that in a correlated equilibrium each player follows a regulative rule of the form ‘if X then do Y’. We then criticize Searle's claim that constitutive rules of the form ‘X counts as Y in C’ are fundamental (...) building blocks for institutions, showing that such rules can be derived from regulative rules by introducing new institutional terms. Institutional terms are introduced for economy of thought, but are not necessary for the creation of social reality. (shrink)

Recent debates on the nature of preferences in economics have typically assumed that they are to be interpreted either as behavioural regularities or as mental states. In this paper I challenge this dichotomy and argue that neither interpretation is consistent with scientific practice in choice theory and behavioural economics. Preferences are belief-dependent dispositions with a multiply realizable causal basis, which explains why economists are reluctant to make a commitment about their interpretation.

Economists and biologists have proposed a distinction between two mechanisms – “strong” and “weak” reciprocity – that may explain the evolution of human sociality. Weak reciprocity theorists emphasize the benefits of long-term cooperation and the use of low-cost strategies to deter free-riders. Strong reciprocity theorists, in contrast, claim that cooperation in social dilemma games can be sustained by costly punishment mechanisms, even in one-shot and finitely repeated games. To support this claim, they have generated a large body of evidence concerning (...) the willingness of experimental subjects to punish uncooperative free-riders at a cost to themselves. In this article, I distinguish between a “narrow” and a “wide” reading of the experimental evidence. Under the narrow reading, punishment experiments are just useful devices to measure psychological propensities in controlled laboratory conditions. Under the wide reading, they replicate a mechanism that supports cooperation also in “real-world” situations outside the laboratory. I argue that the wide interpretation must be tested using a combination of laboratory data and evidence about cooperation “in the wild.” In spite of some often-repeated claims, there is no evidence that cooperation in the small egalitarian societies studied by anthropologists is enforced by means of costly punishment. Moreover, studies by economic and social historians show that social dilemmas in the wild are typically solved by institutions that coordinate punishment, reduce its cost, and extend the horizon of cooperation. The lack of field evidence for costly punishment suggests important constraints about what forms of cooperation can or cannot be sustained by means of decentralised policing. (shrink)

This paper proposes a framework for representing in Bayesian terms the idea that analogical arguments of various degrees of strength may provide inductive support to yet untested scientific hypotheses. On this account, contextual information plays a crucial role in determining whether, and to what extent, a given similarity or dissimilarity between source and target may confirm an empirical hypothesis over a rival one. In addition to showing confirmation by analogy compatible with the adoption of a Bayesian standpoint, the proposal outlined (...) in this paper reveals a close agreement between the fulfillment of Hesse’s (Models and analogies in science, University of Notre Dame Press, 1963) criteria for analogical arguments capable of inductive support and the attribution of confirmatory power by the lights of Bayesian confirmation theory. In this sense, the Bayesian representation not only enriches a framework, Hesse’s, of enduring relevance for understanding scientific activity, but may offer something akin to a proof of concept of it. In Soph. 237b7–239a11 Plato lays out a sequence of arguments that are generally considered homogenous. An analysis of each argument can shed light on the need to differentiate their respective nature. Firstly, it will be shown that the arguments do not work only at the linguistic level, contrary to the way these passages are interpreted by most of commentators. The meta–linguistic nature of the third argument will be particularly emphasised. Secondly, it will be argued that the three arguments follow each (...) other according to a crescendo. The implications of this argumentative structure will be specifically appreciated. Both these results of the analysis induce to attribute a crucial importance to the notion of medamos on: the arguments do not aim to definitively exclude the possibility of a Parmenidean non–being; they play a positive role within the inquiry of the Stranger of Elea, inasmuch the thematisation of Parmenidean non–being is seriously taken into account and embraced at this stage of the dialogue. In fact it is only through this dialectical step that the Stranger gains the chance to proceed in the direction of a relational ontology and a new concept of non–being. The positive role played by the medamos on presupposes that this expression and the equivalent ones are not mere absurdities and can find place in the Platonic use of language; this implies that the notion of medamos on must have a justification in the framework of Platonic relational ontology and conception of language. The consideration of this aspect eventually gives the opportunity to return to the three arguments and present an explanation of their positioning in that stage of the dialogue. (shrink)

