Se propone un método paradójico para el análisis del Derecho. Este método de conocimiento consiste en una mirada a la complejidad del fenómeno jurídico, presentando sus aspectos complejos en forma de aparentes contradicciones. No son contradicciones reales, sino elementos complejos que, al constatarlos como0 dándose conjuntamente, nos permite dotar de profundidad nuestra reflexión. Hay diferentes maneras de definir la paradoja, pero aquí nos centramos en las cualidades literarias, retóricas y filosóficas que ofrece el tipo o tipos de paradoja utilizados, de (...) forma magistral, por el escritor inglés G.K. Chesterton. De las funciones de las paradojas (desde esta perspectiva, pero no solamente) son especialmente útiles para el análisis jurídico: criticar el sistema de pensamiento y abrir a la realidad. La primera se relaciona con el Derecho porque este siempre está bajo la amenaza del formalismo. La segunda se relaciona con él porque el Derecho es un fenómeno humano, de forma que, cuando hablamos de Derecho, estamos analizando la realidad compleja de la persona humana. Esta nos e puede reducir a una sola de sus dimensiones, y por ello es necesaria la paradoja, para equilibrar los distintos enfoques del análisis. Tras explicar todo esto, se procede en el artículo a sugerir siete paradojas que muestran la complejidad del fenómeno jurídico y pretenden ser retos al pensamiento. (shrink)

En este artículo explico una parte de la labor de G. K. Chesterton como crítico económico: su crítica al sistema capitalista. Con la imagen de la locura (loco sería, no el incapacitado para razonar, sino el que vive fuera de la realidad), considera al capitalismo como una locura porque su discurso es coherente pero no ofrece una vida digna para el ser humano: el capitalismo quita la libertad al proletario, le obliga a desvincularse espiritualmente de su propiedad y le desalienta (...) cuando propone alternativas económicas. Desarrollo también cómo otros autores coinciden con Chesterton, con críticas parecidas. (shrink)

Vivimos en una sociedad en la que lo digital lo ha invadido todo. Han se ha ocupado de analizar este cambio desde la perspectiva antropológica y social, con una posición radicalmente crítica. Para Han el medio digital es un medio que nos re-programa. El cambio principal consiste en que desaparece lo que Han llama la “negatividad”. La negatividad aparece como aquello que no es positivo, que no es puesto (positum) por el individuo, sino que le viene dado y se percibe (...) inicialmente como límite. Esa negatividad de lo dado tiene múltiples manifestaciones: es lo no-inmediato, lo extraño, lo otro, lo que produce pesar y resistencia. Esta transformación hacia la transparencia “es una coacción sistémica que se apodera de todos los sucesos sociales y los somete a un profundo cambio”. Esto afecta incluso al hombre mismo, que es convertido también en un elemento funcional del sistema. Han analiza esa coacción violenta de la transparencia digital, y su omnipresencia, desde distintos enfoques a lo largo de sus libros. De ellos hemos seleccionado cinco: las relaciones personales (respeto y confianza), las relaciones comerciales (el mercado), las relaciones políticas y las relaciones con la realidad, mediadas por nuestro entendimiento del espacio y el tiempo. In this paper, we explicate an underappreciated distinction between two conceptions of valuing. According to the first conception, which we call the surface-account, valuing something is exclusively a matter of having certain behavioral, cognitive, and emotional dispositions. In contrast, the second conception, which we call the layer-account, posits that valuing is constituted by the presence of certain representational mental states underlying those dispositions. In the first part of the paper, we introduce the distinction in proper detail and show that the (...) accounts have different implications regarding the valuings of agents. In the second part, we situate the accounts within the extant philosophical literature. First, we relate them to the recent debate between so-called dispositionalists and representationalists about the nature of beliefs and point out that this debate can help anticipate some of the main dialectical fault lines to be expected between surface- and layer-theorists. Second, we examine the contemporary meta-ethical debate on conceptualizing valuing, indicate that scholars have largely ignored the distinction introduced here, and outline that this oversight has substantial theoretical costs: as we show, key arguments within the meta-ethical debate require thorough re-evaluation in light of the proposed distinction. The third part of the paper illustrates the theoretical leverage of the distinction for practical research by exploring its implications for behavioral welfare economics. (shrink)

