Cet ouvrage rend hommage au Professeur Claude JOURNÈS, ancien Président de l'Université LUMIERE Lyon 2 et membre fondateur du mouvement Critique du droit. Les Mélanges offerts au Professeur Claude JOURNÈS ont retenu cette approche, utilisant le droit comme un outil de mise en perspective critique de l'ordre social et de l'ordre politique. Après un hommage au Doyen JOURNÉES (P. BLACHÈR) et l'évocation des ambitions et perspectives du mouvement critique Du droit (S. BASSET ou J. MICHEL), l'ouvrage se construit en deux (...) temps. La première partie, intitulée « Le droit critique de l'ordre social », regroupe des réflexions sur le pouvoir médical (F. DEMICHEL), sur les crimes coloniaux (A. MAHIOU), sur la dimension anthropologique du vocabulaire juridique (M.-C. HATTI) et sur le contrôle policier (M. SAOUDI), le tout ouvrant sur la possibilité d'un humanisme séculier (H. PUEL). La seconde partie, « Le droit critique de l'ordre politique », entend montrer comment le droit porte en lui une conception du pouvoir et de l'autorité. Les études explorent des pistes très diverses mêlant les finances publiques (J.-L. ALBERT), les renseignements (C. ARROUDJ), l'histoire du droit (J.-L. AUTIN, J.-C GENIN), l'histoire de la doctrine (H. GOURDON), les institutions politiques (P. BACOT, A.-S. MESCHERIAKOFF, R. CHARVIN), les institutions territoriales (J.-J. GLEUAL, H. OBERDORFF, R. PAVRE), la littérature (S. CAPORAL, G. HARE) ou les nouvelles technologies (G. PROTIÉRE). II ressort de l'ensemble que, loin d'être un simple outil technique, le droit est un puissant instrument de modélisation sociale et de justification du pouvoir. Inversant la logique dominante, la perspective critique du droit dévoile les limites d'une telle conception et rappelle que le droit, comme tous les construits sociaux, est le produit de luttes politiques et de rapports de force. En ce sens, à l'instar des valeurs défendues par le dédicataire de cet ouvrage, l'ordre critique du droit est un appel à contester les évidences, condition d'une conception plus ouverte et pluraliste de l'ordre juridique. Shaftesbury's Characteristicks of Men, Manners, Opinions, Times is a collection of treatises on interconnected themes in moral philosophy, aesthetics, literature, and politics. It was immensely influential on eighteenth-century British taste and manners, literature, and thought, and also onthe Continental Enlightenment. The author was a Whig, a Stoic, and a theist, whose commitment to political liberty and civic virtue shaped all of his other concerns, from the role of the arts in a free state to the nature of the beautiful and (...) the good.This is the first new edition of Shaftesbury's Characteristicks as a coherent collection for almost a century. A substantial Introduction discusses Shaftesbury's works and ideas in the context of his times, and traces the reception and influence of his writings through the eighteenth century andbeyond. A full and scholarly commentary is provided, as well as a complete textual apparatus. The very thorough Index is Shaftesbury's own.The text is essentially that of the first edition of 1711, as marked up with changes by Shaftesbury himself in preparation for the posthumous second edition of 1714; and the striking emblematic engravings he commissioned especially for the second edition are incorporated. _The Research Review for School Leaders, Volume III_ is specifically designed as a practical resource for school leaders whose schedules preclude opportunities to locate and review key research on every issue they must address. It places comprehensive, current, and accessible reviews of educational research at their fingertips, and is organized to make the research and practices it summarizes useful to them in their professional endeavors. This is the third volume of the _Review._ Although the title has changed, its purpose and (...) substance is continuous with the work of the earlier volumes. The first _Annual Review of Research for School Leaders_ summarized research on the status of public schooling, interdisciplinary curriculum, and educational applications of computers. The second volume addressed the topics of middle-level education, the extracurriculum, mathematics education reform, and drop outs. The present _Volume III_ offers educational leaders reviews of research on five timely educational issues: * citizenship education; * multicultural education; * gifted and talented education; * classroom assessment; and * scheduling. A basic premise of this volume is that, to make sound decisions, professionals need to be up to date on current research related to the problems with which they grapple. A second premise is that research cannot simply be imposed in a formulaic way on a local setting; the nature of the particular problem to be solved will always bear upon the relevance of research to a specific context. Thus, this volume is envisioned as a helpful resource for school leaders as they engage in important discussions of the research with teachers, school board members, parents, and other interested parties as they collaboratively seek effective resolutions to local educational problems. This new edition of Hume's Enquiry concerning the Principles of Morals, published in the Oxford Philosophical Texts series, has been designed especially for the student reader. The text is preceded by a substantial introduction explaining the historical and intellectual background to the work and its relationship to the rest of Hume's philosophy. The volume also includes detailed explanatory notes on the text, a glossary of terms, and a section of supplementary readings.

During the winter months we gratefully received donations from our readership and we've applied these funds to offset some of the costs of maintaining our tidy corner of the Web. Specifically, we've used these funds to renew our accounts at Flickr, Soundcloud, and Vimeo. We also bought a snippet of code. We continue to accept donations at our WePay (...) account so that we can upgrade our server space, which is currently being donated to us. For this, our fifth issue, we offer varve as our constellating theme. From the Swedish varv , whose semantic web includes notions of “revolution,” accretion “in layers,” and “circle,” a varve is that precise geologic formation referring to the whole of any annual sedimentary layer. We didn't need to rely on Einstein alone to relativize space and time; all of the build-up of matter accrued by the passage had already accomplished that—the spatialization of time. Scaling the term up, we recall ecologist Eugene F. Stoermer coined the term Anthropocene to refer to the extent to which human impact upon the Earth had come to constitute a new geological era. Today the time we take for reflection plumbs an unprecedented ecology and brings to consciousness undiscovered contingencies. As material and medium for making, remaking, archeologizing, and archiving thought, varves (and/as/or journals) are species of the broader category of rhythmites . Secret-ing the rhythms of deep time, every record, geologic or otherwise, is subject to all the effects of interpretation and rhetoric that the contemporary DJ has at their disposal—reverberated, delayed, stuttered, syncopated, beat-juggled, back-spun, cross-faded from one epoch to another. The record itself, however, is hyperspecific: referring to moments of passing contexts, communities, and histories. But as such, a record constitutes the possibility of a long view, chronicling changes in climates, movements of occupation, and the long counts of calendars. In response to the ongoing Covid-19 pandemic, the Erasmus Journal for Philosophy and Economics invited scholars to reflect on the philosophy and economics of pandemics, in general, and on the current pandemic, in particular. The result is this special issue, comprising ten articles—four by special invitation and six through open submission.

Community treatment orders are a legal mechanism to extend powers of compulsion into outpatient mental health settings in certain circumstances. Previous ethical analyses of these powers have explored a perceived tension between a duty to respect personal freedoms and autonomy and a duty to ensure that patients with the most complex needs are able to receive beneficial care and support that maximises their welfare in the longer-term. This empirical ethics paper presents an analysis of 75 interviews with psychiatrists, patients and (...) family carers to show how these ethical considerations map onto the different ways that community treatment orders are used and experienced in practice. A complex and nuanced account of how the requirements to respect patients’ autonomy, to respect patients’ liberty and to act beneficently should be interpreted in order to make judgements about the ethics of community treatment orders is presented. The article argues that, due to such complexity, no general ethical justification for community treatment orders can be provided, but a justification on the basis of the promotion of patients’ autonomy could provide an ethical reason for community mental health practitioners to make use of a community treatment order in some limited circumstances.
