This paper explores the presence of late medieval ius commune in Grotius’s thought on the use of force in internal strife and war, based on De iure belli ac pacis. To this end, it examines Grotius’s use of ius commune sources, and considers some similar sources, which he does not actually cite, but which relate to his discussion. By clarifying Grotius’s selection and use of ius commune sources, the paper intends to contribute to the achievement of a double aim: firstly, (...) to determine the place of rebellion and civil war in De iure belli ac pacis, especially in relation to war; and, secondly, to assess Grotius’s approach to the two former issues, particularly with regard to the criteria by which a distinction between rebellion and civil war can be drawn, and to the effects of this distinction. Lo storico della filosofia e filosofo francese Étienne Gilson (1884-1978) ha notoriamente offerto una lettura innovativa di importanti figure del pensiero medievale, da Tommaso d’Aquino a Duns Scoto e Bonaventura, includendo in questa lista anche Agostino di Ippona. L’originalità della lettura offerta da Gilson si esprime per lo meno in due modi. In primo luogo, Gilson ha argomentato a sostegno dell’effettiva caratura filosofica, e non semplicemente teologica, del pensiero di quei pensatori. Contro un pesante pregiudizio che all’epoca in cui egli (...) iniziava le sue ricerche, e specialmente nella sua Francia, gravava nei confronti della cultura medioevale – di non aver espresso alcuna filosofia ma solo una teologia – egli acquisì «il merito di aver non solo iniziato genialmente la riscoperta della filosofia medievale, ma di aver decisamente contribuito a riportarne la storia ai livelli della scientificità e della dignità accademica». In secondo luogo, Gilson ha sostenuto che la filosofia in questione si caratterizza di uno «spirito cristiano» che, come aveva caratterizzato l’epoca medievale sotto ogni altro aspetto, ne aveva informato il pensiero filosofico, dando vita a una vera e propria «filosofia cristiana». Ma se questo significa che, per il filosofo francese, si dava un elemento di caratterizzazione unitaria del pensiero medievale, va anche rilevato che, per lo stesso autore, questo pensiero andava indagato nella sua notevole varietà. Con competenza e lettura fedele dei testi, Gilson valorizzò le differenze tra le filosofie dei vari autori presi in considerazione. In questo articolo, intendo mostrare che queste due caratteristiche dell’interpretazione gilsoniana del pensiero medievale si applicano entrambe all’interpretazione che il filosofo francese offrì del pensiero di Dante Alighieri. In primo luogo, Gilson ha riconosciuto anche a Dante, come al pensiero medievale tutto, una caratura specificamente filosofica. In secondo luogo, della filosofia del sommo poeta (che Gilson riteneva anch’essa ‘cristiana’) ha evidenziato la peculiarità, sganciandola dalle classificazioni che la volevano ridurre a qualcuna delle correnti filosofiche del Duecento. Il fine che mi propongo è quello di mostrare (nella prima sezione) in che cosa consista questa peculiarità, per poi procedere (nelle successive tre sezioni) a rilevare che essa conduce Gilson a una coerente interpretazione di Dante filosofo secondo tre direttrici: quella etica, quella politica e quella filosofico-storica. I will discuss some aspects of the concept of “point” in quantum gravity, using mainly the tool of noncommutative geometry. I will argue that at Planck’s distances the very concept of point may lose its meaning. I will then show how, using the spectral action and a high momenta expansion, the connections between points, as probed by boson propagators, vanish. This discussion follows closely.

O artigo apresenta uma investigação, no âmago do pensamento de Nicolau Maquiavel, sobre o papel que os conflitos romanos ocorridos entre nobres e plebe tiveram para que a República de Roma se tornasse uma potência militar. O entrechoque de desejos de grandes e povo foi responsável por promover naquela cidade um autêntico vivere civile e libero, mas também foi a principal causa de sua expansão político-militar. Aqui, buscaremos elucidar os motivos que alçaram Roma àquela grandeza. Em um primeiro lugar, as (...) dissensões ocasionaram o aperfeiçoamento constitucional das instituições romanas, encaminhando-as rumo a um estado republicano de governo misto. Com a instituição dos Tribunos da Plebe, o povo alcançava seu reconhecimento político, possibilitando que os exércitos fossem formados pelos próprios cidadãos advindos da plebe. Em segundo lugar, a regulação institucional dos conflitos e o anseio expansionista de Roma foram a razão pela qual a "guarda da liberdade" havia sido confiada à plebe, promovendo um governo popular, medida que permitiu que a República se voltasse para campanhas expansionistas em direção a conquista do império. Em terceiro lugar, reconhecer o conflito e institucionalizá-lo foi um meio para precaver-se dos caprichos da fortuna. Dessa forma, regular institucionalmente os eventos que atribulam a ordem política interna significava dar garantias para que os confrontos externos fossem bem-sucedidos. (shrink)

