El autor examina la naturaleza de la Sharía y su relación con los sistemas jurídicos modernos para considerar cómo podría seguir operando en el contexto del estado secular moderno en el que todos los musulmanes viven hoy día. La Sharía es muy influyente entre los musulmanes, con independencia de su estatuto jurídico formal en el país. Sin embargo, la noción de un estado islámico es conceptualmente incoherente e históricamente falsa, y cualquier principio de la Sharía que se haga cumplir mediante (...) la autoridad coactiva del estado deja de formar parte del sistema normativo del Islam y se convierte en expresión de la voluntad política del estado. El autor propone que el fundamento de toda política y legislación públicas debe siempre basarse en lo que podría llamarse “la razón pública”, en virtud de la cual los musulmanes y otros creyentes estarían capacitados para proponer iniciativas políticas y legislativas que emanen de sus creencias religiosas, siempre que puedan sostenerlas en un debate público, libre y abierto mediante razones que sean accesibles y convincentes para la generalidad de los ciudadanos, con independencia de su religión u otras creencias. Pero, dado que tales decisiones serán adoptadas en la práctica por el voto mayoritario, según principios democráticos, toda acción estatal habrá también de conformarse a salvaguardias básicas constitucionales y de derechos humanos contra la tiranía de la mayoría. This article calls for moral choices and political action to escape the trap of the duality of aggression and resistance, of domination and liberation. Conflict is a permanent feature of human relationships, but violence is not only unproductive in resolving conflict, but can be rendered unnecessary by developing normative resources and institutional mechanisms for mediating conflict. Taking self-determination as a core human value and political reality in today’s globalized world, this article argues that we should reconceive realpolitik to escape the (...) trap by acknowledging the moral choices of others, and striving to be persuasive about our moral choices and political actions. Persuasion, and not violence, provides sustainable mediation of conflict. The article concludes with a brief discussion of the possibilities of mediation of the trap of resentment and retaliation in Dar Fur, Sudan, through multilayered strategies from immediate and short- to long-term action by local, regional and global actors. The method is applicable to a large, central class of (generalized) finite-valued logics with the language satisfying a certain minimal expressiveness condition. The expressiveness condition decrees that the truth-value of any formula φ must be identifiable by determining whether certain formulas uniformly constructed from φ have designated values or not. The transformation preserves the general (...) structure of proofs in the original calculus in a way ensuring preservation of the weak cut elimination theorem under the transformation. The study will employ the analytical approach in describingthe essential characteristics of a corporation as inherent in Islamic law throughinterpolation from the natural person and the possibility of adapting the existingconventional bankruptcy laws. This study employs an analytical approach to Islamic literature and regular related works. The study found out that eventhough the concept of financial distress has basis in Islamic law, it remainscomplicated as it entails insolvency, bankruptcy and interdiction in a debtorcreditorrelationship. This study investigated ethical leadership and staff innovative behaviour in Nigeria. The aims of this study are to find out the relationships that exist among ethical leadership and staff innovative behaviour. This study also seeks to find the level of practice for the parts in ethical leadership and staff innovative. Quantitative research design was adopted in the study. Sample of 350 participants were randomly selected from the sample university in line with Research Advisor, table of determining sample size of known (...) population. Pearson correlations and linear regression analysis were used to analyze the collected data. The findings show that leadership integrity, power sharing and fairness positively and significantly correlated with staff innovative behaviour. The result also shows that staff innovative behaviour can be influenced by ethics behaviour of academic leaders. In order to improve staff innovative behaviour and development of universities, academic leaders must demonstrate high standards of professional conduct, encourage an open and transparent culture, develop framework that will encourage staff to work together irrespective of their race, gender, religion or age, as well as demonstrate effective fairness in terms of unbiased evaluation of staff performance. If all these are put in place, staff innovative behaviour will be achieved. (shrink)

