The author's starting point is Bobbio's theoretical approach to the problems of the relations between law and reason. He then appraises the meanings of reason and the concept of theoretical and practical rationality in the application of law. He examines the complex problem of the rationality of legislation and distinguishes five levels of rationality.

'Theory' is one of the most important words in the lexicon of contemporary sociology. Yet, their ubiquity notwithstanding, it is quite unclear what sociologists mean by the words 'theory,' 'theoretical,' and 'theorize.' I argue that confusions about the meaning of 'theory' have brought about undesirable consequences, including conceptual muddles and even downright miscommunication. In this paper I tackle two questions: what does 'theory' mean in the sociological language?; and what ought 'theory' to mean in the sociological language? I proceed in (...) five stages. First, I explain why one should ask a semantic question about 'theory.' Second, I lexicographically identify seven different senses of the word, which I distinguish by means of subscripts. Third, I show some difficulties that the current lack of semantic clarity has led sociology to. Fourth, I articulate the question, 'what ought "theory" to mean?,' which I dub the 'semantic predicament', and I consider what one can learn about it from the theory literature. Fifth, I recommend a 'semantic therapy' for sociology, and advance two arguments about SP: the principle of practical reason--SP is to a large extent a political issue, which should be addressed with the help of political mechanisms; and the principle of ontological and epistemological pluralism--the solution to SP should not be too ontologically and epistemologically demanding. Epistemology has taken a zetetic turn from the study of belief towards the study of inquiry. Several decades ago, theories of bounded rationality took a procedural turn from attitudes towards the processes of inquiry that produce them. What is the relationship between the zetetic and procedural turns? In this paper, I argue that we should treat the zetetic turn in epistemology as part of a broader procedural turn in the study of bounded rationality. I use this claim to motivate and (...) clarify the zetetic turn in epistemology, as well as to reveal the need for a second zetetic turn within practical philosophy. (shrink)

Un grand nombre de problèmes dont traite aujourd'hui la théorie de la décision reposent sur des problématiques qui appartiennent à des approches philosophiques, méthodologiques et théoriques fort différentes et dont l'auteur deChoix rationnel et vie publiquedéplore à juste titre l'absence d'unité intrinsèque. En effet, les racines de la théorie contemporaine du choix rationnel ont des ramifications dans trois traditions philosophiques qui ont été maintenues sans entretenir de contacts: théories philosophiques de l'action d'Aristote à Hume, à Kant et à la philosophie (...) analytique de l'action de Davidson; la théorie du conflit de Hobbes à David Gauthier; la théorie de la justice (d'inspiration utilitariste qui a profondément marqué la pensée économique du XXesiècle). Ces branches ont entretenu des interactions sporadiques, mais ces relations n'ont jamais été exploitées systématiquement. This paper examines the conceptual and terminological overlap between theories and models of practical deliberation developed within the fields of Practical Reasoning (PR) and Practical Argumentation (PA). It carefully delineates the volitional, epistemic, normative, and social commitments invoked and explicates various rationales for attributing the label ‘practical’ to instances of reasoning and argumentation. Based on these analyses, the paper develops a new approach to practical deliberation called the Stakeholder Commitment Approach (SCA). By distinguishing between ‘problem holder’ and ‘problem solver’, and (...) specifying the distributions of attributable commitments among the stakeholders, the SCA introduces an extension and refinement of the grounds for assigning the label ‘practical’ that brings PR and PA closer together. In this paper my primary aim is to present a logical system of practical reasoning that can be used to assess the validity of practical arguments, that is, arguments with a practical judgment as conclusion. I begin with a critical evaluation of other approaches to this issue and argue that they are inadequate. On the basis of these considerations, I explain in Sect. 2 the informal conception of practical validity and introduce in Sect. 3 the logical system P , which (...) is an extension of propositional logic and can be used to assess the validity of a wide range of practical arguments. The issue of what consequences to draw from the existence of non-classical logical systems has been the subject of an interesting debate across a diversity of fields. In this paper the matter of alternative logics is considered with reference to a specific belief system and its propositions :the Azande are said to maintain beliefs about witchcraft which, when expressed propositionally, appear to be inconsistent. When the Azande have been presented with such inconsistencies, they either fail to see them as such (...) or else accept them as non-problematical. Is our knowledge of logical truths a relative and culturally determined phenomenon, or is there some (transcendent) criterion that allows us to adjudicate between alternative logical systems? The authors propose an approach for resolving disputes about the status of Azande reasoning which assumes a paraconsistent framework, thus providing a new perspective on this debate. (shrink)