Carroll Izard’s theoretical and empirical work has played a preeminent role in energizing the renascence in the study of the emotions and emotional development in normality and pathology. A brief historical overview of his career is presented. Izard’s differential emotions theory (DET) has exerted influence in a number of domains and disciplines. Illustrations are provided from research and prevention in developmental psychology and developmental psychopathology. A power of attorney for healthcare (POAHC) form gives designated individuals legal status to make healthcare decisions when patients are unable to convey their decisions to medical staff. Completion of a POAHC form is crucial in the provision of comprehensive healthcare, since it helps to ensure that patients’ interests, values, and preferences are represented in decisions about their medical treatment. Because increasing numbers of people suffer from debilitating illness and cognitive deficits, healthcare systems may be called upon to navigate the (...) complexities of patients’ care without clear directives from the patients themselves. Hence, the healthcare industry encourages all individuals to complete a POAHC form to ensure that persons who have the patients’ trust are able to act as their surrogate decision makers. However, sometimes POAHC agents, even when they are patients’ trusted agents, lack the capacity to make fully informed decisions that are in the patients’ best interests. We describe designated surrogate decision makers who have impaired or diminished judgment capacity as incapacitated surrogates. Decision making that is obviously flawed or questionable is a significant impediment to providing timely and appropriate care to patients. Moreover, failure to redress these issues in a timely and efficient manner can result in significant costs to an institution and a diminished quality of patient care. The authors offer a legal, ethical, and interdisciplinary framework to help navigate cases of incapacitated surrogates. (shrink)

Epistemic limitations concerning prediction and explanation of the behaviour of robots that learn from experience are selectively examined by reference to machine learning methods and computational theories of supervised inductive learning. Moral responsibility and liability ascription problems concerning damages caused by learning robot actions are discussed in the light of these epistemic limitations. In shaping responsibility ascription policies one has to take into account the fact that robots and softbots - by combining learning with autonomy, pro-activity, reasoning, and planning - (...) can enter cognitive interactions that human beings have not experienced with any other non-human system. Psychopathy is typically seen as a trait that is undesirable in any context, including the workplace. But several authors have suggested that people high in psychopathy might possess resources that preserve their ability to perform well in stressful contexts. We consider the possibility that primary psychopathy is adaptive—for the employee, if not for the organization—under conditions of abusive supervision. In particular, we draw from the multimotive model of interpersonal threat and the theory of purposeful work behavior to argue that high (...) primary psychopathy individuals possess characteristics that enable them to experience higher levels of well-being and lower levels of anger than their peers under abusive supervisors. Based on a scenario study and a time-lagged field study, we found support for a model in which abusive supervision moderates the relationships between primary psychopathy and positive work-related outcomes, such that these relationships are positive under conditions of abusive supervision and either diminished or negative under conditions of low abusive supervision. Abusive supervision also affected the relationship between primary psychopathy and anger in the field study such that high primary psychopathy individuals were less angry under more abusive supervisors. Thus, there appears to be some credence to the notion of a “psychopathic advantage” in that primary psychopaths do have access to greater psychological resources than their peers under abusive supervision. However, these findings also suggest that abusive supervisors may empower employees with characteristics that hold strong potential to damage the organization and its stakeholders. (shrink)

The car has become ubiquitous in late modern society and has become the leading object in the ordinary social relations of mobility. Despite its centrality to the culture and material form of modern societies, the relationship between the car and human beings has remained largely unexplored by sociology. This article argues that cars are combined with their drivers into an assemblage, the ‘driver-car’, which has become a form of social being that brings about distinctive social actions in modern society – (...) driving, transporting, parking, consuming, polluting, killing, communicating and so on. To understand the nature of this assemblage a number of theoretical perspectives that describe the interaction and collaboration between human beings and complex objects are explored; the process of driving, ‘affordance’, actor-network theory, and the embodied relationship between driver and car. This theoretical account of the driver-car is intended as a preliminary to the empirical investigation of the place of the driver-car in modern societies. (shrink)

Dante's Convivio, composed in exile between 1304 and 1307, is a series of self-commentaries on three of Dante's long poems. These allegorical love poems and philosophical verse become the basis for philosophical, literary, moral, and political exposition. The prose is written in Italian so that those who were not educated in Latin could take part in what Dante called his 'banquet of knowledge'. In this edition, eminent Dante translator-scholar Andrew Frisardi offers the first fully annotated translation (...) of the work into English, with an extensive introduction, making Dante's often complex writings accessible to scholars and students. The parallel Italian text is also included for the first time in an English translation of the Convivio. Readers of this work can gain a strong understanding of the philosophical themes across Dante's work, including the Divine Comedy, as well as the logic, politics and science of his time. (shrink)

