However diverse and even conflicting definitions of world literature may be, there is a consensus in previous scholarship about circulation as a key defining feature. Being circulation modeled and (in)validated by a corpus of statutes, rules, and regulations, the absence of a law-oriented approach to world literature appears completely contradictory. This essay is a first step toward a more sustained treatment of world literature and law. Here I claim that in the late 1830s the history of world literature as mastered (...) by the West started to change as a consequence of the first two international copyright laws in the world––the Prussian Statute of 11 June 1837 and the British Act of 31 July 1838. The Prussian law is discussed in relation to the evolution of the Collection of British Authors of the German firm Tauchnitz between 1841 and 1847 by paying special attention to the case of American writers. The British law, in turn, is discussed in relation to French piracies of works printed in the UK by focusing on Frances Trollope’s Domestic Manners of the Americans (1832). Both laws sowed the seeds of the 1886 Berne Convention, whereby a vast transcontinental geography with a population of over five hundred million people was created for the legal circulation of literary works. One important limitation of the current renditions of interpretivism is that its emphasis on the moral dimension of sport has overlooked the aesthetic dimension lying at the core of this account of sport. The interpretivist’s failure to acknowledge and consider the aesthetic implicitly distances this realm from the moral. Marcia Muelder Eaton calls this distancing the separatist mistake. This paper argues that interpretivism presupposes not only moral but also aesthetic principles and values. What it sets out to demonstrate is that (...) interpretivism is an integralist, or nonseparatist, account of sport, one in which ethical and aesthetic values are not exclusive. Making explicit and specifying interpretivism’s combined moral-aesthetic approach to sport not only helps to better distinguish the whole range of values that make up sport as well as their interconnection but also encourages sportspeople to pursue more coherent sport and, thus, more enriching lives. Drawing from ethnographic research in the Research Triangle of North Carolina and Williamsburg, Virginia, the authors build on Anzaldúa's conceptualization of “borderlands” to analyze how borders of social membership are constructed and enforced in “el Nuevo South.” Our gender analysis reveals that intersecting structural conditions—the labor market, the organization of public space, and the institutional organization of health care and other public services—combine with gendered processes in the home and family to regulate women's participation in community life. Enforcers of borders (...) include institutional actors, mostly women, in social services and clinics who occupy institutional locations that enable them to define who is entitled to public goods and to categorize migrants as undeserving “others.” We reveal how a particularly configured matrix of domination transcends the spheres of home, work, and community to constrain women migrants' physical and economic mobility and personal autonomy and to inhibit their participation in their societies of reception. The multiobjective optimization on the basis of ratio analysis method captures diverse features such as the criteria and alternatives of appraising a multiple criteria decision-making problem. At the same time, the multiple criteria problem includes a set of decision makers with diverse expertise and preferences. In fact, the literature lists numerous approaches to aid in this problematic task of choosing the best alternative. Nevertheless, in the MCDM field, there is a challenge regarding intangible information which is commonly involved in multiple (...) criteria decision-making problem; hence, it is substantial in order to advance beyond the research related to this field. Thus, the objective of this paper is to present a fused method between multiobjective optimization on the basis of ratio analysis and Pythagorean fuzzy sets for the choice of an alternative. Besides, multiobjective optimization on the basis of ratio analysis is utilized to choose the best alternatives. Finally, two decision-making problems are applied to illustrate the feasibility and practicality of the proposed method. (shrink)

En el contexto de la ética fenomenológica de Dietrich von Hildebrand, indagamos sobre las vivencias implicadas en la acción moral y en las condiciones, tanto formales como materiales, que la constituyen en una acción moralmente buena o valiosa. En este análisis planteamos que en toda acción humana están presentes tres vivencias intencionales, a saber, la aprehensión cognoscitiva del valor, la respuesta al valor y la realización de la acción; y que el valor moral de una acción depende, principalmente, de la (...) respuesta volitiva a un grupo especial de valores, los valores moralmente relevantes. Junto con ello, recuperamos el rol central del modelo o ejemplo moral en la educación valórica de las personas y la importancia de la imitación en el desarrollo moral de estas. Para ello, contraponemos la ética de Hildebrand a la ética kantiana. Además, reflexionamos sobre el sentido y alcance de la teoría de Hildebrand sobre las acciones inmorales, concluyendo que una acción formalmente moral (correcta) puede ser materialmente inmoral. En este encuentro convergen monstruos reales y ficticios -aunque nos cueste diferenciarlos-, así como las neurosis del siglo XXI y las leyendas del siglo XIX, que aliviadas unas por el psicoanálisis y alimentadas otras, por los primeros experimentos de “ingeniería genética”, consiguen sembrarnos una interrogante sobre la (in)distinción de lo real en nuestro entorno. This paper addresses the problem of sound