Este é um estudo sobre a mediação da cultura no processo de compreensão e interpretação das normas jurídicas na determinação de seu significado e alcance de sua aplicação concreta, com base no estudo da obra Verdade e Método, de Hans-Georg Gadamer, analisa-se o papel da cultura no procedimento hermenêutico jurídico, tanto do ponto de vista do intérprete, quanto do destinatário da norma jurídica, onde o jurista entra no jogo da interpretação da norma, com o conjunto de preconceitos proporcionado pela tradição, (...) tendo um horizonte que deve fundir-se com o horizonte do caso concreto, para produzir simultaneamente uma compreensão e interpretação da norma, que permita resolver o caso concreto, por uma solução interpretativa criativa que se manifesta através da linguagem, que no que lhe concerne é um produto cultural que permite a compreensão e expressão do pensamento humano em diálogo até com outras culturas, para que a cultura seja o palco, o horizonte onde se dá o processo histórico de formação e aplicação do ordenamento jurídico. Strong evidence shows that exposure and engagement with the natural world not only improve human wellbeing but can also help promote environmentally friendly behaviors. Human-nature relationships are at the heart of global agendas promoted by international organizations including the World Health Organization’s “One Health” and the United Nations “Ocean Decade.” These agendas demand collaborative multisector interdisciplinary efforts at local, national, and global levels. However, while global agendas highlight global goals for a sustainable world, developing science that directly addresses these agendas (...) from design through to delivery and outputs does not come without its challenges. In this article, we present the outcomes of international meetings between researchers, stakeholders, and policymakers from the United Kingdom and Brazil. We propose a model for interdisciplinary work under such global agendas, particularly the interface between One Health and the UN Ocean Decade and identify three priority research areas closely linked to each other: human-nature connection, conservation-human behavior, and implementation strategies. This article sets forth a compositional model of ideology by drawing on the tradition of historical materialism and further developing its insights into the aesthetic composition of reality. It demonstrates how ideology is not simply a set of false beliefs but is rather the process by which social agents are composed over time in every dimension of their existence, including their thoughts, practices, perceptions, representations, values, affects, desires, and unconscious drives. By working through a number of diverse debates and authors—ranging (...) from Karl Marx and Friedrich Engels to Louis Althusser, Eduardo Galeano, Rosaura Sánchez, and Paulo Freire—it thereby elucidates how ideology is best understood as an aesthetic process that includes aspect of sense and sense-making, and that therefore requires a collective, cultural revolution as its antidote. Contextualizar os processos oriundos de um período pandêmico é reconhecer que, para a nossa sociedade, o que vivemos com a pandemia da Covid-19 foi, de fato, inédito e histórico. Além de apresentar um cenário de acúmulo de emoções, mudança de rotina e sentimentos de medo e angústias, uma nova forma de interação social e trabalho precisou ser vivenciada. Assim, verificamos a importância de levantar reflexões acerca da maternidade vivenciada no contexto de isolamento social pelas mulheres que são mães discentes e (...) que precisaram conciliar suas atividades de cuidados diários com os estudos acadêmicos. É fundamental refletir sobre como funcionou o ambiente universitário no formato virtual e como tem sido o processo de retorno às aulas presenciais. Desse modo, neste artigo, o objetivo é apresentar reflexões acerca dos efeitos que o isolamento social no contexto da Covid-19 pode ter gerado à saúde mental de mulheres que são mães e universitárias. Tal texto compõe o levantamento bibliográfico do projeto de pesquisa “Atenção à saúde mental de mães universitárias no contexto da Covid-19”, realizado no curso de Psicologia da Universidade Federal do Pará. Acreditamos ser possível vivenciar no ambiente acadêmico aquilo que consideramos uma clínica da situação contemporânea e que colabora para a criação de espaços de acolhimento dentro da Universidade. No caso específico desta pesquisa, buscamos um acolhimento voltado para as mães universitárias que buscam permanecer nesses espaços, mesmo diante de tantos desafios. (shrink)

