Obituario de nuestro compañero Rogelio Rubio.

El siguiente informe pericial se basa en la experiencia de investigación de los firmantes en relación a las exhumaciones de fosas comunes de la Guerra Civil y la postguerra, y al conocido como “movimiento para la recuperación de la memoria histórica” que están teniendo lugar en España desde el año 2000, que ha enfatizado sus demandas sobre la suerte de los desaparecidos y ha puesto en marcha un ciclo de exhumaciones de fosas comunes derivadas de la Guerra Civil y la (...) dictadura. En este peritaje se usan las exhumaciones del siglo XXI como indicadores de la persistencia en el tiempo de las políticas y culturas del miedo instaladas en la sociedad española durante la Guerra Civil y la dictadura, más allá de las profundas transformaciones políticas e institucionales acaecidas en el país tras la muerte de Francisco Franco. Fue presentado como parte de la documentación de la demanda de Fausto Canales contra España el 15 de septiembre de 2012 en el Tribunal Europeo de Derechos Humanos. (shrink)

Psychological flexibility is a key concept of acceptation and commitment therapy. This factor has been linked with psychological wellbeing and associated factors, such as quality of life, in cancer patients. These and other positive results of acceptation and commitment therapy in cancer patients found in previous research could be enhanced by using mhealth tools. A three-arm randomized superiority clinical trial, with a pre-post-follow-up repeated measures intergroup design with a 1:1:1 allocation ratio is proposed. A hundred and twenty cancer patients will (...) be randomly assigned to one of the following interventions: face-to-face ACT + mobile application, face-to-face ACT, and Waitlist control group. The primary expected outcome is to observe significant improvements in psychological flexibility acceptance and action questionnaire- II in the face-to-face ACT + app group, after comparing baseline and post-treatment scores, and the scores will remain stable in the two assessment points, 3 and 6 months after the intervention. Secondary expected outcomes are significant increasing scores in quality of life and post-traumatic-growth, and significant decreasing scores in anxiety and depression, insomnia and fatigue at the same assessment points. Also, it is expected that the scores of this group will be higher than the scores of the face-to-face ACT group and the waitlist control group. This study aims to assess the efficacy of a combined intervention for psychological flexibility and associated symptoms in cancer patients. The results of this protocol may help to consider the use of acceptation and commitment therapy and mhealth applications in cancer settings as a valid therapeutic choice.Clinical Trial Registration[www.ClinicalTrials.gov], identifier [NCT05126823]. Playing traditional games has a direct impact on the mood states of the players, and this is the reason why physical education is an ideal setting for teaching how to recognize them and be aware about how they can swing. The objective of the study was to determine if participating in traditional opposition games causes changes to the participants' mood states. A total of 102 students participated. Each participant recorded the intensity of the mood state experienced at the beginning and (...) at the end of the sessions, using the validated Profile of Mood States instrument. The pedagogical experience was planned as 4 sessions with 6 and 5 opposition games each: with competition in mixed groups, equally and unequally mixed; without competition in mixed groups, equally and unequally mixed; with competition in same-gender groups; and without competition in same-gender groups. When comparing the different mood states according to session, the mood states of the depression, fatigue, and vigor dimensions were significantly different, with higher scores in the sessions with competition for the mood states of vigor and fatigue. Also, when comparing the mood states depending on session grouping and group type, the results showed differences in the scores obtained for the dimensions fatigue and anger, and general mood state. These differences were found at the start of the session and at the end, with the dimension fatigue being the only one with differences in both situations when comparing the same-gender, equally-mixed, and unequally-mixed groups for the two types of traditional opposition games compared. In addition, after an analysis of the mood states depending on gender was performed, the results and therefore the significant differences found, were very similar to those obtained according to group type. Lastly, it was concluded that the type of group, and gender were decisive, causing variations in the mood states of the students. This provides valuable information for teaching professionals about the structuring and organization of PE sessions, aiming to promoting positive motor experiences. (shrink)