The supreme counsel of the religion of Islam insistently emphasizes and promotes social solidarity and solidarity at every stage of life. Among the encouraged advices; the Qur'an and the hadith how meticulously focused on orphans and promised conditions and provisions for a virtuous life. The aim of the protection of orphans, shelter, representation, surety, evaluation of his property for bestowal, approaching with compassion and mercy. The prophet of Islam, who was born as orphan, Muhammad (pbuh.), by addressing the conscience of (...) humanity in order to protect the rights and law of orphan, brought preventive, encouraging orders and prohibitions. When it comes to dealing with orphans and protecting their rights and laws, it is not a correct approach to understand only in the form of protecting and meeting their material needs. On the contrary, it has been emphasized to meet his spiritual and psychological needs, not to insult his personality, and to contribute to his growing up as a beneficial individual for the society. This issue is stated as follows in the verse: “So don't crush the orphan” (Duhâ, 93/9). This order and the person of the Messenger of Allah also, draw the attention of mankind to respect for the material and spiritual rights of the orphan. The main target of the related things is not to leave the orphans alone, but to protect them, to provide an atmosphere of love. Otherwise, orphans deprived of the environment of love may pose problems for themselves and society while struggling with some psychological problems. The main purpose of our study is to draw attention to the compliance of the orphans' rights-law in the axis of the Qur'an and hadith according to the rapidly developing and changing life conditions in our age. This paper is a comparative study of two northern Nigerian Muslim societies (the Ebira in central Nigeria and the Hausa in the North-west) in which the youths contested religious traditionalists in the 20th century and in the process brought about transformation in their societies. In the religious sphere, which was hitherto considered an affair of the elderly, the youth have equally come to assume a dominant place, especially in their assertive activist posture. In these two case studies, the youths have (...) managed to assume leadership in religion and subsequently have used religion to transform and redefine their roles and status in the societies in a manner that challenged the existing norms. That could be seen as a tradition in the religious convention of the northern Nigerian area that occurs repeatedly through this period. In the 19th century, the Shehu Usmanu Danfodiyo and his cohorts in their youthfulness championed a reform and transformation that continue to inspire other reforms to date in the region. Religious actors in the contemporary Muslim societies of Nigeria are young men and women. It is important to note that these youths are people who possessed both Islamic and Western education and often have international networks and connections, largely through the educational institutions they have attended and/or literature they have studied. Among the Ebira, for instance, the youth subscribed to the religion of Islam, and converted their parents who largely professed African traditional religion to Islam. In Hausaland on the other hand, the youth, unlike the elderly, subscribed to “modern” rather than the “traditional” Islam that the latter do. In both cases therefore, the young engaged the elderly in a struggle to change their conception and practices of Islam. The process has had a tremendous impact on the relationship between the groups in an atmosphere being somehow defined or determined by the young adults in the two northern Nigerian societies being examined. South-South cooperation is an approach to international economicand political relations among developing countries to enhance developmentprospects; it has been increasing in significance. Such a strategy was adoptedbilaterally at the outset between Malaysia and Sudan but eventually evolvedto include a broader network of Asian and African Countries. This paper isfocused on Malaysia-Sudan relations as a case study. It adopts a qualitativeapproach comprising reliance on primary and secondary sources of data to studythe relations of exchange between the two countries. Findings lend supportto (...) claims of potential rewards in South-South Cooperation. Through it Sudanmanaged to exploit its idle oil reserves and achieve high rates of economicgrowth. Similarly, Malaysia achieved very good results in areas of trade andinvestment and managed to open up business opportunities in other Africancountries. Purpose This study aims to examine the long-term effects of an Israeli digital literacy government program for disadvantaged populations, as they are perceived by participants of the program one year after completing the course. Design/methodology/approach Participants in the program were interviewed about the effects of participating in the program, their experiences and satisfaction, in retrospect, a year after they completed the program. Findings The main reasons for joining the program included cognitive motivations, mainly interest to become familiar with internet applications, (...) followed by employment aspiration. Positive benefits from participation included accumulated knowledge, confidence in using technology, empowerment and enhanced sense of self-efficacy. Interviewees also reported that as they could not practice or communicate with instructors once they completed the program, a significant portion of the accumulated gains faded. Social implications Social and practical implications: Digital technologies constitute key infrastructure to facilitate public participation, as well as for gaining social, political and economic capital. Therefore, there is a significant social value in reducing digital inequality by increasing digital literacy of disadvantaged