This interview with Jeremy Waldron covers three topics. Firstly, we dealt with the methodology debate, that is, the discussion about how to proceed in analyzing the nature of law. Does the question ‘What is law?’ require a descriptive analysis of the concept of law or, rather, a normative exercise in political philosophy? Secondly, we spoke about the role of law in response to historic injustice, especially in relation to the restitution of property rights. Our competitive, service-oriented societies are taking a toll on the late-modern individual. This study starts from the premise that mandala is a design of the Cosmos and consciousness. mandala is a contracted and systematically designed cosmic space and represents high-level spirituality at the same time. The work of designing mandala is an experience with a sacred world as itself and constitutes a process of self-discipline. In other words, mandala is to ritualize the world of Buddhism beyond a design context and visualize religious experience through a specific object. Therefore, it serves as a (...) medium that gets both producers and audiences to experience the sacred world. In this way, mandala is present as an experiencing design and a behaving medium. This study aims to identify the archetype of empirical and synthetic design by analyzing mandala as an integrated icon for which the Cosmos and human beings or consciousness and matter meet each other. Spatial structuralization is considered most important in the icon of mandala. The space in mandala is the place where consciousness joins reality, which represents the state of enlightenment. Many multi-dimensional Buddhas coexist in the space, and they are arranged in harmony and in order. This visual structure allows mandala to play the role of interactive medium. In the iconic shapes of mandala symbolizing a sacred world, major elements include a circle, square, semicircle, triangle and the numbers of 8 and 4. The respective shapes are matched to white, yellow, red and black, and the five different senses are connected to one another. The five senses are symbolic of earth, water, fire, wind and void which constitute the universe, and again they remain connected to five different parts of the body of a disciplinant drawing mandala: liver, kidney, spleen, lungs and heart. Those organs are associated with five Buddhas and in turn connected through the boundless space of the universe. By analyzing such a composite structure of mandala, this study tries to appreciate its in-depth meaning as an integrated design. (shrink)

Toutefois, vers la fin du xvie siècle, le philosophe hollandais Rodolphe Snellius, père adoptif du théologien Arminius, composera un traité de morale dans lequel il tente de concilier la morale aristotélicienne avec la méthode développée par Ramus et son équipe. Debt-ridden corporate growth and increased vulnerability was one of the causes of the 1997 financial crisis in Korea. Introduction of the outside director system has been the core part of the board reforms following the crisis. Our estimation using instruments obtained from a natural experiment illustrates that outside monitoring has improved capital structure of firms even when we control for the leverage regulation effect, enhanced compliance with leverage regulation and thus reduced business risks, and reduced excessive growth and excessive investment (...) more consistently for the top 10 largest chaebols than non-chaebol firms and smaller sized chaebol affiliates. Our results shed some light on why existing studies report the positive effect of outsiders on firm value and add value to existing agency theory by illustrating that the effect of improved governance on capital structure could be non-linear. Transparency is the order of the day. It is a term, a slogan, that dominates public discourse about corruption and freedom of information. Considered crucial to democracy, it touches our political and economic lives as well as our private lives. Anyone can obtain information about anything. Everything—and everyone—has become transparent: unveiled or exposed by the apparatuses that exert a kind of collective control over the post-capitalist world. Yet, transparency has a dark side that, ironically, has everything to do with a (...) lack of mystery, shadow, and nuance. Behind the apparent accessibility of knowledge lies the disappearance of privacy, homogenization, and the collapse of trust. The anxiety to accumulate ever more information does not necessarily produce more knowledge or faith. Technology creates the illusion of total containment and the constant monitoring of information, but what we lack is adequate interpretation of the information. In this manifesto, Byung-Chul Han denounces transparency as a false ideal, the strongest and most pernicious of our contemporary mythologies. (shrink)

Western thinking has long been dominated by essence, by a preoccupation with that which dwells in itself and delimits itself from the other. By contrast, Far Eastern thought is centred not on essence but on absence. The fundamental topos of Far Eastern thinking is not being but 'the way' (dao), which lacks the solidity and fixedness of essence. The difference between essence and absence is the difference between being and path, between dwelling and wandering. 'A Zen monk should be without (...) fixed abode, like the clouds, and without fixed support, like water', said the Japanese Zen master Dōgen. Drawing on this fundamental distinction between essence and absence, Byung-Chul Han explores the differences between Western and Far Eastern philosophy, aesthetics, architecture and art, shedding fresh light on a culture of absence that may at first sight appear strange and unfamiliar to those in the West whose ways of thinking have been shaped for centuries by the preoccupation with essence. Outside directors’ regular board meeting attendance is important in improving the effectiveness of a governance system. Such attendance is evidence of their commitment to the firm as key other players in monitoring and decision making. Using a unique dataset for Korean firms, and three-level random coefficients models, we find that, foreign outside directors, an independent appointment process, professional knowledge of business operations and accumulated firm-specific knowledge are important factors that affect outside directors’ attendance of board meetings. The results also confirm (...) that both outside directors’ personal characteristics and the social context are crucial in understanding their board meeting attendance. Further analysis shows that a positive corporate environment that supports the outside director system encourages outside directors’ attendance at board meetings. (shrink)