individuation (SI) and its connection to sound ontology (SO). It is argued that the problems of SI, such as aspatiality, extreme individuation, indexical perplexity and duration puzzles are due to SO’s uncertainties. Besides, I describe the views in SO, including the wave view (WV), the property view (PV), and the event view (EV), as Casey O’Callaghan defends it. According to O’Callaghan, EV offers clear standards to individuate sounds. However, this claim is countered by (...) the consideration that any view could also defend the standards in SO, and thus, EV does not solve any of the problems mentioned above. As a way of showing the difficulties inherited by sound’s inner ontology, the problem of its linguistic representation is also addressed. The problem of SI can be developed within the frame of the philosophy of language and, specifically, regarding the discussion about mass vs count-­sortal terms. Is the term sound a mass or a count­-sortal? It is shown that, for reasons pertaining SO, the decision regarding the case of sound as a mass or count-­sortal term remains open. SI is, thus, covered from the SO to the philosophy of language. (shrink)

As a result of recent corporate scandals, several rules have focused on the role played by Boards of Directors on the planning and monitoring of corporate codes of ethics. In theory, outside directors are in a better position than insiders to protect and further the interests of all stakeholders because of their experience and their sense of moral and legal obligations. Female directors also tend to be more sensitive to ethics according to several past studies which explain this affirmation by (...) early gender socialization, the fact that women are thought to place a greater emphasis on harmonious relations and the fact that men and women use different ethical frameworks in their judgments. The goal of this paper is to determine the influence of these characteristics of the Board in terms of promoting and hindering the creation of a code of ethics. Our findings show that a greater number of female directors does not necessarily lead to more ethical companies. Moreover, within Europe as a continent, board ownership leads to an entrenchment of upper-level management, generating a divergence between the ethical interests of owners and managers. In light of this situation, the presence of independent directors is necessary to reduce such conflicts. (shrink)

It is common in contemporary sport to liken the notion of the team to that of the family. That is, the family is used to evoke team life. Portraying the team as a family usually implies a positive evaluation. Despite its prevalence, the team as a family equation has not been analyzed in the sport philosophy literature. Thus, the purpose of this article is twofold. First, it explores whether the team is to be equated with the family. To discuss the (...) nature of the family and the team, I draw together the work of several sport philosophers with that of Laura Wildemann Kane. Second, and considering what characterizes the team, this article investigates whether teammates have special responsibilities to one another by virtue of their relationship and the value attached to it. I propose that the team as a family equation does not align with the constitution of these two social groups and that teammates have special responsibilities to one another, but such responsibilities are different from those observed in the family. Los procedimientos para realizar dicho proceso son fundamentales en la estrategia definida por el país que incluye la "Guía cubana de migración al software libre", sin embargo, su aplicación práctica enfrenta dificultades que han motivado a los autores a la elaboración de una estrategia específica para la migración al software libre en el sector de la (...) Salud Pública de la provincia de Camagüey, Cuba. En esta estrategia se proponen las acciones concretas, los programas docentes que permitirán la recalificación del capital humano y las acciones que posibiliten garantizar la sostenibilidad de la migración al concluir el proceso. In the present Cuban and world scenarios the migration to free software constitutes a need for the development to guarantee technological independence. The procedures to carry out that process are vital in the strategy defined by the country that includes “Cuban guidelines for the migration to free software” however its practical implementation is facing difficulties that have motivated the authors to elaborate a specific strategy form the migration to free software in the Public health sector in the province of Camagüey, Cuba. In this strategy actions are suggested, like teaching programs that will allow the recertification of the capital human resources and steps that will make possible to guarantee the sustainability of the migration at the end of the process. La Educación Sensible es ayuda para que el “yo” habite en su “hogar interior” y crezca hacia su “apoteosis original” en el “nosotros”, donde se hace cocreador de belleza con libertad, sabiduría y amor. La educación sensible es pedagogía no invasiva pero radicalmente exigente para que la persona acepte desplegar su versión original y vivir con gozo en un “nosotros-maduro”. No es una pedagogía que protege a los sensibles; es una educación que atiende a todas las personas, independientemente de su (...) grado de sensibilidad: alta, media o baja (como intervalos comunes que se manejan en las ciencias de la sensibilidad). La sensibilidad personal es capaz de captar la propia originalidad y disponerse para interpretarla en los dos sentidos: comprenderla y actuarla. La sensibilidad humana necesita la educación sensible para que sea punto de partida de un desarrollo personal auténtico y pleno de la propia originalidad que es alterada y altera la de los “yoes” con quien habita la existencia formando “nosotros”, que a su vez, se impactan