Como introducción al monográfico sobre reduccionismo y emergencia brindamos aquí un contexto teórico al debate contemporáneo. Hablaremos primero del acercamiento naturalista en filosofía (§2), así como de dos de las características más importantes de la emergencia: autonomía y universalidad (§3). Finalmente, basándonos en la literatura contemporánea (principalmente en Patricia Palacios y Jessica Wilson, además de Mario Bunge y Alicia Juarrero) presentamos algunas de las definiciones y distinciones más importantes para entender mejor el debate sobre la emergencia (§4).

Is it fair to leave the next generation a public debt? Is it defensible to impose legal rules on them through constitutional constraints? From combating climate change to ensuring proper funding for future pensions, concerns about ethics between generations are everywhere. This article aims to theoretically analyse so-called character friendship from the perspective of emotions. From this angle, our research enables us to distinguish different types of emotions, and we propose a conceptual model of the hierarchy of the emotions of character friendship and their influence on social behaviour. With this model in hand, the article discusses whether other-oriented emotions fully explain the emotional underpinnings of character friendship. We find other-oriented emotions to be ambiguous because they may or may not be (...) selfless. Thus we question whether these emotions can adequately explain the bonding content of character friendship. We conclude that there is a higher affective tier related to moral emotions and moral behaviour, which we have labelled the ‘bonding feeling’. This feeling is described with reference to its historical precedents (Rof Carballo’s ‘affective warp’), thus explaining its particularity. (shrink)

The Introduction goes on to discuss the aims of the book, which is to offer a sustained discussion of intergenerational justice as seen by practical philosophers. The first part of the book focuses on the way in which various schools of thought in moral and political philosophy approach the domain of intergenerational justice, while the second part focuses on more specific aspects, (...) such as how these theories address the question of motivation, how they deal with demographic fluctuations, or how they can be applied to real-world issues such as climate change. In an interdisciplinary discussion with an international group of experts, we address the question of why faces matter so much. We approach the issue from different academic, technological and artistic perspectives and integrate these different perspectives in an open dialogue in order to raise awareness about the importance of faces at a time when we are hiding them more than ever, be it in “facing” other human beings or in “facing” digital technology.

I present a condensed exposé of systemic materialism, a synthesis of materialism and systemism originally proposed by Mario Bunge. Matter is identified with mutability of propertied particulars, and a concrete or material system is defined as an object with composition, structure, mechanism, and environment. I review different aspects of this ontology, and discuss some of its implications for epistemology, ethics, and aesthetics. I also try to identify some problems of this view and offer some ways to overcome the difficulties. The concept of ideology is central to the understanding of the many political, economic, social, and cultural processes that have occurred in the last two centuries. And yet, what is the nature of the different ideologies remains a vague, open, and much disputed question. Many political, sociological, and ideological studies have been devoted to ideology. Very little, on the other hand, has been done from the philosophical field. And this despite the fact that there are undoubtedly many philosophical questions related (...) to ideology and its role in modern industrialized societies. Just a few examples of ideology-related philosophical questions suffice to prove the point: What objects do ideologies deal with? Are the ideologies testable? Are there true ideologies? Do they evolve? How are ideologies related to societies? Is the existence of ideologies inevitable in modern societies? What is the relation of ideology to science? Is science just another kind of ideology? Are we, as human beings, innately predisposed to believe in ideologies? Or, instead, ideologies proliferate through indoctrination and propaganda? Are ideologies necessarily harmful?...and much more. In this article I try to answer some of these questions from a philosophical point of view, taking a materialist approach. I begin by characterizing ideology as a complex, multi-layered concept. Then, I briefly discuss the material systems on which ideological movements operate, that is, societies and concrete human groups. I identify at least 11 different elements that seem to be present in most ideologies, and I compare these characteristics with those of contemporary science and technology. Although some superficial similarities can be identified, there are deep differences that make ideology completely different from science. The similarities, however, are stronger with technology. Ideologies continually evolve with technological advances, social changes, and even with mere fashion. The current fragmentation of ideologies caused by the widespread use of new technologies and social networks has given rise to new phenomena of ideological propagation which, in my opinion, are very dangerous, particularly for open societies. I discuss these processes, within the context of the nature vs nurture debate, along with the question of whether we can get rid of ideologies. (shrink)

