The aim of this paper is to explore the peculiar case of infectious logics, a group of systems obtained generalizing the semantic behavior characteristic of the -fragment of the logics of nonsense, such as the ones due to Bochvar and Halldén, among others. Here, we extend these logics with classical negations, and we furthermore show that some of these extended systems can be properly regarded as logics of formal inconsistency and logics of formal undeterminedness.

IntroductionCardiology is characterized by its state-of-the-art biomedical technology and the predominance of Evidence-Based Medicine. This predominance makes it difficult for healthcare professionals to deal with the ethical dilemmas that emerge in this subspecialty. This paper is a first endeavor to empirically investigate the axiological foundations of the healthcare professionals in a cardiology hospital. Our pilot study selected, as the target population, cardiology personnel not only because of their difficult ethical deliberations but also because of the stringent conditions in which they (...) have to make them. Therefore, there is an urgent need to reconsider clinical ethics and Value-Based Medicine. This study proposes a qualitative analysis of the values and the virtues of healthcare professionals in a cardiology hospital in order to establish how the former impact upon the medical and ethical decisions made by the latter.ResultsWe point out the need for strengthening the roles of healthcare personnel as educators and guidance counselors in order to meet the ends of medicine, as well as the need for an ethical discernment that is compatible with our results, namely, that the ethical values developed by healthcare professionals stem from their life history as well as their professional education.ConclusionWe establish the kind of actions, communication skills and empathy that are required to build a stronger patient-healthcare professional relationship, which at the same time improves prognosis, treatment efficiency and therapeutic adhesion. En los procesos de identificación social muchas veces la valoración del pasado resulta fundamental. La existencia objetiva de esa valoración ha propiciado que distintos actores sociales, en diferentes momentos históricos, hayan hecho uso del pasado en la estructuración de las ideologías que sustentan los procesos de identificación y, en consecuencia, sus propios proyectos políticos. Es decir, los mitos políticos están compuestos manifiestamente de dos componentes básicos. Por un lado, consisten en la así llamada política simbólica y por el otro lado, (...) son parte de la memoria colectiva. Es por esto que los mitos se enfrentan con las bases mismas del proyecto de modernidad, quizás la razón por la cual sea la politología la disciplina de las ciencias sociales que menos los ha estudiado. La utopía andina, el mahdi o el doceavo imán, el emperador alemán oculto y dormido y el bolivarianismo, constituyen algunos estos mitos políticos. (shrink)

En el contexto del sistema presidencial chileno, el artículo analiza el rol del Congreso en la elaboración de la política exterior, desde la perspectiva del enfoque transaccional desarrollado por Pablo Spiller y Mariano Tommasi (2000). De este modo, se plantea que el trabajo del Congreso en general, y de las comisiones de Relaciones Exteriores del Senado y de la Cámara de Diputados en particular, se caracteriza por la permanencia y continuidad de los miembros y, en consecuencia, por un trabajo especializado (...) y de alta calidad profesional, lo que favorece la cooperación entre los actores y los intercambios intertemporales entre éstos. In this article, we rebuild the reading of Benjamin’s Critique proposed by Menke and consider the appropriateness of violence in the law not as a tragic tension, but as a condition for its reproduction. Se examina la noción de espectro, propuesta en Espectros de Marx, para evidenciar la problematización que Jacques Derrida hace a la oposición, que se supone tajante, entre las nociones de vida y muerte. Se evidencia que Derrida no traza tal problematización exclusivamente a partir de Espectros de Marx, sino también desde diversos textos que dan cuenta de un constante asedio que ronda su pensamiento: la sobrevida. A su vez, se analiza la discusión que Derrida sostuvo con el espectro de Marx (...) para evidenciar: (1) de qué modo la herencia fiel-infiel de Marx contribuye al pensamiento de la sobrevida; (2) cómo en tal pensamiento de la sobrevida se inscribe necesariamente el problema de la justicia y la alteridad. This text proposes an interpretation of the work of Franklin Leopoldo e Silva based on the reading of some of his numerous published articles and books, without neglecting the classes and guidance received from the stage of Scientific Initiation to Postdoctoral studies. Precisely, by highlighting the importance of three thinkers widely studied by Professor Franklin – Berkeley, Bergson and William James –, we suggest that at the heart of this philosophical experience there would be a constant: empiricism. Indigenous conservation through patrimonialization is the product of political and legal decisions made by a non-indigenous agent: the liberal state, using the law to retain a form of bios. We propose that patrimonialization is the device by which liberal states have processed and integrated indigenous claims into a form of bios ultimately designed to safeguard state legal structures. We argue that, to uphold the rule of law in contexts (...) of struggle and resistance that challenge the very understanding of the law, states respond by wielding the law in the form of the rule by law, that is, pushing the law to the limit to give normative content to the criteria by which the state conducts its affairs, without straying from the individual rights framework. We hold that the rule by law is an operation that defines the patrimonialization of indigenous peoples. It increases their visibility while imposing limits on political action to keep them from becoming sui juris subjects capable of breaching the distinction between zoe and bios. In this article, we try to understand the political–ideological intent of these decisions, the intentions beyond the letter of the law of patrimonialized peoples. (shrink)