Se intenta no solo comprender el fenómeno amoroso en el pensamiento heideggeriano, sino mostrar la incidencia que habría tenido en la interpretación de otras cuestiones y, sobre todo, en el asunto central sobre el sentido del Ser. Heidegger's scarce treatment (...) of love has been frequently pointed out. This article aims to recover and articulate some important allusions. A distinction can be made between three topical registers: as a way of "finding oneself"; as an "attitude" with others and as a trait of "being itself". An attempt is made not just to understand the phenomenon of love in Heidegger's thoughtbut also to show its impact on other topics, and, above all, on the central topic of the meaning of Being. In this paper a view of self-deception is given which eliminates the paradox usually associated with self-deception.Self-deception is distinguished from ignorance, false belief, wishful thinking, and reluctance to believe. Through an analysis of ordinary language, the role of knowing and believing in self-deception is examined as well as the notion of the self-deceived person "persuading himself to believe." The role of intention and the function of "self" in "self-deception" is analyzed through a discussion of evidence and interpretation.It is shown that (...) the self-deceived person does not know or even believe p, but is, nevertheless, properly characterized as "self-deceived." It is argued that the self-deceived person believes not-p and does not know, or even believe, p. The paradox turns out to be more apparent than real. (shrink)

Considering dialogue as a fundamental philosophical experience, this paper aims to understand the possibility of a radical and emphatic dialogic practice in the formation of the educator-philosopher. “Educator-philosopher” is the term used to detach the importance of a dialogic specialization in philosophy so that the teacher’s teaching practice becomes a philosophical activity, and he finds himself as a philosopher in the ways of philosophy. The transdisciplinary perspective announced is configured as an epistemologic field of a dialogue methodology practiced at all (...) ages of basic education. It has to do with an understanding of philosophy as an apprenticeship of appropriative thinking, which requires of the educator-philosopher a radical transformation, because only the one who learned to be a philosopher – the one who learned to investigate the "what" of things, investigating thoughts themselves – can favor the event of a dialogic practice whose focus is the apprenticeship of the articulator thought: to learn to learn with the seriousness of a child. En el presente artículo se piensa la relación entre el golpe, los problemas de la re-presentación y la militarización neoliberal a través de varias imágenes, entre las que la del tanque de guerra será primordial para reflexionar acerca del origen violento del nuevo régimen económico y vital que se desplegó con el golpe. Lo anterior se enmarca desde el imaginario político de México en los años setenta, particularmente a través del régimen del presidente Luis Echeverría y su singular relación con (...) el elemento militar. La multiplicidad de miradas mexicanas sobre el golpe chileno está mediada por las imágenes. En esa miríada de elementos, existe un resto incontable, anónimo y excesivo: lo plebeyo. (shrink)

