A well-established narrative in the history of science has it that the years around 1800 saw the end of a purely descriptive, classificatory and static natural history. The emergence of a temporal understanding of nature and the new developmental-history approach, it is thought, permitted the formation of modern biology. This paper questions that historical narrative by closely analysing the concepts of development, history and time set out in Karl Ernst von Baer’s study of the mammalian egg (1827). I show that (...) Baer’s research on embryogenesis aimed not simply to explain temporal changes, but to inscribe the formation of new individual organisms into a continuous, unending organic process. I confront Baer’s views with other explanations of embryogenesis arising in the 1820s and 1830s, especially those of Jean-Baptiste Dumas and Jean-Louis Prévost and of Theodor Schwann. By highlighting divergences between these scientists, especially as to their view of the role of gender differences in reproduction, I argue that biology evolved not from a homogeneous concept of developmental history but out of various, even opposing, views and research programmes. Thus, the birth of biology did not imply the end of all natural history’s thought models. (shrink)

Le "mal radical" n'est pas le mal absolu ou diabolique, mais il consiste en une inversion (Verkehrtheit) de l'ordre des principes au sein du vouloir, et ne peut être (...) déraciné que par l'entière conversion du coeur. Avec le mal, s'ouvre l'antinomie du judaïsme, considéré par le philosophe comme le contre-modèle de la foi par excellence, et du christianisme, criterium unique et anhistorique de la religion, seul à même de résoudre le problème de l'homme nouveau. Si, selon Kant, le judaïsme est nouménalement nul parce qu'incapable de véhiculer le contenu de la religion rationnelle, le philosophe, qui considère l'interdit biblique de l'idolâtrie comme "le commandement le plus sublime du Livre de loi des Juifs", lui reconnaît néanmoins le mérite de mettre l'accent sur le respect. Le christianisme, quant à lui, met l'accent sur l'amour, dont Kant retient la signification pratique, à savoir qu'il est l'état de perfection de l'intention vers lequel nous devons tendre. (shrink)

By attending to how people speak about their gender, we can find diverse answers to the question of what it is like to have a gender identity. To some, it is little more than having a body whereas others may report it as more attitudinal or dispositional—seemingly contradictory views. In this paper, I seek to reconcile these disparate answers by developing a theory of how individual gender identity comes about. In the simplest possible terms, I propose that gender identity is (...) how we make sense of our gender subjectivity, the totality of our gendered experiences of ourselves. Gender identity is constituted by gender subjectivity, but this constitutive relationship is underdetermined. While gender subjectivity may narrow the range of inhabitable gender identities, it is always compatible with more than one. To arrive at a gender identity, we arrange gender subjectivity like building materials. My theory helps us understand how different people offer seemingly incompatible accounts of their gender identity without questioning their authenticity or validity. Background Seeking assent from children for participation in medical research is an ethical imperative of numerous institutions globally. However, none of these organizations provide specific guidance on the criteria or process to be used when obtaining assent. The primary objective of this scoping review was to determine the descriptions of assent discussed in the literature and the reported criteria used for seeking assent for research participation in pre-adolescent children. Methods Medline and Embase databases were searched until November 2020 using the (...) term “assent” in the title or abstract. Inclusion criteria were (1) studies enrolling children which specifically described operationalization of the assent process and (2) studies of the assent process which provided a description of assent. Data collected included participant information, patient criteria for seeking assent, guidelines referenced, description of assent reported, how assent was obtained and assent information presented, and reported assent rate. For qualitative articles focusing on the assent process, important themes were identified. Results A total of 116 articles were included of which 79 (68.9%) operationalized assent and 57 studies (%) described the assent process. The most commonly reported criterion used to determine the ability of a child to assent was age (35.4%, 28/79). The reported minimal age for obtaining pediatric assent varied considerably across and within jurisdictions (5–13 years; median 7.5 years, IQR 7.0, 9.75). Cognitive ability was reported as a criterion for obtaining assent in 5.1% (4/79) of studies. Assent rates were only reported in 17.7% (14/79) of citations and ranged from 32.0 to 100%. Analysis of the 57 studies describing the assent process identified several themes, including age thresholds, assessment of capacity, variable knowledge of pediatric assent and parental roles. Conclusion We found significant variation in criteria used for assessment of patient capacity, delivery of information used to obtain assent and documentation of the assent process. While we acknowledge that individual children, settings and jurisdictions may require different approaches to obtaining assent, there should be agreement on important principles to be followed with resulting common guidance on assessing capacity, delivering information and documentation of the assent process for publication. Malebranche's psychology of error and psychology of moral choice are the core of what Locke kept on admiring, even when criticizing the metaphysics and the theory of ideas underlying them. So to understand why Locke rejects Malebranche's "idea" and Malebranche rejects Locke's "idea", it is useful to see where they agree and disagree in the theory of moral choice: pleasure, supreme good, suspense, uneasiness, desire are themas debated around them (Arnauld, Bayle) and between them.