El uso de sistemas de machine learning en los procesos de selección laboral ha sido de gran utilidad para agilizarlos y volverlos más eficientes, pero al mismo tiempo ha generado problemas en términos de equidad, confiabilidad y transparencia. En este artículo comenzamos explicando los diferentes usos de la Inteligencia Artificial en los procesos de selección laboral en Estados Unidos. Presentamos los sesgos sexuales y raciales que han sido detectados en algunos de ellos y explicamos los obstáculos jurídicos y prácticos para (...) su detección y análisis. Un posible remedio jurídico a la discriminación algorítmica es el régimen de impacto diferencial sistémico utilizado en Estados Unidos. Usamos algunas características de este régimen para señalar los vacíos jurídicos frente a la discriminación en el acceso al empleo en el ámbito del derecho laboral colombiano, y ofrecemos algunas características generales que podría tener un régimen de esa naturaleza. Jair Bolsonaro, the current President of Brazil, has made himself into one of the most influent advocates of COVID-19 denial. His health policy and his political doctrine are partly based on an implicit moral claim, which is neglected by contemporary political theory. Bolsonarism’s rhetoric raises a moral claim to freedom without responsibility, which relieves its followers from the burdens that emerge from liberal accounts of liberty or from basic goods accepted in a political community. In opposition to liberal or communitarian (...) accounts, Bolsonarism endorses a Hobbesian concept of freedom that describes it as the absence of ‘impediments to motion’. Nonetheless, it differs from Hobbes because it treats this liberty as endowed with moral value and non-negotiable through a social contract. (shrink)

Partiendo de distintas racionalidades parciales que, en diferentes pasajes de la historia, han aportado a la idea de persona y dignidad humana, en este artículo se profundiza en lo que significa ser persona, en el sentido de la dignidad que le es propia. Se reflexiona así sobre el puesto que le corresponde en una sociedad justa, a la altura de nuestro tiempo, con las consecuencias que se derivan de ello, particularmente para la moral, la política y el derecho. Un cierto (...) tipo de sociedad donde cada persona pueda encontrar las condiciones adecuadas para el desarrollo de todas las dimensiones de su humanidad y vivir de manera armoniosa en comunidad y con el resto de la naturaleza. Estamos ante una reflexión que busca contribuir a que el ser humano pueda desarrollarse plenamente, con su esfuerzo, pero con el apoyo de los demás. Un modo de convivencia social donde la democracia y el Estado de Derecho se presentan, junto con los derechos fundamentales, como las formas de organización jurídico-políticas más acordes con la dignidad humana, con los objetivos de racionalización y humanización que se persiguen para construir y fortalecer una sociedad justa. Esta obra se abre con una introducción histórica, no heleno ni eurocéntrica, en la que se reinterpretan los sistemas éticos en la historia mundial, hasta situar la problemática en la Modernidad dentro del sistema-mundo como proceso de globalización que simultáneamente excluye a la mayoría de la humanidad. En la primera parte se aborda una crítica a las morales formales (Kant, Rawls, Apel, Habermas) desde un principio material o de contenido con pretensión de universalidad; el deber de producir, reproducir y desarrollar (...) la vida humana en comunidad. El principio de factibilidad ética, por su parte, permite que el cumplimiento del acto, institución o sistema de eticidad pueda tener la pretensión de bondad. En la segunda parte, desde la imposibilidad de que dicho acto, institución o sistema de eticidad «buenos» pueda tener pretensión de perfección acabada, se descubren los que «sufren» en su corporalidad vulnerable la imposibilidad de vivir, el hecho de ser excluidos. Se trata de las víctimas, al decir de Marx, Horkheimer, Benjamin, Nietzsche, Freud o Lévinas. Desde las víctimas comienza propiamente el discurso de la Ética de la Liberación, en su nivel negativo material (deben poder vivir), en el principio discursivo crítico (deben poder participar en la argumentación), todo lo cual culmina en el principio crítico negativo de la factibilidad: el principio-liberación que inspira las transformaciones con pretensión de justicia. En este artículo nos centraremos en la figura de Eurípides, concretamente en el tema de los juicios morales que trasmiten sus obras trágicas. La cuestión es que si en Esquilo la razón triunfaba sobre el dilema trágico, en Eurípides no se ve claro ese triunfo si viene impuesto desde fuera y no ha arraigado en el corazón de los ciudadanos. La razón tiene muchas dificultades para ejercer su control sobre (...) la acción y orientarla hacia el bien común. Eurípides planteará que es la persona, su conciencia interior, la que debe de estar convencida de que algo le obligue moralmente. In this article we will focus on the figure of Euripides, specifically on the issue of moral judgments his tragic plays transmit. The issue is that if in Aeschylus reason prevailed over the tragic dilemma, in Euripides it is not clear if that triumph is imposed from outside and has not rooted in the heart of the citizens. Reason faces much difficulty to exercise its control over action and go for the common good. Euripides proposes that it is the person, their inner consciousness, which must be convinced that something should oblige them morally. Hrushovski proved that the theory of difference-differential fields of characteristic zero has a model-companion, which we shall denote DCFA. Previously, the author proved that this theory is supersimple. In supersimple theories there is a notion of rank defined in analogy with Lascar U -rank for superstable theories. It is also possible to define a notion of dimension for types in DCFA based on transcendence degree of realization of the types. In this paper we compute the rank of a model of (...) DCFA, give some properties regarding rank and dimension, and give an example of a definable set with finite rank but infinite dimension. Finally we prove that for the case of definable subgroup of the additive group being finite-dimensional and having finite rank are equivalent. (shrink)

This book provides theoretical tools for evaluating the soundness of arguments in the context of legal argumentation. It deals with a number of general argument types and their particular use in legal argumentation. It provides detailed analyses of argument from authority, argument ad hominem, argument from ignorance, slippery slope argument and other general argument types. Each of these argument types can be used to construct arguments that are sound as well as arguments that are unsound. To evaluate an argument correctly (...) one must be able to distinguish the sound instances of a certain argument type from its unsound instances.
