For many people "animal rights" suggests campaigns against factory farms, vivisection or other aspects of our woeful treatment of animals. Zoopolis moves beyond this familiar terrain, focusing not on what we must stop doing to animals, but on how we can establish positive and just relationships with different types of animals.

Many theorists of the ‘political turn’ in animal rights theory emphasize the need for animals’ interests to be considered in political decision-making processes, but deny that this requires self-representation and participation by animals themselves. I argue that participation by domesticated animals in co-authoring our shared world is indeed required, and explore two ways to proceed: 1) by enabling animal voice within the existing geography of human-animal roles and relationships; and 2) by freeing animals into a revitalized public commons where citizens (...) encounter one another in spontaneous, unpredictable encounters in spaces that they can re-shape together. While animal rights have been a central topic within moral philosophy since the 1970s, it has remained virtually invisible within political philosophy. This article explores two key reasons for the difficulties in locating animals within political philosophy. First, even if animals are seen as having intrinsic moral status, they are often seen as ultimately distant others or strangers, beyond the bounds of human society. Insofar as political philosophy focuses on the governing of a shared social life, animals are seen as (...) falling outside its remit. Second, even if animals are recognized as members of society, they are seen as lacking the capacities or competences said to be essential for politics, and for membership in the demos. We challenge both assumptions. Many animals live and work alongside us, within an interspecies society, and all members of society should have the right to shape decisions about how that society is governed. In this interview, Sue Donaldson and Will Kymlicka reply to some questions and objections to their book Zoopolis . A distinctive feature of their approach is the idea that domesticated animals should be seen as cocitizens of our political community. Donaldson and Kymlicka discuss how this view of animal citizenship relates to issues regarding the right to vote, the right to political representation, and rights to residence and membership. The authors also explore how their political account of animal (...) rights theory relates to theories of multiculturalism as well as conflicts between individual and group rights. We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

This paper is a dialogue with Sue Donaldsons and Will Kymlickas book Zoopolis: A Political Theory of Animal Rights. My thesis is that, despite the authors reticence, considerations in first philosophy regarding humans and nonhumans are relevant to their goal of building a more comprehensive animal rights philosophy. What is more, I believe that first philosophy actually can be of help for their proposal, specifically in the form of phenomenology and phenomenological ontology. For this purpose, I first summarize the basic (...) outline of Zoopoliss position and indicate some questions that arise from a strictly internal consideration of its theses. And secondly, I introduce some aspects in which phenomenological research would be relevant, along with some particular and provisional analyses carried out from the standpoint of a phenomenologically-based ontology. The study was undertaken in a community hospital located in a rural area in the Midwest. In their 2011 book Zoopolis Sue Donaldson and Will Kymlicka present their political theory of animal rights. In a recent essay, Animals and the Frontiers of Citizenship, the authors respond to the main criticisms of that theory. They argue that when we think about animal protection, we do so from a presupposed relationship between man and animal: for example, how can we improve animal welfare within the meat industry. When animals take part in our society however, we ought, according (...) to the authors, to recognise them as such and think about how we can enter into a relationship with animals that is mutually beneficial. They believe this is possible by granting domesticated animals citizenship, including the corresponding civil rights that citizenship entails. Their main argument supporting this thesis is that domesticated animals are fully dependent on humans in their everyday life, and therefore share a society with them. On these grounds they deserve to be fully recognised as an integral member of that society, and consequently they deserve civil rights. However noble I think the authors’ project is, in this essay I will criticise one of their presuppositions: that animals are subjects of law, or the mere idea that it is possible for them to possess rights, since, as the authors indicate, citizenship is a collection of civil rights. Traditionally, legal subjectivity entails the possibility to possess legal rights and duties. According to Kymlicka and Donaldson we can clearly identify certain rights and duties that rest on domesticated animals. Therefore we ought to recognise them as the legal subjects they are. However, the Supreme Court of the State of New York recently ruled, in a matter concerning animal legal subjectivity, that in order to posses a duty one has to be able to reflect upon it, a capacity animals would lack. Therefore they cannot be considered to be subjects of law. The authors would however argue that this traditional conception of legal subjectivity, as grounded in reason, is inadequate because it does not cover the entire range of human diversity. If we were to use the traditional conception, children and persons with disabilities would not be considered as legal subjects. However, in practice, they are considered as such. An adequate conception of legal subjectivity would then also allow for it to be attributed to domesticated animals. However, as I will show, the traditional conception does cover the entire range of human diversity, as it is not grounded in the factual exercise of reason but the principle capacity to reflect reasonably. This is a fundamental distinction the authors fail to recognise and which is made apparent by recent human rights conventions, such as The UN Convention on the Rights of Persons with Disabilities. Most management researchers pause at the threshold of objective right and wrong. Their hesitation is understandable. Values imply a “subjective,” personal dimension, one that can invite religious and moral interference in research. The dominant epistemological camps of positivism and subjectivism in management stumble over the notion of moral objectivity. Empirical research can study values in human behavior, but hard-headed scientists should not assume that one value can be objectively better than another. In this article, we invite management researchers to rethink (...) this presumption. We show how accepting at least a limited form of moral objectivity, namely, an epistemic orientation that seeks objective moral reasons, can benefit management research by 1. guiding research practice; 2. using patterns of moral objectivity as clues for formulating empirical hypotheses for psychological explanations; and 3. adding prescriptive power to empirical theories. Does stakeholder theory’s “arrival” mean continued dynamism, refinement, and relevance, or stasis? How will superior stakeholder theory continue to develop? In light of these and related questions, the authors of these essays conducted an ongoing dialogue on the current (...) state and future of stakeholder thinking. Beginning with a review of research and theory that has developed since the major stakeholder theorizing efforts of the 1990s, the authors individually offer their perspectives on the key issues relevant today to stakeholder thinking, and to suggest possible approaches that might lead toward and enable the continuing development of superior stakeholder theory. This book presents an exploration of the idea of the common or social good, extended so that alternatives with different populations can be ranked. The approach is, in the main, welfarist, basing rankings on the well-being, broadly conceived, of those who are alive. The axiomatic method is employed, and topics investigated include: the measurement of individual well-being, social attitudes toward inequality of well-being, the main classes of population principles, principles that provide incomplete rankings, principles that rank uncertain alternatives, best choices (...) from feasible sets, and applications. The chapters are divided, with mathematical arguments confined to the second part. The first part is intended to make the arguments accessible to a more general readership. Although the book can be read as a defense of the critical-level generalized-utilitarian class of principles, comprehensive examinations of other classes are included. (shrink)

