Indian Secularism is different from the understanding of Secularism in the West. In India the concept of secularism is understood not as a separation of State and Religion but the recognition, protection and support of all religions by the State without any discrimination. Though Hinduism is the religion of about 80% Indians it is not a State religion. In the recent past some Hindu fundamentalist groups are trying to destroy the pluralist culture and multi-religious ethos of India by using political (...) power to make India mono-cultural and mono-religious. It is a threat to Indian Secularism. It is to be resisted by all right thinking Indian citizens. The question "What can justify criminal punishment ?" becomes especially insistent at times, like our own, of penal crisis, when serious doubts are raised not only about the justice or efficacy of particular modes of punishment, but about the very legitimacy of the whole penal system. Recent theorizing about punishment offers a variety of answers to that question-answers that try to make plausible sense of the idea that punishment is justified as being deserved for past crimes; answers that try to (...) identify some beneficial consequences in terms of which punishment might be justified; as well as abolitionist answers telling us that we should seek to abolish, rather than to justify, criminal punishment. This book begins with a critical survey of recent trends in penal theory, but goes on to develop an original account (based on Duff's earlier Trials and Punishments) of criminal punishment as a mode of moral communication, aimed at inducing repentance, reform, and reconciliation through reparation-an account that undercuts the traditional controversies between consequentialist and retributivist penal theories, and that shows how abolitionist concerns can properly be met by a system of communicative punishments. In developing this account, Duff articulates the "liberal communitarian" conception of political society (and of the role of the criminal law) on which it depends; he discusses the meaning and role of different modes of punishment, showing how they can constitute appropriate modes of moral communication between political community and its citizens; and he identifies the essential preconditions for the justice of punishment as thus conceived-preconditions whose non-satisfaction makes our own system of criminal punishment morally problematic. Punishment, Communication, and Community offers no easy answers, but provides a rich and ambitious ideal of what criminal punishment could be-an ideal of what criminal punishment cold be-and ideal that challenges existing penal theories as well as our existing penal theories as well as our existing penal practices. AFTER DISTINGUISHING PARAPSYCHOLOGY FAVORABLY FROM VARIOUS PRESENTLY POPULAR YET WHOLLY DISREPUTABLE EXERCISES IN FRAUD AND SELF-DECEPTION, THIS PAPER CONSIDERS THREE ASPECTS IN WHICH IT DIFFERS FROM ALL ESTABLISHED HIGH-STATUS SCIENCES. FIRST, THE FIELD HAS TO BE DEFINED NEGATIVELY. SECOND, THERE IS AFTER OVER A CENTURY OF INVESTIGATION STILL NO REPEATABLE DEMONSTRATION OF THE GENUINENESS OF ANY PSI-PHENOMEN. THIRD, WE HAVE NO EVEN HALFWAY PLAUSIBLE THEORY WITH WHICH TO ACCOUNT FOR THE MATERIALS WHICH PARAPSYCHOLOGY IS SUPPOSED TO HAVE TO EXPLAIN. THE (...) I begin by discussing the ways in which a would‐be blamer's own prior conduct towards the person he seeks to blame can undermine his standing to blame her (to call her to account for her wrongdoing). This provides the basis for an examination of a particular kind of ‘bar to trial’ in the criminal law – of ways in which a state or a polity's right to put a defendant on trial can be undermined by the prior misconduct of the (...) state or its officials. The examination of this often neglected legal phenomenon illuminates some central features of the criminal law and the criminal process, and some of the preconditions for the legitimacy of the criminal law in a liberal republic. Locke's contribution to the discussion was fourfold: First , he saw the importance of the problem; Second , he realized that the puzzle cases, the “strange suppositions,” were relevant; Third , he maintained “same” had a different meaning when applied to “person” from its meaning in other contexts; and, Fourth , he offered his much criticized solution of the problem.

