Democracy is usually conceived as based on self-rule or rule by the people, and it is this which is taken to ground the legitimacy of the democratic form of government. But who constitutes the people? Democratic political theory has a potentially fatal weakness at its core unless it can answer this question satisfactorily. In _The Time of Popular Sovereignty_, Paulina Ochoa Espejo examines the problems the concept of the people raises for liberal democratic theory, constitutional theory, and critical theory. (...) She argues that to solve these problems, the people cannot be conceived as simply a collection of individuals. Rather, the people should be seen as a series of events, an ongoing process unfolding in time. In this article there is a criticism of the thesis that defines the Spanish political transition as a successful attempt to put an end to the "law of the pendulum" that had been governing our constitutional history. On the one hand, this thesis underestimates the conditions of the Spanish situation of 1978, marked by the transit between two worlds, the modern one that inherited and the emerging postmodern, which would become an unquestionable reality from 1989. In addition, the Spanish Constitution (...) of 1978 was drafted at a time when the political-normative conceptual assumptions of the dominant constitutional paradigm in Europe after World War II were declining. Likewise, the thesis ignores the specific spanish differential feature: the civil war of 1936-1939 and the subsequent rupture and radical separation of Spanish modernity into two distinct historical sections: one initiated with the French Revolution and culminated in the most absolute destruction of the pre-existing political and social order; and another that starts in 1939, since the construction of zero of a radically new pattern of society and culture, with which the Spaniards encountered in December 1975 when they assumed their full political protagonism in a situation unprecedented and completely devoid of precedents in our national constitutional tradition. As English Studies researchers and teachers, our experience has shown that there continues to exist an urgent need to incorporate gender as a reading tool of literary texts to foster a non-discriminatory and equality perspective. Given the many advances in gender equality that have been achieved as well as the rising backlash against such progressive moves that spread through Europe, our proposal is based on the “queerification of the classroom”, a notion defined as a transgressive initiative that effectively and systematically (...) incorporates the deconstruction of normativity and fosters resistance to socially constructed assumptions about normativity and deviance. In this article, we review the Agrarian Question focusing on dairy farms. We have the dual aim of adding to the debate surrounding the economic profitability of small and large dairy farms and increasing what is known about the decline of dairy farms. The agrarian question at the heart of our research centres on the paradoxical endurance of family farms, despite predictions from both liberal and Marxist perspectives that they would diminish in number over time. By addressing these complex issues, (...) we hope to shed light on the challenges and opportunities facing the dairy industry today. We focus on analysing dairy farms in the European Union countries, using panel regressions from 2008 to 2018 to define the relationship between the average number of cows per farm, profit margins and Farm Net Income. The most important results show that (i) paradoxically, profits were higher on smaller farms; (ii) however, empirical data show that small dairy farms are disappearing; (iii) this is because when including subsidies, farms with a higher number of cows are more profitable than smaller farms. The thesis of political theology holds that all justificatory theories of the state rely on metaphysical assumptions, rather than just empirical facts and accepted political conventions. For this reason, the thesis challenges liberal theories that justify the state on the basis of individual autonomy and popular will. The thesis is controversial because many theorists believe that metaphysical assumptions introduce decisionism – the view that a state depends on the unrestrained personal decision of a ruler – to the theory of the (...) state. But, does political theology entail decisionism? This article argues that decisionism does not follow necessarily from political theology because an omnipotent deciding sovereign is only one of many possible metaphysical assumptions in theology. It illustrates this claim with examples from the philosophy of Nicholas Cusanus and process philosophy. This conclusion challenges two different entrenched views: first, that the modern state is a continuation of theistic beliefs; and second, that metaphysical discussions have no place in contemporary normative political theory. En este artículo revisaremos críticamente ese mito fundacional del diálogo socrático, mediante un análisis conversacional de los movimientos y las funciones discursivas que en él se desarrollan. Además, exploraremos la evolución moderna del género del diálogo filosófico.