COVID-19 is an acute respiratory illness with higher mortality in older adults. This condition is spread person-to-person through close contact, and among policies employed to decrease transmission are the improvement of hygiene habits and physical distancing. Although social distancing has been recognized as the best way to prevent the transmission, there are concerns that it may promote increased depression symptoms risk and anxiety, mainly in older adults. This cross-sectional study aimed to verify self-concept of social distancing in adults compared to (...) older adults. All participants, over 18 years and residents of São Paulo state, were invited to join this research study by a message application and answered an interdisciplinary questionnaire during the period from May 23 to June 23, 2020. The questions were divided into the following aspects: sociodemographic data, financial conditions, routine-related perception, perception of health, physical and emotional state, and eating habits. The younger adult group was composed of 139 participants, with a mean age of 43.15 years, and the older adult group was composed of 437 participants with a mean age of 67.59 years of both sex. Changes in routine during the period of social distance were reported by 95% of adults and 96.8% of older adults, but adults indicated more significant alterations in routine. Although there was no difference between groups for several aspects, adults revealed greater alterations in sleep quality, evacuation frequency, and more difficulty to perform daily activities at home. Further studies are necessary to follow up the impacts of social distancing among adults and older adults in different socioeconomic contexts to better understand the long-term alterations and the necessity of interventions. Background The COVID-19 pandemic has influenced the approach to the health-disease system, raising the question about the principles of bioethics present in physician–patient relations. The principles while widely accepted may not be sufficient for a comprehensive ethical analysis. Therefore, the aim of this study was to explore the perception of these principles and the physician–patient relationship during a hospital stay through a qualitative approach. Method Sixteen semi-structured interviews took place to know the patients’ perception during their 2020 hospitalization for COVID-19. (...) The data was analyzed through the constant comparison method, creating categories and comparing them. In the end, seven categories were established and were grouped in three: bioethical principles (dignity, charity, vulnerability, autonomy), doctor-patient relationship (participant commitment, informed consent, health staff-patient relationship) and the experience of the disease (illness, the role of the family). Results The research found that most patients described a positive experience, with the feeling of having been well cared for with no sense of discrimination or injustice done. The majority also reported that their autonomy was respected in the treatment decisions. The evaluation of these attitudes is an area of opportunity, especially when the patients' vulnerability is at risk. Conclusions The ethics of virtue offers a better reflection of how human beings manifest themselves by emphasizing the development of virtuous character and behaviors that allow them to realize their values in life. Assessing physical fitness has emerged as a proxy of the health status of children and adolescents and therefore as relevant from a public health point of view. DAFIS is a project included in Plan Galicia Saudable of the regional government of Galicia. DAFIS consists of an on-line software devoted to record the results of a standard physical fitness protocol carried out as a part of the physical education curriculum. The aims of this study were: to obtain normative values of physical (...) fitness of the Galician school population evaluated in the DAFIS project, and to identify a reduced number of components and tests able to capture a significant amount of the variability in the physical fitness of children and adolescents. From an initial sample of 27784 records, 15287 cases were considered after filtering. Generalized Additive Models for Location, Scale and Shape were used for obtaining percentile curves and tables for each sex. Furthermore, a principal components analysis was performed, selecting the number of components by applying the Kaiser’s rule and selecting a subset of variables considering the correlation between each variable and the components. Percentile curves and normative values are reported for each test and sex. Physical fitness was better in boys than in girls throughout age groups, except for flexibility that was consistently higher in girls. Two main components were detected throughout age groups: the first one representing body composition and partially cardiorespiratory fitness and the second one muscular fitness. For boys and girls, waist to height ratio had the highest correlations with the first component in four out of six age groups. The highest correlation with the second component, was most frequently observed for the handgrip test both in boys and girls. This study provides evidence about the utility of school community actions like DAFIS aimed to track the health-related fitness of children and adolescents. The results suggest that fat mass distribution and muscular performance concentrate a high proportion physical fitness variance. (shrink)

