Ontologies represent the standard way to model the knowledge about specific domains. This holds also for the legal domain where several ontologies have been put forward to model specific kinds of legal knowledge. Both for standard users and for law scholars, it is often difficult to have an overall view on the existing alternatives, their main features and their interlinking with the other ontologies. To answer this need, in this paper, we address an analysis of the state-of-the-art in legal ontologies (...) and we characterise them along with some distinctive features. This paper aims to guide generic users and law experts in selecting the legal ontology that better fits their needs and in understanding its specificity so that proper extensions to the selected model could be investigated. L’articolo affronta il problema delle interazioni fra cittadini romani e indigeni nel territorio di Bergomum, municipium della regio xi - Transpadana, attraverso l’esame delle formule onomastiche riscontrabili in alcune iscrizioni. In particolare, l’analisi della documentazione epigrafica agirà su un doppio binario, prendendo in considerazione sia formule di onomastica idionimica – tipicamente indigene e presenti anche dopo la concessione della cittadinanza romana alla Transpadana alla metà del I secolo a.C. – sia formule fedeli al modello romano dei tria nomina, che testimoniano (...) un’ascendenza celtica e una certa persistenza di abitudini locali. Le prove fornite dall’onomastica, dunque, saranno utili ad indagare come gli abitanti “indigeni” di Bergomum abbiano affrontato la romanizzazione del loro territorio e attraverso quali meccanismi vennero integrati nella struttura sociale romana; ciò anche attraverso il confronto con realtà circonvicine, prima fra tutte la Colonia Civica Augusta Brixia. Folk-economic beliefs may be regarded as “evidential fictions” that exploit the natural tendency of human cognition to organize itself in narrative form. Narrative counter-arguments are likely more effective than logical debunking. The challenge is to convey sound economic reasoning in narratively conspicuous forms – an opportunity for economics to rethink its role and agency in public discourse, in the spirit of its old classics.

Hands are commonly held up as an exemplar of well-known, familiar objects. However, conceptual knowledge of the hand has been found to show highly stereotyped distortions. Specifically, people judge their knuckles as farther forward in the hand than they actually are. The cause of this distal bias remains unclear. In Experiment 1, we tested whether both visual and tactile information contribute to the distortion. Participants judged the location of their knuckles by pointing to the location on their palm directly opposite (...) each knuckle with: 1) a metal baton (using vision and touch) 2) a metal baton while blindfolded (using touch), 3) a laser pointer (using vision). In Experiment 2, we investigated whether judgments are influenced by visual landmarks such as the creases at the base of each finger on the palm. Participants localized their knuckles on either a photograph or a silhouette of their hand. In both experiments, clear distortions were found across conditions, of generally similar magnitude. These results show that distal bias is resistant to changes in the stimulus information and does not rely on any specific stimulus cue or single sensory modality, suggesting that such mislocalisations reflect a conceptual misrepresentation of hand structure. The essay is dedicated to war considered through the reflections of Roger Caillois and in particular through certain motifs – feast, sacred, vertigo – that allow us to grasp its ‘metaphysical’ intention, i.e. capable of looking at war as the point of chiasmatic reversibility of life and death.

Focusing on the relationship between two important scientists in the development of ecological thought during the first half of the twentieth century, this paper argues that Yale limnologist G. E. Hutchinson's adoption of the biogeochemical approach in the late 1930s builds on the 1920s work of the Russian scientist V. I. Vernadsky. An analysis of Hutchinson’s scientific publications shows that he first referred to Vernadsky in 1940, on two different occasions. This article analyzes the dynamics of Hutchinson’s formulation of the (...) biogeochemical approach, providing historical context and linking its early application to the existing limnological tradition. Most business ethicists maintain that corporate actors are subject to a variety of moral obligations. However, there is a persistent and underappreciated concern that the competitive pressures of the market somehow provide corporate actors with a far-reaching excuse from meeting these obligations. Here, we assess this concern. Blending resources from the history of philosophy and strategic management, we demonstrate the assumptions required for and limits of this excuse. Applying the idea of ‘the state of nature’ from Thomas Hobbes, we suggest (...) that corporate actors would be excused from duties if complying with them threatened their vital interests. We show how this excuse is not available for most individuals within firms; instead, it is an excuse perhaps available to firms themselves, but only given substantive assumptions about corporate personhood. For those willing to make these assumptions, we apply the competitive advantage construct to delimit the scope of this excuse. We suggest that firms are excused from fulfilling an obligation when complying leads to a competitive disadvantage, as this imperils the firm’s vital interests. After revealing why this excuse does not generalize, we conclude by considering when we should reform the market to avoid the legitimacy of this excuse. (shrink)