Research indicates that religious values and ethical behavior are closely associated, yet, at a firm level, the processes by which this association occurs are poorly understood. Family firms are known to exhibit values-based behavior, which in turn can lead to specific firm-level outcomes. It is also known that one’s family is an important incubator, enabler, and perpetuator of religious values across successive generations. Our study examines the experiences of a single, multigenerational business family that successfully enacted their religious values in (...) their business. Drawing upon intergenerational solidarity and values-based leadership theory, and by way of an interpretive, qualitative analysis, we find that the family’s religious values enhanced their cohesion and were manifested in their leadership style, which, in turn, led to outcomes for the business. Our findings highlight the processes that underlie the relationship between religious values and organizational outcomes in family firms and offer insights into the role of solidarity in values-based leadership. In line with much current literature, Bradley’s regress is here discussed as an argument that casts doubt on the existence of states of affairs or facts, understood as complex entities working as truthmakers for true sentences or propositions. One should distinguish two versions of Bradley’s regress, which stem from two different tentative explanations of the unity of states of affairs. The first version actually shows that the corresponding explanation is incoherent; the second one merely points to some prima facie implausible (...) consequences of the explanation it stems from, e.g., that there are infinite explanatory chains and that, for any given fact, there are infinitely many facts involving exemplification relations of increasing levels. But these consequences can be swal- lowed after all, thereby leading to the acceptance of a doctrine which may be called fact infinitism, a doctrine adumbrated in a well-known discussion of relations by Meinong. This paper defends the thesis of learning from non-causal models: viz. that the study of some model can prompt justified changes in one’s confidence in empirical hypotheses about a real-world target in the absence of any known or predicted similarity between model and target with regards to their causal features. Recognizing that we can learn from non-causal models matters not only to our understanding of past scientific achievements, but also to contemporary debates in the philosophy of science. At one end (...) of the philosophical spectrum, my thesis undermines the views of those who, like Cartwright (Erkenntnis 70:45–58, 2009), follow Hesse (Models and Analogies in Science, Notre Dame, University of Notre Dame Press, 1963) in restricting the possibility of learning from models to only those situations where a model identifies some causal factors present in the target. At the other end of the spectrum, my thesis also helps undermine some extremely permissive positions, e.g., Grüne-Yanoff’s (Erkenntnis 70(1):81–99, 2009, Philos Sci 80(5): 850–861, 2013) claim that learning from a model is possible even in the absence of any similarity at all between model and target. The thesis that we can learn from non-causal models offers a cautious middle ground between these two extremes. (shrink)

A complex brain network, centered on the hippocampus, supports episodic memories throughout their lifetimes. Classically, upon memory encoding during active behavior, hippocampal activity is dominated by theta oscillations (6-10Hz). During inactivity, hippocampal neurons burst synchronously, constituting sharp waves, which can propagate to other structures, theoretically supporting memory consolidation. This 'two-stage' model has been updated by new data from high-density electrophysiological recordings in animals that shed light on how information is encoded and exchanged between hippocampus, neocortex and subcortical structures such as (...) the striatum. Cell assemblies (tightly related groups of cells) discharge together and synchronize across brain structures orchestrated by theta, sharp waves and slow oscillations, to encode information. Rationalist accounts of the development of folk-psychology maintain that the acquisition of this capacity is aided by special-purpose mechanisms rich in innate structure. Rationalists have typically maintained that false-belief understanding (FBU) emerges very early on, before the age of two. To explain why young children nonetheless fail the false-belief task, rationalists have suggested that they may have troubles expressing their FBU. Here I do two things. First, I argue that extant proposals about what might prevent children from expressing their FBU (...) cannot explain some of the relevant data. Second, I put forward a new rationalist proposal, the processing-time account, according to which young children fail because they cannot carry out all the required processing in the time available. I argue that the processing-time account overcomes the challenges extant rationalist accounts face while being compatible with the evidence in their support, thereby providing a compelling explanation of the development of FBU. In this paper, we offer a descriptive theory of analogical reasoning in mathematics, stating general conditions under which an analogy may provide genuine inductive support to a mathematical conjecture (over and above fulfilling the merely heuristic role of ‘suggesting’ a conjecture in the psychological sense). The proposed conditions generalize the criteria of Hesse in her influential work on analogical reasoning in the empirical sciences. By reference to several case studies, we argue that the account proposed in this paper does a (...) better job in vindicating the use of analogical inference in mathematics than the prominent alternative defended by Bartha. Experimental “localism” stresses the importance of context‐specific knowledge, and the limitations of universal theories in science. I illustrate Latour's radical approach to localism and show that it has some unpalatable consequences, in particular the suggestion that problems of external validity (or how to generalize experimental results to nonlaboratory circumstances) cannot be solved. In the last part of the paper I try to sketch a solution to the problem of external validity by extending Mayo's error‐probabilistic approach.