A citation index is a bibliographic database that provides citation links between documents. The first modern citation index was suggested by the researcher Eugene Garfield in 1955 and created by him in 1964, and it represents an important innovation to knowledge organization and information retrieval. This article describes citation indexes in general, considering the modern citation indexes, including Web of Science, Scopus, Google Scholar, Microsoft Academic, Crossref, Dimensions and some special citation indexes and predecessors to the modern citation index like (...) Shepard’s Citations. We present comparative studies of the major ones and survey theoretical problems related to the role of citation indexes as subject access points (SAP), recognizing the implications to knowledge organization and information retrieval. Finally, studies on citation behavior are presented and the influence of citation indexes on knowledge organization, information retrieval and the scientific information ecosystem is recognized. O êxodo rural brasileiro compreendeu um processo de grande magnitude desde o seu início, onde, em comparativo, poucos países experimentaram fluxo migratório tão intenso, tendo em vista a quantidade absoluta da população atingida. Uma das características encontradas nos movimentos migratórios brasileiros se estabelece na diferenciação por sexo. Estudos apontam que as mulheres migram mais do que os homens, além do fluxo migratório se caracterizar cada vez mais pela saída de jovens do campo. Nesse sentido, o presente artigo se propõe a (...) analisar a categoria rural, abordando a situação das mulheres migrantes no contexto do Norte de Minas. Para tanto, utilizará do levantamento bibliográfico na construção de uma revisão acerca das práticas migratórias do campo realizadas por jovens, de modo a entender e problematizar a questão do gênero no processo migratório. Como resultado parcial tem-se que as mulheres continuam migrando, sendo tal deslocamento realizado com propósitos variados e, muitas vezes, devido à ausência de políticas públicas regionais, que resultam em pouca perspectiva de valorização do campo/gênero. Sendo assim, o processo migratório, principalmente no que diz respeito à questão de gênero, não se encerra nas discussões apresentadas, sendo necessários estudos que acompanhem as distintas dimensões que o migrar implica. Tradicionalmente, el patrimonio se ha relacionado con la educación histórica desde una perspectiva restrictiva que dejaba fuera a buena parte de las manifestaciones patrimoniales, entre ellas, las que se incluyen en el ámbito del patrimonio inmaterial. En este sentido, el presente trabajo se centra en la relación entre patrimonio inmaterial y pensamiento histórico dentro de la formación del profesorado de Educación Primaria. Desde el paradigma interpretativo se han analizado 27 propuestas didácticas de un total de 54 estudiantes del Grado de (...) Educación Primaria, con el propósito de conocer la percepción que poseen del uso del patrimonio inmaterial para trabajar los conceptos asociados al desarrollo del pensamiento histórico. Los datos obtenidos apuntan a la existencia de una alta consideración del patrimonio inmaterial para trabajar el pensamiento histórico en la Educación Primaria. (shrink)

This article brings a historical perspective to explain the recent dissemination of randomized controlled trials (RCTs) as the new “gold standard” method to assess international development projects. Although the buzz around RCT evaluations dates from the 2000s, we show that what we are witnessing now is a second wave of RCTs, while a first wave began in the 1960s and ended by the early 1980s. Drawing on content analysis of 123 RCTs, participant observation, and secondary sources, we compare the two (...) waves in terms of the participants in the network of expertise required to carry out field experiments and the characteristics of the projects evaluated. The comparison demonstrates that researchers in the second wave were better positioned to navigate the political difficulties caused by randomization. We explain the differences in the expertise network and in the type of projects as the result of concurrent transformations in the fields of development aid and the economics profession. We draw on Andrew Abbott’s concept of “hinges,” as well as on Bourdieu’s concept of “homology” between fields, to argue that the similar positions and parallel struggles conducted by two groups of actors in the two fields served as the basis for a cross-field alliance, in which RCTs could function as a “hinge” linking together the two fields. In this paper I explain the impact of phenomenological philosophy in the conceptions of Luís Cabral de Mancada about law and juridical experience. Stressing that Moncada was the first scholar in Portugal who made an extensive use of phenomenological doctrines within his own field of research, I show that Husserl, Hartmann, and Scheler were the most influential thinkers for him. As a matter of fact, they had a positive impact on Moncada’s conceptions about Law, the axiological realm, the State, and (...) jusnaturalism. (shrink)

