This volume addresses the intriguing issue of indirect reports from an interdisciplinary perspective. This paper explores the extension of formal accounts of precedential constraint to make use of a factor hierarchy with intermediate factors. A problem arises, however, because constraints expressed in terms of intermediate factors may give different outcomes from those expressed only using base level factors. We argue that constraints that use only base level factors yield the correct outcomes, but that intermediate factors play an important role in the justification and explanation of those outcomes. The 1830s and 1840s are the formative years of modern public health in Britain, when the poor law bureaucrat Edwin Chadwick conceived his vision of public health through public works and began the campaign for the construction of the kinds of water and sewerage works that ultimately became the standard components of urban infrastructure throughout the developed world. This book first explores that vision and campaign against the backdrop of the great "condition-of-England" questions of the period, of what rights and (...) expectations working people could justifiably have in regard to political participation, food, shelter and conditions of work. It examines the ways Chadwick's sanitarianism fit the political needs of the much-hated Poor Law Commission and of Whig and Tory governments, each seeking some antidote to revolutionary Charitism. It then reviews the Chadwickians' efforts to solve the host of problems they met in trying to implement the sanitary idea: of what responsibilities central and local units of government, and private contractors, were to have; of how townspeople could be persuaded to embark on untried public technologies; of where the new public health experts were to come from; and of how elegant technical designs were to be fitted to the unique social, political and geographic circumstances of individual towns. Rejecting the view that Chadwick's program was a simple response to an obvious urban problem Professor Hamlin argues that at the time a "public health" focusing narrowly on sanitary public works represented a retreat of public medicine from involvement with the great social issues of the Industrial Revolution. In exploring the views of medical men who were critical of Chadwick, Hamlin suggests the parameters of a public health that might have been, in which concern for health and well-being becomes the foundation of a public medicine that is a principal guarantor of social justice. This book offers modern public heatlh professionals elements of a forgotten professional heritage that might be useful in responding to the bewildering range of health problems we now confront. This paper describes one way in which a precise reason model of precedent could be developed, based on the general idea that courts are constrained to reach a decision that is consistent with the assessment of the balance of reasons made in relevant earlier decisions. The account provided here has the additional advantage of showing how this reason model can be reconciled with the traditional idea that precedential constraint involves rules, as long as these rules are taken to be defeasible. (...) The account presented is firmly based on a body of work that has emerged in AI and Law. O fenómeno da corrupção não pode ser pensado sem a inclusão das suas potencialidades simbólicas. A informação que, pela acção dos mass media, aparece construída sob a forma de escândalo, acaba por determinar a própria construção da sua natureza factual. Logo, aqui impera a questão de saber por que é que as práticas corruptas favorecem o discurso do escândalo, bem como a legitimação dos mass media como instrumentos de objectivação dos comportamentos ilícitos. Procurar-se-á ponderar essas questões, mediante a formulação de (...) uma estética da "invisibilidade" inerente aos meios de comunicação, que é, por sua vez, reforçada pelas potencialidades discursivas das práticas corruptas. O objetivo do presente artigo é defender as seguintes teses. Em primeiro lugar, as teorias da justiça de Habermas e Rawls devem ser vistas como duas versões do construtivismo kantiano, entendido como abordagem metaética que pretende reunir anti-realismo e cognitivismo forte. Em segundo lugar, o contraste com o “construtivismo reconstrutivista” de Habermas ajuda a esclarecer de que modo a teoria de Rawls atende à pretensão de universalidade própria do cognitivismo forte. Ao realçar o fato de que o construtivismo de Rawls (...) está baseado no trabalho reflexivo da consciência individual, o contraste com Habermas permite compreender em que sentido os conceitos de equilíbrio reflexivo e consenso sobreposto designam um ideal com pretensão de validade universal, o que desmente o particularismo implicado nas interpretações coerentistas e relativistas destes conceitos. Partindo da noção de discurso de Michel Foucault buscamos pontuar os efeitos das falas comumente admitidas sobre o(a) professor(a) nos meios sociais e as formas como essas falas corroboram a instituição da figura do(a) bom(boa) professor(a). Para tanto recorremos aos textos publicados na seção "Obrigado, professor" da revista Nova Escola, sobre os quais empreendemos nossa análise.

Reasoning with cases has been a primary focus of those working in AI and law who have attempted to model legal reasoning. In this paper we put forward a formal model of reasoning with cases which captures many of the insights from that previous work. We begin by stating our view of reasoning with cases as a process of constructing, evaluating and applying a theory. Central to our model is a view of the relationship between cases, rules based on cases, (...) and the social values which justify those rules. Having given our view of these relationships, we present our formal model of them, and explain how theories can be constructed, compared and evaluated. We then show how previous work can be described in terms of our model, and discuss extensions to the basic model to accommodate particular features of previous work. This book provides new theoretical approaches to the subject of virtuality. All chapters reflect the importance of extending the analysis of the concept of “the virtual” to areas of knowledge that, until today, have not been fully included in its philosophical foundations. The respective chapters share new insights on art, media, psychic systems and technology, while also presenting new ways of articulating the concept of the virtual with regard to the main premises of Western thought. The purpose of this paper is to argue that, in order for the debate in Computing and philosophy to move forward with respect to its current state, the advances of Computer Science and Artificial Intelligence of the last decades must be taken into account. Computational reflection, one of these advances, is presented in detail and its philosophical implications are discussed, in contrast with old-fashioned views of computational systems such as those presented by Lucas’ papers on Minds and Machines.