When we consider the issue of linguistic justice, we must define what we mean by language. Standardisation of languages is closely associated with the development of the nation state, and the de Saussurian conception of language as system is in concert with nationalism and its divisions. In the early twenty-first century, however, this view of the world as a mosaic of stable national monolingualisms is outdated. In a globalising world, much of the political, social and economic structure that is developing (...) is transnational and patterns of contact, both real and virtual, have become extraordinarily complex. In the resulting communities of communication of this superdiverse world, much language practice is more function driven than in the recent past. New practices mean that we cannot consider questions of linguistic justice in this new world order using the linguistic toolkit of the old. The flows, exchanges and networks of globalisation present us with a new paradigm and we need to recalibrate concepts. (shrink)

This article argues that rapid eye movement (REM) dreaming is elaborative encoding for episodic memories. Elaborative encoding in REM can, at least partially, be understood through ancient art of memory (AAOM) principles: visualization, bizarre association, organization, narration, embodiment, and location. These principles render recent memories more distinctive through novel and meaningful association with emotionally salient, remote memories. The AAOM optimizes memory performance, suggesting that its principles may predict aspects of how episodic memory is configured in the brain. Integration and segregation (...) are fundamental organizing principles in the cerebral cortex. Episodic memory networks interconnect profusely within the cortex, creating omnidirectional “landmark” junctions. Memories may be integrated at junctions but segregated along connecting network paths that meet at junctions. Episodic junctions may be instantiated during non–rapid eye movement (NREM) sleep after hippocampal associational function during REM dreams. Hippocampal association involves relating, binding, and integrating episodic memories into a mnemonic compositional whole. This often bizarre, composite image has not been present to the senses; it is not “real” because it hyperassociates several memories. During REM sleep, on the phenomenological level, this composite image is experienced as a dream scene. A dream scene may be instantiated as omnidirectional neocortical junction and retained by the hippocampus as an index. On episodic memory retrieval, an external stimulus (or an internal representation) is matched by the hippocampus against its indices. One or more indices then reference the relevant neocortical junctions from which episodic memories can be retrieved. Episodic junctions reach a processing (rather than conscious) level during normal wake to enable retrieval. If this hypothesis is correct, the stuff of dreams is the stuff of memory. (shrink)

This study links corporate reputation, as measured byFortune magazine's Most Admired list, with firm financial performance. Seven measures of financial risk and return were collected for a sample of 149 firms from two time periods, 1981 and 1986. The mean score of four attributes from the 1993Fortune Most Admired list for the sample was then analyzed with the financial data through regression analysis. Two financial variables, Standard Deviation of the Market Return of the Firm and Return on Sales, explained between (...) 0.12 and 0.14 of subsequent reputation. The implication for management is that they can affect a firm's subsequent reputation by lowering financial risk and controlling costs. (shrink)