On Borders asks when are borders legitimate, and it offers a new theory to answer the question. The book challenges critical and normative theories that criticize or justify borders solely in terms of identity, and instead frames borders and border legitimacy from the perspective of place and presence. Instead of thinking of borders as the exclusionary limit of identity groups, the book develops a theory of territorial jurisdictions grounded on place-specific relations, giving central roles to urban settings and the environment. This contribution offers reflections about Chilean Cybersyn, 50 years ago. In recent years, Cybersyn, has received significant attention. It was the brainchild of Stafford Beer, who conceived it to support the transformation of the Chilean economy from its bureaucratic history to hopefully create a vibrant and modern society, driven by cybernetic tools. These aspects have received much attention in recent times; however, in this contribution, I want to discuss how working in Cybersyn influenced my work after the coup of 1973. (...) Perhaps, for me, its major influence was in the management of complexity, through what I refer here as variety engineering and through the Viable System Model VSM as a paradigm to the management of relationships with implications to enterprises, society and the economy. After the 1973 coup major interest was in technological aspects of Cybersyn such as real-time management and its contribution to decision support and executive information systems. In the late 70s I was personally influenced by information management, but by the early 1980s my work moved towards methodological aspects of how to use the VSM. By 1989 I had created the VIPLAN method. Key questions I attempted to answer were, how to model the complexity of enterprises and their interactions with environmental agents. Later on, in the 1990s and 2000s, the main direction of my work was epistemological, ontological and methodological towards second-order cybernetics and relationships. Only in recent decades the political transformations proposed by Cybersyn have captured the imagination of many commentators. The confluence of social and cultural changes with information technology, data models, artificial intelligence, algorithms and several additional technological developments have challenged the excesses of capitalism, particularly after the banking crisis of 2008–2009. Resumen Las enfermedades raras o poco frecuentes constituyen un tema muy complejo desde el punto de vista socio-sanitario y también desde el punto de vista comunicativo. Afectan a menos de 5 por 10.000 personas y suelen ser graves y crónicas. La mayor parte son de origen genético por lo que, con frecuencia, se manifiestan en la etapa infantil. Apenas un diez por ciento tiene tratamientos efectivos. Son pocos los estudios que han abordado el discurso sobre estas patologías. Las ER constituyen (...) aún un tópico que podríamos denominar ‘emergente’ para los profesionales de los medios de comunicación. En este artículo vamos a analizar la representación de las enfermedades raras y de sus principales protagonistas en un corpus de 436 piezas informativas correspondientes a enero de 2014. Clinical ethics refers to an emerging field in clinical medicine that focuses on the process of ethical decision-making in a clinicalsetting. It has developed as a result of a growing awareness that modern medicine – characterized by technological progress, culturaldiversity and social challenges – is posing a range of new “ethical dilemmas” that medical science alone cannot solve. For thisreason, clinical ethics is often linked to “ethics consultation,” which consists of services provided by an individual ethicist, ethicsteam or committee to (...) address the ethical issues involved in a specific clinical case. Although clinical ethics developed in the beginningmainly as a methodological analysis to arrive at a justification for clinical ethical decisions, it quickly has become clear thatthe difficulty in clinical decision-making is only one aspect of wider ethical problems pertaining to the doctor-patient relationshipas a whole and, most likely, to the core value of the medical profession. The principles method is usually presented as the mostpopular methodological approach to an analysis of clinical cases. However, strong criticism of this model has been voiced, and otheralternative approaches are referred to, such as the casuistry model. Recently, significant contributions have been made by narrativemedicine and virtue ethics. According to these methodologies, sound anthropology and a good relationship with the sick person arekey elements required of any person engaged in medical practice who aims to be genuinely appropriate from an ethical perspective. Shared Decision-Making is a widely accepted model of the physician–patient relationship providing an ethical environment in which physician beneficence and patient autonomy are respected. It acknowledges the moral responsibility of physician and patient by promoting a deliberative collaboration in which their individual expertise—complementary in nature, equal in importance—is emphasized, and personal values and preferences respected. Its goal coincides with Pellegrino and Thomasma’s proximate end of medicine, that is, a technically correct and morally good healing decision for and with a particular (...) patient. We argue that by perfecting the intellectual ability to apprehend the complexity of clinical situations, and through a perfection of the application of the first principles of practical reason, prudence is able to point toward the right and good shared medical decision. A prudent shared medical decision is therefore always in keeping with the kind of person the physician and the patient have chosen to be. (shrink)