The relentless exploitation of the earth's resources and technologys boundless growth are a matter of urgent concern. When did this race towards the limitless begin? The Greeks, who shaped the basis of Western thinking, lived in mortal fear of humanity's hidden hunger for the infinite and referred to it as hubris, the one true sin in their moral code. Whoever desired or possessed too much was implacably punished by nemesis, yet the Greeks themselves were to pioneer an unprecedented level of (...) ambition that began to reverse that tabu. If it is true that no culture can truly repudiate its origins, and that gods who are no longer potent can vanish but still leave behind a body of myth which coninues to live and assert itself in modernized garb, then our concern with the limits of growth reflects something more than an awareness of new technological problems - it also brings to light a psychic wound a a feeling of guilt which are infinitely more ancient. Simple assumptions represent a decisive reason to prefer one theory to another in everyday scientific praxis. But this praxis has little philosophical justification, since there exist many notions of simplicity, and those that can be defined precisely strongly depend on the language in which the theory is formulated. The language dependence is a natural feature—to some extent—but it is also believed to be a fatal problem, because, according to a common general argument, the simplicity of a theory is always trivial (...) in a suitably chosen language. But, this trivialization argument is typically either applied to toy-models of scientific theories or applied with little regard for the empirical content of the theory. This paper shows that the trivialization argument fails, when one considers realistic theories and requires their empirical content to be preserved . In fact, the concepts that enable a very simple formulation, are not necessarily measurable, in general. Moreover, the inspection of a theory describing a chaotic billiard shows that precisely those concepts that naturally make the theory extremely simple are provably not measurable. This suggests that—whenever a theory possesses sufficiently complex consequences—the constraint of measurability prevents too simple formulations in any language. This explains why the scientists often regard their assessments of simplicity as largely unambiguous. In order to reveal a cultural bias in the scientists’ assessment, one should explicitly identify different characterizations of simplicity of the assumptions that lead to different theory selections. General arguments are not sufficient. (shrink)

Luigi Giussani, a high school religion teacher throughout the 1950s and 1960s, grounded his teachings in the vast body of experience to be found in Christianity's two-thousand-year history. He told his students, “I'm not here to make you adopt the ideas I will give you as your own, but to teach you a method for judging the things I will say.” Throughout his life, education was one of Giussani's primary intellectual interests. He believed that effective education required an adequate (...) background in the Christian tradition, presented within a lived experience that underscored the capacity of the faith to answer universal questions. What he proposed was a process that allowed one to sift through tradition, critically examining it and comparing it against the ultimate criteria for judgment: the desires of the heart. In Giussani's view, the primary concern was to “educate the human heart as God made it.” In The Risk of Education he states that fear leads students to associate this process of criticism with negativity or doubt. Yet, without an education in criticism, students cannot develop conviction. At a time when young people are abandoning the church and questioning the value of faith, Giussani's method of judging and verifying Christianity as an experience seems a necessary intervention. In The Risk of Education he argues that, ultimately, education and the Christian message reveal themselves through human freedom. (shrink)

We use a lab experiment to examine whether and how leaders influence workers’ (un)ethical behavior through financial reporting choices. We randomly assign the role of leaders or workers to subjects, who can choose to report an outcome via automatic or self-reporting. Self-reporting allows for profitable and undetectable earnings manipulation. We vary the leaders’ ability to choose the reporting method and to punish workers. We show that workers are more likely to choose automatic reporting when their leader voluntarily does so and (...) can assign punishment. Even workers who choose self-reporting tend to cheat less when their leader chooses automatic reporting. Nonetheless, most leaders do not opt for automatic reporting in the first place: they often choose self-reporting and punish workers who rather choose automatic reporting. Collectively, our results reveal a dual effect of leadership on ethical behaviors in organizations: workers behave more ethically if their leader makes ethical choices, but often leaders do not make ethical choices in the first place. Hence, leading by example can backfire. (shrink)