con interdependencia. Además de al “yo”, la educación sensible se orienta al “nosotros”, que será tanto más “sensible” en la medida que altera la intimidad de la persona con “amor-maduro” que es fuente de gozo, a pesar de los pesares. Sin educación sensible la vida daña y cuanta mayor es la sensibilidad de la persona, mayor es el daño, pero también es mayor la capacidad para detectarlo cicatrizarlo y ayudar a otros con educación sensible. Así, la educación sensible se manifiesta de tres maneras: como acción sanadora de la persona, destrucción creadora para evolucionar en el tiempo, como la crisálida se transforma en mariposa, y acción desarrollante del propio potencial con originalidad. In the predominant pedagogical frameworks of our days, rationalist, voluntarist or sentimentalist reductionisms are seen, from which it is about educating people regardless of their Origin and the singular and unrepeatable originality with which they have been given to existence. Faced with this anthropocentric confinement, Sensitive Education arises so that every person, regardless of their culture and creed, remains sensitive to their Origin and captures their own originality, which in the end is what they must accept and try to manifest (...) with education. When educational systems are not sensitive to the original, they develop falsehood. With the aim of consolidating the validity of the pedagogical-anthropological foundation of Sensitive Education, this study seeks to show how Edith Stein’s argument explains Sensitive Education, although Stein, after her conversion, uses explicitly Christian terminology. Stein’s direct terms serve to describe Education Sensitive to the Holy Spirit, but for those who do not start from a Christian worldview, Education Sensitive to Origin can be a more non-denominational way of approaching the Original. To achieve this objective, an analytical-synthetic methodology has been followed in which essential features of Sensitive Education are proposed and in a hermeneutic manner, arguments are extracted from the writings of Edith Stein that offer support for these essential features. In conclusion, it is sufficiently shown that Edith Stein’s thought provides a pedagogical foundation to Sensitive Education. (shrink)

No entanto, Tyler Burge rejeitou essa tese, e Putnam veio a adotar a posição de Burge. A rejeição de Burge está apoiada na distinção entre crenças de dicto e crenças de re. In post-Revolutionary Mexico, the Indian was conceptualized as a problem that needed to be solved. Indians were believed to be weighing down the nation and thought to constitute an obstacle for fulfilling its promised modern future. Thus, the scientific study of indigenous peoples in Mexico became, in the 1930s, a focus of anthropologists, physicians, and other experts, who sought to learn more about indigenous populations in order to solve this "problem." El presente artículo indaga en la construcción de las estéticas y las subjetividades emergentes en jóvenes urbanos mexicanos a través del tatuaje. La pregunta de investigación que articula el trabajo tiene relación con ¿por qué ciertos jóvenes urbanos, hombres como mujeres, se están tatuando los cuerpos? El método utilizado para la reconstrucción de los significados (las subjetividades emergentes) fue interpretativo. La investigación fue exploratoria y de corte etnográfico, debido a la casi inexistencia de investigaciones en México que consideren a la (...) oferta (tatuadores) y a la demanda (los tatuados) en el propio contexto histórico-social de los significados asociados a la práctica del tatuaje como expresión estética en la alteración de los cuerpos. Los instrumentos que se emplearon en la construcción de los datos fueron los diarios de campo, para la observación de contextos; y una guía de entrevista en profundidad, para conocer los significados que dieron los propios actores sociales a sus prácticas. Resumen Como toda actividad social, la investigación en el campo de las ciencias sociales se institucionaliza por la acción de los individuos, instaurando ciertos mecanismos que regulan -a través de pautas organizacionales definidas- su quehacer social e institucional. Es así que la investigación social desarrollada en las instituciones de educación superior es experimentada por sus actores como una realidad establecida y objetiva que antecede al individuo actual, una realidad sujeta a una clara definición de roles, situaciones y comportamientos. Desde una (...) perspectiva sociológica, y ante a la injerencia de las actuales tecnologías de la información y la comunicación, en este trabajo se exploran los obstáculos y las posibilidades que enfrenta la condición institucionalizada de la investigación social y la de sus actores en sociedades con distintos tipos de desarrollo. Con tal propósito nos detenemos en el enlace de cuatro dimensiones del problema: la expansión y dispersión de las ciencias humanas y sociales; la institución como marco normativo de la organización de la actividad de investigación; el académico-investigador como principal actor y, por último, la función del "par académico" como árbitro de una competencia más institucional que cognitiva.As any social activity, research in social sciences is institutionalized by the action of individuals, establishing certain mechanisms that regulate -through defined organizational patterns- its social and institutional activities. In this way, the social research developed in higher education institutions is experienced by their actors as an established and objective reality that precedes the actual individual; a reality attached to a clear definition of roles, situations and behaviors. From a sociological perspective, and confronting the interference of the current information and communications technologies, in this paper are explored the obstacles and opportunities facing the institutionalized condition of social research, and