The lack of academic religious studies in India has several causes: the choice of the secular University of London as model for the first universities in India in 1857, the secular constitution, the secularist approach of the first prime minister of India, Jawaharlal Nehru, and the explosive relation between major faith traditions. However, with the waning of the Indian secularist framework and the continued power and influence of Hindutva ideology, there is a need to discuss different models for religious studies (...) in India. In this article, the point of departure is Banaras Hindu University, one of the few universities in India that has religious studies, but also a faculty of Hindu theology. The focus is on the history of BHU and the recommendations of several educational commission from the 1930s to the 60s, with a note on recent attempts at BHU of renewing value education. The aim is to highlight one alternative for developing religious studies in India, whose primary goal is the formation of good citizens enabled by a set of universal human values instantiated in local traditions. To understand the history of Advaita Vedānta and its rise to prominence, we need to devote more attention to what might be termed “Greater Advaita Vedānta,” or Advaita Vedānta as expressed outside the standard canon of Sanskrit philosophical works. Elsewhere I have examined the works of Niścaldās (ca. 1791–1863), whose Hindi-language Vicār-sāgar (“The Ocean of Inquiry”) was once referred to by Swami Vivekananda as the most influential book of its day. In this paper, I look back to one of Niścaldās’s (...) major influences: Sundardās (1596–1689), a well-known Hindi poet and a direct disciple of Dādū Dayāl (d. 1604). Sundardās is typically classified as a bhakti poet rather than an Advaita Vedāntin; certainly he is not included in existing surveys or histories of Vedānta. In his youth, however, he studied Sanskrit and Vedānta in Banaras, and his poems present us with a mind that found no contradiction in claiming Dādū as his master and at the same time embracing the teachings of Advaita Vedānta. I argue that not only should Sundardās be included in histories of Advaita Vedānta, he should be credited for his originality: not only did he “Vedānticize” the Dādū Panth, he “Dādūized” Vedānta. I conclude by comparing Sundardās to two Sanskrit intellectuals from roughly the same period: Mahādeva Sarasvatī Vedāntin and Annambhaṭṭa, both of whom, like Sundardās, had commitments to Advaita Vedānta as well as to other intellectual traditions. By Jan Willis. New York: Riverhead Books, 2001. 321 pp. This book invites comparison with Diana Eck's Encountering God: A Spiritual Journey from Bozeman to Banaras(Boston: Beacon Press, 1993). Both are by prominent women scholars, both have "spiritual journey" in the (...) subtitle, and both are about Christians who come to terms with a non-Christian religion—Hinduism in Eck's case, Buddhism in Willis's case. But as soon as one gets past the titles, it is the differences that strike one. Where Eck maintains an Olympian poise, hobnobbing with Hindus but remaining a Christian and an objective scholar, interpreting and analyzing as she goes, Willis plunges into Buddhism without rejecting her family's Baptist tradition, becoming a fully participant observer so as to ask how her own history and the history of her fellow African Americans can be healed by an intensely personal internal dialogue. Eck gives us theology. Willis gives us herself. Recognized as "one of the first American scholar-practitioners of Tibetan Buddhism" (294), her students ask her if she practices meditation as well as teaching it. She gives a carefully crafted answer that unifies the practice of Buddhism with the practice of academic teaching as an authentically human activity within the Humanities.The book has the form of a Hindu epic, incidents from Willis's life interrupting the frame story, the dreaming of the title. This dream (whether actual or metaphorical, we are not told) moves with considerable dramatic power from the terror of being pursued by lions to the dreamer's transformation into a lioness who roars the Dharma like Queen Shrimala. Its five parts are called Birth, Odyssey, Choices, Becoming, and Return, taking us from her childhood as a Baptist in Docena, Alabama, to Cornell University, to India and Nepal, and back to Docena, as a self-described Baptist-Buddhist (310).Willis's journey is intimately bound up with her search for self-acceptance as a "white gal"—a noticeably light-complexioned black woman in the Jim Crow South —and for the nobility of African Americans as fully human beings. Her early experiences [End Page 234] were not encouraging. Blacks were not only physically segregated in Docena, they were electronically expunged from television shows by spurious technical difficulties ("trouble along the cable"), and she endured an attack by the Ku Klux Klan on her family's home. The customary but thoroughly illegal suffrage examination administered to her father included such questions as "How many words are there in the U.S. Constitution?" (58, italics in original). He had been specially prepared for such absurdities, and he passed. Midway in her pilgrimage Willis searches for her roots (or "kin," as she says, using the Southern word) in county and federal records, and her initial excitement turns to humiliation as the white historian tells her, with disdainful triumph, that her intelligence must have come from the white slave owner who "everybody says" was her "granddaddy's daddy" (251). A black woman was presumed to be lacking in native intelligence, and Willis's intellectual powers suffered insult not only