The World Health Organization, in its last review of its International Classification of Diseases, established a new classification for chronic pain. Among the principal categories, of particular interest is chronic primary pain as a new type of diagnosis in those cases in which the etiology of the disease is not clear, being termed as chronic primary visceral pain when it is situated in the thorax, abdomen, or pelvis. Due to the novelty of the term, the objective of the systematic review (...) was to examine the psychopathological and neuropsychological disorders associated with chronic primary visceral pain. We carried out a search of the scientific literature following the PRISMA directives using the Pubmed, Medline, PsycInfo and Scopus databases. A total of 33 articles were selected after applying the inclusion and exclusion criteria. The analysis of the studies showed that most persons with chronic primary visceral pain suffer from at least one psychological disorder; the most prevalent being anxiety, depressive or somatoform disorders. The most frequent psychopathological symptoms are anxiety, depression and somatization. Similarly, the findings are insufficient to determine the existence of deficits in the domains of executive functioning, memory and intelligence. However, the existence of attention biases does seem to be clear. This review supposes a starting point for conceptualizing chronic primary visceral pain. It is necessary to continue further research so as to obtain a better understanding of this pathology and the disorders associated. (shrink)

Gracias a la extraordinaria difusión (...) del _Teatro_ y de otras de sus obras en la península, en América y en partes de Europa, Feijoo ejerció una enorme influencia intelectual -una autoridad que posiblemente no haya logrado ningún otro autor posterior en lengua española-. Si este marco de reforma que propugnaba acabó logrando sus frutos en el último tercio del siglo XVIII es otro asunto, pero no cabe duda de que Feijoo fue -utilizando conscientemente un anacronismo- el intelectual público de su época. For the philosopher of Rotterdam, religious coercion has two essential sources of illegitimacy: the linking of religious and ecclesiastical belief and the use of politics for religious purposes. Bayle responds to it, with his doctrine of freedom of conscience, on one hand and by means of the essential distinction between voluntary religious affiliation and political obligation, on the other hand. From my perspective, his doctrine of tolerance does not involve an atheist state, nor does it mean the rejection of the (...) presence of religion in the public space or its displacement to the intimate sphere of the conscience. This paper proposes a reading of Baylean tolerance as a political doctrine that allows the articulation between freedom of conscience, minority confessions, and official religion. Thus, the Baylean theoretical model could be considered a proposal to provide a normative form to the practice of toleration present in the seventeenth -century Netherlands. (shrink)

For most interpreters of the philosopher from Rotterdam, his political doctrine is solely a consequence of his religious and moral doctrines, and so an image of Bayle as a political philosopher is not usually presented. To my mind, however, only by analyzing his political doctrine can the extent of his religious proposal be understood. In this article, I intend to show that both the Baylean criticism of popular sovereignty and his rejection of the right of resistance are analyses that are (...) indissociable from the Baylean doctrine of tolerance. The protection of individual freedom of conscience and the defense of a multi-confessional state model, tolerant regarding religious minorities, can only be articulated as historical reality if they rest on the political doctrine of indivisible sovereignty and on the strictest separation between political obedience and religious membership. In this article, we will analyze the redefinition that Hobbes applies to the essential elements of Protestant biblical hermeneutics in the Leviathan. Establishing who is the authorized interpreter, defining the rules for conducting a proper exegesis, and determining the content that results from both tasks, is of utmost importance. The answers to these three questions lay the foundation for a new relationship between civil and ecclesiastical power and fully immerse Hobbes in the theological-political discussion of the 17th century.