In this paper I take up the question of whether and in what sense action might be the conclusion of practical reasoning and argue against the answer provided by Sebastian Rödl's account of practical reasoning. Rödl's account aspires to steer a middle ground between the attitudinal and the neo-Aristotelian accounts of practical reasoning, by proposing that its conclusion is at once a thought and a movement. This account is worth considering for it promises to explain both practical reasoning's practicality and (...) its rationality in one move. But, I argue in this paper, a Rödlian account—an account which grants Rödl's central theses—fails to deliver on its promise. The reason is that, like others, a Rödlian also assumes that the only sense in which practical reasoning is practical is the sense in which it has a conclusion. Challenging this assumption in the right way, I finally suggest, helps us reassess the task of explaining practical reasoning in a way that goes beyond Rödlian, attitudinal and neo-Aristotelian accounts alike. In this paper, I explore the relationship between epistemic rationality and instrumental rationality, and I attempt to delineate their respective roles in typical instances of theoretical reasoning. My primary concern is with the instrumentalist conception of epistemic rationality: the view that epistemic rationality is simply a species of instrumental rationality, viz. instrumental rationality in the service of one's cognitive or epistemic goals. After sketching the relevance of the instrumentalist conception to debates over naturalism and 'the ethics of belief', I argue (...) that, despite enjoying considerable popularity among both epistemologists and philosophers of science, it is ultimately indefensible. Having thus argued for the distinctness of epistemic and instrumental rationality, I attempt to clarify the role played by each in typical instances of theoretical reasoning. I suggest that being theoretically rational--that is, being proficient with respect to theoretical reasoning--is best construed as a hybrid virtue, inasmuch as it involves manifesting sensitivity to two very different kinds of reasons. Recent experimental work by T.D. Wilson et al. indicates that a consequence of asking subjects to reflect on their attitudes is that they not only reduce the consistency between their attitudes and behavior, but they perform actions which they come to regret. Wilson interprets this work via intra-psychic concepts, and arrives at the conclusion that it is rational to avoid deliberating about a wide range of attitudes and behaviors. This consequence has objectionable implications for philosophical theories of deliberative practical rationality. (...) I respond to this challenge by reinterpreting the experimental results in a way which is not only consistent with a certain theory of deliberative practical rationality but in which the results lend support to that theory. This paper argues that practical reasoning is a mental process which leads a person from a set of existent mental states to an intention. In Section 1, I defend this view against two other proposals according to which practical reasoning either concludes in an action itself or in a normative belief. Section 2 discusses the correctness of practical reasoning and explains how the correctness of instrumental reasoning can be explained by the logical relations that hold between the contents of the (...) mental states. In Section 3, I explore the correctness of normative practical reasoning. I conclude with the sceptical view that correct practical reasoning cannot require us to intend to do what we believe we ought to do. (shrink)

The epistemological problem of the external world asks: (1) “How is knowledge of the external world possible given certain obstacles which make it look impossible?” This is a “how-possible?” question: it asks how something is possible given certain obstacles which make it look impossible (cf. Cassam 2007; Nozick 1981; Stroud 1984). Now consider the following question, which asks: (2) “How is a philosophically satisfying answer to (1) possible?” Skepticism is the thesis that knowledge of the external world is impossible. It (...) therefore represents a negative answer to the first question. Meta-epistemological skepticism is the thesis that a satisfying philosophical explanation of how our knowledge of the external world is possible is itself impossible. It therefore represents a negative answer to the second question. In this thesis, I explore the prospects of meta-epistemological skepticism. In particular, I structure the thesis around two master arguments from for meta-epistemological skepticism. The first argument is that skepticism represents a kind of paradox which requires dispensing with a plausible principle or belief, or even 'platitude', which means that there's no philosophically satisfying response to the paradox (see, e.g., Stroud 1984), and the second argument is “Stroud’s dilemma” (cf. Cassam 2009), that either we explain how external world knowledge is possible by reference to what external world knowledge we have, thereby failing to answer the philosophical question adequately, or else we don't, but then we succumb to first-order skepticism. I argue that the first argument fails to provide adequate support for meta-epistemological skepticism. However, the second argument, Stroud’s dilemma, is plausible and withstands serious objections (e.g., from Sosa 1994, Williams 1996, and Cassam 2009). In short, while the worry emerging out of the 'skeptical paradox' view fails to adequately support meta-epistemological skepticism, Stroud’s dilemma succeeds. Fortunately, it doesn't show that we lack external world knowledge; we rather just can't explain, philosophically, how it's possible. We may have first-order knowledge without understanding how it's possible. This thesis therefore represents a partial defense of meta-epistemological skepticism. Means-end reasoning – deliberations concerning what to do to attain a goal – is at the heart of EBP and practical pedagogy in general, but beset by many misunderstandings. In this paper I discuss the form of means-end reasoning involved in EBP. I bring out its basic features by first comparing it to David Hitchcock’s complex means-end scheme and then to the notion of goal-directed theories. Which approach, if any, best accommodates the means-end reasoning of EBP?

