A raíz de los avances realizados en neurociencia y sus implicancias en el derecho en general, y el derecho penal en particular, nos proponemos a evaluar si la normativa de los tratados internacionales sobre derechos humanos es suficiente para cubrir los principios que surgen de sus postulados, o si es necesaria una ampliación (ya sea interpretativa o normativa) en Latinoamérica. Realizaremos un breve repaso de los avances en el campo del neuroderecho y consideraremos algunas de las propuestas más destacadas. Trataremos (...) el derecho a la libertad cognitiva, la privacidad y la integridad mentales y la continuidad psicológica. Finalmente, proponemos una ampliación del bloque convencional interamericano de derechos humanos para dar respuesta a los nuevos posibles conflictos de derechos y garantías. (shrink)

En Guadalajara, Jalisco, México, surgió la propuesta por parte del gobierno municipal de decorar las calles con el proyecto “Gigantes urbanos”; una de las estatuas que lo conforman se llama La pluma, del artista Pedro Escapa. El presente trabajo tomará esta obra como excusa para reflexionar el papel del escritor y del periodista que podría tener la sociedad actual siguiendo la idea de “posmodernidad” que sugirió Lyotard en 1986. Aunado a esto, se retomarán declaraciones y entrevistas dadas por expertos del (...) arte posmoderno para determinar esta imago que se tiene de los reporteros e intelectuales en Guadalajara y descubrir que del escritor sólo nos queda una imagen borrosa, un mártir o alguien que merece esculturas monumentales de varios millones de pesos: una reflexión útil desde el campo de las Humanidades para los habitantes de esta ciudad. When reasoning about dependence relations, philosophers often rely on gradualist assumptions, according to which abrupt changes in a phenomenon of interest can result only from abrupt changes in the low-level phenomena on which it depends. These assumptions, while strictly correct if the dependence relation in question can be expressed by continuous dynamical equations, should be handled with care: very often the descriptively relevant property of a dynamical system connecting high- and low-level phenomena is not its instantaneous behaviour but its stable (...) fixed points (those in the vicinity of which it spends most of the time, after comparatively short transitory periods), and stable fixed points can change abruptly as a result of infinitesimal changes of the low-level phenomenon. We illustrate this potential gradualist trap by showing that Chalmers’ fading qualia argument falls into it. (shrink)

This study investigates the relationship between mental health and emotional intelligence among senior high school students in a public school. Thus, the study employed a correlational design to measure the relationship between mental health and emotional intelligence among 152 Grade 12 senior high school students in a public school. Hence, to measure the study’s variables - Mental Health Inventory and Emotional Intelligence Scale (EIS) were utilized. Based on the inferential statistics, the r coefficient of 0.32 indicates a low positive correlation (...) between the variables and a p-value of 0.00, indicating a significant relationship between the respondents' mental health and emotional intelligence. Esta experiencia describe las conclusiones extraídas de la realización de un taller de cortometraje como método terapéutico para trabajar habilidades de empoderamiento y de expresión emocional con un grupo de personas con enfermedad mental, usuarias de un centro de día. La finalización del taller culmina con un video fórum y la grabación de un video para un certamen anual de cortos sobre salud mental. Para la evaluación del taller se utilizó un proceso metodológico de carácter cualitativo basado en el grupo (...) de discusión. La mayoría destacó las experiencias positivas resultantes del programa y los efectos positivos, sobre todo a nivel creativo y emocional. (shrink)

This paper examines the scholarship, evidence, and assumptions that place the origins of Chinese drama in shamanic ritual. The paper is roughly divided in two parts: the first contextualizes the use of shamanism within the theories of art and literature of one of the first scholars to link the origins of Chinese theatre to shamanism, Wang Guowei, to show that Wang’s view of the relationship between shamanism and drama differs from mainstream interpretations. The second part assesses the views of modern (...) ethnographers and historians of China on the role of shamanism in theater, with a focus on the work of the scholar Piet van der Loon. (shrink)