In this paper, I stress the importance of Luís Cabral de Moncada for the resettlement of the Philosophy of Law in the Portuguese university. I focus my attention on the overthrown of Positivism, and, as a consequence, on the reintroducing of axiological and ethical issues in the foundations of positive law. In so doing, I consider the relevance Phenomenology had for Moncada’ s theory of law, namely the theory of eidetic insight, and, particularly, the phenomenology of values. Moncada’s appropriation of (...) some phenomenological themes and concepts was developed in a close contact with Husserl, Scheler, and Nicolai Hartrnann. (shrink)

Background Paternalism/overprotection limits communication between healthcare professionals and patients and does not promote shared therapeutic decision-making. In the global north, communication patterns have been regulated to promote autonomy, whereas in the global south, they reflect the physician’s personal choices. The goal of this study was to contribute to knowledge on the communication patterns used in clinical practice in Mexico and to identify the determinants that favour a doctor–patient relationship characterized by low paternalism/autonomy. Methods A self-report study on communication patterns in (...) a sample of 761 mental healthcare professionals in Central and Western Mexico was conducted. Multiple ordinal logistic regression models were used to analyse paternalism and associated factors. Results A high prevalence of paternalism was observed among mental health professionals in Mexico. The main determinants of low paternalism/autonomy were medical specialty and gender, with female physicians being more likely to explicitly share diagnoses and therapeutic strategies with patients and their families. A pattern of highly explicit communication was strongly associated with low paternalism/autonomy. Finally, a modifying effect of age strata on the association between communication pattern or specialty and low paternalism/autonomy was observed. Conclusions Among mental health professionals in Mexico, high paternalism prevailed. Gender, specialty, and a pattern of open communication were closely associated with low paternalism/autonomy. Strengthening health professionals’ competencies and promoting explicit communication could contribute to the transition towards more autonomist communication in clinical practice in Mexico. The ethical implications will need to be resolved in the near future. (shrink)

In this paper, I analyze Carlos Cossio’s theory of law, and how his theory was a reaction to Kelsen’s juridical positivism. The most important aspect I highlight is the logical abstract normativism defended by Kelsen, and how it was overcome by a transcendental and existential theory of law, which Cossio develops in a close relationship to Husserl and Heidegger views.

The justification of Natural Law is a very controversial issue, not only after the Positivist’s rebuttals, but since its very anthropological foundations in the early modern age. In this paper, I try do give an account of Natural Law and natural rights in terms of a phenomenological description of the background of normative intentionality. Taking a genetic stance, I go from the positive norm and the intentionality that constitutes it to the underling pregiveness that supplies the condition of its possibility. (...) I exhibit it as the experience of the live-world, and I analyze it as an intersubjective world, where persons are given as equals and worth-counting. This is the very root of the concept of human dignity. Starting from it, I develop an account of the sense and content of the concept of Human Rights as a set of eidetic laws creating the framework for authentic human relationships. (shrink)

