En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el (...) segundo acápite, mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. An account of assertion along truth-relativistic lines is offered. The main lines of relativism about truth are laid out and the problematic features that assertion acquires in the presence of relative truth are identified. These features are the possibility of coherently formulating norms of assertion and the possibility of grounding a rational practice of assertion upon relative truth. A solution to these problems is provided by formulating norms for making and assessing assertions that employ a suitably relativized truth predicate and (...) a perspectival notion of correctness. Neutral Counterpart Theories of slurs hold that the truth-conditional contribution of a slur is the same as the truth-conditional contribution of its neutral counterpart. In, DiFranco argues that these theories, even if plausible for single-word slurs like ‘kike’ and ‘nigger’, are not suitable for complex slurs such as ‘slanty-eyed’ and ‘curry muncher’, figurative slurs like ‘Jewish American Princess’, or iconic slurring expressions like ‘ching chong’. In this paper, we argue that these expressions do not amount to genuine counterexamples to neutral (...) counterpart theories of slurs. We provide a positive characterization of DiFranco's examples that doesn't deviate from the core of those theories. (shrink)

The aim of the paper is to evaluate the prospects for an aesthetically informed assessment-sensitive semantic account of thick aesthetic predicates (TAPs) such as 'intense', 'sombre', ‘balanced’, ‘harmonious’, etc. We distinguish two meaning dimensions concerning TAPs, truth-conditional and use-conditional or expressive, and provide a dualist semantics that posits assessment sensitivity at both levels. Then we evaluate the extent to which assessment sensitivity is an apt rendition of aesthetic discourse involving TAPs. We distinguish between experiential TAPs (‘intense’, ‘sombre’) and theoretical TAPs (...) (‘balanced’, ‘dynamic’), and argue that there is evidence for a relativistic construal both at the truth-conditional and the expressive level for experiential TAPs, but not for theoretical TAPs. Thus, an upper bound is found on how much assessment sensitivity characterises aesthetic discourse. (shrink)

Art and science is an area of research that has strengthened recently, mainly due to the impact of interdisciplinary work. At the same time, approaches between the humanities and the sciences have succeeded in re-signifying traditional views towards critical positions such as postcolonialism, especially in the colonially so-called “Global South”. In this paper, we want to review the case of the work of the Mexican artist Octavio Ocampo through works that present the case of biological and cultural evolution. From this, (...) we want to reflect on the public perception of science in Mexico, the tensions between social and natural sciences, and the urgent need to strengthen the postcolonial discourse in scientific practice. Presento una extensión del marco de Stalnaker para modelar los efectos conversacionales de la aserción, de modo que este pueda aplicarse a la aserción de proposiciones cuya verdad es relativa a parámetros adicionales respecto de un mundo posible. Desarrollo dos maneras de aplicar este marco a la aserción de proposiciones evaluativas, según la apreciación de las emisiones evaluativas mismas refleje una concepción relativista moderada de sus condiciones de corrección o una concepción radical. Argumento que, en virtud de la diferencia que (...) existe a la hora de concebir la aserción, el relativismo radical tiene una ventaja por sobre el relativismo moderado, dado que el relativismo moderado tiene inconvenientes a la hora de interpretar los desacuerdos evaluativos. I present an extension of Stalnaker's framework for modeling the conversational effects of assertion, so that it may be applied to the assertion of propositions whose truth is relative to parameters beyond a possible world. I develop two ways in which the new framework may be applied to the assertion of evaluative propositions, depending on whether the assessment of evaluative utterances reflects a moderate or a radical conception of their correctness conditions. I argue that, in virtue of this difference in the conceptualization of assertion, radical relativism has an advantage over moderate relativism, for moderate relativism faces problems with respect to the interpretation of evaluative disagreement. El presente trabajo busca defender la tesis de la subdeterminación semántica de las emisiones lingüísticas. Se argumenta a favor de esta tesis al tratar las aserciones suboracionales como casos paradigmáticos de la existencia de constituyentes no articulados. Se defiende la existencia de aserciones suboracionales genuinas frente a análisis alternativos que se han desarrollado para dar cuenta de este tipo de emisiones y se muestra cómo tiene lugar la interpretación pragmática de este tipo de emisiones. In this paper, I defend the (...) semantic underdetermination thesis for linguistic utterances. I argue in favor of this thesis by treating subsentential assertions as paradigmatic cases of the existence of unarticulated constituents. I defend the existence of genuine subsentential assertions against alternative analyses that have been developed to cope with this kind of utterances, and I explain how the pragmatic interpretation of this kind of utterances goes. If sound, Horwich’s argument could entail that truth relativism is incompatible with any conception of our ordinary truth predicate according to which there is some sort of equivalence between a ground-language claim that p and the corresponding claim that p is true. La figura de Alfred Russel Wallace dentro de la antropología ha sido escasamente reconocida dentro de la historia de la disciplina. Un punto importante es ubicar al autor dentro de las discusiones antropológicas de la época victoriana, desde su interés temprano como naturalista por historizar a los seres humanos, hasta su labor institucional como el primer presidente de un departamento de antropología en Inglaterra. En ese contexto, el objetivo del trabajo es presentar la visión de Wallace respecto a la antropología (...) física, a partir de su obra antropológica, que incluye referencias al origen de las razas humanas en términos naturalistas, al desarrollo de características físicas distintivas de los seres humanos o a la relación evolutiva entre primates. Con esto, se amplía la perspectiva sobre el desarrollo de la antropología física en el siglo XIX, al abrir el abanico a autores que contribuyeron de manera importante a su desarrollo. (shrink)