La innovación en el lenguaje es esencial porque supera los sesgos en el uso del lenguaje y expande su forma y significado. En el siglo XX la Literatura Hispanoamericana tuvo un desarrollo muy notable en la experimentación del lenguaje, por ello, esta investigación se centra en el estudio de una obra innovadora en el campo de las escrituras híbridas. Esta renovación de la lengua se engendra desde ya hace varios años en Jalisco, México: la escritura de Dante Medina proviene de (...) una tradición de ruptura, —desde la narrativa fantástica— crea sus definiciones estructurales y, en ese rompimiento, alarga los límites de la lengua. Juan Rulfo le atribuyó en sus Obras Completas: “Dante Medina está usando un lenguaje muy nuevo, completamente original y poco, poco frecuente en la literatura mexicana. Y lo mismo se puede decir de la literatura latinoamericana. Creo yo que el mérito consiste no sólo en los neologismos, sino en la transposición de los sueños”. Dante Medina rompe con normas preestablecidas, y creencias dominantes sobre la “destrucción de la estructura” cuando en realidad se trata de una recreación, una novedad. Desde 1986 el autor ofrece nuevos géneros textuales, que surgen de la hibridación de la estructura del relato con los gustos del ensayo, la poesía o la novela. En el siglo XXI, las posibles reglas que operan en la creación de nuevos géneros literarios son la audacia y la creatividad de una tradición literaria: en la literatura mexicana contemporánea hay nuevos cultivadores para enriquecer la Lengua Española. Representations are not only used in our folk-psychological explanations of behaviour, but are also fruitfully postulated, for example, in cognitive science. The mainstream view in cognitive science maintains that our mind is a representational system. This popular view requires an understanding of the nature of the entities they are postulating. Teleosemantic theories face this challenge, unpacking the normativity in the relation of representation by appealing to the teleological function of the representing state. It has been argued that, if intentionality is (...) to be explained in teleological terms, then the function of a state cannot depend on its phylogenetical history, given the metaphysical possibility of a duplicate of an intentional being that lacks an evolutionary history. In this paper, I present a method to produce, according to our current knowledge in genetic engineering, human-like individuals who are not the product of natural selection in the required sense. This variation will be used to shed light on the main replies that have been offered in the literature to the Swampman thought experiment. I argue that these replies are not satisfactory: representations should better not depend on natural selection. I conclude that a non-etiological notion of function is to be preferred for characterizing the relation of representation. (shrink)

Sometimes two expressions in a discourse can be about the same thing in a way that makes that very fact evident to the participants. Consider, for example, 'he' and 'John' in 'John went to the store and he bought some milk'. Let us call this 'de jure' coreference. Other times, coreference is 'de facto' as with 'Mark Twain' and 'Samuel Clemens' in a sincere use of 'Mark Twain is not Samuel Clemens'. Here, agents can understand the speech without knowing that (...) the names refer to the same person. After surveying many available linguistic and pragmatic tools (intentions to corefer, presuppositions, meanings, indexing, discourse referents, binding etc.) I conclude that we must posit a new semantic primitive to account for de jure coreference. Because of the COVID-19 pandemic, procrastination has become commonplace due to changes in teaching and learning, which trigger students' academic burnout. As a result, it has increased the intensity of procrastination among students who are enrolled in online learning programs. As a result, students have difficulty as a result of the rapid change from in-person learning to online learning. The study investigates the relationship between academic burnout and procrastination among 150 grade 12 senior high school students. Hence, this study employed (...) a correlational design. Based on the inferential analysis, the r coefficient of 0.71 indicates a high positive correlation between the variables. The p-value of 0.00, which is less than 0.05, leads to the decision to reject the null hypothesis. Hence, a significant relationship exists between academic burnout and academic procrastination among grade 12 senior high school students. (shrink)

The traditional approach in cognitive sciences holds that cognition is a matter of manipulating abstract symbols followingcertain rules. According to this view, the body is merely an input/output device, which allows the computationalsystem—the brain—to acquire new input data by means of the senses and to act in the environment following its com-mands. In opposition to this classical view, defenders of embodied cognition (EC) stress the relevance of the body inwhich the cognitive agent is embedded in their explanation of cognitive processes. (...) From a representationalist frameworkregarding our conscious experience, in this article, I will offer a novel argument in favor of EC and show that cognitionconstitutively—and no merely causally—depends upon body activity beyond that in the brain. In particular, I will arguethat in order to solve the problem derived from the empirical evidence in favor of the possibility of shifted spectrum,representationalist should endorse the view that experiences concern its subject: the content of experience isde se.Ishow that this claim perfectly matches the phenomenological observation and helps explaining the subjective characterof the experience. Furthermore, I argue that entertaining this kind of representation constitutively depends on bodilyactivity. Consequently, insofar as cognition depends on consciousness, it is embodied. (shrink)

