The climatic emergency that threats the Arctic constitutes a challenge for the International Community. The inhabitants of this space, mainly indigenous peoples, face a dramatic situation, because their way of life is disappearing. In this context, Arctic peoples formulate the right to be cold. This paper analyzes the implications of this proposal from the point of view of International Human Rights Law, examining the progress made in the link between the environment, climate change and human rights, the initiatives that the (...) One of the main differences between countries within the international community is their degree of development. In fact, the breach between developing countries and developed countries is constantly growing. However, there is not a clear definition of what a developing country is, thus sometimes hindering the classification of countries in this category. The lack of such a definition may be due to the heterogeneity of developing countries. Nevertheless, we can found developing countries subcategories and legal effects of their establishment.

Pocos fenómenos han suscitado tanto debate en América Latina como es la cuestión de su integración, que, a pesar de sus luces y sus sombras, sus avances y retrocesos, sigue ahí, presente, a pesar de las incertidumbres que los diferentes acontecimientos políticos generan sobre su futuro próximo.

Research examining Service-Learning in Physical Education Teacher Education is ample. However, long-term investigations are still scarce and literature demands the application of this type of design to uncover the effects of SL on the long run. This study followed a longitudinal quantitative approach; thus, the participants completed the Civic Attitudes and Skills Questionnaire in three occasions. Results show that there exist significant differences between mean values of the global outcomes of the CASQ; concretely, there was an improvement in the first (...) interval followed by a decrease in the second period. Regarding the different dimensions of the CASQ, leadership skills, attitudes towards social justice and attitudes towards diversity showed significant differences too. This research leads towards better understanding of methodological strategies promoting quality education, positing SL as an adequate possibility in this respect, also in the long term. (shrink)

ABSTRACT:Neuroethics, the study of the cognitive and neural mechanisms underlying ethical decision-making, is a growing field of study. In this review, we identify and discuss four themes emerging from neuroethics research. First, ethical decision-making appears to be distinct from other types of decision-making processes. Second, ethical decision-making entails more than just conscious reasoning. Third, emotion plays a critical role in ethical decision-making, at least under certain circumstances. Lastly, normative approaches to morality have distinct, underlying neural mechanisms. Salvador Piá Tarazona’s book, El hombre como ser dual is an important methodical-thematic advance in the research of transcendental anthropology as much as it does not detain its focus on human nature nor its development , but rather on th readicality of personal intimacy and its openness to transcendence.

It has been argued that in the context of Bohm’s approach to quantum mechanics, the postulation of a three-dimensional ontology (as opposed to a high-dimensional one) is presumed to be the only interpretation that may reliably support object-oriented realism by virtue of the fact that this ontology is approximately preserved through scientific change, at least in the classical–quantum transition. Based on an interpretative analysis of the Bohmian formulation, I shall critically evaluate the tenability of this argument. In so doing, I (...) shall argue that this formulation admits the postulation of an alternative ontology that is properly defined in a high-dimensional space, and is approximately preserved among this transition. As a result, both the three-dimensional and the high-dimensional worldviews shall form the basis of an equally reliable endorsement of object-oriented realism in the context of the Bohmian framework. I shall conclude that this argument becomes a problem of metaphysical underdetermination between a three and a high-dimensional Bohmian interpretation. (shrink)

The feasibility of establishing a proper notion of a distinguishable object in the context of the de Broglie–Bohm approach to quantum mechanics seems, at first sight, uncontroversial by virtue of the fact that this theory can supposedly be interpreted in terms of a system of objective particles distinguished by individuating properties. However, after conducting a critical revision and evaluation of this trivial interpretation, and having assessed different alternatives that have been proposed in recent literature, I argue that within this theory (...) an appropriate notion of a distinguishable object can only be articulated by means of the following theoretical and metaphysical strategies: firstly, by appealing to a pre-existing, symmetrized Bohmian framework that is empirically indistinguishable but physically distinguishable from the standard Bohmian formulation; and secondly, by suggesting a different interpretation of this symmetrized formulation based upon a relational notion of the distinguishable object that can only be appropriately conceived from a structuralist point of view. The main objective of performance sport is to obtain achievements at the highest level through the adequate development of the athlete. The scientific literature demonstrates the fundamental role played by the inclusion of certain psychological variables in the training plan. This study examined the psychological profile of kayak polo players through the variables of burnout, optimism, and mood in the hours prior to the competition, relating these to each other and to some sociodemographic data. A sample of 86 canoeists, 60 (...) men and 26 women, with an age measurement of 24.4 ± 9.1 years belonging to the first male and female kayak polo division, completed the POMS-29, the LOT-R, and the IBD-R. Athletes' levels of optimism were found to be significantly correlated with mood. Optimism also influenced emotional exhaustion. In addition, seniority and internationality were decisive factors in the level of optimism and mood achieved. (shrink)