Intentional actions are those which are performed because the subject sees something to be said for performing them; the subject sees performing the action “in a positive light”. Intentional actions are therefore susceptible to a distinctive kind of explanation, which explains them as intentional; that is, which accounts for them in terms of their unique property, of being performed because the subject sees that there is something to be said for doing so. Practical reasoning is the process of figuring out (...) what there is reason to do; that is, what actions are best supported by the considerations available to the subject. To put it another way, practical reasoning is the process of figuring out which actions there is the most to be said for; so practical reasoning explains intentional action “properly”, i.e., in terms of its special properties. Many philosophers, loosely following the lead of David Hume, have argued for a close connection between desire and intentional action. If desires explain intentional actions properly, then they must do so through practical reasoning; that being the case, how do they do it? Another sizeable group of philosophers, the anti-Humeans, have argued that desires cannot explain intentional actions properly; they claim that desires are not the right sorts of things to appear in the premises of arguments, do not count in favour of any action, do not constitute evaluations of any action, and are in any case too fickle and lawless to take part in distinctively normative forms of explanation. The central question in this thesis is, what is the role of desire in practical reasoning? I put forward a characterisation of desire which explains how some desires can explain intentional actions properly, and leaves the question open whether all intentional actions are properly explained by desires. This 183-page introductory part of my dissertation is an overview of some key debates in philosophical moral psychology and its methodology.

Contrary to philosophical tradition, modern theorists of the mind have often downplayed the importance of consciousness. Instead, they have accounted for the mind in terms of phenomena like mechanisms, dispositions, abilities and even environmental features. One of many inspirations for this trend is a series of passages of the later Wittgenstein. These passages discuss a variety of specific mental phenomena, like searching, comparing, understanding and reading. The passages have often been taken them to show that one may exemplify any of (...) the phenomena at issue without being in any particular type of conscious state. I claim that the passages do not support this conclusion, and that the conclusion is, arguably, false. My conclusion is that consciousness may be a more important aspect of the mind than is supposed by many contemporary theorists--both Wittgensteinians and others. (shrink)

The goal of this dissertation is to offer a practice-based account of intentionality. My aim is to examine what sort of practices agents have to engage in so as to count as talking and thinking about the way the world is – that is, what sort of practices count as representational. Representational practices answer to the way the world is: what is correct within such practices depends on the way things are, rather than on the attitudes of agents. An account (...) of representation must explain how such objective standards of correctness are introduced in human practices: one must explain how the world gets to have a say in what is correct in human discursive practices. Roughly, my proposal is that human discursive practices become responsive to the way things are by virtue of involving practical interactions with the world. The outcomes of these interactions depend on the way the world is and the evaluation of such outcomes contributes to determining which moves within the practice count as correct. Due to our practical engagement with the environment, thus, the world gets to constrain discursive practices. In order to flesh out my proposal, I develop a practice-based characterization of intentional or representational content. On this sort of approach, expressing intentional contents is seen as a matter of playing a certain role in relevant practices, rather than as a matter of engaging in some word-world relation. The expression of content, thus, is explained in terms of use. In particular, I adopt an inferentialist perspective, according to which discursive moves express contents because of their role in practices of giving and asking for reasons. I investigate how practical engagement with the environment introduces friction with the world in these practices of giving and asking for reasons. One of the main conclusions reached in the dissertation is that defeasibility is an essential feature of objective representational practices – so that attributions of representational correctness are revisable in an open-ended way. The discussion of defeasible reasoning – and of the way in which defeasibility shapes human representational practices – is a central point of this dissertation. (shrink)

To be able to say what practical reasoning is, we first need to say what reasoning is and what the conclusion of a process of reasoning is. I shall do this in sections 1 and 2. We can then make a distinction between practical and theoretical reasoning. There are three main ways to do this, which I shall survey in sections 3 to 5. I shall end by suggesting that there are different kinds of practical reasoning.

The paper is a critical analysis of Kant´s concept of practical reasoning. It is based upon an analysis of Kant´s understanding of a man as a sensual-oversensual human being. The author focuses in an analysis of lawmaking of a practical reason. He concerns in Kant´s differentiation of cathegorical and hypothetivcal imperatives, or pure and ordinary will, respectively. Based on this analysis he consequently reconstructs Kantś understanding of a practical reasoning. In this article Aristotleś conception of moving principle of human action is described. The author is interested in Aristotleś way of combining cyclical moving of effective causes with entelecheia, a direction to highest good or happines, as a purposive cause of human action. This idea can be illustrated as a cycle of effective causes centralised around the purposive cause. This reconstruction of Aristotleś conception of causation of human action can be useful in process of contemporary syntetisis human action theories. Acending (...) to the author, Aristotleś idea that the essence of rationality lies in human action is a first step to solving the problem of nature of human being, and his conception of moving principles of human action is congenial anticipation of some aspects of contemporary theories of rational action and choice.