populations, i.e. citizens with low socioeconomic status and low digital literacy. This study sheds light on the benefits gained from such programs, as perceived by past participants. Originality/value While previous studies evaluating digital literacy programs focus on specific technical improvements and short-term gains, this study investigates the long-term effects and shortcomings of the program as perceived by participants. Every scientific or intellectual movement is founded upon basic assumptions and hypotheses that shape its specifically formulated philosophy. This study seeks to explore and explicate the basic philosophical underpinnings of grey systems theory, as well as the paradigm governing its postulates. The study, more specifically, scrutinizes the underlying principles of GST from the perspective of postmodern philosophy. To accomplish this, the epistemology, ontology, human nature, and methodology of GST are substantially investigated in the light of postmodern philosophy. The study draws (...) on Burrell and Morgan’s framework to reveal the paradigm underlying the philosophy of GST. Results demonstrate that GST is an anti-realistic, anti-positivistic, and non-deterministic theory which is inherently pluralistic and ideographic. Based on the principles of GST, change is an indispensable dimension of human speculation about the world and systems, and knowledge is ceaselessly reproduced as new information is collected. As a result, knowledge, narratives, theories and scientific laws are dynamically changed. GST, then, is remarkably compatible with the foundations of postmodern thought and it could be regarded as a postmodern theory governed by a humanistic paradigm. (shrink)

There is a growing global interest in social responsibility and sustainability across all sectors. Other than economic performance, stakeholders are now also concerned about the social and environmental impacts of corporations. Additionally, stakeholders are obtaining a higher salience level and expect organisations to operate sustainably. The banking sector has not been an exception, as banks can have significant impact on their customers, employees, and society in various ways. Given the intertwined links of Islam and ethical principles, it is expected that (...) Islamic banks will show a high level of commitment towards social responsibility (SR) and ethical practices. The current study investigates this issue by examining the annual reports of three fully-fledged Islamic commercial banks in Indonesia over the period of 2007 to 2011. It was found that only two of the investigated banks had continuous improvement in their SR disclosure. Additionally, it was revealed that the highest disclosures have been for ‘corporate vision’ and ‘board of directors and top management’, while the lowest disclosures were evident for ‘environment’ and ‘product, services and fair dealing with supply chain’. Every scientific or intellectual movement rests on central premises and assumptions that shape its philosophy. The purpose of this study is to review a brief account of the main philosophical bases of grey systems theory (GST) and the paradigm governing its principles. So, the recent studies on the philosophical foundations of GST have been reviewed and tried to pay attention to some key ambiguities in the previous studies and give more and clearer explanations in this paper. Also, this paper tries (...) to fill the gap among the previous studies and to provide a purposeful connection between them by expressing two key concepts: complete information and imbalance knowledge. Primarily, the study addresses the theoretical foundations of uncertainty and the concept of greyness. Next, it focuses on the notion of “complete information” and challenges to it. Then, it reviews such processes as perception, cognition, and understanding, as well as their dynamic nature. It explains how knowledge is produced through understanding and interpreting information/data and the dynamics governing the whole process. Also, the study describes any dataset, no matter how large it may be, will remain incomplete, imperfect, and grey, so humans only rely on incomplete datasets to interpret the world. As such, information and knowledge are always grey and uncertain because they are basically contingent on subjective understandings and interpretations and imperfect inputs and data. Finally, as a key development, this study also demonstrates that human grey knowledge remains imbalanced across different disciplines and spheres. In the end, a brief overview of the philosophical paradigm of GST is also provided. GST is depicted as an anti-realistic, anti-positivistic, and non-deterministic approach, which is inherently pluralistic and ideographic. According to GST principles, dynamicity and change are essential parts of human narratives of the world and systems, and human knowledge is constantly reproduced through collecting new information. As a result, knowledge, theories, narratives, and scientific laws dynamically change. Given this premise, one could argue that GST is considerably compatible with the postulates of post-modern thinking. (shrink)

