In response to critiques of rights as moralistic and depoliticising, a literature on the political nature and contestability of rights has emerged. In this view, rights are not merely formal, liberal and moralistic imperatives, but can also be invoked by the excluded in a struggle against domination. This article examines the limits to this practice of rights-claiming and its implication in forms of domination. It does this by returning to Marx’s blueprint for the critique of subjective rights. This engagement with (...) Marx will, however, take a particular form. I will read Marx first through the eyes of Claude Lefort and thereafter against Lefort. The latter’s critique of Marx still constitutes the strongest case against the dismissal of subjective rights. Introducing a reading of Lefort into the argument allows us to discover what is dead and what is well alive in the Marxist theory of rights. What is dead, I will argue, is Marx’s early conception of subjective rights as ideology and illusion. However, the more mature Marx developed a theory and critique of the legal form that is able to explain why the politics of rights—despite its undeniable advances—has not been able to overcome certain forms of domination. Modern individuals grapple with a paradoxical reality: their lives are characterized by a strong feeling of independence as well as by an intense social interconnection. This article argues that despite an increased discussion of dependence in contemporary social and political philosophy, current ways of theorizing it have disregarded the concrete form that our social dependence takes under capitalist relations. I maintain that without integrating the critique of political economy, we risk offering a defense of dependence that remains unaware of important (...) axes of domination. In particular, I suggest recuperating Marx’s notion of objective dependence, which has been insufficiently discussed in the existing literature. Finally, drawing on recent developments in critical theory, I put forward a normative critique of dependence. I contend that the issue with modern societies is that they promote alienated and reified relations of dependence, transforming the basis of our social freedom into an objective form of domination. -/- . This essay offers a new reading of Marx's chapter on ‘the working day’ in Capital Volume One by exploring the textual theme of night-time work. Even as Marx emphasises how the lengthening workday enables the super-exploitation of producers’ wage labour, his depictions of nocturnal experiences highlight more forcefully the destruction of workers’ reproductive resources, capacities and relationships. Night comes to represent the contracted time, condensed space, petrified relational bonds and thwarted desires for human reproduction in a free, fulsome sense that (...) includes reinvigorating oneself, caring for others and enjoying experiences apart from work or care. Night's role as a privileged signifier and catalyst of these changes comes through in key passages about women, children and vampires, and in theoretically meaningful variances between Marx's German paraphrasing of English sources and those original texts, which replace Marx's phrases in English translations of Capital. Contemplating Marx's ambivalent reflections on legal-political action to limit workday hours, I argue for making struggles over social reproduction in a capacious sense central to working-class politics today. I demonstrate the power of this Marxian analytic by considering the compression of social-reproductive time among today's microworkers, who fuel the digital economy by performing platform-based ‘tasks’ at all hours for very low wages. This article is a review of the contemporary ‘leftist’ republican project. The project stands on two legs, and we examine them both in turn. The first leg is a novel reading of history. This reading suggests, on the one hand that, contrary to some popular assumptions, republicanism does have a leftist, even a radical stream. But on the other hand, it also suggests that several authors and movements that did not self-identify as republicans actually did, in fact, employ a characteristically (...) republican thinking. The second leg of the project is a normative one. It is essentially an attempt by political philosophers to demonstrate that there is something in republican theory from which all these leftist, even radical streams spring forth. Primarily, it is suggested that it is republicanism’s sensitivity to the freedom-restricting role of great inequalities of power that provides the normative resource for the development of a characteristically republican critique of capital and capitalism. We briefly review the main arguments in favor of these claims, and also, as a conclusion, raise a few challenges that the ‘leftist’ republican project potentially faces. (shrink)

The concept of practice is thematically central to modern conservative thought, as evident in Edmund Burke’s writings on the aesthetic and his diatribe against the French Revolution. It is also the main organizing thread in the framework in the human sciences known as practice theory, which extends back at least to Karl Marx’s ‘Theses on Feuerbach’. This article historicizes ‘practice’ in conservative thought and practice theory, accounts for the family resemblance between the two, and takes apart that family resemblance to (...) reveal differences. The ingredients of practice theory (historical inheritance, embodiment, cognitive limits, loose coupling between conscious thought and action) are in many cases also distinctive traits of conservative thought. But the similarity is deceptive. Practice theory and conservative thought constitute two distinct interpretations of practice, two disparate endeavours for connecting human science with political strategy, and two different formulas for opposing theory and practice. The present study will argue that this is primarily a political opposition for conservative thought, while it is a human-scientific opposition for practice theory. Conservative thought is initially political and then human-scientific; practice theory is initially human-scientific and then political. This article advocates for practice theory against conservative thought as differently amended versions of a politics that recognizes human finitude. (shrink)

A citizens’ movement in Berlin advocates for the expropriation of housing corporations and has won a significant majority in a popular referendum in September 2021. Building on this proposal, this paper develops a general account of expropriation as a measure for corporate reform and thereby contributes to the ongoing debate on the democratic accountability of business corporations. It argues that expropriation is a valuable tool for intervention in a dire situation in some economic sector to enable a re-structuring of the (...) governance of the assets in question. Compared with other tools available, expropriation is a more forward-looking, genuinely political measure that does not depend on the legal assignment of guilt but rather proceeds in a pragmatic and problem-oriented manner. It also allows us to reconsider in how far the market mechanism should be employed in the administration of assets. Objections from private property rights against expropriation fail as corporations generally are privileged, quasi-public institutions that can justifiably be subject to democratic interventions. Expropriation is thus an important addition to the arsenal of corporate reform proposals, especially for those concerned with a broad democratization of the corporation. (shrink)

