By depicting the anger of the Ottonian kings as just and predictable, Liudprand shows how the ideal ruler should behave. He uses various examples from the Old Testament and especially the Deuterocanonical books of the Maccabees to present the anger of the Ottonian kings in the same fashion. In his vision, the negative counterpart to the (...) Ottonians is played by the Italic kings, who show their unworthiness precisely through the inept and tyrannical use of anger. In addition to this, Liudprand writes about aristocratic anger-management as well as the anger of women. Although a man of the church, Liudprand shows himself to understand and to use the code of honour which applied to noblemen in conflicts. Women do not, on the contrary, show unmediated anger. Law search is fundamental to legal reasoning and its articulation is an important challenge and open problem in the ongoing efforts to investigate legal reasoning as a formal process. This Article formulates a mathematical model that frames the behavioral and cognitive framework of law search as a sequential decision process. The model has two components: first, a model of the legal corpus as a search space and second, a model of the search process that is compatible with that environment. The (...) search space has the structure of a “multi-network”—an interleaved structure of distinct networks—developed in earlier work. In this Article, we develop and formally describe three related models of the search process. We then implement these models on a subset of the corpus of U.S. Supreme Court opinions and assess their performance against two benchmark prediction tasks. The first is to predict the citations in a document from its semantic content. The second is to predict the search results generated by human users. For both benchmarks, all search models outperform a null model with the learning-based model outperforming the other approaches. Our results indicate that through additional work and refinement, there may be the potential for machine law search to achieve human or near-human levels of performance. (shrink)

We propose that marketing of unhealthy foods and beverages to Black and Latino consumers results from the intersection of a business model in which profits come primarily from marketing an unhealthy mix of products, standard targeted marketing strategies, and societal forces of structural racism, and contributes to health disparities.

Purpose: Empirical studies suggest that corporate social responsibility impacts young job seekers’ choices of an employer. Values seem to affect CSR preferences, influencing the felt fit between the person and the organization and hereby the valence of working for that company. This article aims to research in more detail the preference structure of young graduate job seekers. In particular, it seeks to understand whether CSR is important when there is a trade-off between CSR and non-CSR attributes and whether basic value (...) orientations of job seekers have a moderating effect on their employer preferences. Design/methodology/approach: This article used a quantitative approach with a survey sample of 577 German students who were in their last year of study. To gain information on the relative impact of CSR- and non-CSR-related employer characteristics on employer attractiveness, an adaptive conjoint analysis was applied. Correlation analysis and a two-step hierarchical regression were conducted to detect the effects of individual value orientations. Findings: Only a few CSR attributes are relevant for young job seekers compared with other traditional employer attributes. Specific value orientations can be identified as having a moderating effect on CSR preferences. This is particularly the case for value orientations indicating a concern for the welfare of others and the environment positively affect the importance of most CSR attributes while more selfish value orientations have a negative effect. Originality/value: This study sheds light on the relative importance of CSR attributes when compared with non-CSR attributes. Moreover, it relates employee-related preferences to individual value orientations and shows that selected values have a modifying effect on the importance of CSR for job choice. (shrink)