The progressive publication -along the past two decades- of the courses taught by Heidegger in his first years in teaching has allowed the reconstruction of the process of creation of Being and Time , its multiple textual references and influences. Among these, St. Augustine's thought bears a prominent place, for which reason I intend to consider its noticeable presence in some of the key concepts in the work mentioned. The first to be considered is Sorge , with which Heidegger characterises (...) the fundamental ontological constitution of human existence. His first drafts emerged from the reflection upon the famous "inquietum cor nostrum" and the cura for the vita beata from Confessions X. Based on this same text Heidegger had offered a phenomenological interpretation of temptation, which constitutes one of the first elaborations of the so-called "fall", precisely one of the structural moments of the Sorge. Explicit references or suggestive analogies between both thinkers can also be appreciated between the explanation of "tempus" as "distentio animi" in Confessions XI and the heideggerian thesis of "temporality" as the basis of the constitution of human subjectivity; the road from the search of God to the exploration of the interiority of the one who looks for Him and the way back from the question about the "being" to the question about the one who understands the "being", in other no less significant cases.La progresiva publicación a lo largo de las últimas dos décadas de los cursos dictados por Heidegger durante sus primeros años de docencia ha permitido reconstruir el proceso de gestación de Ser y Tiempo , sus múltiples referencias textuales e influencias. Entre ellas, ocupa un lugar destacado el pensamiento agustiniano, por lo cual me propongo considerar aquí su fuerte presencia en algunos de los conceptos centrales de dicha obra. El primero a tener en cuenta es el de "Sorge" con el que Heidegger caracteriza la constitución ontológica fundamental del existir humano. Sus primeros esbozos habían surgido de la reflexión en torno al célebre "inquietum cor nostrum" y a la cura por la vita beata de Confesiones X. A partir de este mismo texto Heidegger había realizado también una interpretación fenomenológica de la tentación, que constituye una de las primeras elaboraciones de la llamada "caída", precisamente uno de los momentos estructurales de la "Sorge". Referencias explícitas o sugerentes analogías entre ambos pensadores pueden apreciarse también entre la explicación de Confesiones XI del "tempus" como "distentio animi" y la tesis heideggeriana de la "temporalidad" como fundamento de la constitución de la subjetividad humana; el tránsito desde la búsqueda de Dios a la exploración de la interioridad de aquel que lo busca y el retroceso desde la pregunta por el "ser" a la pregunta por el que comprende el "ser", entre otros casos no menos significativos. Will Kymlicka ha sido considerado como compatibilizador de liberales y comunitaristas en cuanto a los derechos de las minorías. Su distinción entre derechos de grupo como protecciones externas y como restricciones internas buscó dar cuenta de las reivindicaciones minoritarias sin vulnerar el principio liberal de autonomía. En este artículo se buscan dos objetivos: primero, adoptar una perspectiva crítica, al afirmar que tal distinción soslaya el eje central de la discusión, esto es, la problemática de la titularidad del derecho, y, segundo, (...) proponer una nueva clasificación de los derechos aplicables a las minorías que sea capaz de servir de modelo para futuros diseños institucionales. Will Kymlicka has attempted to harmonize the positions of liberals and communitarians with respect to minority rights. His distinction between group rights as external protections and internal restrictions sought to account for minority vindications without violating the liberal principle of autonomy. The objective of this article is twofold: first, to adopt a critical perspective by arguing that said distinction avoids the core of the discussion, that is, the issue of ownership of rights, and, second, to proposed a new classification of rights applicable to minorities that can serve as a model for future institutional designs. En el siguiente trabajo se retoman las tesis desarrolladas por Arturo Roig en relación a la problemática del sujeto y la dimensión antropológica, entendiendo que constituyen ejes conceptuales centrales que se presentan en su propuesta filosófica. Desde la elaboración singular de lo que denomina como "a priori antropológico", que supone un ejercicio de autoafirmación y reconocimiento, hasta la enunciación de una "moral de la emergencia", es posible ubicar sucesivas formulaciones que sigue en su tratamiento teórico. A partir de la referencia (...) a estas cuestiones se pone de relieve la revisión crítica que implican en relación al humanismo, en el sentido de la especificidad que reviste el mismo en el contexto latinoamericano. In this paper we review Arturo Roig's theses concerning the problem of the subject and the anthropological dimension, being these fundamental concepts of his philosophical proposal. It is possible to find successive stages in his theoretical process ranging from his particular approach to what he calls "anthropological a priori" -which implies an exercise of assertiveness and acknowledgement- to the enunciation of a "moral of emergence". The reference to these matters reveals a critical revision of humanism as regards its specificity in the Latin American context. (shrink)

En la siguiente exposición se propone un comentario de la obra del filósofo cubano Pablo Guadarrama González, denominada Pensamiento filosófico latinoamericano. Humanismo, método e historia. La perspectiva humanista que es postulada contiene una serie de precisiones que son analizadas en sus implicaciones teóricas y prácticas. Asimismo, se extiende su estudio de las ideas filosóficas a distintos momentos del desarrollo particular seguido en América Latina, al igual que está acompañada esta tarea historiográfica de consideraciones metodológicas que resultan significativas. Desde el conjunto (...) de temas planteados por el autor se retoman sus aportes en relación a debates que se inscriben en el cruce disciplinario de la filosofía y la historia de las ideas, que se ubican inicialmente en el contexto latinoamericano pero aspiran a una proyección con alcances universales. We comment the Cuban philosopher Pablo Guadarrama González’s Latin American philosophical thinking. Humanism, method and history. The humanistic perspective posited therein contains some assumptions that we analyze in their theoretical and practical implications. Furthermore, we extend his study of philosophical ideas to different moments of Latin America’s particular development, being this historiographic task accompanied by significant methodological considerations. Of all the themes posed by this author, we take his contributions to the debates raised in the interdisciplinary intersection of philosophy and the history of ideas, initially located in a Latin American context but with universal projection. The purpose of this paper is to analyze some of the thesis developed in the context of the Latin American critical thought in order to address the question of the crisis of modernity. We particularly consider the theories of two contemporary authors: Bolívar Echeverría and Enrique Dussel. Their theoretical positons are clearly different from the critique that had occurred in the postmodern discourse and they intend to account for the meaning of modernity in relation with certain phenomena that characterize it (...) structurally, which are represented by the development of capitalism and the consequent globalization. In this sense, albeit taking into consideration where these critical theories have been enunciated, that is, the particular experience of modernity in Latin America, their reflections have a global scope and try to explain the complex and contradictory characteristics of this civilization process. We analyze Bolívar Echeverría’s original proposal regarding the baroque ethos by which he identifies a particular way of modernity that tends to offer an alternative to the capitalist modernity. As regards Enrique Dussel, we underscore his trans-modernity concept that gives a new response to the Eurocentrism and colonization that marked the historical changes since modernity to the present.