Friedrich Engels’s “History of the Rifle” was among the longest and most detailed studies of technological development that either he or Marx produced. Yet the piece has been almost entirely forgotten. I recover Engels’s essay as a model for the historiography of technology and for the study of the politics of the technical object today, demonstrating its continuity with the larger critical project he was engaged in with Marx in these years. In a famous footnote to Capital, Marx suggested that (...) the method appropriate to a “critical history of technology” in society should be developed by analogy to Darwin’s revolutionary history of organic life. I show that Engels’s study of the rifle works out such a method in practice, recasting technological development as a nondeterministic interplay between the successive mutations of the artifact and the pressures of its social environment. Moreover, Engels’s technological materialism has a socially engaged and emancipatory end, for it is here directed against a particularly pernicious form of the commodity fetish: the fetishism of weapons. Work occupies a central place in most people’s lives, yet a secondary one in most of political philosophy. This article attempts to show the negative theoretical consequences of this neglect by taking the example of the concept of constituent power as it appears in the writings of Emmanuel Joseph Sièyes and Karl Marx. Both authors conceived it as made up of the working classes. This, however, makes them both run into the same paradox: how to politically represent a class that (...) is characterised by a non-political activity – work? I argue that neither of them gives a satisfactory response since both rely on an implausible account of objective class interests based on fragile grounds. I conclude by showing that the political representation of workers is a theoretical and practical problem that the concept of constituent power is unable to resolve. (shrink)

I reconstruct the civic republican foundations of Eugene Debs’s socialist critique of capitalism, demonstrating how he uses a neo-roman conception of freedom to condemn waged labour. Debs is also shown to build upon this neo-roman liberty in his socialist republican objections to the plutocratic capture of the law and threats of violence faced by the labour movement. This Debsian socialist republicanism can be seen to rest on an ambitious understanding of the demands of citizen sovereignty and civic solidarity. While Debs (...) shares some of the commitments of earlier American labour republican critics of capitalism, he departs from them in his thoroughgoing commitment to common democratic ownership of productive property. His socialist republicanism remains valuable today for its ability to illuminate features of plutocratic control, judicial autocracy, and the regime of property best suited to suppressing economic domination. I conclude that Debs not only deserves a prominent place in an emerging radical republican canon but presents a distinctive contrast with many of his Marxist contemporaries and offers a compelling challenge to recent liberal, plebeian, and socialist forms of republicanism. In the Critique of Gotha Programme, Karl Marx famously argues that a communist society will be characterised by the principle, ‘From each according to his abilities, to each according to his needs!’ I take up a question about this principle that was originally posed by G.A. Cohen, namely: what makes communism (so conceived) possible for Marx? In reply to this question, Cohen interprets Marx as saying that communism is possible because of limitless abundance, a view that Cohen takes to be (...) implausible for ecological reasons. I develop a new interpretation of Marx's position. On this interpretation, people in communist society achieve self-realisation through providing others with the goods and services required for their self-realisation. Coupled with a reasonably high (but not immense) development of productive power, self-realisation generates conditions in which people can produce according to their abilities and receive according to their needs. I defend this view as an interpretation of Marx and I argue that it represents a more plausible account of what makes communism possible than Cohen's interpretation in which technological advance and limitless abundance play the predominant role. This paper presents a critique of left republican writings from a non-republican socialist standpoint. It examines three claims that have been advanced by left republican authors: that workers are dominated 1) by their lack of access to the means of production; 2) by the market; and 3) by their employer. With regard to 1) and 2), it argues that alternative conceptions of freedom can identify the unfreedom in question, and that there are good reasons for pressing these complaints on the (...) basis of these alternative conceptions. With regard to 3), it argues that, while alternative conceptions of freedom may be able to identify the unfreedom in question, republican freedom provides a more suitable basis for pressing this claim. It concludes that while left republicans have shown that socialists have reason to care about republican freedom, they have not shown that socialists should adopt republican freedom at the expense of other conceptions of freedom. Under the influence of the first generation of Frankfurt School critical theory, Abensour can be seen as applying a method of thinking in constellations to the study of historical texts, the critical rearrangement of conceptual elements drawn from the latter generating new dialectical images that reveal something previously obscured about the object of investigation. Digital innovations are rapidly changing the contemporary workplace. Big Tech companies marketing algorithmic management increasingly decide on the Future of Work. Political responses, however, often focus on managing the impact of these technologies on workers. They leave the question of how these technologies are designed or how workers can determine their own futures unanswered. This approach risks surrendering the Future of Work debate to techno-determinist imaginaries aligned with corporate interests. Using Cornelius Castoriadis’ early writings on worker struggles in French Tayloristic (...) factories and his later oeuvre on conflictual social imaginaries, I propose an agonistic approach to the Future of Work. Not merely companies implementing workplace technologies, but also workers themselves possess agency in determining the Future of Work. Workers’ frequent contestations against machinic surveillance and technologically mediated coordination of the labour process disclose an alternative Future of Work in which technologies are used to enhance worker autonomy rather than bureaucratic control. Worker struggles at Amazon Mechanical Turk illustrate this agonistic dynamic: Amazon mobilizes algorithmic management to fragment and control a workforce of globally dispersed remote workers, but the latter form online social communities and create counter-technologies to reappropriate control over the labour process.