Durante siglos, se consideró un deber del buen cristiano obligar, a todos los hombres a entrar en el seno de la Iglesia, puesto que de ello dependía su salvación eterna. Esta doctrina presupone que existe una nítida diferencia entre verdad religiosa y error. Para Bayle, sin embargo, la creencia religiosa solo puede aspirar a convertirse en una verdad putativa, sustentada en la convicción subjetiva del fiel, concepción que le permite desdibujar el propio concepto de herejía y criticar las persecuciones religiosas (...) de su tiempo. In this article, I discuss the Protestant contribution to the modern concept of autonomy on the basis of an analysis of John Calvin's moral theology. I show that Calvin affirms our incapacity to know and want what is morally good, as expressed by natural law. Such incapacity is compensated for by the biblical mandates that, according to Calvin, should be incorporated into the positive legislation of Christian republics. In view of all this, I conclude that Calvin is far from the (...) Kantian idea of autonomy which defines our Modernity. (shrink)

En este artículo analizamos la contribución de la teología protestante a la idea de autonomía moral a partir de un análisis de la obra de Juan Calvino. Mostramos cómo se afirma en ella la incapacidad del sujeto para conocer y querer el bien, manifiesto en la ley natural. Esta incapacidad es compensada con los mandatos bíblicos, para los que Calvino justificará una positivación jurídica en los Estados cristianos. Concluimos, por todo ello, que Calvino está lejos de la idea kantiana de (...) autonomía que consideramos distintiva de la Modernidad. (shrink)

Freedom as a natural right, the importance of consent, defending the idea that government should be in the hands of the most virtuous and reflective citizens, denouncing patronage, the need to link individual and political freedom ? These are some of the characteristics of La Boétie's doctrine that I believe place him within the tradition that Quentin Skinner calls the neo-Roman conception of civil liberty. Of course, La Boétie did not write a positive defence of the rule of law, as (...) Livy did in his History of Rome and as the English republicans do, but the Discourse can easily be read as a legal plea condemning absolute monarchy and any kind of arbitrary regime. (shrink)

Este artículo analiza los fundamentos doctrinales del derecho penal eclesiástico calviniano, asentado teóricamente en la teología del pecado original y cuyo ejercicio toma forma en la práctica del Consistorio ginebrino. Asimismo, explora las razones de la diferencia entre derecho penal eclesial y civil. Y es que, aunque en el calvinismo la Iglesia y el Estado son titulares de un ius gladii, sólo uno de estos sistemas penales puede reivindicar el ejercicio de la pena corporal, el otro tan sólo puede reclamar (...) un castigo espiritual: en esto haremos radicar la diferencia entre derecho y disciplina. El derecho de coacción propiamente dicho pertenece en exclusiva al Estado como tal y ni el individuo ni la Iglesia pueden reclamarlos para sí. Estamos ante una aportación fundamental de la Reforma a la historia del derecho. (shrink)

It is usually assumed that political modernity and the reformation go hand in hand. Authors such as Hegel, Tocqueville, Jellinek or Martha Nussbaum find in the protestant reformation the origin of ideas such as political freedom or freedom of conscience. In this paper, I will try to analyze the relationship between these two concepts in two fundamental characters in the Calvinist tradition. John Calvin, its founding father, on the one hand, and, on the other, Pierre Bayle, the Rotterdam philosopher who (...) pushed Calvinism to its most heterodox forms in the XVII century. I will show how they both understand the interpretation of the Bible and the political arrangements that they defended for their close context. (shrink)

