J.M. R. Lenz hat sich keineswegs als ein „vorübergehendes Meteor“ erwiesen, wie Goethe urteilte, sondern gilt inzwischen als einer der wichtigsten Autoren des 18. Jahrhunderts. Sein unglückliches Schicksal ist, vor allem über Büchner vermittelt, ein bis heute aktuelles Thema der produktiven Rezeption. Seine Werke entziehen sich aufgrund ihrer formalen und thematischen Vielschichtigkeit schnellen Deutungen. Das Lenz-Handbuch, an dem namhafte Vertreter der einschlägigen Forschung wie auch junge Autoren mitgearbeitet haben, vermittelt ein umfassendes und differenziertes Bild von Leben und Werk. A commercial tenant's interest in the retention of the rented item can be of paramount importance. In the event of landlord insolvency, the landlord's demands fade into the background and the creditor's rights take precedence. This unforeseeable development for the tenant can endanger the tenant's very existence due to divestiture of the rented item, i.e. his business, shop or factory. This work deals with the typical scenarios of such cases and answers the question concerning the possibility of effectively preventing the (...) specialized right of termination according to 111 of the German Insolvency Act. Nietzsche as Reader. This collective review summarizes and critically reflects on the results of four recent publications. On the one hand, this involves a typology of the specific mode of reception with which Nietzsche often incorporates seemingly selective readings into his thought and subsequently allows them to become productive in his writings; on the other hand, I am also dealing with the exceptional importance of Italian philology for current research into the influences on Nietzsche. The German-Italian conference volume Corrispondenze estetiche (...) focuses on Heinrich Heine’s influence, but it also discusses in a sophisticated way the tension between the two authors in the context of the history of nineteenth-century aesthetics. Vivetta Vivarelli’s study discusses the motif of eternal recurrence in various references to contemporary poetry, while Benedetta Zavatta presents the ultimate study of Nietzsche’s reading of Ralph Waldo Emerson. The need to regulate access to genetic resources and ensure a fair and equitable sharing of any resulting benefits was at the core of the development of the Convention on Biological Diversity (CBD). The CBD established a series of principles and requirements around access and benefit sharing (ABS) in order to increase transparency and equity in the international flow of genetic resources, yet few countries have been able to effectively implement them and ABS negotiations are often paralysed by differing interests. (...) -/- This book not only examines these complex challenges, but offers workable, policy-oriented solutions. International contributors cover theoretical approaches, new significant national legislation, the concept of traditional knowledge, provider and user country measures and common solutions. Exploring specific, salient examples from across the globe, the authors provide lessons for national regulation and the ongoing negotiations for an international ABS regime. We present a theory of sequential information processing in persuasion. It extends assumptions of the heuristic-systematic model, in particular the idea that information encountered early in a persuasion situation may affect the processing of subsequent information. SIP also builds on the abstraction from content-related dichotomies in accord with the parametric unimodel of social judgment. SIP features one constitutional axiom and three main postulates: Persuasion is the sequential processing of information that is relevant to judgment formation. Inferences drawn from initial information (...) may bias the processing of subsequent information if they are either activated rules or valence expectations that are relevant to the subsequent information. Inferences drawn from initial information are resistant to change. Thus, the interpretation of subsequent information is assimilated to inferences drawn from the initial information. Or, if assimilation is impossible, contrast effects occur. The overall effect of a persuasion attempt corresponds to the recipient’s judgment at the moment the processing of information is terminated. We illustrate how our predictions for assimilation and contrast effects may be tested by presenting results from an experiment in which we presented exactly the same arguments but varied the processing sequence. We discuss theoretical and applied implications of sequence effects for persuasion phenomena, as well as challenges for further research developing and testing the theory. (shrink)

Der Aufsatz stellt Leben und Werk des bedeutenden deutschen Rechtswissenschaftlers und Philosophen Arthur Baumgarten dar, der neben Gustav Radbruch einer der führenden sozialliberalen Juristen und Philosophen in der Weimarer Republik war und gegen die nationale Isolierung der deutschen Philosophie seit dem Ersten Weltkrieg früh die angloamerikanische Philosophie aufgenommen hatte. So zeichnete er intellektualistische und utilitaristische Theorielinien vor, die in der deutschen Philosophie erst seit den sechziger Jahren Einfluss gewannen. In engem kollegialem Kontakt war Baumgarten mit Hans Driesch und Helmuth (...) Plessner verbunden.Seine Philosophie verband Baumgarten gemäß empiristischer Tradition vor allem mit der Psychologie. Daraus ergab sich auf der Grundlage einer sich auf Schopenhauer beziehenden Antinomik die Konzentration der Philosophie in einer sensualistischen Moralphilosophie, deren empiristische Partikularität Baumgarten in einer erfahrungsgeleiteten Metaphysik zusammenfasste. In seiner Rechtsphilosophie bietet die Bestimmung des Verhältnisses von Geltung der Positivität des Rechts gegenüber der Geltung moralischer Normen besonderes Interesse. (shrink)

We attack the SSK's rejection of the distinction between discovery and justification (the DJ distinction), famously introduced by Hans Reichenbach and here defended in a "lean" version. Some critics claim that the DJ distinction cannot be drawn precisely, or that it cannot be drawn prior to the actual analysis of scientific knowledge. Others, instead of trying to blur or to reject the distinction, claim that we need an even more fine-grained distinction (e.g. between discovery, invention, prior assessment, test and (...) justification). Adherents of the SSK, however, maintain that the distinction is useless and perhaps nonexistent. We first argue against the assumption that the SSK's objection to the DJ distinction is just the same as Thomas Kuhn's. Second, we point out general weaknesses of the SSK's arguments against the DJ distinction. Finally, we argue that the distinction is useful not only in order to explicate what is meant by an evaluation but even for the empirical explanation of knowledge. We use two case studies from the history of cognitive science to support this point. (shrink)

Ziel dieses Bandes ist es, die Aktualität der Kritischen Theorie Adornos, Horkheimers und Habermas' für die heutige Zeit auszuloten. Es geht einerseits darum, die erkenntnistheoretischen Grundlagen der Kritischen Theorie neu zu überdenken, andererseits darum, neue Varianten dieser Theorie auf Gesellschaft, Kultur und Politik anzuwenden. Vor allem Bereiche wie Wissenschaftstheorie und Medienwissenschaft haben in den letzten Jahrzehnten neue Entwicklungen durchgemacht und fordern den kritischen Geist heraus.
