The article deals with the virtues of the procedural conception of justice for justifying multiculturalism. While proceduralism is at first sight poorly equipped to make democratic equality more inclusive of ethnocultural minorities, it has been supported by liberal philosophers as an efficient method to provide a principled defense of minority rights. By analysing this theoretical path and its limits, and by suggesting more particularly how Alan Patten’s “full proceduralism” fails to solve the difficulties of Will Kymicka’s “multicultural citizenship”, the article (...) raises doubts about the promise to ground multiculturalism on proceduralism. The article introduces a special issue on “Rethinking Liberal Multiculturalism: Foundations, Practices and Methodologies.” The contributions presented in this special issue were discussed during the conference « Multicultural Citizenship 25 Years Later », held in Paris in November 2021. Their aim is to take stock of the legacy of Kymlicka’s contribution and to highlight new developments in theories of liberal multiculturalism and minority rights. The contributions do not purport to challenge the legitimacy of theories of multiculturalism and minority rights, they (...) rather aim at deepening our understanding of the foundations of liberal multiculturalism and of its practical implementation, sensitive to social scientific dynamics of diverse societies. Without abandoning the general idea that cultural minorities should be granted special minority rights, the essays presented raise new questions about three dimensions central to liberal multiculturalism: its normative foundations, its practical categories of minorities or groups, and its fact-sensitive methodology. Taken together they shed light on the renewed variety of theories of liberal multiculturalism highlighting their complexity and internal disagreements. To introduce these articles, the article first draws a brief historical overview of the debates on multiculturalism since the 1990s (section 1). It then highlights the distinctive aspects of Kymlicka’s contribution (section 2) and identifies recent research trends (section 3). Comment les politiques multiculturelles s'articulent-elles aux fondements normatifs de la citoyennete moderne? Quelles sont les raisons qui justifient ou invalident le droit a la difference? Enfin, quel eclairage ces soubassements conceptuels apportent-ils au diagnostic recemment pose d'une crise du multiculturalisme? L'enjeu de cet ouvrage collectif est double: mettre en evidence les sources liberales et democratiques du projet multiculturel, tout en interrogeant (...) les limites de la citoyennete differenciee. The underlying psychological processes that enable framing effects are often described as cognitive. Yet, recent studies suggest that framing effects may also be mediated by emotional response. The role of specific emotions in mediating the framing effect process, however, has yet to be fully empirically investigated. In an experimental survey design, this study tests two positive and two negative emotions as mediators of framing effects. Our results show that while anger and enthusiasm mediate a framing effect, contentment and fear do (...) not. These findings deepen our understanding of which discrete emotions are relevant when studying mediated framing effects. (shrink)

L’origine d’un « besoin de croire » mérite une recherche en particulier dans les profondeurs psychiques archaïques dont on peut retrouver trace en certains phénomènes comme le « sentiment océanique ». Freud, Winnicott, Meltzer et d’autres auteurs après Romain Rolland, inspirés par les pathologies précoces apparentées à l’autisme permettent un aperçu des liens entre ces expériences vécues et un mode psychique premier du « croire » marqué par son absence de limites.

