On September 9, 2013, diplomats and civil society activists gathered in a ballroom in New York to welcome Jennifer Welsh as the UN Secretary-General's new Special Adviser on the Responsibility to Protect. In her first public appearance in that role, Special Adviser Welsh explained that one of her top priorities would be “to take prevention seriously and to make it meaningful in practice.” “In the context of RtoP,” Welsh added during the discussion, “we are talking about crimes, and crimes have (...) implications in terms of how we deal with them. You'll hear me say that a lot.” Welsh's approach of treating RtoP as a principle that is primarily concerned with prevention and is firmly linked to international crimes neatly captures the evolution of RtoP since its formal acceptance by states at the 2005 UN World Summit. Paragraphs 138 to 140 of the World Summit's Outcome Document not only elevated the element of prevention to a prominent place within the principle of RtoP but also restricted the scope of RtoP to four specific crimes under international law: genocide, war crimes, ethnic cleansing, and crimes against humanity. The crime and prevention–focused version of RtoP has subsequently been defended and promoted by Secretary-General Ban Ki-moon and by UN member states. This article seeks to systematically explore some of the implications of linking RtoP to the concept of international crimes, with a particular focus on the preventive dimension of RtoP, the so-called responsibility to prevent. What, then, are the consequences of approaching the responsibility to prevent as the prevention of international crimes?In order to systematically examine this question, this article turns to literature from criminology. While the criminological perspective has so far been neglected in debates on RtoP, the prominent criminologists John Hagan and Wenona Rymond-Richmond argue vehemently that “criminology is crucially positioned to contribute understanding and direction to what the United Nations has mandated as the ‘Responsibility to Protect’ groups that are threatened with mass atrocities.” For the purpose of this article, the label “criminology” comprises domestic criminology, supranational criminology, and international criminal law. While insights from supranational criminology and international criminal law are directly applicable to international crimes, translating knowledge generated in relation to crimes at the domestic level to atrocity crimes at the international level is, of course, not without challenges. Reasoning by analogy is an important method in this regard, though given the anarchical nature of international society some analogies will inevitably be imperfect. The benefits of such an approach, if carefully employed, however, outweigh the risks. (shrink)

Fire setting is a significant problem for society, costing many human lives and causing great property damage. One important risk factor of fire setting observed in forensic samples is fire interest. However, less is known about the relationship of fire interest and fire setting to other variables such as personality traits in subclinical samples. In this study, we observed the relationship of potentially important personality traits with fire interest and fire setting in a sample of N = 222 students. In (...) addition to zero-order correlations, we calculated path models and a logistic regression including all predictor variables. From the Dark Tetrad, consisting of psychopathy, narcissism, Machiavellianism, and three facets of sadism, psychopathy, and physical sadism were found to be associated with fire interest and fire setting. Furthermore, vicarious sadism was associated with fire interest. The other Dark Tetrad traits and four sensation seeking facets did not substantially add to the predictions. This confirms the results of previous studies with clinical and forensic samples with psychopathy and sadism as relevant predictors for fire interest and fire setting. Our results also provide evidence for viewing sadism as the multidimensional construct discriminating between vicarious and other forms of sadism, for the distinction of psychopathy and Machiavellianism, and for the Dark Tetrad being linked to object related violence. Genomic imprinting is an epigenetic mechanism resulting in the preferential expression of the maternal or paternal alleles of a specific subset of genes in the mammalian genome. A key but relatively unexplored question is how imprints are established in the germline. New observations(1) on two classical imprinting disorders, the Prader‐Willi (PWS) and Angleman (AS) syndromes, offer the first genetic insight into this process. Der Band versammelt Beiträge renommierter Vertreter unterschiedlicher Disziplinen zu der Frage, ob wir tatsächlich einen Zugang zur Wirklichkeit haben oder lediglich von unseren eigenen Konstruktionen der Wirklichkeit umgeben sind. In der Debatte kommt der Sprache eine zentrale Rolle zu. Konstruktivistische Positionen gehen davon aus, dass unsere Wörter und Sätze nie die Dinge an sich bezeichnen, sondern dies immer aus einer bestimmten Perspektive tun. Einer ‚Wirklichkeit an sich‘ nachzujagen, ist zwecklos, als wichtig gilt das Aufzeigen der Perspektiven. Nicht selten geschieht das (...) in aufklärerischer Absicht, wenn etwa Formulierungen wie die von der „Größe eines Volkes“, der „historischen Bestimmung einer Nation“ oder der „Natur des Geschlechts“ kritisch hinterfragt werden. Diesen Versuchen, die Wirklichkeit als interessengeleitet konstruierte auszuweisen, wird mit dem Argument begegnet, der Akt der Aufklärung diene letztlich nur dazu, die jeweils eigene Position als die ‚eigentlich richtige‘ durchzusetzen. This essay enquires into the implications for criminal law of Derrida’s analysis in the Death Penalty seminars. The seminars include a reading of Kant’s Metaphysics of Morals, specifically Kant’s reflections on the sovereign right to punish, which is read in conjunction with the reflections of Freud and Reik on the relation between the unconscious and crime, as well as Nietzsche’s reflections on morality, punishment and cruelty. What comes to the fore in Derrida’s analysis is a system of economic exchange (...) operating on an unconscious level, of which criminal law forms an intrinsic part. Derrida’s analysis of the ‘origin’ of crime in the seminars poses serious questions to the assumption of freedom underlying modern criminal law. The link, which he posits between punishment and political theology, likewise challenges the existing theories and forms of punishment. What the seminars call for, in the name of the Kantian Enlightenment, is a radical break with economic circularity as it operates in respect of crime and punishment. (shrink)

