In contrast to the traditional view of Kant as apure retributivist, the recent interpretations ofKant's theory of punishment (for instance Byrd's)propose a mixed theory of retributivism and generalprevention. Although both elements are literallyright, I try to show the shortcomings of each. I thenargue that Kant's theory of punishment is notconsistent with his own concept of law. Thus I proposeanother justification for punishment: specialdeterrence and rehabilitation. Cet article rend compte des modes d'utilisation et d'accès aux TIC au Japon, sous l'angle des controverses et des défis qui se présentent aux différentes générations. Pour les parents, il s'agit d'assurer un environnement informatique sans risque tout en aidant leurs enfants à découvrir des informations en ligne et à en tirer le meilleur parti. Quant aux adultes en général, les inégalités existantes déterminent la nature et les modes d'utilisation des TIC. En conclusion, l'article suggère qu'Internet présente non pas un (...) moyen d'expression transparent à une société civile pré-existante, mais soulève au contraire des problématiques classiques dans la société civile japonaise, ayant trait par exemple à l'égalité, à l'intégration et à la participation aux délibérations civiques.This article reports on usage patterns and access to ICTs in Japan, in terms of controversies and challenges that arise between generations. For parents, it is to ensure a safe computing environment while helping their children discover information online and get the best. For adults in general, existing inequalities determine the nature and patterns of use of ICT. In conclusion, the article suggests that the Internet has not a transparent medium of a pre-existing civil society, but instead raises issues in traditional Japanese civil society, for example in relation to equality, integration and civic participation in the deliberations. L'émergence des TIC et deux changements politiques successifs ont amené une troisième vague de mouvements sociaux à Taïwan. Ces mouvements ont commencé à s'affranchir des partis politiques ; ils se préoccupent de problèmes sociaux et mobilisent différents modes de participation à la base. Cependant, les TIC ne peuvent à elles seules garantir leur succès. La plupart des études sur les nouveaux mouvements sociaux suggèrent que les TIC accroissent l'adhésion à ces mouvements parmi la population, ce qui facilite leur extension. Cette (...) étude analyse deux mouvements récents au sein de la société civile taïwanaise et conclut que ni la théorie de la mobilisation des ressources ni la théorie des nouveaux mouvements sociaux ne montrent comment les TIC seraient suffisantes pour structurer les mouvements de la société civile. En l'absence d'organisation concrète et réelle de la société civile, la participation purement virtuelle de la base risque d'en compromettre le leadership, la mobilisation, les prises de décision et les liens au niveau international.The emergence of ICT and two successive political changes have led to a third wave of social movements in Taiwan. These movements have begun to overcome the political parties they are concerned about social issues and mobilizing different modes of grassroots participation. However, ICT alone can not guarantee success. Most studies on new social movements suggest that ICTs increase adherence to these movements among the population, which facilitates their extension. This study analyzes two recent movements in civil society Taiwanese and concludes that neither the theory nor the resource mobilization theory of new social movements did not show how ICT would be sufficient to organize the movement of civil society. In the absence of concrete and actual organization of civil society participation purely virtual database could compromise leadership, advocacy, decision-making and international links. (shrink)

Contra os atuais intérpretes de Kant, neste artigo tenta-se mostrar que Kant abandona a concepção tradicional de amizade como uma relação dentro de um grupo aberto, e o seu ideal é a amizade em relação a toda a humanidade. Para mostrar isso, é preciso diferenciar acuradamente os elementos psicológicos da amizade, que Kant assume das teorias da amizade anteriores e simplesmente desenvolve, dos elementos genuinamente morais (...) da amizade, de cujo tratamento Kant é o pioneiro. Traditional liberalism's blindness to cultural concerns has often come under fire, while so‐called “liberal multiculturalism” has made it its business to take a good look at the place of culture within liberal law. According to them, cultural minorities should be recognized. In my opinion, however, their proposals, in fact, almost entirely preclude the possibility that cultural minorities would receive recognition within liberal society. In what follows, I explain my view of these matters and, above all, argue for a more vital (...) understanding of cultural minorities. Après trente ans de suppression, le rétablissement de la sociologie en Chine au début des années 1980 et son développement jusqu’à aujourd’hui offrent un cas critique d’analyse des conditions politiques, sociales et intellectuelles d’existence de la discipline. Comment cette science supprimée, violemment critiquée puis réhabilitée par le régime communiste se reconstruit-elle ? L’article présente le processus de reconstitution de la discipline, en mettant en lumière les formes d’engagement des différentes générations de chercheurs, les ressources qu’ils mobilisent ainsi que les débats (...) qu’ils soulèvent. Il analyse ensuite les productions sociologiques et leurs évolutions à partir de deux perspectives,les transformations de la société chinoise et la question de la modernisation.After being banned for thirty years, sociology has been allowed again in China in the early 80s, and its development to date provides a critical case for the study of the political, social and intellectual conditions essential for the existence of the discipline. How did this science, which was discarded, violently criticized and then rehabilitated by the communist regime manage to reconstruct ? The article first describes the discipline’s reconstitution process, focusing on the commitment patterns of different generations of sociologists, on the resources they mobilize, as well as on the debates they raise. The sociological productions and their evolutions are eventually analysed through two perspectives, the transformations of the Chinese society and the issue of modernization. (shrink)