Drawing on the principle of subsidiarity, this article develops a framework for allocating medical decision-making authority in the absence of capacity to consent and argues that decisional authority in paediatric transgender healthcare should generally lie in the patient. Regardless of patients’ capacity, there is usually nobody better positioned to make medical decisions that go to the heart of a patient’s identity than the patients themselves. Under the principle of subsidiarity, decisional authority should only be held by a higher level decision-maker, (...) such as parents or judges, if lower level decision-makers are incapable of satisfactorily addressing the issue even with support and the higher level decision-maker is better positioned to satisfactorily address the issue than all lower level decision-makers. Because gender uniquely pertains to personal identity and self-realisation, parents and judges are rarely better positioned to make complex medical decisions. Instead of taking away trans youth’s authority over their healthcare decisions, we should focus on supporting their ability to take the best possible decision for themselves. (shrink)

Cet article interroge la manière dont les idéologies de la guerre froide ont participé à la construction d’un discours public sur la place sociale des femmes dans la Tanzanie nouvellement indépendante, qui se proclame socialiste et non-alignée. Pour ce faire, il retrace les références explicites et implicites au capitalisme, au socialisme et au marxisme dans les discours sur les femmes publiés dans la presse nationale swahiliphone. Ces imaginaires sont mobilisés avant tout pour construire des modèles et contre-modèles féminins, notamment les (...) figures de la paysanne travailleuse et de la séductrice urbaine. Toutefois, alors que l’Année de la femme des Nations unies (1975) encourage le gouvernement tanzanien à préciser ses politiques d’émancipation des femmes, des articles viennent repenser les liens entre cette ambition et les socialismes, mondiaux et tanzanien. Qu’est-ce qu’un costume de femme en Grèce ancienne? Un costume de séduction? Un costume rituel? Quel est son statut? Le vêtement fait-il la femme et quelle femme? L’étoffe de tissu en raison de sa qualité (texture, couleur, richesse) et de son agencement est un prolongement du corps et un marqueur visible d’identité. L’article s’interroge dès lors sur les valeurs attachées aux costumes féminins en fonction de l’âge, des contextes (domestique, érotique, rituel, politique) et du rang dans la société, sur les (...) façons dont ceux-ci qualifient les femmes et leurs comportements, et disent finalement la condition féminine comme masculine dans le discours poétique, au théâtre, chez les historiens, dans les lois cultuelles et en images. Le vêtement propose un discours sur soi, sur l’autre, et est source de discours. Doté d’un pouvoir agissant, il énonce aussi bien le kosmos, ornement et ordre, autrement dit la beauté des femmes et du monde, l’eukosmia, que le désordre et le chaos politiques dans les cités grecques durant l’Antiquité. The aim of this study was to test the effect of face cooling with cold water vs. face cooling with neutral water during high-intensity swimming training on both the core temperature and thermal perceptions in internationally ranked long-distance swimmers during 2 randomized swimming sessions. After a standardized warm-up of 1,200 m, the athletes performed a standardized training session that consisted of 2,000 m at a best velocity then 600 m of aerobic work. Heart rate was continuously monitored during 5 × (...) 400 m, whereas Tco, thermal comfort, and thermal sensation were measured before and after each 400 m. Before and after each 400 m, the swimmers were asked to flow 200 mL of cold water or neutral water packaged in standardized bottles on their face. The swimmers were asked don’t drink during exercise. The velocity was significantly different between cold water and neutral water. The Tco was increased by ±0.5°C at race pace, under both face cooling conditions with no significant difference. No significant changes were noted in mean HR. TC was higher with Cold Cooling than Neutral Cooling and TS was lower with Cold cooling compared with Neutral cooling. The changes in perceptual parameters caused by face cooling with cold water reflect the psychological impact on the physical parameters. The mean velocity was less important with face cooling whereas the heat rate and Tco were the same in the both conditions. The mechanism leading to these results seems to involve brain integration of signals from physiological and psychological sources. (shrink)

El objetivo de este artículo es presentar esta faceta poco estudiada de la vida de Adrienne von (...) Speyr, y el modo en que su actividad médica modeló su lectura de las Escrituras, en particular del capítulo 11 del evangelio de Juan. In the metabolic control theory, the control coefficient is a key parameter in quantifying the sensitivity of the flux towards an infinitesimal variation of enzyme activity. This concept does not apply just as it is for variations of enzyme concentrations whenever there is spatial, energy or resources limitations in the cell. Due to constraint on total enzyme concentration, the variation of concentration of any given enzyme may affect the concentrations of other enzymes. To take into account these correlations between enzyme (...) concentrations, we propose the concept of "combined response coefficient". Its definition is similar to that of the control coefficient, but its mathematical expression is different. Its range of variation is from – + 1, the null value corresponding to optimum enzyme concentration, i.e. to concentrations that maximise the flux, and the negative values to concentrations beyond the optimum value. A summation property could be derived using a simple weighting of the combined response coefficients, the sum of the weighed coefficient being 0. (shrink)