Cultural heritage can offer tangible and intangible traces of the past. A past that shapes cultural identity, but also a past from which one sometimes wishes to detach oneself and which nevertheless needs to be remembered, even commemorated. These themes of memory, history and oblivion are examined by the philosopher Paul Ricoeur in his work La mémoire, l’histoire, l’oubli. Inspired by these ideas, this paper analyses how they are closely linked to cultural heritage. Heritage serves as a support for memory, (...) even if it can be mishandled, which in turn can affect heritage policies. Memory and heritage can be abused as a result of wounds from the past or for reasons of ideological manipulation or because of a political will to force people to remember. Furthermore, heritage, as a vehicule of memory, contributes to historical knowledge, but can remain marked by a certain form of subjectivism during the heritage and conservation operation, for which heritage professionals are responsible. Yet, the responsibility for conserving cultural heritage also implies the need to avoid any loss of heritage, and to fight against oblivion. Nonetheless, this struggle cannot become totalitarian, nor can it deprive the community of a sometimes salutary oblivion to its own identity construction. These theoretical and philosophical concepts shall be examined in the light of legal discourse, and in particular in Belgian legislation regarding cultural heritage. It is clear that the shift from monument to heritage broadens the legal scope and consequently raises the question of who gets to decide what is considered heritage according to the law, and whether there is something such as a collective human right to cultural heritage. Nonetheless, this broadening of the legislation extends the State intervention into cultural heritage, which in turn entails certain risks, as will be analysed with Belgium’s colonial heritage. This article focuses on Eurimages, the Council of Europe fund for the co-production, distribution and exhibition of European films. The core investigation of this paper relates to the benefits this public fund has had for the European film sector. Reflecting on the fund's twenty-year existence, what output has been realized, both in economic and cultural terms? Turning to the future, what are the fund's prospects now that the sector is facing the technological challenge of digitization? In order to evaluate the (...) performance of the fund, the author takes a closer look at the economic, cultural and technologically innovative results achieved by Eurimages and relates these to the objectives that were set at its establishment. This study focuses on a third-party perspective of idiosyncratic deals. More specifically, we look into the differential judgments co-workers make about i-deals in their work environment, as well as their reactions. Based on equity theory, we examine to what extent the content of the i-deal and the work context explain co-worker judgments regarding i-deal fairness in addition to subsequent voice behavior. A vignette study with 1988 respondents shows that when i-deals are considered distributively unfair, co-workers try to restore equity through (...) voice behavior, thereby making the i-deal less effective. Furthermore, i-deals spark more distributive injustice perceptions and voice behavior in a highly interdependent work context. Finally, on average, financial bonuses were considered most distributively unfair and, thus, trigger more voice behavior. These results have important implications for i-deal literature as they uncover the criteria that co-workers use to judge i-deals and shape their reactions. (shrink)

In Switzerland, research with identifiable human tissue samples, and/or its accompanying data, must be approved by a research ethics committee before it can be allowed to take place. However, as the demand for such tissue has rapidly increased in recent years, and biobanks have been created to meet these needs, committees have had to deal with a growing number of such demands. Detailed instructions for evaluating every kind of tissue request are scarce. Committees charged with evaluating research protocols therefore sometimes (...) face uncertainty in their decision-making. We examine how a pool of Swiss REC members deal with a number of cases involving human tissue, in order to determine the standards they adhere to, and their understanding and implementation of existing laws and guidelines. There is considerable divergence in the approaches and decisions of Swiss REC members regarding human tissue sample requests, particularly concerning the issue of informed consent. Despite recent trends towards less strict consent requirements for biosample research, many of our respondents continue to employ demanding standards for researchers. The question of informed consent, and the circumstances in which it is required, continues to result in differences of opinion. While room for local and cultural interpretation is essential to the workings of an REC, misunderstanding of existing guidelines, or an absence of regulation in sensitive areas, will only lead to suboptimal functioning of the REC itself. Our data suggests that there is uncertainty and disagreement on the question of consent for human tissue sample, which existing laws and guidelines may not fully clarify. Methods to address these uncertainties should be implemented in order to ensure efficient and harmonious review of research protocols. (shrink)

It has come to our attention that in the original article [1] information regarding dates was omitted. The data in this study were obtained in Switzerland four years before the entering into force of the new Swiss Human Research Act in 2014, when the guidelines of the Swiss Academy of Medical Sciences ceased to apply. It is important for readers to know that at the time of the study there was no binding law in Switzerland, only the more open SAMS (...) guidelines that have a different legal status. We would expect to find less variation of opinions among research ethics committee members if the study were repeated after the federal law came into force. (shrink)