En esta investigación intentaremos explicitar hasta qué punto Ser y Tiempo es una suerte de tentativa por retomar, en forma correcta, el originario proyecto filosófico que Kant desplegó en su Crítica de la razón pura. Para lograr justificar nuestra conjetura nos centraremos especialmente en la obra de Heidegger Kant y el problema de la Metafísica (1929). En dicho texto nos encontraremos con una controvertida interpretación que el pensador de Meßkirch elaboró del opus magnum de Immanuel Kant. Interpretación que, justamente, podría (...) sugerirnos que su Ser y Tiempo, no sólo estaría hermanado con la Crítica de la razón pura, sino que vendría a ser una correcta continuación del camino allí trazado por el filósofo de Königsberg. Después, argumentaré que la fundamentación no es una medida de complejidad física, y que, sin un vínculo necesario con la complejidad, quedan pocas razones para pensar que la fundamentación une a los diferentes estratos de la realidad física, que es una de las (...) motivaciones más importantes para introducir relaciones de dependencia (§3). En este artículo se presenta una caracterización del concepto de falacia, con énfasis en la llamada ‘falacia de apelación a lo natural’. Se explica el alcance de esta falacia, y su peligrosidad, en particular en el ámbito de las ciencias de la salud y de alimentos.

El presente artículo realiza un estudio de la recepción en España de la Teoría crítica de la Escuela de Fráncfort, desde la década de los 60 del siglo XX hasta la actualidad. La originalidad de este trabajo es su pretensión de analizar este proceso de recepción académica y cultural sobre el trasfondo de los grandes cambios políticos que afectaron al país en este periodo. Las modificaciones del contexto político han sido adoptadas aquí como una clave interpretativa adicional y complementaria a (...) las interpretaciones intra-teóricas para iluminar en su complejidad y en sus sorprendentes vaivenes la recepción de esa corriente de pensamiento en nuestro país. El resultado es una consideración historizadora de las fases de esta recepción que posibilita y pretende impulsar una reflexión crítica de los investigadores de este ámbito sobre su pasado y su presente. The COVID-19 pandemic has changed the lives of millions of people around the globe and some of the unprecedent emerged disruptions, are likely to have been particularly challenging for young children. Studying the impact of such extraordinary circumstances on their well-being is crucial to identify processes leading to risk and resilience. To better understand how Spanish children have adapted to the stressful disruptions resulting from the pandemic outbreak, we examined the effects of child coping and its interactions with contextual stressors (...) on child adjustment, incorporating in our analysis a developmental perspective. Data was collected in April 2020, through parent-reports, during the acute phase of the pandemic and, temporarily coinciding with the mandatory national quarantine period imposed by the Spanish Government. A sample of 1,123 Spanish children aged 3 to 12 participated in the study. Results showed differences in the use of specific strategies by children in different age groups. Despite the uncontrollable nature of the pandemic-related stressors, child disengagement coping was distinctively associated to negative outcomes, whereas engagement coping predicted psychosocial adjustment across all age groups. Moreover, interactively with child coping, parent fear of the future and parent dispositional resilience appear as relevant contextual factors to predict both negative and positive outcomes, but their effects seem to be age dependent, suggesting a higher contextual vulnerability for younger children. These findings might have implications for identifying individual and contextual risk and informing potential preventive interventions aimed to reduce the impact of future pandemic outbreaks on children of different ages. El estudio buscó evaluar los niveles de dominio de las competencias investigativas en posgraduados de Perú y Ecuador desde un enfoque pedagógico socioformativo. Se desarrolló bajo el método deductivo de alcance descriptivo. El análisis de los resultados ubica a los posgraduados de ambos países en el nivel medio o resolutivo, lo cual indica que existen competencias aceptables y suficientes para investigar, pero no logran expresarse eficientemente ni de manera creativa e innovadora. Asimismo, existen limitaciones en el afrontamiento de distintas competencias (...) inherentes a la investigación científica. (shrink)

