In St. Francis Regional Medical Center v. Blue Cross & Blue Shield of Kansas ), the United States Court of Appeals for the Tenth Circuit upheld Blue Cross/Blue Shield of Kansas's anti-assignment requirement, on the grounds that the Employee Retirement Income Security Act preempted a hospital's claim against Blue Cross. The court also held that public policy supported anti-assignment requirements in health plans not covered under ERISA.When drafting ERISA, Congress did not explicitly address assignability of health care benefits. According to (...) the court of appeals, congressional silence constituted an intent to allow the parties to negotiate freely the assignment of health care benefits. Examining non-ERISA health plans, the court adopted a balancing test to determine the validity of anti-assignment clauses; it found that anti-assignment requirements promote freedom of contract and may include medical costs. According to an argument that I will call the argument from loose lips, we can safely reject certain notorious conspiracy theories because they posit conspiracies that would be nearly impossible to keep secret. I distinguish between three versions of this argument: the epistemic argument, the alethic argument, and the statistical argument. I, then, discuss several limitations of the argument from loose lips. The first limitation is that only the statistical argument can be applied to new conspiracy theories. The second limitation (...) is that no version of the argument suffices to rule out the existence of small initial conspiracies that have no need to add further conspirators. The third limitation is that no version of the argument is dialectically efficacious in the context of arguing with the relevant conspiracy theorists because nothing is said to address the alleged evidence that they cite. People are often inaccurate in their predictions of performance on a variety of cognitive tasks. We tested whether receptivity to bullshit – the tendency to perceive meaningless statements as profound – would relate to the accuracy of metacognitive judgments on several problem-solving tasks. Individuals who were highly receptive to bullshit were less accurate in their predictions of performance on creative problem-solving tasks, but not on verbal analogy or recall tasks. Further, individuals with high BS receptivity were less able to discriminate (...) between solvable and unsolvable problems when making metacognitive judgments. These findings support the possibility that the tendency to perceive semantic connections where none exist, as indicated by high bullshit receptivity, may lead to inaccurate predictions of performance on tasks that require noticing and utilizing distant semantic connections.