The topic I address in this paper is whether the independence of Church and State brought about by the Lutheran Reformation tantamounted to the secularisation of the latter. Taking into account two recent essays by Harold Berman and John Witte on the Lutheran contribution to the Western legal tradition, I argue that Luther’s criticism of the catholic doctrine of Papal power came hand in hand with a theologization of the foundations of the authority of the State, which is difficult to (...) deem «secular». Suele argumentarse que la contribución original de la Reforma a la teoría de la resistencia se basa en una exégesis del pasaje paulino de Romanos, según la cual sólo se debe obediencia a las autoridades que obran en favor del interés general. De ahí se derivaría una teoría constitucionalista de la resistencia protestante, que tendría en Calvino a uno de sus principales inspiradores. Sin embargo, en el derecho de resistencia calviniano la ciudadanía no es concebida como sujeto político en sentido (...) estricto: el pueblo no es ni el fundamento de la autoridad ni puede reemplazarla o resistir si incumple sus deberes religiosos, sociales o políticos. La resistencia activa no está justificada más que como excepción y su motor es únicamente otra autoridad legitimada divinamente, esto es, que ocupe un oficio público, es decir, un tutor. La existencia de una tutoría semejante implica reconocer la incapacidad jurídica del menor tutelado, esto es, el pueblo. Difícilmente puede hablarse aquí de constitucionalismo o democracia. El análisis de las ideas del reformador en el contexto en el que fueron puestas en práctica apoyará esta tesis. (shrink)

For most interpreters of the philosopher from Rotterdam, his doctrine of tolerance is solely a consequence of his religious and moral doctrines. In this article, I intend to show that his doctrine rest on the political doctrine of indivisible sovereignty and on the strictest separation between political obedience and religious membership. Baylean tolerance is a political doctrine that allows the articulation between freedom of conscience (individual), minority confessions (private associations), and public religion (acknowledged as official).

Pierre Bayle and the impossibility of a rational debate on evil I claim that Bayle engaged with theodicy in order to show how philosophy was misused in religious matters. For Bayle, the debate on evil does not oppose dichotomically reason and religion, it just requires that the participants deal with revealed truths using reason alone. In this regard, Bayle does not only criticize the Calvinist theologians of his time, but also the very source of Christian theology, Augustine of Hippo. En (...) ese artículo, sugerimos que el debate sobre la teodicea bayleana tiene por finalidad hacer patente el uso ilegítimo que se hace de la filosofía al aplicarla al debate religioso. La discusión sobre el mal no supone una disputa entre la razón en sentido absoluto y la religión, sino que compromete el uso de la razón en la revelación, de modo exclusivo Por esa razón, como veremos, el filósofo de Rotterdam no limita su crítica a la teología calvinista de su tiempo sino que la dirige al mismo corazón de la teología cristiana: la obra de Agustin de Hipona. Calvin was a man of the Church so his political doctrine stems from his ecclesiology, in response to both the Papal doctrine on the delegate power of the magistrates, and the Lutheran subordination of the Church to the civil authorities. He was not concerned with discussing the best possible regime, but rather with preparing a theological justification of civil power that would make it depend exclusively on God, not on the people. I will hold that Calvin states the people’s function (...) is merely instrumental: they accept the authority chosen by God, but do not institute it. The only really relevant element is that both political vocation and the transmission of power that is indispensable to it, derive uniquely and exclusively from God. The discrepancies apparent in different authors’ interpretations can be clarified by recovering the context of his argumentation. This is the objective of this article. (shrink)

This paper discusses the reach of ecclesiastical power in Hobbes' Leviathan, examining how the State acquires some of the roles traditionally played by the Church. I will first contextualize historically the ecclesiological debates on which Leviathan draws. Then, I will examine the essential role Hobbes assigns to the king in the governance of the church. Although Hobbes' political theology is often deemed atheist, in Leviathan the king becomes the institutional head of the Church. Moreover, he should establish a minimal Christian (...) creed to be shared by his subjects, in order to preserve religious peace among the different churches of his kingdom. (shrink)

In this paper, we try to show that the existing Spanish secular model should be defined in terms of collaboration. Religious freedom is interpreted by Spanish judges in a Catholic framework, as an implementation of the Second Vatican Council's Declarations and Constitutions. In this sense, the Catholic Church has managed to impose its authority through privileged agreements with the Spanish State. _Keywords:_ religious freedom, secularism, Spain, religious law.