La técnica forma parte de la naturaleza del ser humano. Pertenece a su esencia desde su transformación de homo naturalis a homo faber. Siguiendo a Ortega y Gasset (1939), el ser humano como ser natural es un animal biológicamente menesteroso y necesitado ante los retos y dificultades que le presenta la naturaleza. Su salvación –la superación de los obstáculos que lo hubieran conducido casi con toda probabilidad a su extinción como especie– ha radicado en el desarrollado de su capacidad técnica. (...) Mediante ella el ser humano ha podido construir sobre la naturaleza un medio artificial. Es a ese medio al que el ser humano se viene “ajustando” desde su principio como tal ser humano. En ese proceso ha invertido el proceso de adaptación a la naturaleza común y corriente entre el resto de los seres vivos. El ser humano no se adapta a la naturaleza, sino que la naturaleza –filtrándose a través del medio artificial que dicho ser construye sobre ella– se adapta al ser humano. En resumen, la técnica le permite al ser humano construir un medio artificial –una supranaturaleza–. Es a ese medio al que se adapta, venciendo de este modo su estado de precariedad y superando así las limitaciones que le vienen impuestas por los dictados de la naturaleza a la hora de satisfacer sus necesidades. Sin técnica, en definitiva, no habría ser humano. Si esto es así, ¿debemos sujetar la técnica a control o debe ser autónoma? Técnicamente, todo cuanto pueda hacerse, ¿debe hacerse? No perdamos de vista a la hora de responder a estas cuestiones que, en la actualidad, las nuevas tecnologías están posibilitando alcanzar metas hasta hace poco tiempo impensables, ¿las limitamos? Y, si lo hacemos, ¿cuáles son los límites? (shrink)

The European Universities Initiative (EUI), created by the European Commission in 2017, is a recent novel phenomenon within the European Union policy toolkit that explicitly targets the development of transnational cooperation in higher education (HE). To date, the EUI counts 44 European university alliances, involving around 340 HE institutions. In this paper, we argue that the EUI can be seen as a case of a transnational institution building process representing a potentially significant structural reform for European higher education. Anchored in (...) new institutionalism, we explore the regulative, normative, and cultural-cognitive dimensions of the EUI. Methodologically, this study analyzes the perspectives of European policy actors (n = 4), a set of policy documents (n = 13) and the mission statements of the EUI’s partnerships funded before 2022 (n = 41). The results show that the EUI emerges as the ‘next level of cooperation’ in European HE since it aims to transform European cooperation (regulative dimension), to create and diffuse a new model for European HE following a challenge-based approach (normative dimension), and to work as a way to reinforce and institutionalize European and global scripts for European HE (cultural-cognitive dimension). We continue investigating variants of the splitting and reaping numbers introduced in [4]. In particular, answering a question raised there, we prove the consistency of and of. Moreover, we discuss their natural generalisations $\mathfrak {s}_{\rho }$ and $\mathfrak {r}_{\rho }$ for $\rho \in (0,1)$, and show that $\mathfrak {r}_{\rho }$ does not depend on $\rho $.