Returning to sport after the sports injury is a difficult decision because it’s multicausal and the fact that a rash decision can result in numerous negative consequences. Given the importance of psychological variables for the correct rehabilitation of the injured athlete and his or her optimal return to sports practice, there seems to be little information on this subject. In this sense, the objective is to determine the relationship between the subjective psychological disposition of the athlete in the process of (...) Return to Play with the type of mood profile and his mental health. This is based on the fact that each athlete evaluates his or her recovery differently and has different levels of anxiety, depression, and stress. For this purpose, four athletes participated in the study. Two males and two females from the sports of indoor soccer and soccer, who had just returned to sports after a moderate or severe injury. The average age was 24.25 years. Various measurements were taken after practices and after matches, to assess mood, psychological readiness, anxiety, stress, and depression. The results confirm Morgan’s iceberg profile and the influence that subjective psychological perceptions and assessed emotional states have on athletes’ incorporation into their sports practice with a guarantee of success. In Promoting Justice Across Borders, Lucia Rafanelli develops an ethical theory of ‘reform intervention’: a deliberate attempt to promote justice in a foreign society. The theory specifies which types of interventions are justified under what circumstances and who is justified in intervening where. Rafanelli’s theory eschews nation-states and instead makes its main actors societies with capacity for self-determination. This, I argue, can make the theory hard to apply, because different societies can overlap or intersect, and the theory’s implications change depending (...) on how one draws boundaries around groups. So the theory can give contradictory directives for the same event, depending on how one envisions the subject of intervention. The move away from states, however, may be inevitable, because contemporary problems in international relations (such as those related to climate change) cannot be easily contained within the framework of independent sovereign states in the international system. Drug-trafficking in Colombia has been a widely researched phenomenon, especially now, as the country undergoes a transition process with its older guerrilla. Now more than ever it is fundamental to examine how drug-trafficking organizations violent activities affect the consolidation of peace. This article considers different approaches to study violence derived from drug-trafficking, in order to advance towards the objectives of transitional justice. For that matter, this work is based on the idea that drug-trafficking directly generates and reproduces violence which is (...) fueled by the structural violence present in the Colombian context. My thesis is that this phenomenon deters non-repetition guarantees and weakens democracy, which is why there will be three main arguments presented that will revolve around the lack of consensus and the implications of considering drug wars as civil wars, how decisions related to the conceptual apprehension limit the competence of international humanitarian law, and the need for holistic strategies capable of facing drug-trafficking’s political and violent power. Later, alternatives will be explored around the possibilities that each argument offers, as well as which aspects could contribute to a more appropriate approach to combat drug-trafficking. Lastly, I will defend why implementing bottom-up oriented actions can advance towards transitional justice’s intermediate and final objectives, as it is the only alternative that escapes fatalist, utopian or interventionist scenarios. Contributors were asked: What will political theory look and sound like in the next century and beyond? What claims might political theorists or their descendants be making in ten, twenty-five, fifty, a hundred years’ time? How might they vindicate those claims in their future contexts? How (...) will the consistent concerns of political theorists evolve into the questions critical for people decades or centuries from now? What new problems will engage the political theorists (or their rough equivalents) of the future? What forms might those take? This contribution offers the author’s personal experience with a project that took place 25 years ago in Latin America. This was about Second Order Auditing in Colombia during the second part of the 1990s. This project was carried out at the Country’s National Auditing Office, and was an application of the Viable System Model and the Viplan Methodology to a National Context. It was an innovative project at the CGR, focused on Second Order Auditing, to improve communications within the fabric (...) of the Colombian government. Its emphasis was building responsible trust between public enterprises, ministries and political agencies. Its emphasis was building communications between ministries and public entities, with the aim of increasing their effectiveness. At its core were methodological and epistemological developments. Key questions it attempted to answer were how to model the complexity of the enterprises and how to transform the auditors’ views of their relations with people in public entities, from one focused on requesting information, to one focused on communications. Structural changes were proposed for the National Audit Office and state enterprises, and hundreds of auditors were trained, through epistemological methodological workshops, in second order auditing and the reports of their auditing were debated extensively in government and beyond. This paper finishes with a short discussion of these transformations in the light of organisational cybernetics and in particular of the Viable System Model. (shrink)