With the six volumes of the Writings edited by the Peirce Edition Project at Indiana University since 1982, the monumental work of Charles S. Peirce has finally received the care, respect, and love that it deserves. The sixth volume, object of attention of this review, represents a thorough selection and edition of Peirce's writings from 1886 to 1890.

This paper is an introduction to a virtual special issue of AI and Law exploring the legacy of the influential HYPO system of Rissland and Ashley. The papers included are: Arguments and cases: An inevitable intertwining, BankXX: Supporting legal arguments through heuristic retrieval, Modelling reasoning with precedents in a formal dialogue Game, A note on dimensions and factors, An empirical investigation of reasoning with legal cases through theory construction and application, Automatically classifying case texts and predicting outcomes, A factor-based definition (...) of precedential constraint and An improved factor based approach to precedential constraint. After describing HYPO, in this introduction to the special issue I look at various aspects of its influence on AI and Law: the developments led by Rissland at Amherst; the developments led by Ashley in Pittsburgh; the expression of these ideas in terms of rule based systems, and their subsequent formalisation; value based theories, which were inspired by a critique of HYPO; and contemporary approaches which revive the idea of dimensions. This paper studies the use of hypothetical and value-based reasoning in US Supreme-Court cases concerning the United States Fourth Amendment. Drawing upon formal AI & Law models of legal argument a semi-formal reconstruction is given of parts of the Carney case, which has been studied previously in AI & law research on case-based reasoning. As part of the reconstruction, a semi-formal proposal is made for extending the formal AI & Law models with forms of metalevel reasoning in several argument schemes. (...) There is an increasing need for norms to be embedded in technology as the widespread deployment of applications such as autonomous driving, warfare and big data analysis for crime fighting and counter-terrorism becomes ever closer. Current approaches to norms in multi-agent systems tend either to simply make prohibited actions unavailable, or to provide a set of rules which the agent is obliged to follow, either as part of its design or to avoid sanctions and punishments. In this paper we argue (...) for the position that agents should be equipped with the ability to reason about a system’s norms, by reasoning about the social and moral values that norms are designed to serve; that is, perform the sort of moral reasoning we expect of humans. In particular we highlight the need for such reasoning when circumstances are such that the rules should arguably be broken, so that the reasoning can guide agents in deciding whether to comply with the norms and, if violation is desirable, how best to violate them. One approach to enabling this is to make use of an argumentation scheme based on values and designed for practical reasoning: arguments for and against actions are generated using this scheme and agents choose between actions based on their preferences over these values. Moral reasoning then requires that agents have an acceptable set of values and an acceptable ordering on their values. We first discuss how this approach can be used to think about and justify norms in general, and then discuss how this reasoning can be used to think about when norms should be violated, and the form this violation should take. We illustrate how value based reasoning can be used to decide when and how to violate a norm using a road traffic example. We also briefly consider what makes an ordering on values acceptable, and how such an ordering might be determined. (shrink)

Il saggio evidenzia come il «diritto naturale» rappresenti il cuore nevralgico della «scienza» di Giambattista Vico. Questi, nell’opporsi allo scetticismo, da un lato, e al giusnaturalismo, dall’altro, fa del «diritto naturale» il punto di incontro di molteplici questioni, dalla politica alla giurisprudenza, dall’«equità» alla «Ragion di Stato».

In the present article, the role of Gestalt concepts in clarifying the issues of perception is evaluated. Grounded in anti-atomism, Gestalt assumed organizing forces intrinsic to perception. Insofar these were identified with singularity preference, Gestalt is criticized for having failed to distinguish between perception and thought.