Scientific knowledge relies heavily on models, shaped by simplifying assumptions, with common categories being abstraction and idealization. This article aims to expose conceptual challenges inherent in conventional interpretations of these concepts, particularly in their practical application to scientific modeling. The primary hurdle emerges in applying these categories to real­world instances of scientific modeling, which we illustrate with examples of non­causal explanations. Key issues revolve around (i) the ambiguous distinction between abstraction and idealization and (ii) the application of the simplifying assumption (...) of abstraction. Our hypothesis posits that non­causal explanations face unintelligibility due to an unclear understanding of the role of simplifying assumptions in them. To test this, we analyze selected examples, ranging from (toy­)examples to real­world instances, scrutinizing the alignment with the standard notions of abstraction and idealization. Throughout, we investigate the influence of simplifying assumptions on these explanations, assessing their adherence or deviation from conventional concepts. (shrink)

Ensayo introductorio para mi traducción del influyente artículo "Essence and Modality" de Kit Fine.

Fowers et al. recently made a general argument for virtues as the characteristics necessary for individuals to flourish, given inherent human limitations. For example, people can flourish by developing the virtue of friendship as they navigate the inherent human dependency on others. This general argument also illuminates a pathway to flourishing during the COVID-19 pandemic, the risks of which have induced powerful fears, exacerbated injustices, and rendered life and death decisions far more common. Contexts of risk and fear call for (...) the virtue of courage. Courage has emerged more powerfully as a central virtue among medical personnel, first responders, and essential workers. Longstanding inequalities have been highlighted during the pandemic, calling for the virtue of justice. When important personal and public health decisions must be made, the central virtue of practical wisdom comes to the fore. Wise decisions and actions incorporate the recognition of relevant moral concerns and aims, as well as responding in fitting and practical ways to the specifics of the situation. Practicing courage, justice, and practical wisdom illuminates a path to flourishing, even in a pandemic. (shrink)

This thesis makes two claims: first, that conflict is constitutive of human agency, and second, that this understanding of agency in terms of conflict makes politics a problem about the will. I develop an argument to show how these two claims weave together to create the fabric of Kant’s account of political willing. From this Kantian approach to conflict and agency, the systematic question animating this thesis thereby arises: what are the conditions that make political willing possible? This thesis defends (...) the notion of political willing as a placeholder for a number of inter-woven conditions that make political life in common possible. As a form of rightful interaction between free agents of choice, this form of willing emerges in Kant from the constitutive features of what it means to be an agent in a world with others agents. This relation between agents makes conflict unavoidable, a conflict which only a will that is public, omnilateral, and coercive, can rightfully resolve. I trace the development of this model of political willing in three spheres of Kant’s thought: individual ethics, teleology, and politics. I conclude that Kant’s view of politics is, in some ways, more Hobbesian than Hobbes’: for Kant, conflict cannot and should not be fully eradicated, if we are to take seriously equality between agents. Life under the state is not conflict-free, but rather it is a sphere made to preserve and to safeguard the boundaries of a shared political life, always prone to conflict. (shrink)

We propose a new interpretation of the equation E=mc² in special relativity by generalizing ideas of ontological emergence to fundamental physics. This allows us to propose that mass, as a property, can be considered to emerge from energy, using a well-known definition of weak ontological emergence. Einstein’s famous equation gains in this way a clearer philosophical interpretation, one that avoids the problems of previous attempts, and is fully consistent with the kinematic properties of special relativity, while yielding fresh insights concerning (...) the nature of mass. ABSTRACT There has been extensive debate among various disciplines about the nature and value of play. From these discussions it seems clear that play is a phenomenon with more than just one dimension: as a specific type of activity, as a form or structure, as an ontologically distinctive phenomenon, as a type of experience, or as a stance or an attitude towards a particular activity. This article focuses on the importance of the playful attitude in sport. It begins by attempting (...) to describe the underpinning features of a playful attitude, and its relation to Suits’ lusory attitude and the concept of gamification. Finally, it considers and critically evaluates the relationship between play and sport and the importance of the playful attitude in sporting activities. The purpose of this paper is a far deeper analysis of the playful attitude and its relationship to sport than has been previously provided, and a more precise definition as to what the playful attitude is. This will ultimately help to answer questions about the value of sport and how sport ought to be played. (shrink)

O presente artigo visa discutir a função introdutória do capítulo I do _Tratado Político _de Espinosa. Para tanto, ressaltaremos alguns aspectos fundamentais presentes no movimento argumentativo do texto, como a centralidade dos afetos para o raciocínio político e a necessidade de um método investigativo que articule experiência e razão.

