This article explores the ethical concerns and protections that may be required when individually identifiable data originally collected solely for clinical or administrative purposes are used in research or evaluation. It asks the following broad question with respect to the interim policy developed by the Substance Abuse and Mental Health Services Administration (SAMHSA) to protect the rights and welfare of participants in its programs: For those programs and projects not classified as research, are the protections and system for review adequate? (...) Background information on SAMHSA's interim policy is provided, along with issues and questions related to the use of clinical and administrative records in research and evaluation. The article concludes with recommendations for modifying the existing participant protection guidelines, based on the preceding discussion of issues and questions. (shrink)

Wilhelmina (Mina) Rawson (1851–1933) is lauded in both academic and popular circles as the author of the first uniquely Australian cookbooks, which she wrote between 1876 and 1895. Rawson was a prolific writer and stressed that she was the first white woman settler at Boonooroo in the colony of Queensland, where she was ‘beholden to the blacks’ to show her what to eat (Rawson, 1895, p. 54). Rawson's cookbooks famously codified how to use Australian non-human animals, including wallaby, parrot (...) and goanna, as meat, and her published memories of this time detailed the context in which she implemented and refined these recipes. Rawson organised and policed racialised frontier space as a white woman, claiming British sovereignty over Butchulla country in order to profit from and teach other settlers to profit from the coastal land and waterways. This paper draws on ecofeminist and postcolonial theory and works to explore how Rawson organised food production to exercise violent colonial claims to sovereignty as a white woman, explicitly advising other settlers to do the same. In his accompanying article, Dr. Kinscherff has convincingly demonstrated why a categorical exclusion of personality disorders from the definition of “mental disease” in insanity defense adjudication is arbitrary, both conceptually and clinically. He explains his position in the context of a vignette involving a hypothetical defendant, Wilhelmina Sykes, charged with ramming her car into another car obstructing her path, causing serious injury to its driver. Dr. Kinscherff correctly points out that the determinative issue in applying the insanity defense in (...) any case, including the hypothetical case involving Ms. Sykes, is whether the defendant experienced a legally relevant functional impairment at the time of the offense. In many states — and in the hypothetical jurisdiction in which Ms. Sykes is being prosecuted — the relevant functional impairments are those that could have affected her ability “to appreciate the wrongfulness of her conduct” or “to conform her conduct to the requirements of the law. An analysis of the functioning of the Dutch monarchy in the 20th century is hardly possible by lack of documents. For the study of the contacts between the Head of State and the Cabinet-ministers a scholar needs the documents from the Cabinet of the Queen and from the Royal Archives. The archives of the Cabinet of the Queen are now accessible up to the Second World War, but the Royal Archives are closed from 1898.Tbe Dutch people bas a sympathy for (...) the dynasty and by that a deduced sympathy for the monarchy.Tbere was no real criticism on the functioning of the following queens Wilhelmina, Juliana and Beatrix. Tbe Heads of State accomodated themselves to the political and social developments. By that the monarchy lengthened its life.The formation of a new Cabinet is an essential task of the Queen. Wilhelmina did not hide her personal views but respected carefully the constitutional framework and already in the beginning of this century she asked the consulted political leaders to confirm their advices by letter. The possibility to play a role seems to be more limited since 1945. (shrink)