Religious freedoms of minorities in Muslim-majority countries such as Pakistan are compromised due to structural issues as well as social and historical concerns. For instance, the abuse of the blasphemy law has led to minority communities facing threats and violence. And in a country where religious scholars are often absent from, if not against, discourses about human rights, the religious rights of minorities remain a secular and hence culturally unsound discourse. There is thus a need for two parallel movements. One, (...) an awareness within Muslim communities about the need to engage with religious freedoms, and hence the modern human rights regime, as an essentially Islamic process requiring reform from within. And two, the human rights structure also giving religion its due since religious freedoms are part of, and engender, many other rights as well. In this article, a case is made for this dual process, by exploring the work of scholars of Islam such as Abdullahi An-Na’im and Khaled Abou El Fadl as well as the insecurities of religious scholars in Pakistan who have reacted to human rights as a western agenda. In 1979, following a military coup, President Zia-ul-Haq sought to foment his power by ‘Islamizing’ Pakistan. Among other policies, he enacted the Hudood Ordinances to codify classical Islamic fiqh on criminal law, including the controversial Zina Ordinance (“Ordinance”) which criminalizes sex outside of marriage. Shortly after its passing, the Ordinance led to the unjust incarceration of thousands of low-income women across the country. Decrying the law as violence against women, human rights supporters around the world demanded reform. Finally, in 2006, (...) Pakistan passed the Protection of Women Act (PWA) that amended the Ordinance, rendering the law procedurally toothless. Still, reforms left the substance of the Ordinance intact, giving men license to take the law into their own hands with effective impunity, leading to a rise in honor killings. Given the need for repeal of the Ordinance, this paper looks to lessons learned from the successes and failures of the 2006 reform to propose a strategy for the future. The 2006 reform adopted an apologetic ‘pragmatic reformist’ approach, building a coalition of conservative Islamists and secularists behind an incremental policy shift. This paper proposes that for a more substantive change that is still effective, the women’s rights movement should shift away from the purely secular or purely Islamic approach to espouse secularism and human rights but using an Islamic rationale, shifting societal attitudes from within the tradition. Doing this, I echo arguments made by reformist-activists Abdullahi An’Naim and Ziba Mir-Hosseini among others as well as adopt the approach of the Supreme Court of Pakistan, the High Courts, and the Federal Shariat Court (FSC) themselves in their attempts to reconcile Pakistan’s constitutional commitments to both human rights and Islamic law. Such a strategy, I posit, is slow but both effective and long-lasting. (shrink)

A just international order and a healthy cosmopolitan discipline of law need to include perspectives that take account of the standpoints, interests, concerns and beliefs of non-Western people and traditions. The dominant scholarly and activist discourses about human rights have developed largely without reference to these other viewpoints. Claims about universality sit uneasily with ignorance of other traditions and parochial or ethnocentric tendencies. The conflict in Ukraine indicates some of the features of a potential post-liberal order and raises several potential ethical issues that may arise for international interventions as the world changes. What types of interventions, if any, are justifiable in response to situations such as the one in Ukraine? Can interventions be permissible given the potential undermining of universalist claims that are often used to support them? How should states prioritize between situations if there is an even greater number of global (...) challenges in a post-liberal order? Three new books—Solferino 21 by Hugo Slim, Decolonizing Human Rights by Abdullahi Ahmed An-Naim, and Promoting Justice across Borders by Lucia Rafanelli—can help to navigate these questions. Drawing on their insights, this essay argues that reform interventions can be justified to defend the liberal international order, that intervention can be defended from a relativist basis, and that socioeconomic rights should be given greater priority. In standard Albanian studies and Western scholarship, including either any interested religious and political activism or less 'interested' lay people, endeavours of historical and textual fact-finding have been relevant for only to re-confirm and indeed perpetuate the very meaning of a myth, according to which the thinking of Naim Frasheri was formed and dominated by Bektashism and that his 'Albanianism' had a Bektashi foundation. In this paper I intend to scrutinize and disprove this, arguing that while Frasheri did indeed (...) have a religious cast of thought, his religious thinking went far beyond Bektashism in its heterodoxy, being a kind of liberation theology and pantheism which generated an all-inclusive attitude to Albanian identity, not one limited in any special way to Bektashism. Methodologically, such a picture must arise if we submit the available empirical evidence to critical analysis from the perspective of social theoretical approaches to religion developed in sociology and anthropology. In an earlier paper this myth was shown to be unreliable by arguing that (...) Frashëri's religious thinking was shaped by religious dualism. This paper argues further that