Sie gilt zudem als die reifste und elaborierteste Darstellung des Standpunkts seiner Jenaer Wissenschaftslehre, in der die praktische Vernunft in die Rolle des hochsten Prinzips der Philosophie ruckt. Dieser kooperative Kommentar ermoglicht dem Leser, die Argumentation des Textes Schritt fur Schritt (...) nachzuvollziehen und dadurch zu einem vertieften Verstandnis dieses zentralen Textes des Deutschen Idealismus zu gelangen. Against the background of early modernism - a period that justified punishment by general deterrence - Kant is usually thought to represent a radical turn towards retributivism. For Kant, and later for Fichte and Hegel, a just punishment respects the humanity inherent in the criminal, and serves no external ends - it is instituted only because the criminal deserves it. In this original study, Jean-Christophe Merle uses close analysis of texts to show that these philosophers did not in fact hold (...) a retributivist position, or even a mixed position; instead he traces in their work the gradual emergence of views in favour of deterrence and resocialisation. He also examines Nietzsche's view that morality rests on the rejection of retribution. His final chapter offers a challenge to the retributivist position, and a defence of resocialisation, in the context of current legal theory and practice concerning the punishment of crimes against humanity. This volume presents an extended version of the contributions presented at the workshop "Kant's Concept of Law" held at the 26th World Congress of the International Association for Philosophy of Law and Social Philosophy (IVR) in 2013. It handles issues of applied legal philosophy in Kant's Doctrine of Right such as ownership, the alleged right of necessity, the right of resistance and the right of revolution. With each of these applied issues, the focus lies, on the one hand, on the (...) relationship between the principles a priori of law and of the duties of rights, as well as their normative requirements - for instance, the duty of independence from the coercion by others - and, on the other hand, empirical situations and their pressing demands. Thus, this volume illustrates how Kant concretely conceives of the doctrine of "first metaphysical of the doctrine of right" as supplying "the immutable principles for any giving of positive law". Each essay of this volume not only undertakes a careful and original interpretation of Kant's theses, but also offers a critical assessment. (shrink)

Une première observation aboutit à l’hypothèse suivante : l’exclamation se caractérise par un surcroît d’expressivité qui donne de la saillance à un énoncé ou à un fragment d’énoncé. La motivation de l’exclamation peut se trouver en amont, en aval, et/ou à l’intérieur d’un énoncé. L’exclamation est compatible avec tout type d’énoncé, comme modulation énonciative marquée qui s’oppose toujours à une variante non exclamative. On s’interroge sur l’affinité entre exclamation et (...) émotion ; entre exclamation et hiatus par rapport à une attente ; entre exclamation et haut degré, entre exclamation et pluri-modalité. Hoy en día la mayoría de los teóricos liberales o no consideran el tema de un derecho general a la inmigración o simplemente lo rechazan. Esto contradice no sólo la doctrina tradicional del derecho natural, sino también principios actuales de justicia tales como el principio de la diferencia postulado por Rawls. En el presente artículo se propone el siguiente experimento mental: comparar la situación imaginaria en la que la inmigración proveniente del Tercer Mundo estuviera permitida sin restricciones, pero en la (...) que no hubiera ninguna prestación social o asistencial para los inmigrantes, con la situación actual en la que aunque la inmigración está muy limitada, las prestaciones sociales y asistenciales habituales se encuentran aseguradas para los inmigrantes. Contra la opinión predominante hoy en día, la suerte de los peor situados parece ser en la situación actual claramente peor que en la situación imaginaria. Teorías liberales como la rawlsiana deben superar esta inconsistencia entre sus principios de justicia y su posición con respecto a la cuestión de la inmigración y decidirse por una cuestión más coherente. Das Thema des Notrechts und des Eigentums beim jungen Fichte mag paradox scheinen. Im Beitrag zur Berichtigung der Urtheile des Publikums über die französische Revolution ist nämlich von einem Notrecht keine Spur zu finden. In der Grundlage des Naturrechts wird das Notrecht allerdings erörtert, um es aber sogleich aus dem Bereich des Rechts auszuschließen, wie auch Kant dies in der Rechtslehre unternimmt. Zumal behandelt Fichte dabei keineswegs eine Anwendung des Notrechts, in der ein Eigentum auf dem Spiel steht: bei den (...) Schiffbrüchigen geht es um Leben und Tod, nicht etwa um Recht auf Leben gegen Recht auf Eigentum. (shrink)