This article illuminates Henry Irving’s production of Shakespeare’s Cymbeline (1896) as a major contribution to fin-de-siècle Gothic culture. Cymbeline (1896) was one of the most popular Victorian Shakespeare productions, running to wild acclaim for more than seventy-two performances. In Cymbeline’s sexually-charged bedroom scene, Imogen, played by beloved Victorian actress Ellen Terry, was preyed upon by Henry Irving’s villainous Iachimo. Terry and Irving were at the zenith of a twenty-year partnership at London’s Lyceum theatre, and Victorian Britain’s greatest star actors. Ellen (...) Terry’s Imogen became an ideally desirable heroine for both audiences and critics of Victorian Shakespeare. Simultaneously, Cymbeline, and the acclaimed performances of Terry and Irving, became a source for literature’s most famous Gothic vampire novel: Dracula, published by Bram Stoker in 1897. Bram Stoker was Henry Irving’s business manager, and intimately involved with Irving and Terry’s professional lives at the Lyceum theatre. This article reveals the relationship between Shakespeare and Dracula, especially Ellen Terry’s Imogen as an inspiration for Lucy Westenra. Textual evidence includes Terry’s correspondence and unpublished promptbooks, as well as Stoker’s biography of Henry Irving, and facsimile notes on Dracula. Examining Cymbeline (1896) and Dracula (1897) offers a new reading of Dracula, given Cymbeline’s obsession with liminal states and female vulnerability. Moreover, Victorian responses to Ellen Terry’s Imogen in the bedchamber scene highlight fin-de-siècle eroticisations of the sleeping woman, and Victorian fantasies of sexual access to the actress. Examining Terry’s reception illuminates the disjunction between performed female passivity as Imogen, and the professional, creative activity that underlined Terry’s stage practice and agency as a Victorian actress. En 2014 et 2015 se sont tenus à Paris une série d’ateliers de recherches « Autour d’Alexandre de Halès », coorganisés par Claire Angotti, Sophie Delmas, et Dominique Poirel 1.Le point de départ de ces ateliers fut le constat d’un paradoxe: en dépit de son action fondatrice dans l’histoire de l’université de Paris comme dans la naissance d’un courant théologique franciscain, Alexandre de Halès n’avait fait l’objet que d’études nombreuses morcelées. Utiles pour circonscrire ses positions propres sur divers points (...) de doctrine, ces études ne permettaient guère de comprendre l’œuvre et la pensée dans ce qui fait leur originale unité. En... En Afrique, les religions ancestrales enseignent à chercher sa cohérence intérieure, en restant relié aux autres et à l’univers. Ainsi, chez les Maasaï, la spiritualité peut se traduire par ces lignes de force : vaincre ses peurs, rester relié, ne pas créer de divisions en soi et autour de soi. L’homme doit mettre en adéquation ses mots et ses actes pour éviter la dissonance et les antagonistes, sources de déséquilibres personnel et relationnel. Actes et mots doivent être «jumeaux», aller de (...) paire. Aucune différence entre le dire et le faire chez ces peuples d’Afrique, qui savent par expérience que cette cohérence est la garantie de relations saines et durables. Au-delà des images, l’Afrique est avant tout la terre de la religion. Non pas d’une religion mystique et abstraite vouée aux grandes questions de la métaphysique, mais d’une religion terrienne, liée à la nature, qui s’exprime à chaque instant de la vie, qui inspire aux hommes et aux femmes chaque geste, chaque parole. ABSTRACTThis article examines William Barclay's response to Jean Boucher's De Justa Abdicatione Henrici Tertii in view of the complexities of Catholic political thought in this post-Tridentine period. It argues that Barclay's famous category of ‘monarchomach’ is problematic for its avoidance of the issue of confessional difference, and that on questions of the relationship between the respublica and the ecclesia Barclay struggled to find an adequate response to Boucher in his De Regno et Regali Potestate. His De Potestate Papae is treated (...) as the intellectual extension of his battle with Boucher, and more broadly his confrontation with the position of the Catholic League and Jesuits on indirect papal power. By considering Barclay's works in the context of French Gallicanism and the Catholic League in the French Wars of Religion, this discussion aims to reposition Barclay in relation to other Catholic political theorists and thereby re-evaluate the category of Catholic resistance theory. To this end I explain how the objective reality of ideas of God and the immortality of the soul can be qualified as “subjective,” and in what sense the objective reality of the idea of liberty as a res facti can be considered as incomplete in terms of theoretical objectivity. Finally, I propose that the acquisition of practical objective reality does not entail expanding our theoretical knowledge of the objects of these three ideas. (shrink)

Le principe de précaution a éclos sur la scène internationale, tout comme dans les ordres juridiques internes, à la fin des années quatre-vingt. Si sa valeur juridique est aujourd’hui peu contestée à l’échelle nationale, elle reste, en revanche, un objet de débat doctrinal auprès des juristes internationalistes. Toutefois, l’ombre de la précaution plane sur l’ensemble du système juridique international.