Naim Frashëri went far beyond Bektashism in his heterodoxy, not only in a kind of liberation theology, but also by embracing a comprehensive pantheism which generated an active and all-inclusive attitude to Albanian identity, not necessarily limited in any special way to Bektashism. Methodologically, such a new picture must arise if the analysis of the historical and literary contextualization of Frashëri's major works is submitted to the perspective of social theoretical approaches to religion developed in sociology and anthropology. It examines how the poet’s deployment of style makes his poetry more accessible to a larger audience than that of his predecessors. Like the oral traditional performance, his poetry employs rich Yoruba oral literary devices in a way that is unique and glaringly innovative. Osundare’s radical poetic style has a clearly defined concept and role. It is also central (...) to the resolution of the polemics of governance and politics in society. Reproduction and immunity are energy intensive, intimately linked processes in most organisms. In women, pregnancy is associated with widespread immunological adaptations that alter immunity to many diseases, whereas, immune dysfunction has emerged as a major cause for infertility in both men and women. Deciphering the molecular bases of this dynamic association is inherently challenging in mammals. This relationship has been traditionally studied in fast‐living, invertebrate species, often in the context of resource allocation between life history traits. More recently, these studies (...) have advanced our understanding of the mechanistic underpinnings of the immunity‐fertility dialogue. Here, we review the molecular connections between reproduction and immunity from the perspective of human pregnancy to mechanistic discoveries in laboratory organisms. We focus particularly on recent invertebrate studies identifying conserved signaling pathways and transcription factors that regulate resource allocation and shape the balance between reproductive status and immune health. Important decisions are often based on a distributed process of information processing, from a knowledge base that is itself distributed among agents. The simplest such situation is that where a decision-maker seeks the recommendations of experts. Because experts may have vested interests in the consequences of their recommendations, decision-makers usually seek the advice of experts they trust. Trust, however, is a commodity that is usually built through repeated face time and social interaction and thus cannot easily be built in a (...) global world where we have immediate internet access to a vast pool of experts. In this article, we integrate findings from experimental psychology and formal tools from Artificial Intelligence to offer a preliminary roadmap for solving the problem of trust in this computer-mediated environment. We conclude the article by considering a diverse array of extended applications of such a solution. (shrink)

RESUMEN El trabajo reconstruye la recepción del pensamiento de Fr. Schlegel en la obra temprana de Paul De Man. Nuestra hipótesis sostiene que si analizamos los ensayos gestados antes de los años 80 se puede visibilizar que De Man inscribe al romanticismo a partir de algunos de los críticos del romanticismo, pero, al mismo tiempo, modifica la imagen orgánica y totalizadora del romanticismo que una parte de la crítica literaria sostenía en relación con la poesía romántica. A tales efectos, examinamos (...) de qué modo se presenta esta recepción en dos textos previos a 1980: Retórica de la temporalidad y Alegorías de la lectura. ABSTRACT The work reconstructs the reception of the thought of Fr. Schlegel in the early work of Paul De Man. Our hypothesis holds that if we analyze the essays produced before the 1980s, it can be appreciated that De Man inscribes the romanticism from some of the critics of romanticism, but, at the same time, it modifies the organic and totalizing image of romanticism that a part of literary criticism held in relation to romantic poetry. Resumen El objetivo general del trabajo es analizar las influencias y recepciones del post-estructuralismo en las lecturas de Judith Butler y sólo algunas derivaciones en el pensamiento de Paul B. Preciado. A partir de este rastreo se pueden establecer las críticas de la teoría queer al feminismo a través de las imágenes y textualidades que propone el arte. La hipótesis general del trabajo supone que, a partir de la recepción del postestructuralismo en los análisis de Butler y Preciado, se podría (...) reconocer en la estética la capacidad crítica y política que las teorías de la identidad sexual pretenden lograr. A los efectos de identificar estos legados nos detendremos en reconocer los aportes de Jacques Derrida en la obra de estxs autorxs. It is argued that queer theory’s critique of feminism can be established through the images and textualities proposed by art; furthermore, on the basis of the influence of poststructuralism in Butler’s and Preciado’s analyses, one can recognize in aesthetics the critical and political capacity that theories of sexual identity intend to achieve. In order to identify these influences, we discuss the contributions of the ideas Jacques Derrida to the work of these authors. In conclusion, we raise some criticisms that warn of the possible limits of gender theories in the plane of aesthetics. (shrink)