There has been longstanding interest in the consistency of decisions made by research ethics committees in the UK, but most of the evidence has come from single studies submitted to multiple committees. A systematic comparison was carried out of the decisions made on 18 purposively selected applications, each of which was reviewed independently by three different RECs in a single strategic health authority. Decisions on 11 applications were consistent, but disparities were found among RECs on decisions on seven applications. An (...) analysis of the agreement between decisions of RECs yielded an overall measure of agreement of κ = 0.286 , indicating a level of agreement that, although probably better than chance, may be described as “slight”. The small sample size limits the robustness of these findings. Further research on reasons for inconsistencies in decision making between RECs, and on the importance of such inconsistencies for a range of arguments, is needed. (shrink)

Big Data evangelists often argue that algorithms make decision-making more informed and objective—a promise hotly contested by critics of these technologies. Yet, to date, most of the debate has focused on the instruments themselves, rather than on how they are used. This article addresses this lack by examining the actual practices surrounding algorithmic technologies. Specifically, drawing on multi-sited ethnographic data, I compare how algorithms are used and interpreted in two institutional contexts with markedly different characteristics: web journalism and criminal justice. (...) I find that there are surprising similarities in how web journalists and legal professionals use algorithms in their work. In both cases, I document a gap between the intended and actual effects of algorithms—a process I analyze as “decoupling.” Second, I identify a gamut of buffering strategies used by both web journalists and legal professionals to minimize the impact of algorithms in their daily work. Those include foot-dragging, gaming, and open critique. Of course, these similarities do not exhaust the differences between the two cases, which are explored in the discussion section. I conclude with a call for further ethnographic work on algorithms in practice as an important empirical check against the dominant rhetoric of algorithmic power. (shrink)

Recently, some philosophers have defended the idea that knowledge is an interest-relative notion. According to this thesis, whether an agent knows P may depend on the practical costs of her being wrong about P. This perspective marks a radical departure from traditional accounts that take knowledge to be a purely intellectual concept. I think there is much to say on behalf of the interest-relative notion. In this paper, I report on some new evidence which strongly suggests that ordinary people’s attributions (...) of knowledge are in fact sensitive to practical interests. This is noteworthy because recent experiments have been interpreted by many to support the opposite conclusion. I also argue that the new results support an invariantist but interest-relativist account of knowledge, a thesis known as Interest Relative Invariantism (IRI). I do not make the case here that IRI gives us the very best explanation of the results presented here. Any such attempt would require an in-depth survey of the last few decades of work in epistemology. I only want to argue here that IRI gives us a simple and elegant explanation of the new data, and that the same cannot be said about traditional contextualism, a leading competitor to IRI. (shrink)

The well-known distinction between access consciousness and phenomenal consciousness has moved away from the conceptual domain into the empirical one, and the debate now is focused on whether the neural mechanisms of cognitive access are constitutive of the neural correlate of phenomenal consciousness. In this paper, I want to analyze the consequences that a negative reply to this question has for the cognitive phenomenology thesis – roughly the claim that there is a “proprietary” phenomenology of thoughts. If the mechanisms responsible (...) for cognitive access can be disentangled from the mechanisms that give rise to phenomenology in the case of perception and emotion, then the same disentanglement is to be expected in the case of thoughts. This, in turn, presents, as I argue, a challenge to the cognitive phenomenology thesis: either there are thoughts with cognitive phenomenology we lack cognitive access to or there are good reasons to doubt that there is such a thing as cognitive phenomenology. A common theme in social science studies of algorithms is that they are profoundly opaque and function as “black boxes.” Scholars have developed several methodological approaches in order to address algorithmic opacity. Here I argue that we can explicitly enroll algorithms in ethnographic research, which can shed light on unexpected aspects of algorithmic systems—including their opacity. I delineate three meso-level strategies for algorithmic ethnography. The first, algorithmic refraction, examines the reconfigurations that take place when computational software, people, and institutions interact. (...) The second strategy, algorithmic comparison, relies on a similarity-and-difference approach to identify the instruments’ unique features. The third strategy, algorithmic triangulation, enrolls algorithms to help gather rich qualitative data. I conclude by discussing the implications of this toolkit for the study of algorithms and future of ethnographic fieldwork. (shrink)