their actors in societies with different types of development. For that purpose, we look into the connection of four dimensions of the problem: the expansion and dispersion of human and social sciences; the institution as a regulatory structure for the organization of the research activity; the academic researcher as the main actor, and finally, the role of "academic peer" as an arbiter of a competition more institutional than cognitive. Despite society’s increasing sensitivity toward green production, companies often struggle to find effective communication strategies that induce consumers to buy green products or engage in other environmentally friendly behaviors. To add clarity to this situation, we investigated the effectiveness of negative versus positive message framing in promoting green products, whereby companies highlight the detrimental versus beneficial environmental consequences of choosing less versus more green options, respectively. Across four experiments, we show that negatively framed messages are more effective than positively framed (...) ones in prompting consumers to engage in pro-environmental behaviors. More importantly, we find that anticipated shame is the emotion responsible for this effect. Furthermore, both environmental concern and the type of product promoted serve as moderators; thus, the mediating role of anticipated shame is attenuated when environmental concern is low and the product is a luxury one. Finally, we discuss the theoretical and managerial implications of our work, along with its limitations and some directions for future research. (shrink)

La iniciación cristiana implica la conversión del hombre a Cristo. Los sacramentos de la iniciación cristiana realizan la introducción del creyente en el misterio personal de Dios. El hombre recibe el don de la vida divina y la acoge conformándose a Cristo. Esa acogida conlleva una transformación de su existencia en el proceso de identificación con Cristo. En este artículo se intenta mostrar que el proceso de la conversión del hombre es la misma iniciación cristiana y se abordan algunas dificultades (...) para su vivencia en el contexto actual. En este artículo se presenta una propuesta formativa utilizando el cine como material cultural y fuente de conocimiento. Una película como Babel permite trabajar la globalización y la educación de la ciudadanía, con planteamientos que exigen un nuevo humanismo, una nueva relación interpersonal, conscientes de los problemas de comunicación, prejuicios y choques culturales derivados del desarrollo tecnológico. La película cuestiona esta existencia en un mundo global interrelacionado, evocando el viejo mito bíblico de la Torre de Babel haciendo énfasis en identificaciones (...) erróneas, malentendidos y oportunidades fallidas, como manos invisibles que nos guían; o el fin cuyo destino se nos escapa.Babel hace comprender la realidad de la globalización. Nos permite observar cuatro lugares tan distantes como Estados Unidos, Méjico, Marruecos y Japón, no sólo distanciados físicamente. Los cuatro países representan estilos culturales diferentes, tres formas de realización humana. Asistimos al choque, a la incomunicación personal, al aislamiento por la diferencia de cultura y la ficticia proximidad tecnológica. Vivimos juntos, pero aislados los unos de los otros. (shrink)

This paper presents the epistemological proposal of Helen Longino, a philosopher of science who understands scientific knowledge as an unfinished result and who takes into account the context for its realization, the subjects who do science, the importance of criticism as a tool for the improvement of knowledge and science. The normative values that this author postulates are presented, and they are compared with the proposal of Thomas Kuhn, in order to make explicit a novel and alternative proposal to traditional (...) science, which takes into account other perspectives to improve the conduct of scientific activity, and the democratization of it. El análisis de los sesgos de género en ciencia ha dado lugar a una revisión crítica del conocimiento científico y a un cuestionamiento en profundidad del modelo de ciencia existente. Lo que, a su vez, da paso al interés por investigar en torno a las claves epistémicas que harían posible una ciencia no sexista, racista o clasista, fraguando un debate epistemológico de gran alcance.Las pretensiones de estas epistemologías son, principalmente, mostrar que los valores contextuales, es decir, los considerados no cognitivos, (...) influyen en la ciencia, en las metáforas científicas, el lenguaje utilizado, los procesos y métodos de investigación, y en los conocimientos. En esta comunicación se abordará principalmente el tema de la Ciencia Sostenible como alternativa a la denominada ciencia tradicional, y también como disyuntiva a la denominada ciencia feminista. Las posturas que confluyen son las de tres autoras: D. Haraway, S. Harding y Londa Schiebinger. Las cuales, en conjunto, dan lugar a una actividad práctica en ciencia, además de a una forma de mirar diferente, que intenta elaborar propuestas novedosas para la mejora del quehacer científico. En los últimos cursos impartidos por Foucault, la noción de la parrhesía se presenta como un elemento clave en su estudio sobre los discursos de verdad. Opuesta a esta noción, es frecuente encontrar la retórica como técnica de persuasión desvinculada de la verdad. En este artículo analizamos algunas de las formas en que Foucault vincula y opone parrhesía y retórica, partiendo de la tesis de que la parrhesía sería aquel tipo de práctica de la verdad que vendría a marcar la (...) distancia entre el discurso de verdad y el discurso falaz. La problemática que se genera en torno a ese límite deriva de la dificultad por establecer un criterio de distinción entre dos modos de ser del discurso, con sus propias formas de veridicción: el parresiástico y el retórico.