Although informed consent models for prescribing hormone replacement therapy are becoming increasingly prevalent, many physicians continue to require an assessment and referral letter from a mental health professional prior to prescription. Drawing on personal and communal experience, the author argues that assessment and referral requirements are dehumanising and unethical, foregrounding the ways in which these requirements evidence a mistrust of trans people, suppress the diversity of their experiences and sustain an unjustified double standard in contrast to other forms of clinical (...) care. Physicians should abandon this unethical requirement in favour of an informed consent approach to transgender care. (shrink)

In conversation with Hortense Gallois’ recent essay on the importance of bioethicists participating in public discourse, I suggest that speaking up is as fraught as it is important. Focusing on the anti-trans movement’s misuse of expertise, I highlight the fine line between correcting misinformation and inadvertently causing harm through ill-timed speech. Drawing on the work of Eva Feder Kittay, I suggest that knowing when to speak up and when to stay silent starts with understanding the communities we speak about and (...) the consequences that our words can have on them. Tradition analytique et tradition francaise ont eu longtemps des reponses tellement opposees, qu'une tradition pouvait rejeter l'autre d'apres ce seul critere; ceux qui condamnaient la reduction de la philosophie a l'histoire des idees et denoncaient l'oubli de la dimension intemporelle des argumentations valides, etaient eux memes critiques pour la naivete de leur silence sur la dimension historique de toute reflexion philosophique. Les positions ont evolue de chaque cote: un nouveau tournant philosophique, l'existence (...) d'un courant post-analytique, la qualite du travail historique, la percee de la philosophie analytique sur le continent,... ont change les rapports. En faisant du sujet de droit la prémisse anthropologique de la société, la modernité bouleverse la nature de l’intérêt général qui se mesure désormais à l’aune des aspirations individuelles. L’intérêt général est moins un principe qu’une notion relationnelle, qui articule, par le moyen du contrat, la composition des droits et des intérêts particuliers. Pourtant, la réciprocité initiale entre le droit et l’intérêt débouche sur une tension contrariant le projet de composer un intérêt général apte à les satisfaire également. L’étude conjointe (...) de deux auteurs, Thomas Hobbes et John Locke, permet de saisir que la priorité accordée à l’un des deux pôles, le droit et l’intérêt, aboutit à des pensées politiques radicalement divergentes, selon qu’elles portent l’accent sur l’exigence de la justice ou sur la poursuite de l’utilité sociale. Parce que la satisfaction des intérêts menace parfois de se retourner contre les droits, tandis que la protection des droits tend à discriminer les intérêts, la question se pose de savoir si l’univocité de la formule « intérêt général » ne masque pas une dualité dans sa nature, rendant problématique son statut d’idéal régulateur pour les sociétés modernes. Il est courant de déplorer la perte d’un horizon politique fédérateur apte à mobiliser les membres de nos sociétés dans la poursuite de l’intérêt général. Entre autres responsables de la dissolution du lien politique et de l’affaiblissement du devoir civique, est convoquée la philosophie libérale dont la portée individualiste aurait rendu inconcevable le sacrifice des intérêts particuliers au nom de l’intérêt général. Il s’agit d’éclaircir cette critique en montrant que la reformulation moderne du bien commun par le libéralisme a surtout (...) introduit une indétermination qui rend compte de la difficulté pour ses membres à s’y rapporter. En vertu du droit de chacun à poursuivre ses propres buts, l’intérêt général peut aussi bien désigner la protection des droits que la satisfaction des intérêts particuliers. Or ces deux finalités sont non seulement distinctes mais peuvent également entrer en conflit, comme le révèlent aujourd’hui les débats autour des objectifs de l’Union européenne ou ceux entourant la protection des Biens Publics Mondiaux. Cet ouvrage se propose de montrer que cette tension est déjà présente chez les auteurs fondateurs du libéralisme qui oscillent entre la consécration d’un droit déterminant la sphère des intérêts légitimes et la préservation des intérêts dont découle le régime des droits. L’ambiguïté entre ce qui est d’intérêt général, la garantie des droits, et la poursuite de l’intérêt général sur le principe de composition des intérêts particuliers, contraint alors à redéfinir la nature de la participation politique et citoyenne, en particulier dans le cadre de nos démocraties. A recent paper by Teresa Baron and Geoffrey Dierckxsens argues that puberty blockers and hormone therapy should be disallowed before adulthood on prudential and consent-related grounds. This response contends that their argument fails because it is predicated on unsupported premises and misinterpretations of the available evidence. There is no evidence that a large proportion of pubertal and postpubertal youths later discontinue medical transition. Meaningful assent is a viable and commonly accepted alternative to meaningful consent in paediatric bioethics. And finally, the (...) primary purpose of transition-related interventions is to actualise youths’ gendered self-image, not treat an underlying mental illness. (shrink)