The cinema of Martin Scorsese has been analysed in connection with a wide range of themes and issues. In this paper, through a film-philosophical analysis, we aim to demonstrate how his filmography produces storyworlds pervaded by a tension similar to the one Søren Kierkegaard expressed in his existentialist writings. Indeed, one of the tenets of film-philosophy is that audio-visual media generate, in an affective and experiential manner, complex moral and ethical systems and existential viewpoints with which viewers interact in a (...) direct and creative way. Empathising with the self-sacrifice of the unlikely martyr played by Jake LaMotta or feeling the collapsing certainties of a missionary in seventeenth-century Japan are thus occasions to encounter particular conceptual personae. These characters embody specific iterations of Kierkegaardian knights of faith: existentialist figures whose doom takes in ambiguous film ecologies where the desire for wholesomeness constantly clashes with mortality and finitude. Having accepted the premise that Deepfake content can constitute a legitimate form of expression, it is not immediately clear where the rights of content producers and distributors end, and where the rights of individuals whose likenesses are used in this content begin. Comparative process tracing is the best analysis of extrapolation inferences in the philosophical and scientific literature so far. In this essay I examine some similarities and differences between comparative process tracing and former attempts to capture the logic of extrapolation, such as the analogical approach. I show that these accounts are not different in spirit, although comparative process tracing supersedes previous proposals in terms of analytical detail. I also examine some qualms about the possibility of drawing extrapolation inferences in the (...) social sciences and conclude by suggesting that there may be cases of extrapolation without process tracing. Improving the evidence in public health is an important goal for the health promotion community. With better evidence, health professionals can make better decisions to achieve effectiveness in their interventions. The relative failure of such evidence in public health is well-known, and it is due to several factors. Briefly, from an epistemological point of view, it is not easy to develop evidence-based public health because public health interventions are highly complex and indeterminate. This paper proposes an analytical explanation of the (...) complexity and indeterminacy of public health interventions in terms of 12 points. Public health interventions are considered as a causal chain constituted by three elements and two levels of evaluation. Public health interventions thus differ from clinical interventions, which comprise two causal elements and one level of evaluation. From the two levels of evaluation, we suggest a classification of evidence into four typologies: evidence of both relations; evidence of the second but not of the first relation; evidence of the first but not of the second relation; and no evidence of either relation. In addition, a grading of indeterminacy of public health interventions is introduced. This theoretical point of view could be useful for public health professionals to better define and classify the public health interventions before acting. (shrink)

Thaler and Sunstein justify nudge policies from welfaristic premises: nudges are acceptable because they benefit the individuals who are nudged. A tacit assumption behind this strategy is that we can identify the true preferences of decision-makers. We argue that this assumption is often unwarranted, and that as a consequence nudge policies must be justified in a different way. A possible strategy is to abandon welfarism and endorse genuine paternalism. Another one is to argue that the biases of decision that choice (...) architects attempt to eliminate create externalities. For example, in the case of intertemporal discounting, the costs of preference reversals are not always paid by the discounters, because they are transferred onto other individuals. But if this is the case, then nudges are best justified from a political rather than welfaristic standpoint. (shrink)

The deep comprehension of a text is tantamount to the construction of an articulated mental model of that text. The number of correct recollections is an index of a learner's mental model of a text. We assume that another index of comprehension is the timing of the gestures produced during text recall; gestures are simultaneous with speech when the learner has built an articulated mental model of the text, whereas they anticipate the speech when the learner has built a less (...) articulated mental model. The results of four experiments confirm the predictions deriving from our assumptions for both children and adults. Provided that the recollections are correct, the timing of gestures can differ and can be considered a further measure of the quality of the mental model, beyond the number of correct recollections. Arguments from non-causal analogy form a distinctive class of analogical arguments in science not recognized in authoritative classifications by, e.g., Hesse and Bartha. In this paper, I illustrate this novel class of scientific analogies by means of historical examples from physics, biology and economics, at the same time emphasizing their broader significance for contemporary debates in epistemology.