Il panorama intellettuale, politico e sociale del periodo compreso fra la fine del Seicento e i primi anni del Settecento, con la sua complessità, traspare dai dialoghi e dai trattati del pensatore, per il quale si fa strada l' esigenza di (...) tornare a quei valori della tradizione classica che coincidono con il bisogno di recuperare le virtù tipiche della letteratura antica per promuovere un rinnovamento culturale, politico e civile della società. Todavía hoy, a doscientos cincuenta años de su muerte, son de gran actualidad algunas de sus fundamentales teorías y formulaciones, como el principio de la división de poderes dentro de un Estado, la concepción de la existencia de un "espíritu" característico de cada pueblo, el rechazo de la tortura y la necesidad de conmensurar las penas a los (...) delitos. La relevancia, la complejidad y la riqueza de los temas afrontados por el filósofo francés hacen comprender claramente el motivo por el que autores ilustres se han visto influidos por su pensamiento, y esto sería motivo suficiente para recopilar todos sus escritos. This essay emphasizes how Vico was one of the modern philosophers to set himself the goal to reconstruct the history of the primitive world. Differently from several authors who preceded him and also other contemporary thinkers, the Neapolitan philosopher showed that the world of the origin wasn’t idyllic, but it was affected by fear, anguish and basic needs. What mainly characterizes Vico, however, is the fact that he represented the primitive world not as a unitary and fixed block, but as (...) a world made of different historical phases and of class and social conflicts. As there were no written documents, Vico elaborated a reconstruction of history, basing it on a new and revolutionary theory of myths which, being based on creativity induced by fantasy, are called “universali fantastici”. No Tratado político, Espinosa, ao primeiro movimento do texto, faz dura crítica àqueles que criaram utopias ao tratarem da política. Tais filósofos, afirma, por tomarem os homens não pelo que são, mas pelo que gostariam que fossem, conceberam uma forma de política que nunca pôde ser posta em aplicação. Tese muito próxima à de Maquiavel, presente em O Príncipe, segundo a qual, para escrever coisa útil neste campo, deve-se ir direto alla verità effettuale della cosa che alla immaginazione di essa. (...) Não casualmente, portanto, no Capítulo V do Tratado político, último parágrafo, Espinosa usa os termos ‘agudíssimo’ e ‘prudentíssimo’ ao se referir ao florentino. Há mais Maquiavel em Espinosa para além das citações elogiosas? O artigo procurará tratar desta questão ao mostrar alguns traços comuns às respectivas filosofias políticas. Ao que indicam as fontes primárias e alguns comentadores, Espinosa teria se apropriado, e reconceitualizado, à sua maneira, teses-chave do florentino para escrever suas obras, em particular o Tratado político. No primeiro movimento o artigo analisa, em panorama, a ontologia espinosana. Após, mostra como, do interior dos conceitos presentes na ontologia, derivam os de homem, desejo, alegria e tristeza, esperança e medo, segurança e desespero, ação e paixão. Da relação entre ontologia, homens e desejo – bem como dos demais afetos –, são extraídas, em breves considerações, algumas teses políticas de Espinosa. Levanta-se, neste movimento argumentativo, a hipótese de que as teses políticas espinosanas derivam de sua ontologia e de sua (...) concepção de homem como desejo e variação de potência. O conceito de desejo é analisado à luz da variação de potência e do tema do direito natural, o qual, em Espinosa, se identifica a potência. Quando das breves derivações à política, algumas teses hobbesianas – relacionadas aos temas da multidão, povo, representação, direito natural, estado civil, etc. – são trazidas à argumentação para que se mostre, por contraste, o peso das inovações espinosanas. Este artigo investe na ideia de que a infância é um dispositivo histórico do poder. Tem-se como referência analítica Michel Foucault, que concebe a noção de dispositivo em suas discussões a respeito da sexualidade. A hipótese geradora é a de que, a partir do momento em que a criança se torna um dos grupos estratégicos do dispositivo da sexualidade, produz-se sobre ela um conjunto heterogêneo de regimes de verdades e práticas que configura uma maneira de ser e ter uma infância, (...) influindo significativamente nas perspectivas pedagógicas modernas. Dialogando com Deleuze, Agamben e Veyne, considera-se que todo dispositivo possui: linhas de visibilidade e de enunciação que são, respectivamente, máquinas de “fazer ver” e de “fazer falar” ; linhas de força, que sustentam os campos de visibilidade e os regimes de enunciabilidade; e linhas de subjetivação que são, segundo Deleuze a dimensão do “si próprio” e que configuram o sujeito infantil. Apresenta-se três grupos de práticas articuladas às estas características do dispositivo: as práticas pedagógicas, as práticas divisórias e identitárias de gênero e de sexualidade e as práticas médicas. Observa-se que, para Foucault, o dispositivo da sexualidade disciplina os corpos, regula e normatiza a população, regulamenta o prazer e os saberes sobre o sexo, e, além disso, ocupa-se, por meio desse regime sobre o sexo, da preservação da espécie humana. A infância como dispositivo, na perspectiva ora apresentada neste artigo, também regulamenta a criança, constituindo-a em “sujeito infantil”, estabelecendo uma pedagogia e uma ciência que compuseram o pensamento pedagógico moderno sobre e para infância, ocupando-se também da preservação e da manutenção dessa espécie outra, a criança. This paper discusses some engineering considerations that should be taken into account when building a knowledge based system, and recommends isomorphism, the well defined correspondence of the knowledge base to the source texts, as a basic principle of system construction in the legal domain. Isomorphism, as it has been used in the field of legal knowledge based systems, is characterised and the benefits which stem from its use are described. Some objections to and limitations of the approach are discussed.