En esta nota ofrezco una caracterización de los conceptos de experiencia estética, valor estético y belleza.

En este artículo discuto cómo es que la idea intuitiva de que las cosas podrían cambiar, combinada con principios excesivamente plausibles, nos lleva a la paradoja de Chisholm. Arguyo que la mejor respuesta a esta paradoja –pues efectúa la menor mutilación a nuestros principios teóricos y asunciones intuitivas– es la postura esencialista. Primero expongo algunas motivaciones para hacer una teoría metafísica que explique la modalidad de re. Luego reviso los principios a los que estaremos regresando en el curso del artículo. (...) Entonces muestro cómo ellos, conjuntamente, implican la paradoja de Chisholm. Después reviso las posibles fuentes de esta paradoja, rechazando varias salidas posibles. Argumento que la fuente de la paradoja está en que nuestros principios teóricos son demasiado liberales, y que la opción esencialista subsana este defecto. (shrink)

En el siguiente ensayo se reflexiona en torno a la propuesta de Emmanuel Levinas y su concepción de ética de la alteridad como un puente para enlazar con La ética de la Tierra, planteada por Aldo Leopold y así evolucionar el objeto de la ética de una alteridad que se refiere “al otro” para referirse a “lo otro” y poder hacer de los seres no humanos un objeto de obligaciones morales.

Ofrezco una justificación breve del valor de la actividad científica y una vindicación de su defensa.

Per the OpenNotes directive of the 21st Century Cures Act implemented in 2021, patients and their legally recognized representatives must be able to access the electronic medical record in real time. This is an opportunity for clinical ethicists and other providers to reflect on their charting practices, particularly how and when they quote patients. Although using direct quotations is common because it seems to avoid misinterpretation, it may not always be appropriate. In this article, we discuss some of the risks (...) and benefits of quoting in the context of OpenNotes and provide suggestions for how clinical ethicists can leverage their unique position to help mitigate some of these risks and promote more reflective charting practices among the teams they work with. This special issue looks at some of the ways that images are adopted, co‐opted, and adapted in the life sciences and beyond. It brings together papers that investigate the role of visualization in scientific knowledge‐production with contributions that focus on the distribution and dissemination of knowledge to a broader audience. A commentary provides a critical perspective. In this editorial we introduce circulation as a practice to better understand scientific images. Along two themes, we highlight connections across the papers. First, the (...) social life of scientific representation follows the contexts, settings, and spaces through which images circulate. Second, authorship, expertise, and trust inform the capacity and the failure of images to circulate. Altogether, this volume raises a set of new questions about circulation as practice in the historiography of images in the life sciences. (shrink)

Teaching and research are organised differently between subject domains: attempts to construct typologies of higher education institutions, however, often do not include quantitative indicators concerning subject mix which would allow systematic comparisons of large numbers of higher education institutions among different countries, as the availability of data for such indicators is limited. In this paper, we present an exploratory approach for the construction of such indicators. The database constructed in the AQUAMETH project, which includes also data disaggregated at the disciplinary (...) level, is explored with the aim of understanding patterns of subject mix. For six European countries, an exploratory and descriptive analysis of staff composition divided in four large domains (medical sciences, engineering and technology, natural sciences and social sciences and humanities) is performed, which leads to a classification distinguishing between specialist and generalist institutions. Among the latter, a further distinction is made based on the presence or absence of a medical department. Preliminary exploration of this classification and its comparison with other indicators show the influence of long term dynamics on the subject mix of individual higher education institutions, but also underline disciplinary differences, for example regarding student to staff ratios, as well as national patterns, for example regarding the number of PhD degrees per 100 undergraduate students. Despite its many limitations, this exploratory approach allows defining a classification of higher education institutions that accounts for a large share of differences between the analysed higher education institutions.