The aim of this paper is to investigate among a group of non-profit organizations: a) the effect of ethical leadership on volunteers’ satisfaction, affective organizational commitment and intention to stay in the same organization; b) the role played by job satisfaction as a mediator in the relationship between ethical leadership and volunteers’ intentions to stay in the same organization, as well as between ethical leadership and affective commitment. An anonymous questionnaire was individually administered to 198 Italian volunteers of different non-profit (...) organizations. The questionnaire contained the Ethical Leadership Scale, the Volunteers Satisfaction Index, the Affective organization Scale, as well as questions regarding the participants’ age, sex, type of work, level of education, length of their volunteer works, intention to volunteer in the following months in the same organization. The construct as well the effects of EL on volunteers is approached in light of the Social Exchange Theory and the Social Learning Theory. Structural equation models were used to test hypothesized relationships. The results confirm the role of mediation of volunteer satisfaction in the relationships between the variables studied. In particular, ethical leadership was found to be positively associated both with volunteers’ intention of staying and with their affective commitment. In the first case this relationship is fully explained by the mediation of the volunteers’ satisfaction, while the latter is explained by both direct and indirect factors. To the authors’ knowledge, this the first attempt to understand the role played by ethical leadership on volunteers’ behavior and, more in general, in the management of non-profit organizations. Findings are relevant both for practitioners and managers of non-profit organization, since they suggest the relevance of the perception of ethical leadership by volunteers, as well as for scholars, since they further deepen the knowledge on EL and its effects on the followers. Limits of the study: the questionnaire was administered only among a group of non-statistical sample of volunteers. Furthermore, the study reached only volunteers from Italian non-profit organization. (shrink)

Resumo: Arthur Schopenhauer ficou conhecido como o pensador do “pessimismo filosófico”. Tratase de uma doutrina que, em linhas gerais, apresenta uma determinada interpretação acerca do valor do mundo, mas que, em seu sentido ainda mais básico, questiona a possibilidade de atribuição de valor ao todo da existência: há “justificação” para a existência? A partir da resposta a essa pergunta, o filósofo alemão desenvolve sua “metafísica da vontade” e, como seu desdobramento, sua teoria da “redenção”, ou soteriologia. Entretanto, o “filósofo do (...) pessimismo” também afirma, em sua obra, que há uma “ordenação moral de mundo” e um “significado moral da existência”, o que parece ir na direção oposta ao “pessimismo”. O presente artigo analisa o significado das noções de ordenação moral de mundo e justificação da existência no pensamento de Schopenhauer, a fim de demonstrar em que medida significado moral da existência e pessimismo filosófico se relacionam no pensamento do autor.: Arthur Schopenhauer is known as the thinker of “philosophical pessimism”. It means, in general lines, the doctrine that presents a certain worldview, but in its more basic sense, it questions the possibility of giving a meaning to the whole of existence: is there “justification” for the existence? By answering this question the German philosopher develops his “metaphysics of the will” and, as its unfolding, his theory of “redemption”, or soteriology. However, the “philosopher of pessimism” also asserts in his work that there is a “moral ordinance of world” and a “moral meaning of existence”, which seems to go on the opposite direction of what is claimed by the “pessimism”. The present paper analyses the sense of the notions of moral ordinance of world and justification of existence in Schopenhauer’s thought, in order to demonstrate how far moral meaning of life and philosophical pessimismo interact in his thought. El presente artículo se centra en una investigación sobre los vínculos entre la teoría crítica de la educación inclusiva, la justicia social y la literatura de tradición oral, puesto que a través de los referentes hallados se interpela a la literatura desde el mismo contexto del Sur Global, visto como un punto de partida para comprender los problemas culturales, sociales e interculturales. Desde estas consideraciones, se hizo una revisión sistemática de la producción y publicación de trabajos investigativos referentes al estudio (...) de las variables Literatura de tradición oral, Justicia social y Educación inclusiva, bajo el enfoque PRISMA (Preferred Reporting Items for Systematic reviews and Meta-Analyses). El objetivo del análisis propuesto fue conocer las características principales de las publicaciones registradas en base de datos Scopus y Web of Science y su alcance en el estudio de las variables propuestas, logrando la identificación de 106 publicaciones en total. Gracias a esta primera identificación, se refinaron los resultados a través de dos palabras clave, “Social justice (and) Inclusive education”, llegando a un total de 23 documentos, después de excluir los duplicados y aquellos que no cumplían con los criterios de análisis. Luego fueron analizados esperando conocer la relación entre las variables, y cómo en América se ha avanzado en materia de lucha contra la corrupción. Los hallazgos apuntan a: 1) que la educación inclusiva establece vínculos con la literatura de tradición oral desde el reconocimiento de la pluralidad y las diferencias culturales; 2) que los autores resaltan expresiones culturales transmitidas de generación en generación para fecundar nuevos conocimientos desde la comunidad; 3) y que la justicia social se traduce en una educación que reconoce diferencias y genera espacios para otros saberes, como es el caso de la literatura de tradición. The tradeoff hypothesis in the speech–gesture relationship claims that (a) when gesturing gets harder, speakers will rely relatively more on speech, and (b) when speaking gets harder, speakers will rely relatively more on gestures. We tested the second part of this hypothesis in an experimental collaborative referring paradigm where pairs of participants (directors and matchers) identified targets to each other from an array visible to both of them. We manipulated two factors known to affect the difficulty of speaking to assess (...) their effects on the gesture rate per 100 words. The first factor, codability, is the ease with which targets can be described. The second factor, repetition, is whether the targets are old or new (having been already described once or twice). We also manipulated a third factor, mutual visibility, because it is known to affect the rate and type of gesture produced. None of the manipulations systematically affected the gesture rate. Our data are thus mostly inconsistent with the tradeoff hypothesis. However, the gesture rate was sensitive to concurrent features of referring expressions, suggesting that gesture parallels aspects of speech. We argue that the redundancy between speech and gesture is communicatively motivated. (shrink)