Research Ethics Committees (RECs) are frequently a focus of complaints from researchers, but evidence about the operation and decisions of RECs tends to be anecdotal. We conducted a systematic study to identify and compare the ethical issues raised in 54 letters to researchers about the same 18 applications submitted to three RECs over one year. The most common type of ethical trouble identified in REC letters related to informed consent, followed by scientific design and conduct, care and protection of research (...) participants, confidentiality, recruitment and documentation. Community considerations were least frequently raised. There was evidence of variability in the ethical troubles identified and the remedies recommended. This analysis suggests that some principles may be more institutionalized than others, and offers some evidence of inconsistency between RECs. Inconsistency is often treated as evidence of incompetence and caprice, but a more sophisticated understanding of the role of RECs and their functioning is required. (shrink)

The production of good sound generation in the violin is a complex task that requires coordination and spatiotemporal control of bowing gestures. The use of motion-capture technologies to improve performance or reduce injury risks in the area of kinesiology is becoming widespread. The combination of motion accuracy and sound quality feedback has the potential of becoming an important aid in violin learning. In this study, we evaluate motion-capture and sound-quality analysis technologies developed inside the context of the TELMI, a technology-enhanced (...) music learning project. We analyzed the sound and bow motion of 50 participants with no prior violin experience while learning to produce a stable sound in the violin. Participants were divided into two groups: the experimental group received real-time visual feedback both on kinematics and sound quality, while participants in the control group practiced without any type of external help. An additional third group of violin experts performed the same task for comparative purposes. After the practice session, all groups were evaluated in a transfer phase without feedback. At the practice phase, the experimental group improved their bowing kinematics in comparison to the control group, but this was at the expense of impairing the sound quality of their performance. At the retention phase, the experimental group showed better results in sound quality, especially concerning control of sound dynamics. Besides, we found that the expert group improved the stability of their sound while using the technology. All in all, these results emphasize the importance of feedback technologies in learning complex tasks, such as musical instrument learning. (shrink)

El noúmeno se erige en límite ideal de conocimiento para la progresión de la razón hacia lo incondicionado, con valor, entonces, no cognoscitivo sino regulativo. Sobre esa tesis kantiana versal, la irrealidad de lo cognoscible en su comisión objetiva (la objetualidad de lo sólo (...) óntico transluce su ontologización como irreal - fenomenológico) y la transfenomenalidad del en sí agostado en la apariencia (despliegue del ser en el espectro completo de manifestaciones ante conciencia que detrae la realidad al noúmeno, relegado a mera ficción), el libro ensaya patrones de lectura del hiato objeto - sujeto, procurando cauces a la metafísica e imponiendo barreras indelebles a la ciencia, en un recorrido que arranca en el mythos y en la anáfora filogenética del enigma de Edipo. La topología freudiana del aparato psíquico servirá de base para una división de las edades del espíritu que reelabora la propuesta de Comte, asociando el super - yo a la era teocrática de prominencia de la faz acognitiva (vivencia del noúmeno como realidad metafísica significativa en sí misma, no puro ideal, con la jerarquía y envolturas del mundo medio como consecuencia sociológica y el supra - egocidium místico, implosión del superyo decisiva para el renacer -teorema de Thomas-), el yo a la era crítica (inflación utópico - normativa del noúmeno y restrictiva adhesión epistemológica a lo fenoménico en una época que conserva la ilusión transcendental), ambas, etapas de bipolaridad con quiásmica descompensación facial, y el ello, en fin, al orden positivista unifacial surgente con la revolución industrial y el vitalismo que, en sus directrices primarias, sanciona el estatuto canónico del noúmeno, abonándose al fenómeno y abrazando la inmanencia como única solución de fe.