from whites but from her own mother, who, perhaps having internalized the white folks' contempt, regarded being smart as somehow evil (25). As a student at Cornell, Willis discovered black power and participated in Black Student Alliance (BSA) demonstrations, sometimes involving guns, but she came to believe that direct political action was not for her. She was, she decided, a teacher at heart, and after much soul searching she opted for the "peaceful transformation" (129) that she hoped would come from the study and practice of Buddhism.Although her skin color was a puzzlement to some Indians, who wondered about her caste, her Tibetan teachers in Nepal accepted her as a student who was at least the equal of the white students, and even, perhaps, superior to them. Abraham Vélez de CeaThe interreligious theologian, intercultural philosopher, and pluralist mystic Raimon Panikkar died in Tavertet, Barcelona, on 26 August 2010. He was ninety-one. A pioneer of interreligious dialogue and comparative theology, Panikkar claimed to be at the same time yet without contradiction a Christian, a Buddhist, a Hindu, and a secular man.Panikkar's multiple religious belonging was not a matter of choice and shallow (...) eclecticism but rather a matter of personal experience and profound spiritual growth. His distinction between eclecticism and syncretism might be helpful to understand the complex nature of his religious identity. Eclecticism "is an uncritical mixture of religious traditions and an agreement among them obtained by chopping off all possible discrepancies in favor of an amorphous common denominator." On the contrary, syncretism "is allowing for a possible assimilation of elements by virtue of which these elements cease to be foreign bodies so that organic growth within each tradition is possible, and the mutual fecundation of religious traditions becomes a genuine option."1Another point I would like to clarify is that Panikkar's multiple religious belonging was not a question of being primarily Christian and secondarily something else, as if truth could be quantified. Panikkar objected to this "modern" way of thinking. I remember a conversation with him about this issue in which he compared these attempts to quantify religious identity to those who try to understand the Trinity as being either one or three. He said that if you begin counting you miss the point, and then he added in a defiant tone: "I am 100 percent Christian, 100 percent Hindu, 100 percent Buddhist, and 100 percent secular." When I insisted and told him that for many people multiple religious belonging is just not possible, Panikkar replied: "Well, it is my experience; I cannot help it."Panikkar's multiple religious belonging was often misunderstood and cost him the distrust of both Christians and Hindus. For instance, in 1966, Panikkar applied for a chair in Hindu philosophy at the prestigious Banaras Hindu University. Though [End Page 215] everybody agreed he was by far the most competent candidate, he was not offered the position because for many conservative Hindus Panikkar was not Hindu enough.Similarly, many conservative Catholics today would say that Panikkar went too far with his distinction between Christ and the historical Jesus; for them Panikkar was not Christian enough. However, this would be unfair. As I understand Panikkar, he was not trying to undermine any Christian claim. Quite the contrary, he was challenging what he perceived as a tribal Christology and a reduction of Christianity to a two-thousand-year-old sect. Time will tell, like it did with great thinkers such as Nāgārjuna (ca. 150-250), Śaṅ-kara (788-820), Thomas Aquinas (1225-1274), and Meister Eckhart (ca. 1260-1327), who were also criticized at first by their respective traditions. Perhaps Panikkar was simply ahead of his time, and what today seems controversial to some will become the norm in the future; it would not be the first time.Panikkar was an embodiment of interreligious dialogue, and his theology was the result of such dialogue. He was born in Barcelona on 3 November 1918. His mother was a Catholic from Catalonia, and his father was a Hindu from Kerala, India. After studying philosophy and natural sciences in Barcelona, Madrid, and Bonn, he joined the recently created Opus Dei in 1940. It should be clarified that in the aftermath of the Spanish civil war and compared to the pre-Vatican II National Catholicism of Franco's regime, Opus Dei was a progressive Catholic organization for laypeople interested in sanctifying their professional work.Panikkar was ordained a Catholic priest in 1946 and became the chaplain of a student dormitory in Madrid (Colegio Mayor la Moncloa). That very year he earned his first doctorate, in philosophy, with a dissertation titled El concepto de naturaleza: Análisis histórico y metafísico de un concepto (Complutense University of Madrid, 1946, published in 1951). The seventeenth century author Nīlakaṇṭha Caturdhara wrote several works criticising the Vedāntic theology of the sixteenth century author, Appayya Dīkṣita. In one of these works, the Vedāntakataka, Nīlakaṇṭha picks out two doctrines for criticism: that the liberated soul becomes the Lord, and that souls thus liberated remain the Lord until all other souls are liberated. These doctrines appear both in Appayya’s Advaitin and in his Śivādvaitin writings. They appear to be ones to which Appayya was committed. They raise theological and (...) conceptual problems, however, both in themselves as doctrines, and as part of nondual Vedāntic teaching. A study of the Vedāntakataka reveals those features of Appayya’s Vedānta that Advaitins in Banaras in the century after his life