At the beginning of Book X of his last work The Laws Plato turns his attention from violent and outrageous actions in general to the particular case of undisciplined and presumptuous behaviour in matters of religion: “We have already stated summarily what the punishment should be for temple-robbing, whether by open force or secretly. But the punishments for the various sorts of insolence in speech or action with regard to the gods, which a man can show in word or deed, (...) have to be proclaimed after we have provided an exordium. Let this be it: ‘No one believing, as the laws prescribe, in the existence of the gods has ever yet performed an impious action willingly, or uttered a lawless word. Anyone acting in such a way is in one of three conditions: either, first, he does not believe the proposition aforesaid; or, second, he believes that though the gods exist they have no concern about men; or, third, he believes that they can easily be won over by the bribery of prayer and sacrifice”. Nesse cenário é que os textos acerca da língua (...) enquanto colonização, da suposta epidemia enquanto multietnicidade, da diáspora, das miscigenações vistas com muita resistência, e certas inversões de significados tidos como maniqueísmos e tabus, como sugere o próprio título Venenos de Deus, remédios do Diabo, desvelam estéticas da crueldade nos cruzamentos de fronteiras e nas fronteiras que se cruzam em discursos identitários. First published in 1961, this book considers Hume’s request to be judged solely by the acknowledged works of his maturity. It focuses on Hume’s first Inquiry in its own right as a separate book to the likes of his other works, such as the Treatise and the Dialogues, which are here only used as supplementary evidence when necessary. This approach brings out, as Hume himself quite explicitly wished to do, the important bearing of his more technical philosophy on matters of (...) religion and of world-outlook generally: "Be a philosopher; but amidst all your philosophy, be still a man.". This article discusses contemporary social psychological approaches to the social relations and appraisals associated with specific emotions; other people’s impact on appraisal processes; effects of emotion on other people; and interpersonal emotion regulation. We argue that single-minded cognitive perspectives restrict our understanding of interpersonal and group-related emotional processes, and that new methodologies addressing real-time interpersonal and group processes present promising opportunities for future progress.

Dependency relationships within the cell cycle allow cells to arrest the cycle reversibly in response to agents or conditions that interfere with specific aspects of its normal progression. In addition, overlapping pathways exist which also arrest the cell cycle in response to DNA damage. Collectively, these control mechanisms have become known as checkpoints. Analysis of checkpoints is facilitated by the fact that dependency relationships within the cell cycle, such as the dependency of mitosis on the completion of DNA synthesis, and (...) the DNA damage checkpoint can be separated genetically. In fission yeast, Schizosaccharomyces pombe, the dependency of mitosis on prior completion of DNA synthesis is mediated through tyrosine‐15 phosphorylation of the ubiquitous mitotic regulator p34cdc2. In contrast, the arrest of mitosis caused by DNA damage acts through a separate mechanism that appears to be independent of tyrosine‐15 phosphorylation. Despite these distinct interactions with the mitotic machinery, the majority of fission yeast mutants that are deficient in mitotic arrest after DNA damage are also unable to respond to inhibition of DNA synthesis. In this essay we survey the current knowledge concerning feedback controls and checkpoints within fission yeast and relate this to information derived from other systems. (shrink)

I discuss a significant distinction between two different applications of the principle of double effect. It serves sometimes to distinguish the intended effects of an action from side-Effects which are "relevant" to it, As providing reasons against it, For which the agent must admit responsibility, And of which he is the intentional agent; and sometimes to distinguish intended effects from side-Effects which are "irrelevant" to the action, As to which the agent denies responsibility and intentional agency.

The concept of anticipation, on the one hand, has received a considerable treatment in classical phenomenology, particularly in Husserl. The Zhuangzi, on the other hand, has not been explored with the help of Husserl’s concept of anticipation. Broadly construed, anticipation, due to its association with robust proclivity to seeing and conjuring up possibilities issuing from a phenomenon, shall have no place in the Zhuangzi. Against such backdrop, I argue that—albeit the Zhuangzi does not develop an explicit discourse on anticipation—a delimited (...) form of anticipation (‘d-anticipation’), that is, one which is inspired by Husserl’s concept of anticipation evident in his genetic phenomenology, can work in concert with the thoughts articulated in the Zhuangzi. I demonstrate this via examining death, desire, and freedom evident in the Zhuangzi. That ‘d-anticipation’ can work in concert with the thoughts articulated in the Zhuangzi can be apprehended in a variety of ways. Firstly, it can be seen in our natural response to death and the way in which we handle desires. Secondly, it points to Zhuangzi’s reductionistic manner of appreciating the richness of reality. Thirdly, it offers a way in which we can live life according to our nature. Fourthly, it points to an exercise of freedom which opens up the possibility of transcending conventional standards. Fifthly, it is inherently constitutive of the process of comportment with the Dao. Finally, it is in essence constitutive of a phenomenon or circumstance. In setting out to demonstrate these contentions, I seek to show that ‘d-anticipation’ can fill in a lacuna brought about by the negative appraisal of anticipation in the Zhuangzi and can assume a pivotal role in one’s comportment with the Dao. In Chapter VI of his powerful study God and Other Minds Dr Alvin Plantinga deploys what—following a suggestion of mine—he calls ‘The Free Will Defence’. He presents his case there as a reaction to two earlier attempts to overcome that defence. I propose to take this chapter in Plantinga as my starting point here; and, as far as can be, to ignore, though not by that token to repudiate, those by now rather ancient earlier essays.