Traditionally, people, territory, and rights must align to justify state control. However, states have recently shifted their borders so that these three elements are decoupled. How should we understand state legitimacy then? This paper examines three contemporary responses to the phenomenon of shifting borders. First, sovereigntism seeks to stabilize the relation of people and territory, even if that requires limiting the scope of rights. Second, democratic cosmopolitanism tolerates shifts in territory, as long as the people and rights coincide. Finally, the (...) Watershed Model keeps rights within the territory, but it accepts changes in the people, as it separates democratic governance and rights from a particular national identity. The paper argues that the Watershed Model can better respond to the challenges posed by human mobility in times of planetary crises. Tradicionalmente, pueblo, territorio y derechos deben coincidir para justificar el control estatal. Sin embargo, los Estados han desplazado recientemente sus fronteras de modo que estos tres elementos se encuentran desacoplados. ¿Cómo debemos entender entonces la legitimidad del Estado? Este artículo examina tres respuestas contemporáneas al fenómeno del desplazamiento de las fronteras. En primer lugar, el soberanismo trata de estabilizar la relación entre pueblo y territorio, aunque para ello haya que limitar el alcance de los derechos. En segundo lugar, el cosmopolitismo democrático tolera los desplazamientos del territorio, siempre que pueblos y derechos coincidan. Por último, el modelo de la cuenca hidrográfica mantiene los derechos dentro del territorio, pero acepta cambios en el pueblo, ya que separa la gobernanza democrática y los derechos de una identidad nacional concreta. En el artículo se sostiene que el modelo de cuencas hidrográficas puede responder mejor a los retos que plantea la movilidad humana en tiempos de crisis planetaria. (shrink)

The purpose of this paper is to outline a thesis which in some ways attemts to retrieve the value of meaning as a constituent element of theories. It will be argued that theories possess in common a more or less explicit relational structure, but, at the same time, they possess a meaningful function by means of which they are instruments of knowledge or, rather, by means of which theories have the value ofknowledge in science. In conclusion, it will be suggested (...) that this approach to theories allows those with weak relational structure (social, historical theories, etc.) to be treated with a degree of adequacy by the philosophy of science. Likewise, it will be suggested that the method of semantic analysis linked to the theory of “possible worlds” could be fruitful for this purpose. (shrink)

Resumen: Las nuevas tecnologías biomédicas han planteado la posibilidad de intervenir en la capacidad de decisión sobre el bien y el mal, es decir, en la evaluación de la moralidad de los actos humanos. Aunque estas intervenciones (genéticas o neurológicas) no pretenden alterar la identidad del individuo, sus planteamientos no lo descartan. En consecuencia, el dilema entre terapia y mejora, en el contexto moral, adquiere especial relevancia. Aunque la terapia intentaría restaurar la capacidad individual para decidir entre el bien y (...) el mal, la mejora biomédica plantea otros objetivos para los que es necesario abordar los fundamentos de la entidad humana, en particular algunos conceptos filosóficos como la identidad y la autonomía. Desde la filosofía moral, el desarrollo del individuo debe estructurarse fuera del campo tecnológico y abordar una perspectiva que considere el factor relacional y la existencia del otro como elemento fundamental para alcanzar la plenitud del ser humano. Abstract: The new biomedical technologies have raised the possibility of intervening in the decision-making capacity regarding good and evil, that is, in the evaluation of the morality of human acts. Although these interventions (genetic or neurological) do not intend to alter the identity of the individual, their approaches do not rule it out. Consequently, the dilemma between therapy and improvement, in the moral context, acquires special relevance. Although the therapy would try to restore the individual capacity to decide between good and evil, biomedical enhancement raises other objectives for which it is necessary to address the foundations of the human entity, in particular some philosophical concepts such as identity and autonomy. From moral philosophy, the development of the individual must be structured outside the technological field and approach a perspective that considers the relational factor and the existence of the other as a fundamental element to achieve the fullness of the human being.