Based on a license to travel granted in February 1610 1 and a parenthetical date in a late seventeenth-century source, 2 scholars from (...) George Croom Robertson (1886) to John Stoye (1952 and 2nd ed. 1989), Miriam Reik (1977), Noel Malcolm (1981), Arnold A. Rogow (1986), Richard Tuck (1989 and 1993), and Johann Sommerville (1992) have asserted that Hobbes and Cavendish left on the Grand Tour in 1610. Scholars have claimed that the trip to France, Italy, and perhaps Germany lasted anywhere from three to five years, and they have speculated as to where Hobbes and Cavendish went and whom they met. Robertson wroteThe first journey, which lay through France, Germany, and Italy, was begun in the year when France and Europe were thrown into consternation by the deed by Ravaillac; and so readily does the fanatic’s name slip from his pen even half a century later, that we may well suppose the future apostle of the inviolability of the sovereign to have been moved by what he may have heard or seen of the tragic event and its consequences at the time. 3 [End Page 177]Arnold A. Rogow in Thomas Hobbes, Radical in the Service of Reaction, expands on Robertson’s point by suggesting thatthe tour of 1610, close in time to the murder of Henry IV, if not overlapping it, may have been decisive in convincing Hobbes of the dangers to society and civil peace of religious fanaticism. Guy Fawkes and his coconspirators in the 1605 Gunpowder Plot and François Ravaillac were all fanatical Catholics, and Hobbes, although he wrote nothing about these conspiracies at the time, may have decided when still a young man that the single most important condition for domestic order and stability was the total and absolute submission of religion to political authority. 4While noting that the first forty years were the “dark years” in Hobbes life, Miriam Reik agrees on the date of the trip: “In 1610, the Baron sent his son for that indispensable part of a seventeenth century nobleman’s education, the Grand Tour; Hobbes went along as an escort the journey receives scant notice in his writing.” 5 Stoye commented that “Perplexed biographers can only state that Hobbes accompanied Cavendish on a journey to France and Italy, commencing in the year 1610.” 6Noel Malcolm tried to establish a chronology for the Grand Tour in his article “Hobbes, Sandys and the Virginia Company,” 7 demonstrating that Cavendish was back in England for the Parliament of 1614 to which he was elected although he was soon back in Venice on a second trip. 8 Later, in his De Dominus (1984), 9 Malcolm suggested in a footnote that the account book of the first Earl of Devonshire (Chatsworth, Hardwick Ms. 29), supported only one trip between 1614 and 1615 but he provided no detailed evidence. Biographies of Thomas Hobbes are hardly lacking. Reik’s book, however, with its attention to aspects of Hobbes’s life not usually considered in a general biography and specifically with its use of manuscripts not previously consulted by Hobbes scholars is a definite addition to the literature on Hobbes. Though Reik begins by noting that a "modern biography of Hobbes…must be in large part a history of his thought for the simple reason that he never did much in the active (...) sense", the value of this work lies not in its somewhat shallow analysis of Hobbes’s ideas, but in its description of the social, intellectual, literary, scientific, and religious worlds in which Hobbes moved and the particular individuals in all of these circles with whom Hobbes had associations-whether favorable or otherwise. One of Reik’s theses is that the basic orientation of Hobbes’s thought and writings was set in the English Renaissance and that this orientation was not cast aside as the intellectual climate of England moved towards the Enlightenment—a factor which seems to account, in part, for Hobbes’s position as something of a misfit towards the end of his life. This English translation gathers together essays from Le sujet de la philosophie: Typographies I and L'imitation des modernes: Typographies II, along with a major essay entitled "Typographie." These essays are an inquiry into the delimitation of mimesis from Plato to Heidegger as representation or imitation "with a character of veri-similitude " [[sic]]. Concealed within the Platonic determination of Being as eidos is the filiation between "the representation of Being as figure and Darstellung, presentation... or 'literary representation'". In uncovering the derivation (...) of Gestalt and Darstellung from Ge-stell, or installation, Lacoue-Labarthe exposes the "ontological power of poiesis.... Philosophy, then, will have always been a matter of erection", that is, of fiction in the sense of installation, which is to say of mimesis as poiesis. The threat of mimesis lies in its displacement or "disinstallation of poiesis," or the productive capacity of representation so that "it proves difficult, if not impossible, to refer the thing thus installed to its truth or Being, to its idea". In the six essays that make up the book, Lacoue-Labarthe turns to Plato, Diderot, Hölderlin, Nietzsche, Reik, Heidegger, and Rene Girard, and to such topics as tragedy, music, autobiography, and the problematics of individual and national self-identification. In demonstrating how mimesis has determined philosophical thought, Lacoue-Labarthe provokes us into reconsidering our understanding of history and politics. (shrink)