As global warming continues to attract growing levels of attention, various stakeholders have put climate change on corporate agendas and expect firms to disclose relevant greenhouse gas information. In this paper, we investigate the consistency of the GHG information voluntarily disclosed by French listed firms through two different communication channels: corporate reports and the Carbon Disclosure Project. More precisely, we contrast the amounts of GHG emissions reported and the methodological explanations provided in each channel. Consistent with a stakeholder theory perspective, (...) we find that GHG amounts are significantly lower in the CR than in the CDP. We also find that firms increase the CR figures’ traceability when there is a discrepancy between disclosures in the two channels. We suggest that the aim of this greater traceability is to enhance information credibility across the different channels used. (shrink)

In the shadow of various business scandals and societal crises, scholars and practitioners have developed a growing interest in authentic leadership. This approach to leadership assumes that leaders may access and leverage their “true selves” and “core values” and that the combination of these two elements forms the basis from which they act resolutely, lead ethically, and benefit others. Drawing on Heidegger’s work, we argue that a concern for authenticity can indeed instigate a leadership ethic, albeit one that acknowledges the (...) unfounded openness of existence and its inherent relationality. On this basis, we propose an ethics-as-practice approach in which leaders respond to the situation at hand by being “attuned to attunement,” which cultivates an openness to otherness and a responsibility to others. Locke’s hermeneutics is not a particular instance of the general method exposed in the Essay concerning Human Understanding; such a deductive process would be contradictory to Locke’s very method. The Essay does not elaborate a general method applied afterwards in various fields, but analyses existing sciences and beliefs in order to improve them: it is a critique of previous learning more than a Discours de la Méthode. In order to be coherent with the epistemology of the Essay, it is necessary (...) to start anew with every field of learning, considering its singularity and trying to correct wrong conceptions. Scholars have noted persistent high rates of agricultural health and safety incidents and the need to develop more effective interventions. Participatory research provides an avenue to broaden the prevailing research paradigms and approaches by allowing those most impacted to illuminate and work to solve those aspects of their lives. One such approach is photovoice, an emancipatory visual narrative approach. Yet, despite its broad appeal, photovoice can be hard to implement. In this article, we leverage our experience using photovoice for a (...) farm children safety project to describe and reflect on the ethical and methodological aspects broadly relevant to agricultural health and safety topics. We first contextualize the tensions of navigating between photovoice, the research ethics committees (RECs) regulatory frameworks, and competing views on visual representations in agriculture. We then discuss the sources of risks to participants and researchers, how we addressed these risks, and how these risks unfolded during the research phase of the photovoice activity. We conclude with three lessons we (re)learned: the importance of collaborating with RECs, the need to increase preparation to limit psychological risks to participants and researchers, and avenues to augment the emancipatory power of photovoice in a virtual environment. Le problème historique majeur posé par l’étude de la prostitution à Rome est celui de l’existence de prostitué(e)s libres dans une société esclavagiste. Puisque des corps serviles, ou affranchis, masculins et féminins étaient disponibles en grand nombre, aussi bien dans les demeures des hommes libres que dans les maisons de prostitution, comment se fait-il que des femmes nées libres aient renoncé à leurs privilèges et statut de matrones? Comment se fait-il aussi que la société ait institutionnalisé ce renoncement en prévoyant (...) d’enregistrer officiellement ces prostituées d’origine libre? L’explication proposée ici est que les prostitué(e)s libres assument une fonction symbolique qui est d’être l’autre du soldat comme l’acteur est l’autre de l’orateur. Ces « parias » de la société romaine, toujours « efféminés » servent à marquer les marges de l’humanité civilisée dans la continuité, à définir les hommes, libres et adultes et donc « masculins » par ce qu’ils ne sont pas mais ce qu’ils pourraient par malheur, devenir des « effeminés » ou leur équivalent, des prostituées libres. Auguste Comte’s classical status in sociology and social theory is routinely taken to mean outdated. Coupled with this perception, there has been a pervasive tendency within contemporary discourse to presume a positivism that is largely rationalistic or scientistic and therefore critically and analytically useless. This paper explores how some of Comte’s lesser acknowledged perspectives on science, history, ‘progress’ and what it is to be human may yet compel us to reexamine our ideas about the kind of positivism we think we (...) have inherited and therefore need to renounce. I focus my reading of Comte through the lens of genealogies of thought not normally associated with his work, for instance, science and technology studies (STS) and posthumanist social theory.