Para muchos, el sujeto moderno se origina en la Reforma protestante. Si esto es así, deberíamos encontrar el embrión de estas ideas fundacionales en los textos políticos de Juan Calvino (1509-1564), reformador de Ginebra y padre de una de las corrientes principales del protestantismo. Sin embargo, frente al tópico, el lector encontrará en esta selección de escritos políticos, a un Calvino para quien Dios sigue siendo la fuente de toda autoridad, el pueblo carece de cualquier tipo de legitimidad política y (...) la Biblia ha de ser la fuente de inspiración moral y social. Sin embargo, su influencia es innegable en debates tan centrales para laposteridad como las disputas sobre el derecho de resistencia durante las guerras de religión en Francia, la tolerancia política en la Holanda del siglo XVII, o la vinculación entre libertad política y libertad de conciencia del siglo XVIII americano. Esta edición pretende poner en evidencia la complejidad del legado de Calvino. (shrink)

Le travail mené par Jonathan Israel dans sa trilogie sur les Lumières aurait fourni des éléments pour une critique de la théologie comme fondement de la politique moderne et, de ce fait, il nous aurait offert une critique indirecte à l’œuvre de Carl Schmitt. Schmitt et Israel souscrivent à l’analyse des idées majeures que Spinoza hérite de la modernité. En revanche, ils ne s’entendent pas sur l’appréciation de cette contribution ni sur le sens qu’il faut donner à cet héritage. Tandis (...) que Spinoza s’avère être l’ennemi par excellence pour Schmitt – juif, libéral et paradigmatique −, il représente pour Israel le pilier du républicanisme démocratique; alors que pour le premier le pêché originel implique l’acceptation d’une anthropologie modérément pessimiste qui fondait la nécessité de l’État, le second assure que le perfectionnement humain et l’idée de progrès sont possibles ; tandis que Schmitt justifie l’existence de la guerre et du concept de katechon en tant que piliers politiques, pour Israel la tolérance universelle d’origine baylienne se pose comme alternative ; si Schmitt considère que le dialogue et le débat constituent de simples distractions bourgeoises qui empêchent de distinguer la véritable nature de la souveraineté – la décision dans un état d’urgence –, Israel estime quant à lui que la dialogue rationnel et philosophique qui suppose la revendication de la liberté de philosopher est la seule forme acceptable pour concevoir des normes morales et politiques ; si le juriste allemand attribue à la théologie catholique l’origine de tout concept politique – au sens historique et systématique –, pour l’historien anglais c’est plutôt dans la philosophie rationnelle matérialiste énoncée par les acteurs des Lumières radicales qu’il faudrait chercher les fondements de la doctrine politique occidentale républicaine et démocratique. La reconstrucción de lo común se ha convertido en el tema de nuestro tiempo. Las llamadas a la regeneración empiezan a ser escuchadas y encuentran respuesta en la filosofía, que se ve emplazada como en otros momentos a problematizar las categorías en curso, sometiéndolas a escrutinio ontológico, epistemológico, político… Pero siendo hoy, quizá, más sensibles, desde el pensamiento crítico, a la ambigüedad inherente a cualquier proyecto comunitario, a la vinculación de lo común y lo coercitivo, la reciprocidad y la dependencia, (...) lo emancipatorio y la violencia. De ahí la dificultad y necesidad de mirar hacia el afuera del excluido, como horizonte para una reconstrucción inacabable de lo común. Este libro aspira a poner de manifiesto la multiplicidad y complejidad con que dichas demanda afectan al pensar de nuestro tiempo. (shrink)

En el quinto centenario de su nacimiento, esta monografía ofrece una nueva interpretación de la teología política calviniana, analizando sus textos clave a la luz de los antecedentes conceptuales y de las circunstancias prácticas en que Calvino los escribió. Se analiza así el sentido político que originalmente tuvieron sus ideas sobre la predestinación, el voluntarismo divino, la interpretación bíblica, la ética protestante, la disciplina eclesiástica o la obediencia al príncipe cristiano. ¿De qué modo contribuyó el protestantismo a la Modernidad secular?