The primary purpose of this study is to examine the relationship between the dynamic capabilities embedded in ESG management, which are being pursued by global companies, and corporate performance amid increasing uncertainty. Furthermore, the secondary purpose is to examine the function of environmental uncertainty moderating the DCs-performance relationship. Concerning the analysis tool, this study employs topic modeling with Word2Vec embedding that analyzes unstructured data. This was employed as an alternative method beyond the limitations of the traditional approach, i.e., survey or (...) interview. A DCs dictionary was constructed by redesigning the 12 detailed dimensions of Teece’s DCs into 10 dimensions, and then time series scores of individual global companies were extracted by applying this dictionary to the sustainability reports of 97 companies. Sustainability reports of 153 companies among Fortune Global 500 companies announced in 2020 were originally collected, but in the process of collecting additional financial data about these companies from OSIRIS, a total of only 97 companies was selected in the end due to omission of data. A fixed effect panel analysis was conducted, and the main findings are as follows: First, the DCs embedded in ESG management have a positive or negative direct effect on corporate performance. In particular, a statistically significant relationship was not observed in the innovation oriented capabilities, whereas a statistically significant positive relationship was observed in the customer oriented capabilities. Second, uncertainty moderates the relationship between DCs and corporate performance positively or negatively. Interestingly, the moderating effect of uncertainty only appears in the function of the sensing and reconfiguring capabilities. From this, it can be seen that the function of DCs, which is embedded in the ESG management of global companies, is limited due to the imbalance between the sensing-seizing-reconfiguring capabilities. These findings imply that, despite the positive function of DCs embedded in ESG management, costs and benefits occur at the same time, and DCs can improve performance only if there is an organizational adaptation strategy suitable for uncertainty. Accordingly, business managers need to recognize the importance of pursuing sensing-seizing-reconfiguring capabilities in a balanced way to improve corporate performance through ESG management under uncertainty. Notwendig für die Überwindung der heutigen Zeitkrise sind die Revitalisierung der vita contemplativa und das Wiedererlernen der Kunst des Verweilens.

A substantial amount of recent work in natural language generation has focused on the generation of ‘‘one‐shot’’ referring expressions whose only aim is to identify a target referent. Dale and Reiter's Incremental Algorithm (IA) is often thought to be the best algorithm for maximizing the similarity to referring expressions produced by people. We test this hypothesis by eliciting referring expressions from human subjects and computing the similarity between the expressions elicited and the ones generated by algorithms. It turns out that (...) the success of the IA depends substantially on the ‘‘preference order’’ (PO) employed by the IA, particularly in complex domains. While some POs cause the IA to produce referring expressions that are very similar to expressions produced by human subjects, others cause the IA to perform worse than its main competitors; moreover, it turns out to be difficult to predict the success of a PO on the basis of existing psycholinguistic findings or frequencies in corpora. We also examine the computational complexity of the algorithms in question and argue that there are no compelling reasons for preferring the IA over some of its main competitors on these grounds. We conclude that future research on the generation of referring expressions should explore alternatives to the IA, focusing on algorithms, inspired by the Greedy Algorithm, which do not work with a fixed PO. Long ago, when Alexander the Great asked the mathematician Menaechmus for a crash course in geometry, he got the famous reply ``There is no royal road to mathematics.'' Where there was no shortcut for Alexander, there is no shortcut for us. Still, the fact that we have access to computers and mature programming languages means that there are avenues for us that were denied to the kings and emperors of yore. The purpose of this book is to teach logic and (...) mathematical reasoning in practice, and to connect logical reasoning with computer programming in Haskell. Haskell emerged in the 1990s as a standard for lazy functional programming, a programming style where arguments are evaluated only when the value is actually needed. Haskell is a marvelous demonstration tool for logic and maths because its functional character allows implementations to remain very close to the concepts that get implemented, while the laziness permits smooth handling of infinite data structures. This book does not assume the reader to have previous experience with either programming or construction of formal proofs, but acquaintance with mathematical notation, at the level of secondary school mathematics is presumed. Everything one needs to know about mathematical reasoning or programming is explained as we go along. This paper asks why information should ever be expressed vaguely, re-assessing some previously proposed answers to this question and suggesting some new ones. Particular attention is paid to the benefits that vague expressions can have in situations where agreement over the meaning of an expression cannot be taken for granted. A distinction between two different versions of the above-mentioned question is advocated. The first asks why human languages contain vague expressions, the second question asks when and why a speaker should (...) choose a vague expression when communicating with a hearer. While the former question is purely theoretical, the latter has practical implications for the computational generation of utterances in Natural Language Generation (NLG). (shrink)