El autor llama unilateralismo a la presentación de nuestros sistemas de normas e instituciones como si obedecieran a un único valor inspirador. El unilateralismo, en este sentido, implica la negación, explícita o implícita, de que tales normas e instituciones están atravesadas por tensiones internas que obedecen a que tratan de realizar valores que se encuentran, a su vez, en tensión entre sí. En el artículo se examina la posición de Luigi Ferrajoli en relación con cuatro ámbitos en los que, a (...) juicio del autor, dicha posición es unilateralista en el sentido indicado: primero, el de la relación entre constitución y legislación; segundo, el de la distinción entre principios y reglas; tercero, el de la opción por un determinado sistema electoral; cuarto, el del problema de la guerra. Este unilateralismo desemboca, a juicio del autor, en una presentación distorsionada por parte de Ferrajoli de los problemas de estos cuatro ámbitos. (shrink)

El objeto de este trabajo es el de dar cuenta de las críticas a Kelsen contenidas en el último libro, todavía inédito, de Luigi Ferrajoli, Diritto e logica. Dieci aporie nell’opera di Hans Kelsen, y formular algunas críticas a las tesis sostenidas en él por el propio Ferrajoli. Entre las críticas que el autor considera que cabe dirigir a este respecto a Ferrajoli, las principales afectan al carácter exclusivamente interno de la mirada ferrajoliana sobre el derecho, al carácter siempre opinable, (...) y nunca verdadero o falso, que, según Ferrajoli, tienen los enunciados interpretativos, y a la incompatibilidad que, según el autor, se presenta entre las ambiciones de la teoría ferrajoliana y las limitaciones que a la misma impone su anclaje en el no cognitivismo ético. Se recorre el camino de la formación del sujeto humano que a par- tir de los prejuicios va constituyendo la intimidad propia haciendo suya la “intimidad social”. El problema que se plantea es en qué medida los prejuicios desaparecen o no por completo y si es posible hablar de un auténtico yo mientras se mantengan. En la respuesta de Ortega tiene gran importancia la distinción entre “yo” y “vida”.

Physical education is often selected for applying multilingual initiatives through the use of the content and language integrated learning (CLIL) approach. However, it is still unclear whether the introduction of such approach might entail losing Physical Education’s essence and distorting its basic purposes. The aim of this study is to analyse the impact of CLIL on the Physical Education lessons. Given the purpose of this study, a mixed methodological approach based on a sequential exploratory design divided in two different phases (...) is used. We begin with an initial qualitative data collection (phase I) consisting in the analysis of interviews with 12 participants (8 teachers and 4 students). Based on its analysis, two foci are identified: social relationships and physical activity. Then, informed by the results obtained, a quantitative approach is used (phase II), differentiating these two sets of data to deepen on them. On one part, a sociometric questionnaire was applied to analyse the social relationships among CLIL students. On the other part, a quasi-experimental design (n = 49) was implemented using accelerometry to measure the MVPA of the PE sessions. Regarding physical activity, the results show that levels of MVPA are higher in the experimental group (CLIL) than in the control group showing light to the divergent viewpoints of interviewees. However, focusing on social relationships, the sociometric questionnaire results show that there were no statistical significative changes, although some signs of a slight effect on students’ relationships arise depending on their gender. Therefore, more research would be necessary to deepen on how CLIL affects in this regard. (shrink)