The present work explores the possibility of conciliating the truth-conditional relevance of referential uses of definite descriptions with the assignment of a univocal linguistic meaning to these constructions. It is argued that conciliation is possible if we reject the thesis, central to the debate between Russellians and ambiguity theorists, according to which referential uses are truth-conditionally relevant if and only if they constitute referential meanings. We sketch a framework within which the denial of that thesis has theoretical content, by drawing (...) on the conceptual resources of Relevance Theory and on a pragmatic conception of reference, following Strawson. The linguistic meaning of definite descriptions is analyzed as a procedural meaning that is semantically underdetermined with respect to both referential and attributive readings, and a pragmatic strategy for understanding this ambiguity is sketched. El presente trabajo explora una posible conciliación de la relevancia para las condiciones de verdad de los usos referenciales de descripciones definidas con la postulación de un significado lingüístico unívoco para tales construcciones. Se argumenta que dicha conciliación es posible si se abandona la tesis, central en el debate entre russellianos y teóricos de la ambigüedad, según la cual los usos referenciales son relevantes para las condiciones de verdad si y sólo si constituyen significados referenciales. Se esboza un marco dentro del cual la negación de esta tesis tiene contenido teórico, apelando a los recursos conceptuales de la Teoría de la Relevancia y a una concepción pragmática de la referencia en la línea de Strawson. Se analiza el significado de las descripciones definidas como un significado procedimental, semánticamente subdeterminado respecto de una lectura referencial o atributiva, y se esboza una manera pragmática de entender esta ambigüedad. In 'An undermining diagnosis of relativism about truth', Horwich claims that the notion of relative truth is either explanatorily sterile or explanatorily superfluous. In the present paper, I argue that Horwich's explanatory demands set the bar unwarrantedly high: given the philosophical import of the theorems of a truth-theoretic semantic theory, Horwich's proposed explananda, what he calls acceptance facts, are too indirect for us to expect a complete explanation of them in terms of the deliverances of a theory of meaning based (...) on the notion of relative truth. And, to the extent that there might be such an explanation in certain cases, there is no reason to expect relative truth to play an essential, ineliminable role, nor to endorse the claim that it should play such a role in order to be a theoretically useful notion. Estudio sobre los diferentes manejos que de la conquista de México y de la época Virreinal hicieron los dos países, al construirse como naciones modernas. Análisis de los desacuerdos, lagunas, fobias, ficciones, vacíos que quedaron en la memoria de cada país, y los efectos nocivos que estos dejaron en la autovaloración y en la mentalidad, más bien negativa, de cada nación.

Como han puesto de relieve Evans y García-Carpintero, uno de los problemas más importantes respecto de la aserción en el marco de una concepción relativista radical de los discursos evaluativos es dar un tratamiento coherente de los compromisos y de las responsabilidades que la aserción misma genera cuando sus condiciones de corrección son inestables. Construyendo sobre la base de un trabajo de Losada, el presente trabajo busca ofrecer dicho tratamiento.