considered to be anomalous, and illuminates aspects of the context in which his ideas developed and circulated. This well-written examination of the texts of the Indian Tantric tradition is both a lucid introduction to an important aspect of Hindu philosophy and a valuable sourcebook expounding certain detailed questions in that tradition. Unlike Agehananda Bharati’s book, The Tantric Tradition, which surveys concepts and practices in a more anthropological way, Dr. Mishra, who teaches at Banaras Hindu University, probes the fundamental teachings directly and shows where they contrast with and how they complement the views of the more widespread (...) Advaita Vedanta philosophy. Here is a philosophical idealism intrinsic to India which is not based on Vedic or Upanishadic writings but draws upon the Agamas and the tradition of the idealistic Kashmir Shaivism. Even the Gita, we are told, can be understood in a Tantric way. (shrink)

Judicial process is an integral part of legal systems. The process rests primarily on established principles of constitutional governance and responsibility. In the last ten years, the dynamism within judicial institutions and the judicial process has gained considerable attention. The dynamism is often viewed in light of the diversity of claims being addressed, the openness of courts to foreign material, and the use of non-legal studies and findings in court proceedings. How one views the judicial process in the traditional sense, (...) and in the light of the new experiences is an important question today. Also, what new theories explain this public sphere of activity? -/- In this regard, Dr. Pathak’s book "Judicial Process" is a noteworthy contribution. The book explores the complex nature of the judicial process, along with its wider constitutional, political, and social relevance. The book builds on an understanding that the judicial process, the courts, and the judges are central to constitutional governance. With that backdrop, it engages with four aspects of the judicial process, including (1) the nature of the judicial process, (2) the engagements and interactions within the judiciary, (3) the engagements and interactions between the courts and other institutions, and (4) the protection of rights and redressal of violations function performed by courts. -/- The book includes a detailed discussion on key concepts, practices, tests, and principles. The following chapters and discussions are particularly interesting. Chapter one involves a jurisprudential take on the subject while referring to the works of Blackstone, Holmes, and Cardozo. Particularly relevant in chapter one are Indian cases that have cited Cardozo while determining important judicial matters. Further, the chapter includes foreign case law which has been cited by the Indian courts to discuss the nature of the judicial process. Chapter three on Judicial Review discusses the scope of judicial review in India and its centralizing force in constitutional governance. The author carefully explores the expansion in a judicial capacity for review. The chapter highlights the dynamism attached to the practice of judicial review, moving from the review of constitutional amendments, to that of laws, administrative actions, and policy. Further, the chapter includes a discussion on the basic structure of the Indian Constitution. Chapter four on Law of Precedent includes a discussion on stare decisis, which the author refers to as a principle conferring legitimacy and stability to the judicial system. Recent scholarship on the nature of obiter dicta of higher courts and persuasive quality of foreign case law in domestic cases has been cited. Chapter five covers the Independence of the Judiciary debates in India. It discusses the issue of post-retirement appointments of judges and recusal from judicial matters. Chapter eight Judicial Activism traces the development of the concept from its early days to the present times. The chapter adopts the five core meanings offered by Keenan Kmiec to substantiate the old and the new avatars of judicial activism. The chapter discusses the role of social action litigation in India and its hand in defining the judiciary as a protector of rights and constitutional values. -/- The book provides sufficient guidance to study the nature of the judicial process. It also makes one curious about the changing nature of the judicial process and the new waves of constitutional ethics and governance. The following are some of the themes not attended to in the book. First, the judgments of the courts. The written judgments constitute an integral part of the judicial process. The judgments constitute public law reaching out to beneficiaries including litigants, people at large, as well as foreign institutions and courts. That being said, a discussion on judgements and the written or unwritten standards governing the same needs attention. Also included in this point is the role of dissenting judgments. How should one view or study dissent in judgments of constitutional significance? A normative framework to study the same is much needed. Second, the tools and indicators to measure judicial impact. The judicial impact can include (a) the impact of judicial decisions on the law, policy, and society (b) the impact of law/legislation on the judicial process, and (c) the impact of technological and scientific advancements on the judicial process. Tools like judicial impact assessment have been widely argued to be important to the working of the courts. Further, parameters to study compliance, policy integration, and the impact of judicial decisions on other state institutions have gained attention. (shrink)