India has a long, rich, and diverse tradition of philosophical thought, spanning some two and a half millenia and encompassing several major religious traditions. Now, in this intriguing introduction to Indian philosophy, the diversity of Indian thought is emphasized. It is structured around six schools of thought that have received classic status. Sue Hamilton explores how the traditions have attempted to understand the nature of reality in terms of inner or spiritual quest and introduces distinctively Indian concepts, such as karma (...) and rebirth. In an increasingly complex military operating environment, next generation wargaming platforms can reduce risk, decrease operating costs, and improve overall outcomes. Novel Artificial Intelligence enabled wargaming approaches, based on software platforms with multimodal interaction and visualization capacity, are essential to provide the decision-making flexibility and adaptability required to meet current and emerging realities of warfighting. We highlight three areas of development for future warfighter-machine interfaces: AI-directed decisional guidance, computationally informed decision-making, and realistic representations of decision spaces. The Philosophy for Children in Schools Project is an ongoing research project to explore the impact of philosophy for children on classroom practice. This paper reports on the responses of head teachers, teachers and local educational authority officers in South Wales, UK, to the initial training programme in Philosophy for Children carried out by the University School of Education. Achieving change in schools through the embedding of new practices is an important challenge for head teachers. Interviews and qualitative questionnaires were (...) used to explore perceptions of and attitudes towards the dialogic practice of P4C and the related challenges for school leaders. The results provide an insight into how head teachers planned to embed the new practice of P4C in their schools. Results from the interviews and questionnaires have been subject to iterative analysis and categories derived under which to discuss the findings. There are many similarities in the ways in which different head teachers go about planning change n their schools as well as differences. The results provide insight into the role of initial continuing professional development in school development and the processes by which individual heads plan to embed change in practice across the whole school. Advances in technology have made it possible for us to take actions that affect the numbers and identities of humans and other animals that will live in the future. Effective and inexpensive birth control, child allowances, genetic screening, safe abortion, in vitro fertilization, the education of young women, sterilization programs, environmental degradation and war all have these effects. Although it is true that a good deal of effort has been devoted to the practical side of population policy, moral theory has (...) not dealt adequately with the new possibilities. The dilemma faced by moral theory is that traditional theories cannot answer moral questions involving the creation of people. Two related problems arise. The first concerns numbers: how many people should there be? The second asks what sort of people should live and what their levels of well-being should be. Conventional social-contract theories, including the work of Rawls (1971), are restricted to situations with a fixed number of individuals. Sumner (1978) attempts to extend a Rawlsian veil-of-ignorance approach to possible people but is aware of the difficulties involved. The main problem is that possible people must be thought to benefit when they move from non-existence to existence, a view that we reject (see Section 1, Heyd, 1992, Chapter 1; McMahan, 1996a; Parfit, 1984, Appendix G). Rights-based and duty-based theories suffer from a similar problem; there must be a person who has the right or a person to whom the duty is owed (see McMahan, 1981). (shrink)

If both waking and dreaming consciousness are functional, their de-differentiation would be doubly detrimental. Differentiation between waking and dreaming is achieved through neuromodulation. During dreaming, without external sensory data and with mesolimbic dopaminergic input, hyper-cholinergic input almost totally suppresses the aminergic system. During waking, with sensory gates open, aminergic modulation inhibits cholinergic and mesocortical dopaminergic suppresses mesolimbic. These neuromodulatory systems are reciprocally interactive and self-organizing. As a consequence of neuromodulatory reciprocity, phenomenologically, the self and the world that appear during dreaming (...) differ from those that emerge during waking. As a result of self-organizing, the self and the world in both states are integrated.Some loss of self-organization would precipitate a degree of de-differentiation between waking and dreaming, resulting in a hybrid state which would be expressed heterogeneously, both neurobiologically and phenomenologically. As a consequence of progressive de-differentiation, certain identifiable psychiatric disorders may emerge. Ultimately, schizophrenia, a disorganized-fragmented self, may result. (shrink)

Most of this work is devoted to presenting aspects of proof theory that have developed out of Gentzen's work. Thus the them is "cut elimination" and transfinite induction over constructive ordinals. Smullyan's tableau systems will be used for the formalisms and some of the basic logical results as presented in Smullyan [1] will be assumed to be known (essentially only the classical completeness and consistency proofs for propositional and first order logic).