O segundo objetivo, é promover o diálogo de suas teses, contrárias ao processo de secularizaçáo, com as teses de Gianni Vattimo (1936-), pensador italiano e entusiasta de um mundo secularizado. A despeito (...) de suas diferenças, a política e a secularizaçáo aparecem no pensamento dos dois autores. Ambos partem, na verdade, de análises muito próximas, isto é, do conceito paulino de kênósis . A partir dessa idéia, ambos constroem suas respectivas visões acerca da política e da secularizaçáo. Todavia, o foco principal deste artigo é analisar a filosofia de Kierkegaard. A filosofia de Vattimo será analisada apenas de forma secundária e em diálogo com as teses de Kierkegaard. (shrink)

Este artigo busca interpretar a gravura "Melancolia I", do renascentista alemão Albrecht Dürer, segundo o pano de fundo filosófico do pensamento de Spinoza. A ideia central é a de que, nessa gravura, haveria uma intuição artístico-filosófica pela qual Dürer foi levado a associar a tristeza melancólica à ideia de um conhecimento confuso e turvado pela imaginação. Tal intuição se completaria numa outra gravura, criada no mesmo ano, o "São Jerônimo em seu gabinete", na qual a melancolia do "homem de cultura" (...) renascentista desaparece. Tais intuições permitiriam ler as duas gravuras sob a ótica das "teorias" da mente e do conhecimento de Spinoza, para quem o conhecimento está associado à alegria, desde que esteja livre das sombras da imaginação projetadas pelo medo, pelo desejo excessivo, pelas crenças ou pelas superstições. This article seeks to interpret the engraving "Melencolia I" , made by the German Renaissance’s painter Albrecht Dürer, according to the philosophical background of Spinoza’s thought. The central idea is that, in this picture, there would be an artistic-philosophical intuition by which Dürer associated melancholy to the idea of a confused and muddied knowledge caused by imagination. Another engraving, also created in 1514, completes this intuition: "St. Jerome in his study", in which the melancholy of the Renaissance’s "man of culture" disappears. Such insights allow reading the two pictures from the perspective of Spinoza’s "theories" of mind and knowledge. He assumes that knowledge is associated with joy, since it is free from the shadows of the imagination projected by fear, excessive desire, beliefs or/and superstitions. (shrink)