Political communication in modern democratic societies often requires the speaker to address multiple audiences with heterogeneous values, interests and agendas. This creates an incentive for communication strategies that allow politicians to send, along with the explicit content of their speech, concealed messages that seek to secure the approval of certain groups without alienating the rest of the electorate. These strategies have been labeled dogwhistling in recent literature. In this article, we provide an analysis of overt intentional dogwhistling. We recognize two (...) main stages within the OIDs’ way of conveying a concealed message: the expression of a perspective together with the transmission of an accompanying positioning message vis-à-vis the OID targeted sub-audience, and the inferential extraction of a set of cognitive and non-cognitive contents inferred on the basis of the former stage. Furthermore, we identify three linguistic mechanisms whereby these contents may be transmitted: conventional meaning, conversational implicature and perlocutionary inferencing. Hence, on our view OIDs are not a uniform category, as they may differ as to what extent the concealed content is speaker-meant, and thus actually communicated by the speaker. (shrink)

Philosophy of language has been witnessing for the last fifteen years or so, if not a turn, at least the rising of a new trend, with its usual methods applied to new non-semantic phenomena linked to language use in the context of politics, and with new methods arising from the distinctive features of the new subject matter. Among these phenomena, dogwhistles have taken somewhat of a center stage (other phenomena include ethnic slurs, testimonial and hermeneutical injustice, propaganda and gender-inclusive language, (...) among others). This special issue is devoted to their study. In this brief introduction, we seek to succinctly review the key aspects of the phenomenon. First, we present some intuitive examples; second, we put forward a preliminary characterization of dogwhistles; then we discuss some of the main issues raised by these examples, as well as some basic notions found in the literature. We close by presenting an overview of the articles to be found in the current issue. (shrink)

In the past, deception detection research has explored whether there were specific personal characteristics that were related to lying and found that factors such as personality and morality are indeed related to lying. However, past research has usually focused on a variable-centered approach. Yet, a person-centered might be more suitable here as it allows for the study of people in an integrative manner. In this experiment, 673 students completed a questionnaire which included measures of the five factors of personality, the (...) level of moral disengagement, the perceived cognitive load when lying, lying strategies, frequency of lying and the LiES scale, a tool measuring the tendency to tell self-serving, altruistic and vindicative lies. We performed a Latent Profile Analysis to integrate personality, moral disengagement, and perceived cognitive load scores into specific profiles. Then, we related profile membership to lying behavior. We obtained four profiles, and found that extraversion, moral disengagement, and the perceived cognitive load contributed most to profile differences. We also found that lying frequency did not differ across profiles, whereas lying tendency did. In conclusion, our results suggest that several facets of the individual play a joint role in lying behavior, and that adopting a person-centered approach might be a good strategy to explore the role of interpersonal differences in lie detection research. Since the outbreak of COVID-19, many conspiracy theories have spread widely, which has the potential to reduce adherence to recommended preventive measures. Specifically, anti-vaccine conspiracy beliefs can have a strong negative impact on COVID-19 vaccination attitude and intention. The present study aimed to clarify how such beliefs can reduce vaccination intention, exploring the possible mediating roles of attitude toward vaccination, trust in science, and trust in government, among a sample of 822 unvaccinated Italian adults. Path analysis showed that anti-vaccine conspiracy (...) beliefs influenced intention to get vaccinated both directly and indirectly through the mediating effects of attitude, trust in science, and trust in government. In particular, the simple mediating effect of attitude was the strongest one, followed by the serial mediating effect of trust in science and attitude itself. Findings provide insights into the design of interventions aimed at reducing misinformation and subsequent vaccine hesitancy. (shrink)

Genomic instability is a hallmark of cancer. Cancer cells that exhibit abnormal chromosomes are characteristic of most advanced tumours, despite the potential threat represented by accumulated genetic damage. Carcinogenesis involves a loss of key components of the genetic and signalling molecular networks; hence some authors have suggested that this is part of a trend of cancer cells to behave as simple, minimal replicators. In this study, we explore this conjecture and suggest that, in the case of cancer, genomic instability has (...) an upper limit that is associated with a minimal cancer cell network. Such a network would include (for a given microenvironment) the basic molecular components that allow cells to replicate and respond to selective pressures. However, it would also exhibit internal fragilities that could be exploited by appropriate therapies targeting the DNA repair machinery. The implications of this hypothesis are discussed. (shrink)