De entre el ingente corpus teórico del pensador franciscano Buenaventura de Bagnoregio, hemos focalizado aquí nuestra atención sobre el libro titulado Itinerarium mentis in Deum (1259), porque en él nuestro autor condensa el núcleo esencial de su peculiar Estética. Restringiendo aún más el enfoque investigador, en el presente artículo nos limitamos a analizar la primera de las tres fases o niveles en que Buenaventura estructura su Estética, a saber, la fase que podríamos denominar Estética inmanente. En ella, según el autor, (...) el ser humano puede llegar al conocimiento de Dios, si considera los seres materiales como vestigios e imágenes bellas que reflejan visiblemente la invisible belleza divina. En la segunda parte de nuestro artículo, intentamos poner en evidencia algunas tesis de filósofos precedentes que parecen haber inspirado casi con certeza a San Buenaventura en los enunciados básicos de su Estética inmanente. Prispevek kritično obravnava znano Bobbievo tridelbo pravnega pozitivizma na pozitivizem kot splošni pristop k učenju prava, nauk o pravu in ideologijo. Avtor uvodoma opozori na nekaj problemov same tridelbe, nato pa se osredotoči na Bobbievo samoopredelitev znotraj nje. Na primeru Bobbieve obravnave pojmov temeljne norme in pravila priznavanja pokaže, kako ga njegovo kasnejše zavračanje teh dveh pojmov nezavedno privede do sprejemanja pravnega pozitivizma kot nauka o pravu in pravne ideologije – ki ju je sicer zavračal. Avtor vidi razlog za ta (...) nezavedni Bobbiev zdrs predvsem v njegovi vpetosti v specifično pravnokulturno okolje, ki ga prežema notranji pogled na pravo. Ob tem predlaga, da zavrnemo tridelbo pravnega pozitivizma in ga namesto tega proučujemo kot skupek ne vedno ločljivih stališč, ki tvorijo specifično pravnokulturno okolje. (shrink)

En este trabajo el autor defiende la necesidad de completar la distinción entre permisos fuertes y débiles con otras dos distinciones: una de ellas relativa también al sistema jurídico –la distinción entre permisos protegidos y permisos no protegidos– y la otra relativa al proceso de aplicación del derecho: la distinción entre permisos prima facie y permisos concluyentes. El trabajo concluye con un cuadro en el que, sobre la base de estas tres distinciones, se recogen ocho combinaciones posibles a distinguir en (...) materia de permisos. (shrink)

The paper critically examines Bobbio's famous disctinction between legal positivism as a method, a theory and an ideology. The author first highlights certain problems of the distinction itself and then focuses on Bobbio's self-determined position within it. Delving on Bobbio's analysis of the concepts of basic norm and rule of recognition, he demonstrates how Bobbio's later rejection of these two concepts implies acceptance of positivistic legal theory and ideology – despite the fact that he explicitly rejected them in the first (...) place. The reason for this Bobbio's slip is found in his absorbtion in the positivist legal culture which is permeated with the internal point of view on the law. The author suggests rejecting Bobbio's tripartite disctinction of legal positivism and proposes instead to view this as a set of seldom indvisible standpoints forming a specific legal culture. En este artículo pretendemos definir el concepto mismo de «biopolítica» en su originaria significación foucaultiana. Para ello, pondremos en relación diferentes aspectos de la obra de Michel Foucault, con el fin de aclarar ciertos elementos no exentos de dificultad interpretativa. A continuación, trazaremos un breve recorrido histórico a través de las distintas formas de «biopolítica» que han ido sucediéndose a lo largo de los últimos doscientos años, a fin de justificar nuestra visión discontinuista de la historia, y deslegitimar así la (...) conocida como «hipótesis de la sofistificación progresiva» de las tecnologías de poder. Normative and historical arguments support the idea that religion potentially shapes decisions to support fair trade products. That said, the question of how religion influences organizational decision-makers to purchase fair trade products in a business-to-business context has remained largely unaddressed. This research examines the interactive effect of individual religious commitment and contextual religious salience on an individual’s willingness to pay a price premium for a fair trade product, when buying on behalf of an organization. Findings from two experimental studies reveal (...) that the effect of a decision-maker’s religious commitment on his or her willingness to pay a price premium, for the purchase of a fair trade product on behalf of an organization, is moderated by the contextual salience of religion. Specifically, when religion is highly salient in the organizational context, religious commitment is positively related to the decision-maker’s willingness to pay a premium for the fair trade product; when contextual religious salience is low, religious commitment and willingness to pay a premium are unrelated.