Images of and references to women are so rare in the vast corpus of his published work that there seems to be no "woman question" for Hans-Georg Gadamer. Yet the authors of the fifteen essays included in this volume show that it is possible to read past Gadamer's silences about women and other Others to find rich resources for feminist theory and practice in his views of science, language, history, knowledge, medicine, and literature. While the essayists find much of value (...) in Gadamer's work, he emerges from their discussion as a controversial figure. Some contributors see him as promoting genuine respect for and engagement with Otherness: others claim that in a Gadamerian conversation the Other has no voice. For some, Gadamer's immersion in tradition is an impediment to feminist inquiry; for others, cognizant of the need to understand tradition well in order to contest its intransigence or benefit from its insights, his way of engaging tradition is especially productive. Some contributors take issue with the separation he maintains between philosophy and politics; others find problems in his relative silence on matters of embodiment; still others maintain that a "fusion of horizons" amounts to a colonizing of difference. But a common aim of each of these controversies is to discern what feminists can learn from Gadamer as well as what limitations feminist reinterpretations of his work must inevitably encounter. The concept of burnout has become ubiquitous in contemporary discussions of work stress in the post-industrial, service economy. However, it originated outside of the market, in the counter-cultural human service institutions of the San Francisco Bay Area and New York City. This article explores the first decade of the development of the burnout concept, demonstrating how it represented a reaction against the counter-culture and the alternative institutions that emerged alongside it. Focused in particular on the work of psychoanalyst Herbert Freudenberger (...) and social psychologist Christina Maslach, this article demonstrates how the burnout phenomenon inspired professional helpers to engage in self-care and reduce their commitment to clients. As burnout migrated from the human services into the broader business environment in the early 1980s, the dedication to social change through helping others would largely vanish, to be replaced by the idea that the best way to ‘serve’ customers and co-workers was by practising self-awareness and self-management. ABSTRACT Between 1920 and 1922, the University of Bristol biochemist, Maximilian Nierenstein, published four papers in a series exploring the structure of catechin in the Journal of the Chemical Society. The Society then abruptly refused to accept any more of his papers on catechin, or any other subject. It provided him with no reasons for the embargo until 1925. It then transpired that Nierenstein was boycotted because it was deemed that he had not responded adequately to criticisms of his work (...) made by his rival in catechin research, the German natural products chemist, Karl Freudenberg. It was not until 1929 that, as a result of a petition by a group of his former Bristol pupils and friends, that Nierenstein was again permitted to publish in the Society’s journal. The paper explores the Chemical Society’s treatment of Nierenstein in detail, sheds new light on his career and his reaction to the Society’s unprecedented boycott, examines some of the structural chemistry involved in the disputes, and discusses whether Nierenstein’s research deserves the label of ‘bad science’. In this article, we address the problem of the potential crisis in people’s life’s meaning due to massive automation-driven technological unemployment. Assuming that the problem of (re)distribution of economic resources to the whole of society in such a scenario will be solved (e.g. through provision of a Universal Basic Income), the question arises concerning the meaning of people’s lives in a world in which almost everyone does not have to (or even could not) work in order to live. Here, we (...) side with many current proposals that paid work is not the only possible source of meaning and hence, that a meaningful life could indeed be led in a post-work society. We especially focus on one of the most developed accounts, Danaher’s Virtual Utopia (Danaher, 2016, 2019, 2022). According to him, living immersed in playful virtual worlds where new, expanded and personalized possibilities of personal and collective experiences and actions, could not only be perfectly meaningful lives, but furthermore, “be the utopia we are looking for” (Danaher, 2019, p. 270). However, our analysis will suggest that although it is a very well thought and carefully articulated position, it suffers from various important problems. Our criticism will be based on an alternative framework to think about life’s meaning and the conditions for leading a good life in general. This alternative is based on the philosophy of buen vivir (“good living”). This notion has its roots in common aspects of various Latin American indigenous cultures regarding a community-centered way of life where humans, society and nature are taken to be deeply interconnected and interdependent, and where the notions of respect, harmony and balance are at the core of this interrelationship (Gudynas, 2011; Acosta, 2008; Beling et al., 2021). Buen vivir has many facets, but we will focus on three: the importance of healthy human communities, the human-nature relationship, and the intrinsic value of nature. Based on these, we argue that the Virtual Utopia is not a good candidate for human’s post-work utopia because i) it unnecessarily augments the environmental damage that is already involved in massive labor automation; ii) it entails an unnecessary and detrimental dependence on technology for human relationships; and iii) increases the severance of the link between humanity and nature. We conclude that the buen vivir approach is a promising candidate for an alternative utopian project, but one that needs further construction. (shrink)
